7:01 pm
hello, everyone. this is don lemon tonight. thanks so much for joining. if i actually wrote all of this for hbo max, you would say, no! no way. that didn't happen. you almost have to remind yourself that actually happened. that a president of the united states, right? refused to accept the results of our free and fair election. tried to stop the peaceful transfer of power that makes us a democracy. try to hold on to power for himself. they ignored the will of the
7:02 pm
people. you will set to remind yourself that it actually happened. it did. today, we learned a lot more about how it actually happened. the testimony from witness after witness after witness about the shameful episodes in our history, a lot of it, never before seen. i'm going to play with what they play with the people to hear. i'm gonna play it for you. the biggest bombshell came the last few minutes. this is what liz cheney had to say. >> after our last hearing, president trump tried to call a witness in our investigation, a witness you have not yet seen in these hearings. that person declined to answer or respond to president trump's call. instead, alerted their lawyer to the call. their lawyer alerted us. this committee has supplied that information to the
7:03 pm
department of justice. let me say one more time, we will take any effort to influence witness testimony very seriously. >> try to call a witness. not call a witness to the stand. blue-collar witness. that is a no no. the former president, calling a witness. we don't know who it is. we know one thing, whoever they are, they were concerned enough to avoid president trump and called their lawyer. that tells you something. and there is more here. eyewitnesses, people who were there when it all went down, telling the committee and the american people, but they actually heard inside. there is the december 18th oval office meeting, with the sydney powell. her client, michael flynn, rudy giuliani, not to mention over stocks eo, patrick byrne. they were there, tossing that outrageous ideas to overturn the election. sources telling cnn, including invoking martial law.
7:04 pm
an executive order to seize voting machines. for the first time, we heard pat cipollone's testimony about that, telling the committee that what happened when he walked into the oval office that, night right before the screaming started. here he is. >> i opened the door. i walked in. i saw general flynn. i saw sydney powell sitting there. i was not happy to see the people in the oval office. again, i don't think they are providing over fall, overstock person for who it was. the first thing, i walked in and looked at him. i said, who are you? he told me. i don't think any of these people were providing the president with good advice. and so, i didn't know how they gotten in. >> i think it got to the point where the screaming was
7:05 pm
completely, completely out there. you have people walking and, late at night, it's been a long day. what they were proposing, i thought, was nuts. >> i'm going to categorically describe it as, you guys are not tough enough. maybe, put it another way. you are a bunch of was. that's the word that was used. . he turned around and screamed at me. i yield back, come over or sit your butt back down. >> hearing from rudy giuliani. just a couple hours after that screaming at each, the then president sent out his infamous tweet, big protest on january
7:06 pm
6th. be there. it will be wild. it's like he had a megaphone and his supporters heard it loud and clear. the leader of the stop and steal movement, registering while protest.com to give out details about protests in washington. meanwhile, other supporters chiming in. >> it is saturday. december 19th. the year is 2020. one of the most historic events in american history has just taken place. president trump, in the early morning hours today, tweeted that he wants the american people to march on washington, d.c., on january 6th, 2021. >> now, donald trump is calling on his supporters to descend on washington, d.c., january 6th. >> he is now calling on we, the people, to take action and show our numbers. >> we are going to only be saved by millions of americans
7:07 pm
moving to washington, occupying the entire area, if necessary, storming right into the capital. >> it is informative. that is where people listen to, if you have not heard of those sites, if you never heard about info war of alex jones, any of that. people are listening to that. that's why they stormed the capitol, in part. the rhetoric turning to discussing. >> dj t has invited us and it will be wild. some of the online rhetoric turned openly homicidal and white nationalists, such as, why don't we just kill them, every last democrat, down to the last man, woman, and child. it's time for the day of the rope. white revolution is the only solution. >> look, i think i'm an informed person. i didn't really know the day of the rope. the day of the rope is a slogan
7:08 pm
for white supremacists. it refers to mass lynchings and so-called, race -- and then on the night of january 5th, there was a rally just a couple blocks from the white house, featuring another then roger stone and michael flynn. >> through the open door of the oval office, the president could hear the sound of the crowd, the music, and the freedom in the plaza. this are some of the things that they were hearing the plaza, just blocks from where the president said that evening, excited for the next day. >> this is nothing less than an epic struggle for the future of this country between dark and delight. between the godly and the godless. between good and evil. and we will win this fight or america will step off into 1000
7:09 pm
years of darkness. >> tomorrow. tomorrow. trust me. the american people that are standing on the soil that we are standing on tonight, and they're gonna standing on this soil tomorrow, this is soil that we have fought over, fought for, we will fight for it in the future. the members, the members of congress, the members of the house of representatives, the members of the united states senate. those of you who are feeling weak tonight, those of you who don't have the moral fiber in your body, get some tonight. tomorrow, we the people are going to be here. we want you to know that we will not stand for ally. >> he has general in front of his name. hours later, trump supporters stormed the united states capitol. in the crowd, members of the oath keepers, nine members, have since been charged with seditious conspiracy. a former spokesman for the oath keepers testifying today.
