>> good evening everyone, i'm kate bolduan in for erin burnett, ukraine's president zelenskyy declaring tonight as russia faces another setback, new video shows a russian battalion decimated as it tries to cross a series of bridges in northeast ukraine. you can see the riverbank just littered with russian artillery. artillery and tanks. u.s. official says attacks like this are quote-unquote, frustrating, russian efforts to move troops into the donbas region. and according to the pentagon, ukraine has essentially stalled putin's war plans. >> they have prevented the russians from achieving virtually any of their strategic objectives thus far in the war. >> we're also getting new images outside kharkiv where ukrainian forces have pushed back russian troops from ukraine's second largest city.

check points and buildings once occupied by putin's forces now back in ukrainian control. meanwhile, in the south, told difficult negotiations are still under way to get out some of the seriously injured ukrainian soldiers inside that sprawling steel plant. a top official saying that russia keeps changing the conditions for their release while continuing to bombard and attack the plant. and despite ukraine's advances, one ukrainian lawmaker today describes the frontlines this way -- it is hell, saying they cannot win without more weapons and more support from the united states. specifically, air defense systems and fighter jets. now, we have reporters across ukraine this evening, i want to start with sam kiley "outfront" live in kramatorsk. what is the latest on the ground now?

>> reporter: well if we take mariupol, that extraordinary fight still going on with 700 fighters from the ukrainian side holding out against the odds, most, if not all civilians have been evacuated from mariupol but they continue to be pounded. they even claimed the ukrainian sides have launched a minor counterattack to try to drive the russian forces back from the perimeter of that steel plant. that's been a very important draw away of troops to be focused that could have been focused where i am on the kramatorsk which really is the strategic prize in the campaign now of the russians now that they have gone from effectively wanting to commit regime change to capturing the donbas. this is the biggest city remaining in ukrainian hands in the donbas region and the regions of luhansk and donetsk and as you're rightly pointing out there in the introduction, there's been a significant battle over the pontoon bridge over the last couple days with

very significant losses inflicted on the russians by the ukrainians in a counter attack there and another counterattack going on around kharkiv, to the northeast there, pushing the russian forces back so far that they've actually destroyed bridges as they've been retreating, indicating they're giving up entirely on ever trying to get involved in the fight again for kharkiv. but i think the most significant kind of analysis does come from oleksandr busae saying they need more troops and those problems are going to become more apparent for the ukrainians. >> thank you for that analysis, the first war crimes trial on a russian soldier now under way, "outfront" with us in kyiv with all the details, i warn you, some of what you might see may be disturbing. >> reporter: still at war with russia, but already fighting for

justice. ukraine's opened its first war crimes trial, a 21-year-old russian soldier, accused of shooting an unarmed on the fourth day of the war, so far, identified 439 alleged war crimes according to the country's prosecutor, include the massacre of 300 unarmed civilians in bucha and the killing of many hundreds of civilians, mainly women and children in the siege of kharkiv. >> we have now some evidences that commanders give the orders to shot civilians. but from other side, we understand that ordinary soldiers have the own responsibility for these atrocity. >> and that, says ir irena venedictova is a message that needs to be sent now so russians understand there will be no impunity even as the fighting in regions like luhansk

continues. she says she's been held to gathering facts with the many forensic teams working in bucha evidence to be used by the criminal court as it investigates russia's invasion in ukraine and the war crimes allegedly committed by russian soldiers which russia denies. >> and they can understand they cannot use the armies to undermine another country and use against civilians. >> for now though, a small court in kyiv that ukrainian justice has its first say, but can a trial be fair during a war? >> tra >> reporter: shishimarin's ukrainian lawyer says he has faith and the court can be counted on to make an honest decision. say they have no information about the case but the size of the media pack inside spoke of

