good evening, to four weeks after the search of mar-a-lago until four weeks into a courtroom silence on the subject. the former president's legal team's often -- first filing of any kind since the surge. they've asked a federal judge to stop any review of seize material until a third party attorney, or special mask or is it's call's name to review the evidence. beyond the specific request, it contains the filings by the former president, and the tone

it strikes and claims it makes neither of which are typical of the category. quoting now from the introductions first line, politics cannot be allowed to impact the use of justice. so, we'll focus on the filing ahead in the chances that a judge will agree with any or all of it given how early in the process it is. as well so examine how the various a surgeons are in fact in the filing, actually stand up to the facts themselves. also tonight, cnn exclusive that the justice department is issued a new subpoena for more january six related documents. katie collins starts us. off what is the president seeking and with this? >> one, is a third party attorney which is known better as a special master. it can go through these documents if they're appointed. see what has regal privilege, what doesn't. it takes up time though. it's a little unusual that they waited two weeks to file for this. there's a chance for the justice department has already gone through this, the

investigators are already looking at this, how they handle these documents for two weeks. the other thing they want is a pause on what the investigators are doing, i review the documents until a special -- has been. made the third thing is a more detail inventory. list we saw -- where talked about the note about roger stone's clemency that he got. information about the french president, a lot of it nine sets of classified documents, in addition to that they won a more detailed list of what they have. they also would like to essentially, anything they say that was outside the scope of the search warrant to be returned to them. we know for example, they had some of the passports of the

former president. they return those. we don't actually know if they've anything else outside the scope of that. but basically the legal team, if you do have anything else we'd like to to give it back, which is pretty standard. >> what was the timeline with a new election be? as you said this would basically delay the entire thing? >> they know that would work potentially to their advantage. it's not that unusual that they asked for a special master, we've seen that in other situations where there's potentially attorney pry privilege material. what's unusual is they waited two weeks to do so. it has been two weeks since the search was carried out in this is their first actual court filing. >> why did they wait so long? is it? clear >> it's a sign that there's disapprove it behind the scenes of what the legal strategy should be. what it should look like. they haven't coalesced under a single strategy much pursue this, let's do this. there's some debate over the special master an extra filing of this motion. some critics saying that you should've done this two weeks ago, people that are allies of

the president say that you did it too late. i think it's a sign of the trouble the, disagreement they've been having overwatch avenue to pursue. >> we are learning more about this message from the former president to merrick garland? >> this is the most fascinating part of the filing. we knew the special master thing was likely coming based on our reporting, they have confirmed for the first time that trump did try to get a message to biden's attorney general, merrick garland. he tried to do it through his uttering and jay brat, the lead justice department official on this. it says in the filing, basically the returnee relayed the message who is at mar-a-lago, and june and he said that trump's been hearing from people one word to describe the reaction to the right is anger. and trump instructed his counsel to say, the heat is building up, the pressure is building up whatever you can do to take it down to bring the pressure down, just let us know. it's very unusual to have a former president, who we know is under investigation for how we have handled the information, to send the message to merrick garland, it's not unusual for trump i guess because remember of course, nancy pelosi was pursuing the impeachment charges against them. he tried to reach out to.

her it's notable that they confirmed that in this filing that they did try to relay a message to the attorney general who signed off on the search warrant. >> stay with us, caitlin, i want to bring our political analyst maggie haberman, cnn contributor and john dean former federal judge, nancy - harvard law school. judge, let's start with you. how unusual requests for a special master two weeks into, after new that like this? >> it would be very unusual to do it two weeks after. as it was said, the government's been going through these documents. it's usually done in a situation where the search of a law form, where the documents are presumptively privilege. because they've been in a law firm and we say you don't want the government to be going through attorney-client privilege documents. this is the reverse and away. if the coverage is right, these are presumptively presidential records, not privileged and so the notion that you need a special master to win your way through what is presumptively belongs to the american people. is a little odd. >> what's, what sorts of things with a special master be likely

to throw out, or prevent the government from looking at, judge? >> well, any kind of attorney private privilege. there's no indication and they haven't mentioned that there is a privilege document there. the president does have, the former president does have an opportunity to figure out things that are personal. to him, but that's hardly something that you would say the government can see. and the latter that started all of, this the letter from kim jong-un, is hardly personal to that's clatsop glee belongs to the american public. this is a stretch. the question is whether the magistrate drudge would say, this is a special case, we should duke special things in this case to make sure that the eyes are dotted, the teaser crosses, but it would extraordinary her, as i said the presumption is that everything in those boxes

belong to the american people. not to. trump >> maggie, give us a sense of what's the strategy is right now, his lawyers are including this purported back channel message from the former, to merrick garland? >> right, anderson, this court filing a model lawyer but this filing has a lot of public relations comments to. it unless the defense strategy, or anytime a court strategy. and more about trying to sway public opinion, it's notable that he referenced that conversation, that intermediary hat with garland, that is kaitlan said it a classic donald trump move where he starts to have a negotiating with a prosecutor. but there is also an implicit