7:10 pm
listen to his killing warning. >> i do fear for this next election cycle because who knows what that might bring if a president that is willing to try to instill and encourage, to whip up a civil war amongst his followers easing lies and deceit and snake oil -- regardless of the human impact, what's else is he going to do if he gets elected again? >> let's bring in, let's discuss, now senior legal analyst, and the political analyst and political commentator. scott, jenny, thank you for joining us here in new york. let's start with you, kyrsten, this new cipollone testimony. he told trump that there was no fraud. that he should concede.
7:11 pm
he refused to go along with powell, special counsel. how important should that be? >> i think it is important to those points. i think it was jamie raskin who pointed this out. that he cooperated everyone's testimony. so, that is very important. didn't contradict anything that cassidy hutchinson had said, which were a lot of people were saying that she made things up. i think it's important for that reason. you know, i think, as liz cheney pointed out, i think is towards the end -- no other person had more information about how the election was legitimate that donald trump. no human being alive had more disinformation showing and having more people telling him, including pat cipollone, that this was a legitimate election. >> and he didn't do -- >> he chose to ignore. and he chose to ignore it. he chose to try and find other people. he had people like cipollone, but who we have to say is a die
7:12 pm
hard trump supporter. this is not someone who did not like donald trump. a liberal who snuck into the white house. this is someone who supported him and was telling him, along with a lot of other people, there's no fared there. >> a conservative at the table, shaking their head. >> yeah, all the series, people all the professionals, all the people that don trump had chosen to advise him, notably, his lawyer -- whether things are legal or illegal, telling him that this election was lost. when you're trying to do here is not based in reality or based in law. that has serious implications, particularly when you consider all of the efforts that were being made, internally and externally, to influence mike pence, to intimidate mike pence and other members of congress to interrupt the constitutional process that was our peaceful transference of power. the phrase, day of the rope. night of the dopes. the fact that you have the serious people telling you one thing and then you gather, what
7:13 pm
is essentially a canteen from star wars in the oval office, the white house residence, to take their advice? i mean, we were off the rails. we were absolutely off the rails. thank goodness, as paths of the lonely said, my parents did his job and duty. it's clear, this entire thing was designed to break him, to intimidate him and break him. >> this is all to break him? the vice president? >> absolutely. >> when trump didn't get what he wanted, this is for you elie, with his late night tweet. he knew what he was doing. it was a call to arms. any legal implications? >> so, one of the things that the committee told us, betty thomas told jake tapper, they needed to proof of conversations between domestic extremist groups and people in don from's orbit. we did not see that today. that was a promise that went unfulfilled by the committee. but they did establishments that donald trump knew darn well how to communicate with his people. he knew how to run those bells
7:14 pm
and whistles. boy, the response that we saw that tweet was incredibly compelling. all across social media, within the crowd boys, the rallies, they saw that as a call to action and war. you're not going to the clean conspiracy that prosecutors like, that agreement. right there! meeting up the lines! uncharacteristic not to bash, and he's a master knowing where the line, is going right up to the line, dipping half a toe over the line, but it is a tough call. >> what about the fact that we don't know the missing link between how the organizers from the extremist groups got the information that he was going to say, let's go to the capitol? >> does not suggest that there is some sort of connection? >> so, this is a great. point flynn and stone both, unimaginably, associated and posting pictures with the extremist groups. remember cassidy hutchinson told us january 5th, donald trump told meadows to talk to those guys and, presumably,
7:15 pm
that was done at trump's behest. we don't know what was said. that is a gap in the evidence here that the committee may not be able to fill. prosecutors could fill it because they can compel mark meadows to talk. the committee, he walked away from the committee, he defied. that no charges. >> prosecutor. >> i would subpoena. when i would. a grand jury, the real kind. not the kind you can brush off. get him in from the grand jury, he is under oath. ask him precisely, what are your conversations? maybe take the fifth. maybe he'll tell us something. >> you don't have the legal piece nailed down. you have the moral piece nailed down. it's quite obvious that donald trump wouldn't accept the best advice from all of his advisors, that he lost the election. he decided to whip up a mob and intimidate mike pence into breaking up the constitution. that's what happens. >> okay so, obviously it's not going to matter to -- does it matter to conservatives enough? >> yes i believe it does. >> does it change the