the interest and emotion involved on all sides. shishimarin's court translator said she felt no anger towards the 21-year-old who could face life in jail, after all, the tears of russian mothers are salty too. >> okay, given the number of war crimes registered here in ukraine by the ukrainian prosecutors so far, there will be many more trials to come. now clearly, many of them will happen in international courts and what we've seen in the war is that those war crimes tend to be uncovered, registered, sifted through by forensic experts once russian troops withdraw. the trouble with international justice, is it was set up in 1945 after the second world war, it had come after the event. the war finishes, the teams get on the ground, collect evidence, and then the trials begin, perpetrators are brought to justice. the point of what's happening in ukraine now, is to get there

early, to start prosecuting people now so active withdrawal, they think again about what it is they might carry out as they look to try to gain or keep what ground they have in ukraine so far, kate. >> great point, thank you so much. prosecutor general saying they estimate 10,000, some 10,000 war crimes have been committed in this war so far. "outfront" with us now, emily fargas former u.s. deputy assistant secretary defense for russia, ukraine and eurasia and retired general peter zwack, good to see both of you. evelyn, first, with the war crimes trial, the world cares about this trial and should care about the trial, of course, but do you think putin cares about this trial? and the many that are likely to follow? >> yeah, i mean kate, thanks for having me on. putin doesn't care about this trial. we know that he has very little respect for ukraine as a country, he doesn't respect president zelenskyy and he certainly doesn't respect the

government including the judicial system. but it's not really about what vladimir putin thinks. more importantly, and your correspondent touched on this, it really matters what the russian military leadership hears and sees and of course, the soldiers. and we don't know how much of this they will see, but i suspect through telegram and other social media means they will hear about this and hopefully, it will be a deterrent for future crimes. >> yeah, it's going to be hard to avoid hearing about it but you can be sure in russia they'll try very hard to do just that. general, senior u.s. defense official said today the ukrainian artillery is frustrating. that's the word they used, frustrating russian efforts to gain ground in the donbas, this eastern part of the country. slightly west of donbas and kharkiv, ukrainian military says russia is pulling back further still from there. we add all this together and i see this a little bit, i don't know if it's correct to see this way, kind of the ebb and flow of

the war now, what do you think these moves mean for where the battle is headed? >> the ukrainians, with terrible losses, have the initiative. and the artillery is important. it looked like it was a fire strike that took out that pontoon bridge crossing and wiped out a good chunk of a battalion tactical group, 700 people, and the ukrainians are reinforcing with artillery. we've read about that, but artillery takes a lot of rounds and the pipeline needs to continue with shells and ordinance. overall, it looks like the russians, again, while they may have numbers, they're wavering. you got ukrainian grit,

determination, and they're going to stick with the fight, as difficult it has been and are new, increasingly open armed ki whether on the ground, more and more in the air and indirect, the artillery. >> evelyn, we also learned today that about an hour-long call happened between u.s. defense secretary lloyd austin and russia's defense minister and it's the first time they have spoke in 84 days, since before the war began. and our reporting is that it came that it's, this call came in at austin's request after russia repeatedly refused to speak with u.s. officials. after 84 days, why do you think russia agreed to this call now? >> well, kate, my sense is, first, hour long call with interpretation means it's probably a half-hour call but still, you know, what it tells me is that the russians felt that they might learn something in this call and i, what i'm sensing across the board with the russians, you know, peter,

my good friend, the general, says is wavering and i sense the russians are trying to figure out what to do next. so it may be that the defense minister shoigu decided that he wanted to hear what we had to say, that somehow he would gain some information that he could bring back to putin about american resolve. although, you know, it may be that we had a serious message to convey and there was enough pre-information granted that he got on the phone. it's hard to tell without a really good read-out of the phone call. >> yeah, of course. and also, general, add into this, i would ask about wnba star brittney griner, she was arrested in february, in russia in february. today, it was announced that the court is extended her arrest until at least june 18th, for at least another month. the state department, we know, has said she is being wrongfully detained. what do you think this adds into

