tonight. we have major news on the january six investigation. we're getting big revelations every night. this could be a game changer. just imagine what officials in the trump white house who heard and saw what was going on and how far that then-president was willing to go to hold on to power? just imagine, that's where they could tell us. cnn exclusively reporting the justice department is trying to force former white house officials to testify about with the former president is trying to keep secret. with his claims of executive privilege. it is the clearest sign yet. the feds are zeroing in on the former presidents conduct. so, what do those officials know that they could not say? we may find out. as the justice, as the department of justice prepares for that epic court battle, the january 6th committee is pushing ahead with his own investigation. they're talking to more and more trump campaign members. there are a lot of trump cabinet members, mick mulvaney speaking to the committee for several hours this afternoon. he was an envoy

in this potential conspiracy to overturn the results of the election. i think that the revelation, or the discovery, i should say that the ot has already started putting people in front of a criminal grandeur this the most significant development we have seen so far about the doj investigation. and, let's, remember doj doesn't have the same clock taking over it said that the committee does, the d.o.t. work will go on until they feel they have reached the end of it no matter how long that takes. , of the reason i asked the question the way that i did was because that you, guys any of you can correct me if i'm wrong, but i'm wondering, if you look at what's happening with the fake electors, i mean i think that that is probably maybe the major legal case, here right? for putting up these fake electors which is obviously illegal. if the questions surrounding that would be similar, if not the same questions about the former president and maybe people are reading too much into it. am i off on that and? >> i don't think that you are,

don. i think that, as we have seen with the committee testimony over the last couple of weeks, it is really hard to pull one thing like the fake electors efforts out of this overall effort to overturn the results of the election. you see, we have talked about this many times of a hub and spoke conspiracy. you could think about it in terms of the intent of this conspiracy, and we know what they were trying to do. that just so happens that they have different kind of avenues, different kind of layers of efforts that we're all pursuing that same ultimate goal of overturning the election. so, i think they're going to go after the fake-elect, or as one example as they're trying to pull that off but we will likely hear other efforts as well. all, right well what do you think? that do you think that i am wrong and often think that maybe they're asking similar questions about the fake election. and how this is about trump,

and how there is earring on him. >> so, he certainly right that this is more than one scheme. it's a series of overlapping into relations, game but what i think is right i want i think is different about the news we got today is the conversation that they're gearing up to go to court and fight about. our conversation specifically involve donald trump, this is where donald trump, around him maybe claiming executive privilege. to give you one, example we know that cipollone talked to the committee. when we saw the clips of pat cipollone last, week there were certain questions he was asked about the conversation that he had with donald trump where he looked to his lawyer and said, privilege. well, they didn't get the answer to those questions, we didn't get the answer to those questions, but now the reporting is that doj is getting ready to go to court to fight to get the answer from those questions. whether it's from pat supple one, marc short, or whoever else they may bring in. so, in that respect, don, it is targeted specifically conversations involving donald trump. >> jonathan, just to answer no. do you agree?

>> yes. >> okay, so, good i want to ask you about if we're getting some significant reporting and i want you to respond. do you have been breaking so much news about what's happening with the trump white house. i'm not sure if you know about it. but i will redo. this is from the washington post. it says that january six text messages missing from trump home land security, wolf and cuccinelli okay, that's the headline. this is from caroline and maria. from the washington post. text messages from former president donald trump's acting homeland security -- acting -- kim cuccinelli, are missing for a key period meeting up to the january 6th attack on the capitol. that's according to four people briefed on the matter and internal emails. again, this is just coming in. i'm just getting it. can you help me with this, jonathan martin? >> sure. this is important. those are two of the most senior officials in trump's orbit who would have been directly engaged on the security measures that were or were not taken. in washington, ahead of january 6th. they

would potentially have information about what was or wasn't done ahead of the planned protests that became obviously on insurrection. that could be revealing. especially if they've gotten to the point of their guest. if they had anything that sort of speaks to president trump's mind said in that period and speaks to his intent when it comes to the stop the steal rally in washington on the sixth. that could be very significant. i would just say, don, briefly, if you think about what's happened from two angles, the january 6th committee and the department of into -- the department of justice investigation, the picture we are seeing coming into focus is the true probes that are getting closer and closer to