7:16 pm
conversation? >> you are already seeing evidence in some of the political polling that he's not in a great shape that he used to be for republicans. there's a new york times survey that comes out ahead. and a fragmented field. obviously people are looking for another alternative. a couple of weeks ago there was a survey showing ron desantis beating donald trump and the desantis survey. there is mounting political evidence that republicans are casting about because they don't want to do this again. there's also evidence that trump knows it. there's only one reason you would want to be launching your campaign's cause you hear the footsteps. and thank launching your campaign would put the fire out. and maybe insulate you legally from being embedded by your possible opponents. so i see evidence that the republicans. it's always going to be a group. i see evidence that a lot more people in the party who voted for him twice gave him rub money, supported him. >> you have said that before. >> i feel it today. >> stick around everyone. when we come back. i want to talk about the
7:17 pm
bombshell that liz cheney dropped in the last few minutes of today's hearing. and what it could mean to the investigation. don't go anywhere.
7:18 pm
7:19 pm
the mosquitoes are just all over the quiet please. okay. wow! [light bulb breaks] hey! i said get a pro. i did get a pro. an orkin pro. [mosquitoes buzzing] i got you. got mosquitoes? don't call any pro, call the orkin pro. orkin. the best in pests.
7:20 pm
so we are talking about these new revelations from the
7:21 pm
january six committee. what was going on inside the trump white house. in the weeks leading up to the insurrection. with me now, cnn political analyst, also any elie honig, and scott jennings. [laughs] earlier, but his car was driving into d.c.! >> slight miscommunication. >> we are happy that you're here, welcome. i don't know -- you guys want to respond what's got says. scott believes this is not helping the former president. that it is weakening him. am i correct? >> look i think there is mounting polling events, that there is an opening here. and this is really eroding him. >> this brought to mind something i saw something earlier. anderson cooper was interviewing john dean. he was asking him, were you nervous when you testified in the watergate hearings? he said no, because richard nixon was weekend. he was politically weekend. and of the question is, has that happen, or is that happening to donald trump? i will defer to you as the conservative in the room. it sounds like you are saying that maybe starting? now >> it's starting, look, he
7:22 pm
is still the front runner for the 24 nomination. but any fragmented, field, it's clear to me, that there are more and more people every day in the party. who are looking for a way out of this. >> i thought this was important, because scott, how long have we've been doing this? 25 years? 15, 2016, we've been talking about this. this is the first time i've heard you say that. we have all these sayings, two impeachments, and the beginning of the insurrection. and the take, you know, the infamous p-word tape. and you said, we are making all this hay about this, and people don't care. they will still vote for him. they still support him as a person. i think it's important to hear someone like you say that. so let me give you this question. the committee was hammering home today that trump was surrounded by people from cipollone and bill barr, to his own daughter ivanka trump. who knew he lost the election, here it is. >> i want to start by asking
7:23 pm
you if you agree, mr. cipollone. bill barr [inaudible] all of the individuals. no evidence of election fraud [inaudible] to undermine -- >> yes i agree with that. >> meadows had caught up with me, and leaving the office, and caught up with me, and said, that -- he said look -- i think that he's become more realistic, and knows that there is a limit to how far he can take this. and jarred said, yeah we are working on this. we are working on it. >> did that affect your planning or realization? as to whether or not there was going to be an end of this administration? >> i think so, i think it was my sentiment, probably prior as well. >> miss cheney said today, trump is no child, he had the right information, and he chose
7:24 pm
