12:00 am
hello, welcome to our viewers in the united states and all around the world. in atlanta following our breaking news. a stunning breech of u.s. supreme court confidentiality. a draft opinion leaked that would strike down roe vs. wade. shocking many across the country. >> i'm live in ukraine where the non-stop bombardment of the steel plant in mariupol made evacuation efforts a nightmare.
12:01 am
and we begin with this bomb shell report that indicates a american women could soon lose their constitutional right to a safe and legal abortion. the news web site has published a draft of what it calls a supreme court majority opinion that would strike down the landmark ruling. which legalized abortion nationwide in 1973. angry and somber abortion rights supporters have already been gathering outside the supreme court. to be clear the final opinion hasn't been released. and until it is, abortion is still the law of the land. it seems unlikely votes will change. given the conservative majority among the justices. the publishing of this draft opinion is a stunning breech of supreme court confidentiality. and secrecy. cnn cannot confirm the documents
12:02 am
authenticity. legal analyst reports from washington. >> this is seismic news coming from the supreme court. in a draft opinion obtained by plit co, the court appears poised to over turn the landmark decision roe vs. wade that legalized abortion in the united states. nearly 50 years of legal access to abortion in any state may soon change. states could have the option of banning abortion entirely. once this ruling is officially handed down. a number of states already have laws ready to be enacted to limit or ban abortion. as the law stands now in america, states cannot ban abortion before about 23 weeks of pregnancy. the case at hand brought on by the state of mississippi will entirely change that precedent. what is also shocking is how we came to learn about the decision. normally we hear at the very end once the decision is complete from the supreme court, we hear from the majority and we hear
12:03 am
from a dissent. but this first draft of the majority decision was made available in an entirely unpres dentsed way. and for some people might further bring into question the legitimacy of the supreme court. according to chief justice john roberts would be a dissent in an opinion to over turn it. and he will be even more concerned about the out come of the ruling now. cnn, washington. >> reaction to the supreme court draft opinion has been swift. with both democrats and republicans weighing in. several republicans praise the opinion. and congresswoman mclain of michigan tweeted this. i pray the supreme court makes it officially and over turns this attack on unborn. new mexico governor a democrat wrote, the ramifications of this
12:04 am
decision would be devastating for new mexico women and access to abortion is access to healthcare and that won't change here. another democratic lawmakers told cnn don lemon under privileged women will be impacted the most. >> it's not a decision yet. but should it be? it's game changer for america. it's a game changer for women. and women's rights to control their own body. it is dangerous what is taking place right now. and as some of your other guests have said, those that are affluent. they can go from one place to another to do to have an abortion if they have to. those who are poor, they will be victimized. >> meanwhile, some california lawmakers have announced a proposed amendment to the state constitution that would protect the right to abortion in response to the high court draft
12:05 am
opinion. we will continue to follow this story of course. now for the latest on the situation in ukraine, let's bring in live from lviv. >> thanks. good morning. u.s. and west officials believe vladimir putin could formally declare war in ukraine as soon as may 9. that is victory day in russia marking the defeat of the nazis in world war ii. up to now russia called its actions in ukraine a special military operation. and there could be more. have a listen. >> according to the most recent reports we believe that russia will try to annex the republic. so called to russia. the port state russia has plans to engineer on joining russia. sometime in mid-may. and moscow is considering a
12:06 am
similar plan for kerrson. >> meanwhile russian forces are pushing further to the west in ukraine. officials report a number of russian missiles strikes on the city of odesa. ukraine president says a 14-year-old boy was killed in another teen wounded in an attack on a dorm. also signs that ukrainian forces are fighting back. claiming to hold off 12 russian attacks over the past day. and video posted online shows the after math of a large explosion at an airfield in a russian held area. near neither side is commenting. this morning yet again all eyes on mariupol. and the bombed out steel plant where many civilians are still trapped. the city counsel says more evacuation efforts are due to resume this morning. it's not clear if the plans involve the people inside the plant. around 100 were able to make it out for the plant sunday.
12:07 am
but another round of evacuations planned for monday never happened. a ukrainian commander inside the plant says they have been under constant bombardment since monday. this video right here appears to confirm the reports. it shows a large plume of smoke rising from an area near the plant. meanwhile, some evacuees did begin arriving on monday. the city and the ukrainian control is often where people fleeing mariupol go first. for those who made it to safety the relief is pal paable. the future remains uncertain. we have the story. after two months when they finally emerged into the light, it was a rafaged world that awaited them. path out through this mariupol steel plant. battered by russian explosives for weeks. could be mistaken for the first steps of hell.
