developments in the doj's criminal investigation of january 6th and the efforts to overturn the 2020 election. cnn is live in the capital with the latest. good evening. we appreciate having you. what are you learning about today? >> reporter: this is a significant development in terms of the department of justice investigation into donald trump's election interference and how that led to what happened on january 6. both jacobs and marc short were the first big witnesses that the january 6th elect committee were able to cooperate

that were inside that orbit of the white house, the oval office, west wing and the days leading up to january 6. what the testimony revealed at that time, was the intense pressure campaign that was put on vice president mike pence and the steps that he stood to resist that and satellite on the fake collector plot going on around the country. these are things we did not previously know until the committee was able to crack core of mike pence and the inner circle. the fact that they are cooperating, they are under subpoena and the testimony is behind closed doors to a grand jury but it is a significant move. and more than anything it shows they are very much interested in the plot to subvert the will of the american people beyond just the violence that took place on january 6. >> the select committee releasing new evidence today, what does that show? >> reporter: it shows they left a lot on the cutting room floor last thursday.

they indict a former president. >> i would say we had norms in this country that you would typically, try hard not to indict a former president. gerald ford pardoned richard nixon. but this ain't any old former president. he broke those norms when he stopped the transition of power. i think he should be treated no better than any criminal defendant being investigated and no worse. if we let them go for the sake of moving on, he is not getting better. he is getting worse and putting in place people across the country who would go into office who are inspired by him who will not honor the next transition of power.>> richard nixon ended his political career. he left office as president. there is new information about the select committee, they played in the last hearing the outtakes. on the day of the

insurrection, trump refused to say he was sickened by the violence. and also crossed out the line, you don't represent me or our movement. it is a stunning piece of evidence. does this amount to a crime? >> that line did not represent what donald trump believed. he was with the violent mob attacking police officers. it goes to his intent that he wanted the mob to storm the capital and stop the count. and obstruction of congress, which is a crime. conspiracy is a crime. january 6th committee has laid it out and hopefully and in the pond independent department of justice sees it the same way. >> i don't know that congress

can take a member of congress to court under the speech or debate clause. we have never been in a situation before. our point is not to come up with a dozen new dazzling theories to end up in a lot of wild goose chases all over the land. >> the concern when i said, it may seem political if you try to indict the former president, are you concerned that the shoe is on the other foot? >> and they already said that they will go after me and adam schiff. which shows this is really just about retaliation, not anything else. we have had the power and we have used it before to use contempt of congress and to put a system in place, if you're not going to comply, you will be held accountable. it will be interesting. we have no intention of losing the house but if they ever have

subpoena power, how could they expect anyone to comply with it, if they are showing themselves as being above the law? >> it is interesting. every time at the end of the hearings, liz cheney will say or someone on the committee will say you have so much time to call the committee and they say they're getting this evidence. they say they are seeing so much evidence coming in they may have to continue the work after election day. cannot happen if republicans take the house? >> if the republicans take the house they shut down the committee, the congressional gold medals don't go to the capitol police. they go to the rioters. they are more comfortable with voting, more comfortable with violence than voting. what is inspiring to me is courage with this committee has begun courage. as people show courage, like cassidy hutchinson it inspires other people who have information, who may not want to go public.

members of the january 6th select committee say they get so much evidence they may need to continue after election day. but that cannot happen if republicans take the house in november. the evidence coming out of the select committee is damning and we are learning two former top aids to mike pence testified. do you think all of these developments are registering with voters when most are struggling to pay for groceries, rent, gas et cetera? >> you are absolutely right. the economic issues when they are bad, tend to occupy a special dominant place. but let's not forget the story of the last 10 years in

american politics, which has been that cultural issues matter a lot to people. people increasingly are defining themselves politically by where they are in culture and this is one of the reasons why republicans have tended to do so well. even in cases where working- class whites, republican policies are often not particularly well geared to get those voters economically certainly. they rub certain cultural issues very well. they scratch those itches very well. this time, for the first time we are seeing the democrats take the offense on some of these cultural issues. abortion. voting rights. guns. there are issues on which for some reason, part of it is the overturn of roe v. wade. part of it is just the overwhelming persistence of these mass shootings.

part of it is the september, the january 6th hearings. which have been very successful in making people understand both the level of the significance of what happened, but donald trump's culpability. all of those three cultural issues are working in the democrats favor in a kind of unusual way.>> do you think democrats will be able to convince americans that they are looking for them? the midterms is a few short months away. as i discussed with congressman swallow, democracy is at stake right now. >> your skepticism about this is well warranted. the congressman said that the generic ballot, the democrats were surging. i think that might be a slight exaggeration. the democrats are doing better than they were. the republicans still have an advantage.

they are leading in the generic ballot. unfortunately because of all kinds electoral rules and gerrymandering and things like that. republicans over perform. even when they lose the overall vote, they get a small majority. if they are leading they will do even better. >> i don't think it is enough yet to change the directory but people are talking about a republican blowout, that does not seem as likely. there is a troubling indicator, which is a predictor, the president's approval rating continues to be very bad. and of all the indicators of the president's party's performance in a midterm, i think -- i don't think i am wrong. the single most surefire predictor is what is the approval rating. >> not very good right now.