to lie. >> i think that's true, that's clear from the evidence they presented. the people who he brought into that room to discuss where to go next. were people he knew we're going to agree with his plot to overturn the election. he had actually kind of systematically removed himself from all the people who were going to tell him the truth. interesting hearing those advisers talk. because it sounds like people talking to a child. you know, they say trump is the child. but it sounds like they're talking about someone who -- when they tell them the truth, the reality, they don't think they're going to accept it. because frankly, it's not what he wants to hear. he was plowing ahead, not only because of a lack of information, he refused to hear. this is consistent for donald trump he has surrounded himself with conspiracy theorists. with people who do not provide him correct information. it is only -- the only thing he has cared about throughout his political career is the information he was receiving was going to advance him. and going to achieve his interests. and that tracks with what we heard today. >> the picture you painted was
7:25 pm
-- >> donie [laughs] >> that tweet that he sent the night after the meeting. the fact that he said in the tweet: it's statistically impossible that we lost. i have been involved in sneakers and winners. it's very statistically possible. i'm just telling you, he got his butt kicked. [laughs] >> vice chair liz cheney revealing today, that the last hearing, that they had, that trump contacted a witness. and the committee alerted the g the doj. i mean, the hubris, the gall, is that a bombshell? >> donald trump is an inveterate habitual witness tampering, and witness rallied are. i can't think of anybody, think back to michael cohen, to all the witnesses in ukraine, alexander vindman, his twin brother. on through right now. even if the other day, he lashed out in public against cassidy hutchinson. he does it in realtime. it was remarkably foolish, horrible judgment to reach out
7:26 pm
to anybody who might have been a witness. i have no doubt if we had to guess. not in the world of guessing. he probably had intent to at least try to persuade that person, maybe not out right intimidate them. if all we have as a phone call that was not answered, and not returned, just a missed connection, that's not going to be witness tampering. people need to cool down [laughs] >> on this front. >> attempted witness tampering! >> you know -- you don't have enough proof. >> on this front, you have people, look what happened to hutchinson. starting out, she had a lawyer that was arranged by them. and i guess paid for by them to. so if you are a witness, and you get call to do this thing. and someone is getting into your lawyer and taking care of that. i mean, you know, you are in the business. don't you feel compelled to act a certain way? >> absolutely a conflict of interest, common in the criminal and normal corporate world. it definitely has the effect of making it much more difficult to cooperate. i will say, one of the biggest
7:27 pm
red flags we would have us prosecutors, is someone -- 's they dump their lawyer, they dump their corporate paid for lawyer. or their lawyer that the drug king pin gave them. that simple tasks. >> this is why our legal system [inaudible] [laughs] >> this is the truth! >> look at his suit. these people are not cheap, they are not cheap, they cost a lot of money. i ran up like a quarter of 1 million dollars in legal bills. and i didn't do anything [laughs] i didn't try to overthrow the government. it's not cheap. you can see the yellow, or you take a young person, with no resources, give them a lawyer, and pay for it. >> they'll do. it >> you can see the connections. >> we're learning that trump had planned for that crowd to march to the capital, we saw a drafted tweet, that the president has seen, that said in part: march to the capitol after stop the steal! it was never sent, but how significant is that? >> well this isn't the only evidence that he wanted to march to the capitol. there's also the fact that this was somehow communicated to organizers you know these
7:28 pm
right-wing organizers. katrina pierson also mentioned this and the fact that he kept it from everybody else right. so that they couldn't be stopped. so it shows that there is an awareness of guilt, there's an awareness that there's something wrong with this and that this was his intent to do this all along. and it was even being communicated to the people in these -- that were organizing this mob basically. what ended up being a mob. i think it is significant, it does go to the point that it wasn't the sort of -- oh just throw this out of nowhere. it didn't really comprehend what it meant. i think what we also just saw today, was how clearly his followers understood the ultimate tweet that did go out. when they play the response to it, it's just so clear, that they all hear what he is saying. >> the witnesses said it. >> yeah they all hear what he is saying and amplify it. so it's very clear.
7:29 pm
he knows what he's saying, they know it too. >> it's interesting, as i watch these, right. the hearings every day. whenever they have them. i'm like oh katrina pierson! oh i remember her!