12:08 am
rescue awaited at its end. these ukrainians who had endured the savage rumble of blasts above. grateful to be whisked out even if it is through a hometown now unrecognizable. she turned six months the day before. spent a third of his life under ground. children always wanted to eat. adults you know can wait. this was a beginning of possibly thousands of similar journeys. here escorted by the united nations and red cross. during a brief pause in the violence. after a weeks of moscow and kyiv at highest level. thank you and stay healthy, she says. walking out. these pictures filmed in russian controlled territory appear to show some of the first movements out of mariupol guided by the un. they are still here under
12:09 am
russian armed guards. and russia ministry of defense claimed 11 evacuees decided to stay in territory they control. and 69 to head held by ukraine. still, monday before dusk, none of the convoy either from tens of thousands of civilians who might want to get out in the un move had arrived here. a welcome center where slowly people have been arriving from wider mariupol in the areas around it. under their own steam. over journeys spanning previous days. she said she got out of the mariupol three days ago. they bombed the buildings. the bodies have been buried. her unbroken spirit clear when she tries to get up and walk. before she's reminded her wheelchair is there for a purpose.
12:10 am
in the days ahead the numbers under un escort arrive here will be a powerful omen of whether any sort of talking in this war can save lives. >> joining me now the cofounder and vice president of the ukrainian american human rights organization. based in new york. thank you for taking the time to speak to us. i understand that you were in contact with some of the people inside. the steel plant a few days ago you were in contact. give us a sense of what they told you. >> i have a few friends in different brigades now. trying to the plant. my last contact was more than a day ago. i don't know what is happening
12:11 am
right now. but i talked to them almost told them have almost no food and no water. and they have been started but what's really bad rations are only to people who can walk by themselves. not wounded people. i guess so because they don't want to show what happened to people. so they don't want to show the world the real picture. only people who can walk themselves and they're not okay but good compared to the wounded people. >> we know from one of the ukrainian commanders inside the steel plant the last time i think you said between 50,600 wounded people. soldiers at least inside that steel plant.
12:12 am
do you know -- they're running out of the water and food. we saw hundreds civilians were able to be evacuated sunday. nothing monday. because they keep being bombarded and shelled. do you know whether some of the soldiers are part of the evacuation plan and the red cross? have they told you that? >> they don't allow to participant in the evacuation. only for civilians. >> when you talk to your colleagues, your friends inside that, when you hear that, what do you tell them? what's the mood like right now? >> they have connections to the internet. they see the entire picture. they know what's happening. they're trying to keep positive and -- >> do you worry about them? >> of course i worry. but i cannot show them -- we
12:13 am
almost have no plan how to save them. because currently it depends on one person. that is mr. putin. he doesn't want to speak to anyone in the world. so i don't know what we can do to help these people. they have to keep trying and do what they can. like speak to everyone, trying to reach every politician in the western world. to try to convince them to speak to putin. i'm not sure he'll listen. but we have to. >> let's talk about your organization. you work with various ukrainian activists throughout the u.s. you're here now. you were telling me before that perhaps you won't go back to the u.s. for the time being.
12:14 am
tell us why your work is so important here right now. >> yes, we have presence at different countries. the biggest presence is here. particularly in the east coast we have about 300 volunteers currently. we have people in great britain and poland. and of course in ukraine. in the united states, like we're set ul everything. we have a warehouse. we have volunteers working on like our processes to buy tactical medicine and communication devices. for ukrainian people. and logistics set up. i'm more needed in ukraine. our processes of the delivery to
12:15 am
the civilians. and paramedics, military units. and i'm just feeling like home. >> you were home. you grew up and spent time outside lviv. >> yeah. and just -- in ukraine right now it's people are more lives than everywhere in the world. because here you can feel the real life. even in lviv it looks pretty much safe. but it's not safe right now. we know rockets can hit any time. and there's no safe place in ukraine. and circumstances you can feel the real life and you know, what's good and bad.

