spoke with an official the sheriff department, who said they are awaiting the final corner report which they hope will give them some insight into what type of projectile took the life of helena hutchins, and the issue of liability, whose the people are who are the people ultimately responsible? the armor, responsible on the set for safety or the assistant director who handed alec baldwin the weapon telling him it was safe, or the responsibility of the actor himself to ensure a safe and clear weapon, and law enforcement they talk about the three cardinal rules of firearm safety, treat every weapon as if is loaded, keep the muslim a safe direction and 3, keep your finger off the trigger unless you intend to present copy my say hold on, this is hollywood, it's a movie, a prop gun is supposed to go off but in this incident, even a prop gun can turn out to be fatal, i talked with an official of the district attorney's office he said no new updates yet, the investigation continues, we're waiting to see whether there

will be charges filed in this case. >> sharon, maybe you can help us out with this, your reporting at the wrap, reporting about the gun that alec baldwin used? >> we learned and reported exclusively that the gun that alec baldwin used two tragically accidentally shoot helena hutchins had been used earlier in the day for target practice, and you probably know this, and the crewmembers, they sometimes do that, plinking, they go to rural areas and shoot with live ammunition, this happened the morning of the day that helena hutchins was killed, in the early afternoon. so what happened between the time those guns came back with live ammunition between them, should have been checked obviously, and a lot of information the search warrants filed, about what happened to the guns and a break for a few minutes for lunch and they came

back was the gun checked again, unclear before the first a.d. called it when he said he called gun, and handed it to alec baldwin he distrusted. and the noticeable reporting, the gun expert who had been on movie sets as an armor himself, it was a possibility since they were in a rural area, where they target practicing, and possibly trying to show the actor how to be more authentic and so on, just so the audience knows, cnn has not confirmed the reporting, when asked by the rep for comment, they referred back to the previous statement, though we were not made aware of any official complaints concerning weapon or prop safety and said, we will be conducting the internal review while production is shut down, safety concerns, and my

correct? >> the day of the shooting, resigned the night before, not only safety conditions, problems, people working long hours, and the more we learn about what was going on, the more concerning it really is, and while there is no bringing back halyna hutchins and alec baldwin has to live with what he tragically accidentally did, there is a real concern of reliability and whether corners were cut and whether the camera crew that walked off in the morning was replaced by nonunion workers, were the people who were being replaced as experienced, as knowledgeable and careful, as the people who were there before hand, i know there has been a big contract negotiation between hollywood unions and producers over issues that are not unrelated to this, and they are not happy, basically

nonunion people came in, and that tragedy happened. we can't -- >> did the production say they had had official reports of crewmembers walking off, is that change now? >> all the reporting we've had since friday, have confirmed kites in the search warrant.>> okay. there clips from the broadcast for the armor talked about hannah gutierrez finished her first job as the head armor, her father, an industry vet, taught her about guns and she was 16, some of this, watch it.>> also my first time being handed -- head armor, i was nervous at first and i almost didn't take the job because i wasn't sure if i was ready about doing it, but it went really smoothly. >> we know gutierrez is just 24 years old, combine this with a

a.d. who had been fired over gun safety, veteran crewmembers, clearly important to the safety of the set, who is responsible here? >> all we can hear over and over, i must've talked to half- dozen people saying they should never happen, 10 different ways that should never have happened in hollywood is looking very deeply at the moment internally, what is it that they need to do as an industry to make sure this never happens because it is a small industry, so many people know halyna hutchins and had great love for her, she was apparently an extremely well-liked colleague and a rare female cinematographer, not a rule that many women get to rise up into, so i think there is a broad sense of not liability and pointing fingers but what is it that the industry needs to do to make sure that this absolutely never happens again. >> looking at pictures of her husband and child, and it is

sad all the way around. josh, take us forward. and what else are they looking for at this point josh?>> liability is a big question, whether there will be charges, perhaps negligence, people we talked to said it appears to be in accident, but that doesn't mean that anyone involved was involved in the cases and still liable for negligence, according to the sheriff department, the weapon itself, what was inside the weapon, that will come from the corners report, no formal report yet received, but what investigators tell us is the hope with that information they will know what was inside the weapon and help them illuminate other possibilities, life around her debris or a blank that shot a projectile in close range of someone, so many possibilities which only a corners report or friends examination can help answer. >> thank you, and thank you sharon. i want to bring in our senior legal analyst, ellie

honigford, and thank you for joining us, i want to get your reaction, the reporting, and the gun was taken out for target practice or shooting outside the scope of the movie, what will investigators be looking at with this information and how can impact who is responsible in this case?>> yes, this is enormously important, if confirmed, it tells us two things, if the round that killed trent before turns out to be alive round, this could explain how a live gun with live ammo on it got on to that tray before it was handed to alec baldwin, more generally speaking, if people are doing target practice, recreational target practice with live weapons when they are not shooting, that suggests a

set that is very poorly cared for, negligence is more the norm than anything else, that's going to be a big problem for the people in charge. >> let's talk about who's doing the hiring, a crewmember is putting it on the armor and the producers and josh campbell's reporting about the prior incidents at the 80 had on a set, will legal challenges come to those who are vetting the crewmembers or is it just the crew involved in the producers, what is a come down to?>> two types of line ability -- liability, negligence, to sue some deals for money damages, then criminal charges, you have to show criminal negligence or recklessness, a higher standard, and the assistant director, what had he done to confirm that it was a cold gun, did he look at the gun, what did he see, did he not inspected and handed to alec

