what's the message? he's with my guest tonight, let's go "outfront." >> good evening, i am erin burnett. the wild west masking up and states and businesses are all scrambling to address the new cdc guidance that fully vaccinated people don't have to wear a mask anymore, not outdoors and indoors. the guidance results in a lot of confusions. today president biden doing little to clear up the confusion. >> as i said last week some people may want to continue to wear a mask even if they are fully vaccinated. that's a decision they can make. some businesses may want to continue requiring wearing masks. >> whole depot and whole foods have not updated their mask policy. now, nobody seems to know and it

seems different even within a given store, nobody is sure and there is a lot of confusion. while 20 states plus the district of columbia drops mask rules, it is confusing. take maryland, the state is saying okay, you can take the masks off. the city of baltimore, the biggest city in the state is not. some states like california and new jersey as an entire state are going incredibly solo. well, here is the governor of new jersey. >> i don't know how we can expect workers who's vaccinated or who is not. it is unfair to put the burden on business owners and front line employees to police patrons. >> so you can understand the confusion. fundamentally the cdc admits this whole new policies is based on trust. >> in terms of the honor system, people have to be honest with themselves. you are protected if you are vaccinated and you are not if you are not vaccinated.

>> the thing is, look at some of the images from this weekend. i will show you kansas city, one of the largest sporting events where masks are optional. i am looking and you don't see any masks, right? if the honor system was working, 31%, of the people in that stadium would have had no masks. you would have 69% of people wearing masks and the picture would not look like anything you actually saw, right? is that what honesty looks like? just days before the cdc changing their guidance, president biden was sending this message again and again. >> why am i wearing a mask? because when we are inside t good policy to wear a mask and then it just completely changed. >> the cdc is making decisions

based on the science they have and the truth is hundreds of thousands of deaths could have been prevented according to dr. de debra birx. today if you look at the deaths situation, deaths as biden pointed out are at their lowest levels since april of 2020. some experts feel those gains could be lost because of the sudden shift of the total reversal on masks. our dr. sanjay gupta is reporting that he spoke with senior leaders at the cdc, days before the announcement when biden says it is good policies to wear a mask insight. they were telling sanjay indoor masking were to be lifted and it was not imminent in any way. former health commissioner dr. leana wen wrote "this is a major

blunder that threatens to setback much of the progress made, president biden needs the fix it, urgently." >> when you talk to white house officials they understand there is a scramble going on right now. they see it and hearing about it. they acknowledged their hands are tied by the system they put in when they took office. the president and his top aid made it clear they were not going to meddle of what science said and what health officials decided of the best course of action. the president's top adviser did not find out that the cdc shifting their guidance. they had to scramble to figure out what the repercussions were. clearly, they lean into it fully. the vice president and president walking out that day without

masks on and trying to use it to underscore the improvements that have been made and progress. behind the scenes there is no questions about it. there were some frustration about how this was dropped on their laps and without any sense or grasp of the repercussion nationwide. that being said, white house officials are making it clear, they believe the cdc guidance up to this point was clear. they believe the science behind the decision backs up the decision was made. they blelieve over the course o the next several days and week to smooth out a rough transition process over the course of the last several days. what we'll see is heavy hand changes from the administration. it all comes back to the posture they wanted when they took office. public health officials were going to lead the way, that's what they have done here.

press secretary jen psaki was asked about this. this is the way the white house was going to go along the cdc. >> thank you very much. i want to go out front as promised to mayor of kansas city. i appreciate your time. biden finds out that morning and you found out a few hours later. the new york times pointed out, you went from tweeting, you were not changing your mask order to completely getting rid of it in the span of seven hours because the guidance changed in the middle there. it sounds like you were caught off guard by the city announcement as well. >> we were cut-off guard. our goal has been to align ourselves with the cdc. we are in a red state and a red region. we want to say it is the science and medical experts helping us to make our decisions.

when you see this shift, particularly one that does not align with how enforcement is done, it creates a challenge for us. >> then you changed to go along with the cdc. the context what you point out where you are, the cdc, you heard director wallensky saying if it is the honor system and about 70% of the picture i showed would be wearing masks, they were not wearing masks. i don't say it to pass judgment on them. i am making a point are you worried on this, quote on quote, "honor system." >> we are very worried. if you were vaccinated, you can be in a room where you knowvacc. that's one way where you can have some sort of checks where you can say go to your near by

to understand is they need to customized how they enact these guidelines. maryland where i live has a test positivity rate of 1.7%, about half the national average. mississippi on the other hand has a test positivity rate of 13.8%. states should also look at what their vaccination rates are. some states in the northeast have adult vaccination rates of 70%. some states in the south have vaccination rates of 45%. the leaders in those states should take the guidelines from the cdc and enact sensible regulation that makes sense for their state. there is so much vaccines out, i am not sure any of this going to matter. >> that's true, there is plenty for everybody who wants it. i raise the question though that the administration wanted to go ahead with the science and they did not want to get a tip from

support the case against kim potter. potter accidently fired her gun at wright instead of taser after he tried to escape being arrested for an outstanding warrant. it was captured by body cam video which i'll warn you is distu disturbing. >> i'll taze you! oh [ bleep ] i shot him. >> adrian, obviously, this can now go ahead this case probable cause bound by the judge in order for it to proceed. how did potter react to today's hearing and ruling? >> reporter: well, erin, she only spoke once to answer a question from the judge. she was wearing -- not wearing her mask as she sat inside the office of her defense attorney

earl gray. we were able to see her facial expressions. for example, the prosecuting attorney told the court emotion has been found requesting video and audio be allowed inside of the courtroom if and when this case goes to trial. at that moment, potter opened her mouth widely. before that she was sitting with her hands together and her lips sealed. she also began to flinch and blink her eyes when the judge set a potential trial date for december 6th. and there was a moment at the beginning of the trial or excuse me at the beginning of the hearing when potter bowed her head. that was the moment when the judge acknowledged the attendance of daunte wright's family and friends who were inside of the courtroom. toward the end of this hearing, the judge made it very clear by saying she wants this case expedited and she said the judge regina chew in part says it to the benefit of everyone to come