12:21 am
antisemi-ism are jews. and denazify the country. he had this response. >> how could this be said on the eve of the anniversary of the victory over naziism? he's words mean that russia top diplomat is blaming the jewish people for nazi crimes. no words. such an antisemitic thrust by the minister means russia has forgotten all the lessons of world war ii. or maybe never studied those lessons. >> more on this. following this live from london for us. claire, it's clear from what i have seen the global backlash to his comments this morning has been swift. >> yes, first of all a diplomatic over this in israel. prime minister said the goal is such lies to accuse the jews themselves the most awful crimes in history and ab solve enemies
12:22 am
of responsibility. foreign minister said this was unforgivable and outrageous. terrible historical error. is summoned the russian ambassador to israel for an explanation. state department called it despicable. out rage is growing beyond israel. this puts israel in a difficult position because throughout the conflict in ukraine, they have sought to maintain a delicate balancing act. they condemned the invasion, condemned the actions particularly the foreign minister. they provided aid to ukraine but stopped short of joining a fully joining western sanctions because they have regional security concerns. which involve russia which has a military presence for example in syria. they have interests in maintaining a relationship with russia. whether or not this sort of puts pave to that is a big question. going forward. and certainly something that

12:28 am
welcome back to our viewers here in the united states and all around the world. we are following major breaking news this hour. the u.s. supreme court appears poised to over turn the landmark roe vs. wade decision guaranteeing a women's right to abortion. published what is calls a majority draft opinion written by justice samuel alito. the decision itself would be stunning chl the fact it's gone public before any official ruling is also unprecedented. according to the draft, each individual state should decide how it handles abortion. the official opinion is expected to be published in late june. there's already been strong and swift reaction to this breaking news. including from the president and ceo of planned parenthood. she spoke earlier with cnn anderson cooper and called the
12:29 am
draft opinion unconsciousable. >> what we have seen tonight is not just a draft. we believe this is a road map for how they will take row down. and we have already seen it over the last nine months in texas. the devastation of what we have seen, patients traveling thousands of miles to get access to basic abortion care. i will tell you abortion is still legal right now. we are letting our patients know, patients who are seeking access to abortion they can still go and seek their provider right now. what is happening right now in front of the court is unbelievable. >> how -- how many states do you think would still continue to if it goes to state legislature. how many will continue to allow abortions to take place?
12:30 am
>> here's what we know, 26 states that are poised and ready and em boldened because of this court to over turn roe in their own state. federal protection is gone states will be making these decisions. we have seen it in texas. we have seen florida move to 15 week bans. arizona 15 week bans. oklahoma and idaho six week bans. we'll see 26 states move to ensure that we no longer have control over our own bodies to make these decisions about ourselves and our families. and that is actually what's truly devastating. they forecast this in the draft opinion. however it was leaked which is unprecedented in itself. it was also unprecedented the fact we have had the right for 49 years. we have fought to make sure that we are able to make these
12:31 am
decisions. not some lawmakers down the street. not somebody who doesn't know how our bodies work. and now they are determined to take this right away from us. >> that was president and ceo of planned parenthood speaking with cnn anderson cooper. still to come we are following a rise of new covid infections across dozens of u.s. states in the past week. we'll take a closer look at that. i mean, obviously, let it out. ghaa. yeah, i'm nonot really sure if this is working either.

the u.s. is on the brink of reaching 1 million covid related deaths since the start of the pandemic. that grim milestone is expected to happen within the next few weeks. new infections are also rising again. john hopkins says cases climbed in 37 states in the past week. and hospitalization are up 10%. in new york, the city is covid risk alert level has been raised from low to medium. up tick in cases triggered that move. last hour i asked a national consult for covid-19 testing in the u.s. to weigh in on the situation in new york. take a listen. >> one of the things i would say to new york is, when you wait to
12:37 am
change the level to orange. since they moved the goal post in the middle of the covid pandemic, that's a little bit too late. when you use hospitalizations as an indicator. that means that the patients are already ill. they already can go onto die we're trying to prevent them from being there. i totally agree with her when she said that we're going to expect a surge that will go into the southern states and anywhere where there are lower vaccination rates. and then very important point which we have talked about. is waning immunity. just because you had two shots don't feel like you are protected. especially where we are with the new variant. so we have to watch out for this summer. we're facing a surge. >> such an important point. let's talk about that. dr. fauci says that we should find out by this summer what
12:38 am
type of covid booster shot will be required to deal with the next phase of the pandemic. and when it needs to be administered. what more are you learn about this? and of course the possible options available for yearly covid booster shots ahead of each fall season. every year. >> yeah, a few things, dr. fauci needs to be a little more explanatory and forthcoming. right now, there already into the trials and nearly done with the trials. one major one is done another one will be done next month. to talk about the potential vaccination that will be available to us in september. the more than likely that is going to be a vaccine meaning it will be a little different that what we have. it will have two components in it. something with omicron and one of the prior versions. trying to broaden out the vaccine what it does to us. that's important. but the real magic is what's
12:39 am
already going on across the world. most people don't realize there are 150 vaccines in trial that are already in clinical trial. another 190 that are in preclinical trial. everybody is rushing to try to find one. this is what we're looking for, next year, 2023, we're hoping to have a polly vaccine. one that has multiple different components that uses ai trying to guess where's it going to go. where's the mutation going to go. >> our thanks to the doctor for his insight. talking last hour. it sounds like something out of a horror movie. but it happened. a shanghai care home resident mistakeningly sent to the morgue on sunday. but still alive. the person is now in stable condition. but video of the incident was posted on chinese social media triggering a wave of criticism.