the former president. in part, because of the growing cooperation of his former advisers. every day it seems like we are hearing more people in trump's orbit testifying before the grand jury in the doj probe, or participating with the 16 committee and they're turning over more and more information and getting closer and closer to the former president. >> that may answer the question -- it may make it nolan void. andrew mccabe, another quote from the article. the department of homeland security notify the inspector general in late february that wilson cuccinelli's texts were lost in a reset of their government phones when they left their jobs in january 2021 in preparation for the new biden administration, according to an internal record obtained by the project on government oversight and shared with the washington post. andrew? >> don, i feel like i've heard the story before. it seems very familiar. this is just -- we

are back in the same conundrum than we were in just a few days ago. the secret service texts. is this an intentional act, subterfuge of getting rid of embarrassing or uncomfortable texts that these executives don't want to get out, or is it just the height of -- incompetence at an agency level? it's starting to get harder and harder to believe it's just in confidence. everyone knows this. especially at the levels that those two men serve. all of their communications are supposed to be preserved as under the federal records act. that stuff goes directly to the national archives, so for dhs to have just erased their phones as they walked out the door is just really, really hard to believe. really hard to believe. >> elie honig, i want you to respond. let me read this and i want your response. telephone

and texas indications of wolf and cuccinelli in the days leading up to january six could have shed considerable light on trump's actions and plans in the weeks before the attack on the capital. trump had been pressuring both men to help him claim the 2020 election results were rigged, and even to seize voting machines in key swing states to try to re-run the election of course, that is potentially crucial evidence, down. it's a day to top officials at the age s and they split it up to january 6. of course, the h s includes the secret service. of course, investigators want to see this. of course, commitment to see it. prosecutors want to see it someday. and he is exactly right. this is exactly like what we heard last week, about the other missing secret service tax. i am very skeptical, a, given the pattern and, be, given it is known throughout the hms that you have an obligation to preserve those tax. you don't just say, well, we are getting better soft phones, so everything gets tossed out, and that is that.

about whether his way of governing was too updated to work, but how does look now to you? >> it looks good. he is quietly amassing a legislative record. you left out the manufacturing the chips bill that was just passed, the china competitive spill that is quite significant. he has a lot of accomplishments to harold here, assuming that this next bit pass. there are things that he has gotten done, the infrastructure bill, if he gets the gun bill, if he gets this bill, negotiating medical pharmaceutical prices -- these are things that democrats have been talking about for decades, and he was able to get it done. yeah, he has a real body of work here that democrats can run on in november. whether or not he aids some of the

headwinds being created by the economy is a question, but without question, joe biden has amassed a really strong legislative record here. >> the question is, simple question is, why is that? why is he not able -- maybe it is because he has not sold properly or it is the medias fault, i'm not sure. maybe it is a combination, because he faces a dismal approval rating. huge part of the party in a new cnn poll would rather have someone else run. is that the because they have not been able to solve the success of the american people, because he's not like the former president, okay, i stumped motto today, it is not on twitter, you don't i mean? >> honestly, one of the reasons that he was elected was because it was not like that. i think it is a combination of things. one, as i mentioned, the economic conditions as it

relates to inflation, is significant and that is creating a lot of had one for him. i think also, mistakes were made at the beginning of the administration by touting the potential for more than they were likely to get. it is better to under promise and over-deliver then over promise and under deliver. >> it is transformative. if you go anything less than that, then he will face criticism. >> the result of that is despite the fact that he is passing -- really, i don't think it is too much to say historic legislation, certainly the infrastructure bill was, the negotiating for your prices -- this bill that they will pass is also financed by closing some corporate tax loopholes that i've been on the target list for democrats for decades, as well. but, they all seem smaller because of all that chatter at the beginning, the new fda are, we will make the social compact and so on, which is never realistic when you have a 50/50 senate and a nearly 50/50 house. in that