this conversation right now? i mean what do you think president putin could be wanting to do with her? >> i believe that it is punitive and petulant on the russian side. they are trying, in their perspective, to stick it to us and using britney as, if you will, a prop. however, it's -- i think plays badly internationally and they may be, maybe they're looking for a trade or some type of swap, but it shows ugly. i mean, it shows ugly. and it doesn't seem to be particularly credible. >> general, good to see you. evelyn, thank you as always. formula. we also reported earlier today that the white house strongly is considering using the defense production act to make more formula and make it more readily available so there's a recognition that this is more of a longer term solution and not an immediate solution that's going to lead to formula literally being on store shelves tomorrow. now, we heard the president say there to our colleague that he believes the white house moved as quickly as possible, but that doesn't mean that he is not confronting a barrage of questions and a lot of criticism about the crisis because the recall, as you recall, goes back to february. one other thing i want to quickly note is that yesterday, we asked the white house whether there was any kind of federal guidance for parents that are unable to find formula. we didn't get a good answer, and just this afternoon, the white house rolled out a new website, hss.gov/formula with information

have two people considered to be front runners and the head to head in this race beating the crap out of each other for months and months and opens up a lane because people get tired of the negativity, hate what they hear about everybody and someone can surge late and it's really too late to do anything about it, you mention the republicans let it go, well what can they do? just a few days away, and so no one's really quite sure how this will turn out, and donald trump, backing dr. oz, hedging in the statements, saying she couldn't win in november but said nice things about her and reporting tonight he may be endorsing the candidate kind of piling around with so even he's hedging a bit wondering how to main tin his one loss record ratio as the pennsylvania primary approaches. total mess and not a lot of answers right now. >> yeah and his statement was a classic like, maybe if i have to later, you can count on it i guess. it was a pretty classic one.

jonathan, speebing of endorsements, scenario ted cruz came in the campaign with david mccormick today which is interesting because he's not the first trump ally to break with the former president in throwing their support behind a different candidate than trump is backing. is it clear to you yet how big a factor donald trump is with republican voters in pennsylvania for this race? >> it's not clear. it's really mixed evidence, because as you said, he's endorsed them in oz and oz has spent a lot of money yet has not been able to pull away with this thing, certainly hasn't been decisive or powerful enough to seal the deal or we wouldn't be here talking about kathy bar net. the question is, in a race that could come down to a couple of percentage points, is his endorsement worth that? is it worth one, two, three percentage points? and that's what i think we're all waiting to see but there are a lot of questions about oz, and in fact a lot of negatives built up on

him before trump came in so it was unclear how much he would be able to move the dial once a lot of people already had a negative impression of him. >> and scott, similar thing, is playing out in georgia as well. you got mike pence going to be campaigning alongside georgia governor ryan cappin in his re-election bid before the state's primary and trump essentially hates kent because he certified trump's 2020 election loss, seen that criticism over and over, trump backing other candidate, david purdue in that governor's race, what do you make of this pence versus trump dynamic there? >> well it makes a lot of sense for pence to show up here and try to take a victory lap with bryan kemp. they essentially have the same position on the 2020 election which displeased donald trump so it makes sense for trump to be in for kemp and by the way, not like it's a close race like we have in pennsylvania, running circles around purdue and a

run-off all together, when this race started out it wasn't sure how it would go to smart move by pence to get in and take a victory lap there with bryan kemp and this will be a primary where trump certainly has an egg on his face. not many but this will be one of them and if you're mike pence looking at running against possibly donald trump for president in 2024, you need to be able to show people there's a way to run as a republican in this country, not go down trump's road on the 2020 election and still maintain your conservative credentials, still maintain your ability to influence republican voters. this is a good way to do it in georgia. >> and you know mike pence knows that, of course, he knows the moves he's making and very clearly okay with making that statement and he's playing the odds pretty well on this one. good to see, scott, jonathan, thank you very much.