12:40 am
you can hear a person saying in chinese, the nursing home is such a mess. they sent a living person on hearses and said they were dead. the under taker staff said they were still moving. i can't believe such a thing happened. in response to the backlash the shanghai government says four people were dismiss ds over the incident. thank you so much for joining us. for our international voice, african voices change makers is next. for our viewers in the united states and canada, i'll be right back with more news after the break.

the u.s. supreme court maybe on the verge of out lawing a woman's institutional right to an abortion. which for decades remained one of the most contentious issues in the u.s. much to the shock of the other western countries where abortion is not a major issue. the news web site says it's obtained a draft opinion that would strike down roe vs. wade. the landmark ruling that legalized abortion at the national level. the release of the document is a shocking breech of supreme court confidentiality. cnn cannot confirm the authenticity. the final opinion is not expected until late june. votes and language can change before then. that seems unlikely given the courts conservative majority.
12:46 am
cnn conducted polling on abortion and over turning roe vs. wade earlier this year, findings show 30% of americans want the supreme court to over turn the ruling. vast majority a whopping 69% of americans said no. they do not want to see the court take such action. over all, more than half the country 52% say the should the ruling be over turned, they would want this state to become a safe haven for women who want abortions but can't get them where they live. meantime conservatives who have long sought to under mine or over turn roe vs. wade, a slamming the release of the supreme court draft opinion. republican alabama governor tweeted this unprecedented leak is concerning. o outrageous and attempt to manipulate the sacred procedures of the u.s. supreme court. those responsible should be held accountable. my prayer is that roe vs. wade
12:47 am
is over turned and life prevails. cnn senior legal analyst says the supreme court decision could impact the upcoming u.s. midterm election. take a listen. >> what's this mean for politics, for the midterm elections, what's this mean for the other side of the aisle for a long time state in loud terms they care a lot about the court. but because some of the things have been on their side and the particularly roe and other things. i don't want people to send mail to me. but there's been a little bit of complacency. conservatives care more about the court and cared more about changing what they haven't been able to do legislatively like this issue through the courts. than liberals have been. >> democrats are promising to turn abortion rights into a major campaign issue. the democratic national committee released a short statement saying quote, make no mistake, reproductive rights
12:48 am
will be on the ballot. and this midterm election is more important now than ever before. democratic senator amy klobuchar said this to don lemon. >> if this opinion is issued, it will be against the wishes of 80% of americans. who believe that women should have the right to make that their own healthcare system. it would trigger the laws in over 20 states that have already said they will out law abortion in their state. it will create a patch work of laws across the country and my prediction is that it will drive women to the polls and men. anyone that 80% of the public who believes healthcare decisions should be made by a woman and her doctor and not by ted cruz. >> pennsylvania governor tweeted abortion is and will remain legal in that state. and he vowed to veto what he called any antichoice legislation that lands on his desk.