sense, i think the administration did itself a disservice, and then there is the issue of biden himself, who i think is very skilled and obviously knowledgeable after 36 years in the united states senate about how to get deals done. he isn't as great and from the camera as perhaps he once was and perhaps as some others have been. but it may be that the modesty is one of the elements that is being able to get the deal done. i was the one who said back a few -- when the build back better bill fell apart, i wrote a piece for the new york times saying, hold on to your hats, this thing is not over, there is the potential to get something done. here in the 11th hour, it appears that he is going to do that. >> even he admits that it is not everything they wanted. it is a lot less, but still, there is something done here. it is interesting because the democrats get criticized a lot

for not being able to play politics, so to speak, as well as the republicans have. senate republicans are furious because they say they went along with the newly passed bill that democrats would not move forward an economic bill. the senate minority leader mitch mcconnell was essentially played here. they finally get a taste of his own medicine, they've? >> they certainly seems to be outmaneuvered here. he was the one that insisted that they would move forward without the other. i don't know what representation senator schumer made to him, but they obviously helped this build back until that one was passed. as you point out, mcconnell was a master at these kind of universe, just ask justice garland about that. you know, yes, i think that democrats have played this well and while you say it is not everything that they wanted, that is the nature of governing. you never get anything you want, but under the circumstances, i have to say, if they get this bill, along with everyday completion, he is quite a bit.

this one, but, you know, if you hold yourself out of the party that is pro democracy and you have someone who knowingly voted to impeach the president, knowing that he would put his young political career in jeopardy, as he has, knowing that he would incur the wrath of trump, but he did it anyway because he thought it was his responsibility as a former military guy. i think that probably had something to do with his thinking on this. having taking that oath. but i don't think it's becoming for the party that is fighting for democracy. you said what are you going to do about it when it comes to standing up for democracy? he did something about it. if democrats -- if he is the nominee and democrats have a candidate who's also pro democracy, but they agree with on a lot of other issues, then go ahead and vote for that candidate. but let me just ask you this, don. if liz cheney were in a swing district, i

hired as town manager. all the officers are white. now a small community is trying to figure out what is going on. here is cnn's dianne gallagher. watch. >> a tiny town with big problems and whispers that friendly north carolina may not be living up to its nickname, at the entire police department abruptly resigned, with the chiefs placing the blame on the new town manager. >> they're not police, they are family. >> leaving some of the tight-knit community of roughly 1500 concerned about safety. >> we are worried about what the future holds for the town. >> other residents speculate that there may be something more behind the police retreat. >> this seemed more about power. >> i feel like it is a race issue altogether. >> the new town manager, justine jones, is black. the entire police department is white. >> i don't think they support

black people. i feel like they harass us a lot. i feel like they don't want a black woman over the top of them, you know, basically managing them or telling them what to do. >> i think there is too much jumping to conclusions. we really don't know what is going on. >> the town council held an emergency closed-door meeting on friday and released a statement this week saying, in part, the prudent course of action is to find out what happened and not make rash decisions. in a place like kenly, 2 square miles where everybody knows your name and your business, mystery is unusual. >> it is just weird. for us to not have any information as to what to expect, are we going to have police, we have a town manager? >> cnn has obtained a resignation letters in total. the longtime chief of police, josh gibson, for full-time officer, one part-time and 2 town clerks. the letters are similar in language and most site stress and a hostile work environment. but the letters are short on details. no information about the specific causes of stress or examples of what they call a hostile work environment. the letters also

did not point fingers at the detail manager, who has been on the job of less than 2 months. but gibson, the longest serving chief in town history does. and a facebook post that has since been made private and in an exclusive interview with fox news. >> she brought me up for going to business, for going to talk to businesses. she wrote me up for talking with council members that i have known for 20 years. >> so she was targeting you? josh, -- >> cnn has not looked that gibson's records, and the town would not provide supporting documents when requested this week. john started as time manager on june 2nd. the town announced they're hiring, approved unanimously by the council, noting her 16 years of responsible positions with local governments and several other states. and jones told cnn that since the personal