>> maybe the worst. i think tied with donald trump for being the worst ever. >> maybe lower. you have a lot of people talking about an article you wrote, coming up and saying, he said this and i cannot believe it. what you think about this? you want something for the washington post thing democrats need to once more become the party that gets stuff done, build things and make's government work for people. that is more important to most americans than using the right pronouns. a lot of pushback for this. what are you thinking? >> i 100% stand by my point. the most important thing to do is to win. if you cannot win, you cannot do anything. you cannot enact any program or protect any civil rights. nobody is going to be protected are looked after, affirmed

without that. you got to figure out what is the way you win. the way democrats will win, is if they show they can be a party that governs and uses government to do stuff. one point i was making is the democrats pass these instruction bills, but very little actually happens. it takes so long to build anything in america. mostly in the blue states. especially in blue states. there are so many reviews, so many regulations that make it impossible to build anything. it is one of the reasons why housing in blue states is such a nightmare. housing costs have gone up so much. because a combination of environmental reviews and that review, you cannot get stuff done. if you are the party of government, you are the party that says we will use government to improve your lives. you've got to show you can actually do it.

instead of a lot of virtual signaling about this, that or the other. i am not against any of those things. i am saying focus. when you're running an election you have to prioritize and if you ask yourself, what is it that you want to stand for and people to know about you, and what franklin roosevelt and lyndon johnson and even bill clinton understood, the way you get people to see the democrats in the right light is to say we are the party that uses government to help the little guy. that is what obama did with obamacare. that is why it was so important . he prioritize that over everything else. you may look back and say why didn't obama domarriage? at that moment he was saying my priority is to take this once- in-a-lifetime opportunity i have and push forward something that will raise tens of millions of americans. you have to focus.

democratic crisis. we know that one of two things will happen. donald trump will win or he will claim he won. even though he lost. and all kinds of state-level officials and state legislatures have been primed for this. so the most important thing to do is to break the momentum. i don't know and i don't really think the best is a legal one. you have to fight this politically. you have to win this politically. there are tens of millions of people out there who are believing in something that is a lie and believe in someone who is a demagogue. you have to break the fever and join this fight. >> you have to remember the context in which were having this conversation. it is not as political activists , but the only party in general for the most part he was

how does that happened? >> it is a combination of bad history and bad theology. the bad history comes through books, films, things we have heard the sound pretty innocent. for example, you have heard people say this nation was founded as a christian nation. i hear that all the time. it is not true. we were not founded -- the founding fathers had a lot of different theological beliefs. and many saw how religion had torn the continent apart because of the religious wars. this is not a christian nation. part of the bad theology is that preachers and pastors and christian leaders, pass these messages on in the pulpit. people have gone to churches and they see an american flag by the pulpit and they don't think about it. people do the pledge of allegiance at church and they don't think there is anything wrong with that. that is part of how this

congressman thompson to join us on this program and we have not heard back. he is welcome. i want to hear what he says and i would love to have a son and the new husband on. >> i don't know congressman thompson and would not pretend to know what the relationship is between him and his son. i think it is very personal. i did read the statement when he cast a vote against it and the office said he was voting no because he thought it was a show vote and a distraction from the real issues of the day. to take him and his office at his word. this is a very personal deal between him and his son. i would not pretend to know what is going on between them. i am glad he went. candidly, i know people who have had similar situations in their family where the parents chose not to attend and chose not to engage, which i think is incredibly sad. when people cannot celebrate as families. it is a strange situation.

>> if you look at the polling on marriage specifically, it has moved a long way from 10 years ago or 15 years ago or five years ago. the majority of republican support, a wide majority support it. i think you will see different people act in different ways for jurisdictional reasons. people who represent more rural states that have more weekly churchgoers will feel one way and people who represent other kinds of constituencies will feel another. in the senate i think you will see a split conference like in the house. my presumption is it will pass in the senate. it will get at least 10 republican votes. i don't who they are. i think the republicans have moved somewhat on this. at the same time calm popular opinion has moved as well. >> more rural -- i grew up in a rural area. they needed it the most. there are more gay people in the rural area that you could