baldwin, the armor, how did it come about that the podcast, those are the three people who are going to focus here. >> obviously this was an accident, alec baldwin is also a producer, not the only producer on the show, when liability could he be looking at if any here? >> my view right now is that alec baldwin in his capacity as an actor does not have any liability, the standard norm referred from various experts is if you're an actor near handed a gun and told cold gun, you are entitled to bank on that but as a producer the question is, what type of role did you, not all producers are created equal, some are just in name, because big names but if

he was directly involved in the hiring of people who may have had red flags for the management of the site, that kind of thing, he could have liability, i think it's more likely to be civil liability than criminal liability but serious issues here. >> prosecutors and police have gotten a search warrant executed by the sheriff, does that tell you anything or just pro forma standard operating procedure? bigger it does tell me something, to get a search warrant, you can't get prosecut police officer write out what we call the probable cause, the affidavit and bring it to a judge, the judge reviews it has to agree there is probable cause that a crime was committed, many more likely than not, and b, we will find evidence at the scene, as a prosecutor you are going to want more than that before you charge someone criminally but it is a good step of the way there, towards an eventual

whistleblower, and regulating hate speech and misinformation this country, and around the world really. and redacted versions were obtained by cnn in a group of 16 other news organizations, and what this tells us is really chilling, as well. >> one of the things that happens with groups and networks of groups is that people see echo chambers, create social norms, if i'm in a group that has lots of covert misinformation and i see over and over again if someone gives covert vaccine that encourages people to get vaccinated, they get pounced upon and torn apart, i learned that certain ideas are acceptable and unacceptable, when the context is run hate, you see normalization of hate and dehumanizing others, that's what leads to violent incidents. >> think about this anytime you've been on any of the social media platforms or even video platforms. you have it upon something that

whatever you happen upon, and it clicks you to the next one, that is similar, and misinformation website, and it's a rabbit hole, and does deserve so five we are watching, and it will show you something that tells the truth, doesn't do that, you continue down the rabbit hole of whatever it is, it is like what you clicked on, and sometimes it starts to get scarier and scarier, and i like what is this, is this what happens to everyone? they get in through their own media bubble and their own echo chamber, that's what happens, if you get stuck in the whole echo chamber, it is normalizing hate and becomes normal to you that's what you see, angry

right, the experiment that you spoke about were they set up this account of the north carolina mom, 41 years old, she starts off by liking donald trump, of melania trump and foxnews, and after a few weeks, facebook is recommending facebook, recommending that she follow qanon pages. >> that's what i said yes. >> follows the 3% pages, this is experience we are familiar with right, and i think that is really what demonstrates all of this, mark zuckerberg can say whatever he wants, i will say i think he's doing some more and more like trump in that rather than engaging in substance he's attacking the media and everybody seems to be wrong apart from facebook in his view, even people who used to work at the company, but specifically dance your question, they knew about this project and this q and on experiment in 2019, and it took them another year to ban qanon,

we adjudicate them and hold them accountable. >> you are an attorney, do you think that is possible? >> yes, look, i have thrown a lot of, you know, things that windmills and some things have stuck and been successful in some of not, no one thought when they sued the tobacco industry that they would be successful either, on the impact of lies and deceit, facebook is another similar example. you look at those three examples, whether or not it is what they did on january 6 or didn't do, if you look at with it in charlottesville and dylan roof, those are three clear examples where mark zuckerberg and cheryl's handbook have done nothing, it's embarrassing with a done to help divide the country and they sit out in palo alto or silicon valley and chill out with her friends. and there it is.

a lot of news tonight including the weather. new york governor kathy hochul declaring a state of emergency for more than 20 counties ahead of the anticipated nor'easter. the rain is already coming down in the tri-state area, worrying officials that after the remnants of hurricane ida that caused deadly mass flooding in september, what could happen? what are the possibilities? our meteorologist pedram javaheri joins me now. pedram, good to see you. what are you expecting from this storm? >> you know, don, this has been a storm with a history of producing significant damage. it was the same storm last thursday into friday that impacted parts of california that's now moved 3,000 miles to the east, brought severe weather in the midwest. the concern is the storm undergoes bombogenesis or the bomb cyclone trend you often

here. it drops about 24 millibars of pressure within 24 hours. that is a rapidly intensifying storm system that is already strong because you notice, again, it has a history of producing 17 tornadoes. that was around the midwest. parts of missouri, an ef-3 observed there. right now you're seeing heavy rainfall pour in. washington, baltimore, working your way towards allentown and scranton. eventually this skirts in right towards portions of new york city later on tonight into tomorrow. the concern, don, is that over the next 24 hours, potentially later on tomorrow evening and tomorrow night, we get some very, very heavy rainfall, maybe one to two inches per hour. the national weather service taking this very seriously. about 40 million people underneath these flood alerts. notice where the heaviest guidance for the rainfall is. widespread coverage over the next two to three days here of four to six inches with potentially six-plus inches in areas around central and northern new jersey. again, you bring this much rainfall in an urban environment, you've seen how things played out in august and