matter, she cannot comment on the post recognitions. the town attorney said that he will oversee a investigation past inducted by an outside firm starting next week, one is when the recognition thinking back. the johnston county sheriff's office, which already services kenly, will increase its presence in town because the police department will be gone. according to the town's website for the police park, they should be staffing that still includes 2 part-time police officers, don but i spoke with the town attorney, he tells me that as far as he is aware, there is simply are no more officers once those resignations take effect next week. i also reached out or attempted to reach out to those who were involved in the situation. the attorney for chief josh caption tells me that they will work on getting an interview but noted that the chief is stepping back from interviews for a bit because of the amount amounts a stress that the situation is causing his family. >> diane, great reporting, standby because i want to discuss this more. i want to bring in cnn legal analyst rib marin, who is a civil rights

involving a hostile work environments in stressful situations. rarely do you see someone with 21 years on the job resign, stating a hostile or toxic work environment because someone knew it has been there less than 2 months. typically, when you see hostile worker moments, someone is talking about having worked in an environment for many months, if not many many years. this is a highly suspicious act or actions by these individuals. let's be clear, don. with the chief said is that if the town gets rid of the new african american city manager, he will return. it seems like a big power play. obviously, we cannot ignore the issue of race in the potential that is actual driving the recognitions. >> it is interesting because he said she has not been at the job with that long. usually, if you came hostile work environment, you had to bring receipts over a period of time. diane, the chiefs last day is tuesday of next week. what is the endgame here? is it a lawsuit? he did tell our affiliate that he would

>> will you buy food or parent? >> i am not confident that the prices will go down. it has been a little frustrating. >> let's bring in now cnn economic commentator, catherine ramp l. catherine, i, how are you, i have so many questions. i have so many questions for you because the fed is trying to -- it might shrink growth, which is gdp, to cool down and overheated economy. it is like we are in a weird place. you can respond to that. biden officials are now officially calling this a recession, although the common definition of a contract to gdp growth, 2 consecutive quarters. how do you see what is going on? >> actually, that is a misconception, that 2 consecutive quarters of negative gdp growth means recession. in the united states, at least, a recession is determined by a special independent committee of academic economists, who basically look at a broader set

of economic metrics. they do look at gdp, but they also look at job growth, consumer spending, income, manufacturing, industrial production, that sort of thing. their goal and job, essentially is to say when overall those numbers seem to be turning negative, when there seems to be a broad based construction and economic rampell activity, that is when a recession is happening. the numbers that we are seeing in the economy right now are -- >> so the last part again about whenever session is happening. >> it's one and there is a broad based construction in the economy, as measured by a whole different data points. right now, the economy is sending really mixed signals. there are some numbers that bad. gdp growth being one of them. but there are numbers look really good, job growth being one of

them. it is really hard to sort through all of that noise and figure out what is going on right now. i think, probably, right now, one this committee meets, and they usually do it long after the business cycle has turned, i think most likely, they will not say that this particular moment represents a recession, but the risk of recession in your head have in fact risen for a lot of reasons. >> gotcha. we got this at the white house thinks or what even experts think, we whether we are in a recession or not, we heard every day americans speak before i introduce to. they are hurting. is there anything that can be done to reduce the impact of a possible recession on every day americans? >> so, yes, whether or not we meet this sort of pedantic definition of recession, at some level it is relevant, people are suffering. they're worried about their finances, et cetera. the goal of the fed is to try to cool down demand just enough to get price pressures down, but not to tip us into recession. that is a really, really challenging task. historically, when they

have raised interest rates to get demand to slow, they have accidentally killed the economy. we don't want to do that. there are some things that the president and a congress can do to make the fed's job easier. there is not a lot, but there are a few things they can do. for example, they can repeal the trump tariffs. that would have a modest effect on prices. they can get some of the bottlenecks in the legal immigration system that seems to be contributing to label shortages right now. they could suspend some of the restrictions on their time shipping that makes shipping products like oil more expensive. there are some things that lawmakers, the president can do to take some of that pressure off the fed. but, ultimately, interest rate hikes are unfortunately the most powerful tool available to get inflation down, they come with the risk. >> that is what happened, catherine, i had around, thank you very much. i appreciate you helping us up. thanks. it is a bill that could help save lives and ease the suffering of