a warrant has been issued for an alabama corrections officer after she and an inmate went missing from a detention center friday. a man hunt is under way for both. and the county sheriff says it appears the officer is willfully assisting the inmate. who is charged with capitol murder. cnn ryan young has details. >> i would be surprised if they are in alabama. >> tonight a man hunt for a dangerous murder suspect and correction officer vicky white. who may have helped the inmate escape. >> if she did this willingingly, all indications are she did. i guess we're trying to hold onto the last straw of hope that maybe some reason she was threatened and did it under coercion. i feel betrayed. >> friday morning the sheriff office says assistant director vicky white said she was taking casey white to the courthouse
12:50 am
for a mental heflt health evaluation. awaiting trial on murder charges and say security video shows the pair never arrived at the courthouse and no evaluation or court appearance was scheduled. several hours later, her patrol car was found abandoned in a shopping center parking lot less than mile away from the detention facility. >> we have a couple tips on the possible vehicle. we're pursuing that. >> investigators say they still have no evidence of relationship between them. >> we're reviewing phone calls and looking into that. video from the jail. >> cnn got a firsthand look at security procedures inside the detention center. >> you can see the security. >> the sheriff says vicky white actually violated protocol when she removed him from the detention facility. >> this is the hall way the inmate walks down. through this door to loaded into a car. normally it's two deputies per van. but this time, it was just the
12:51 am
deputy and the inmate. >> the sheriff says since vicky white is in charge of the center, nobody questioned her. the sheriff office says last week after about two decades with the department, she put in her retirement paper. friday was supposed to be her last day. casey white was already serving 75 years for a rash of crimes. next month he is scheduled for trial on two counts of capitol murder for the stabbing death of conny ridgeway in 2015. tonight investigators are hopeful he'll be back behind bars. >> keep in mind that casey white is a large individual. he is 6'9". he will stand out. >> there's a lot of questions about how this played out. she worked here for more than 15 years. so there's a lot of shock in term of the deputies who work here about exactly what happened. they are hoping to get some sort of tip that leads them to a break in this investigation. right now just a lot of questions. reporting in alabama, ryan

young, cnn. u.s. midterm elections are six months away. first candidates have to secure their parties nomination. one of the most contested primaries right now is the republican nomination for ohio u.s. senate seat. voting is set for today. cnn reports on what's become a race for donald trumps endorsement. >> i want to pick somebody that is going to win. and this man is going to win. come on up jd. >> donald trump is testing his role as a king maker. >> ohio. do we love this guy? >> many republicans do still love him. the question, is whether they will follow his lead and support jd vans in the crowded senate primary. on campaign trail today he made famous by his best selling book. was still explaining his evolution from trump critic to accolade. >> i see my fat head say
12:53 am
something i wish i hadn't said six years ago. >> i didn't vote for trump. >> what he said -- >> i never liked him. >> has been played again and again. >> i can't stomach trump. >> on tv adds from rivals and critics. >> i'm a never trump guy. i never liked him. i might have to hold my nose and vote for hillary clinton. >> we asked him about the words today. >> do you regret them? >> i certainly wish i hadn't said them. it was a mistake. i was wrong. i think it's much more important to worry about whether you regret something is to actually admit when you make a mistake. >> a loyal trump fan was offended by his old comments but changed her tune after trump offered his blessing. >> i couldn't in good faith vote for him because of the things he said against trump. but trump endorsed him i thought okay, i can vote for him now. >> she also admires trump sees it differently. >> do i like president trump? yes. do i follow everything he says
12:54 am
or think he's the ultimate source? no. god is the ultimate source and i rely on my own sense of judgment and research. >> with early voting under way the former president up ended the race to replace retiring senator rob portman. he endorsed jane. a form e chair of ohio gop. who also fought hard for the trump endorsement. >> i think it created a lot of confusion and many voters know that jd was a never trumper. hillary clinton would have been president. >> he apologized for that. >> but the question is, who is the real jd? >> they have a aligned themselves with trump. but didn't gain support. >> fb obviously i would have lea le loved to earn it. >> texas senator cruz backs man dell and said this about trump's seal of approval. >> every candidate says, i love
12:55 am
donald trump. no, new no, no, i love him more. i have trump tattooed on my rear end. it's okay, we get it. what's your record? >> the only gop rival who didn't seek the endorsement said it's time for republicans to move on. >> i hope this election when i win is about that people begin to understand that you can run on ideas. >> many republicans are keeping a close eye on matt dolen. the establishment candidate who didn't seek the former president's endorsement. of course every other candidate did and they are dividing some of the support amongst themselves. for trump, it's the biggest bet he's made in the 2022 midterm elections. but every tuesday in the month of may he'll be tested a new. with his endorsement facing primary challenges here in ohio, pennsylvania, georgia and beyond. the former president weighing in deeply. we'll see if the republican base responds. cnn, columbus, ohio. thanks for spending part of