threat, it seems and what he is saying. which is while people are angry and who know what will happen. for all the reasons that we are said, under, said his arguments not only weak but it's the argument of a privilege that's hard to see where it applies here. i think everything they're doing right now is about basically a time by, which is another classic donald trump strategy. >> maggie, what's the advantage why buy time? >> he doesn't tend to think and long term strategy. he tends to think in minute ten minute. i think his folks were caught vary off-guard by the search warrant, they were very surprised by, there was a lot of discussions going on including the subpoena. they shouldn't have been surprised the government was trying to get these documents back. it was pretty clear from the subpoena. but regardless, they were really surprised they didn't realize that the case was going where was going. and now there's sort of playing catch-up, and donald trump i would note, it's interesting how late this court filing has

come. however, questionable might be about privilege because it is not a lawyer, not a law firm, michael cohen's home and office in hoteliers search a couple years ago, in 20. 18 trump moved very quickly to file our quest for special master. and that was through one of his lawyers. it does suggest they recognize that this is not a clear standing issue. >> caitlin, you're reporting you believe that giving them time helps their cause? >> it doesn't hurt. it does raise questions about why they didn't do it two weeks ago. it's still would've bought them sometime. 11 boxes of documents to go through, is a lot of documents to go through. i think it is assigned a legal strategy maggie was saying there, they struggle to figure out exactly how they were gonna respond to this, and they were really caught off guard by it. we should know the justice department's responding tonight, they say they're aware of this filing by trump, maintaining as they have been, that there was a federal judge signing a

federal court on probable cause being behind this search warrant. they're very critical of it as maggie was saying, it is very pr related. the very critical of the judge doing. that the doj says they will respond. >> john, when you read this is this a substantial legal document or or a lot of public relations? >> i think it's a lot of public relations. in fact, it is so weak that the law they rely on, they don't even side it properly and they're brave, but u.s. versus nixon they claim gives a presumptive privilege to a presidential document. that's nonsense. if they read the case then that citing a court of appeal agreement, and the supreme court immediately marks is away from that and says there is no such privilege presumption. in fact, it's subject to the rule of law which embraces grand jury information of this

nature. it is a pr document, that's all it. is >> judge, have you ever seen a filing like this? as these filings go how does it relate to others you've seen? >> i don't even know where to begin. i've never seen anything like. this first of all, there's a search warrant affidavit, which the fbi agent has sworn to facts, on which the search was based. there are pages and pages in this document. in which they're just saying stuff. not sworn to, they're making statements, that on their face someone needs to swear to. i imagine there was some concern about swearing to any of this. and as john dean was saying, there is no presumption of privilege here, it's really just the opposite. the documents that were in those boxes, that presumably match the scope -- which was then based on probable cause.

and are covered by the presidential records act or classified documents. i mean, this is a pr move. and nothing. more >> maggie, give a sense of what the team, who's around the former president, who was involved in these, how did things gets decided in trump world right now, who are's attorneys, what's the process? >> look, at the end of the day, donald trump is always focused performance's own advisor on everything. and that includes legal issues is obviously not a lawyer. so people can do with that what they. will he likes to find lawyers alike to do what he wants. but he, has understand it which is slow and lying to do everything, he has a handful of lawyers around him in various cases anderson, it's not the only legal fight he's fighting on one is a man name evan --

deadliness cajun to -- declassify them. it's up to the government to have the burden of truth or trying to deprive a man of his liberty to show that no such order was in fact given. >> does any of that makes sense to you, do you see any kind of coherent legal strategy and all this? >> it's a public relations strategy. again, it's not a legal strategy. it's questionable if he did anything that would declassify the documents that are relevant. >> there would be a paper trail? >> there would be a paper trail. and the documents would've been marked as declassified and the rest of worldwide been told they're declassified because they're not isolated documents, that typically multiple copies, they knew they were missing because they were so logged everywhere and the lure abounds are known so this, when mr. patel is doing is getting himself a front row seat to the grand jury. we'll be testifying very soon under oath and we'll hear what his story later. >> i want to bring in one more person in the conversation. cnn's chief political commentator david axle road. david, what can the former

president potentially gain or lose by requesting a special master and prolonging the process? >> well, as has been said by others squeezed into these boxes, i do think it's a lot about politics and public relations. i think it implies that there is something untoward about the materials that were taken, that they may be being used in ways that are inappropriate. i don't want to use the word spying, but that's with the word conspiracy theorists think, that the fbi went in and seized the presidents documents. as the judge pointed out, these are not his documents. those documents belong to the american people.

i remember how rigorous the presidential records process was when i was in the white house. the hole is absurd. by the way, patel in that same interview was asked about the process of the class, since the president just said it, and then there's declassification, to? he says one, a witness. and the whole thing was absurd. i think the advantage was political in his mind. >> david, result so this and we see people or ask, do you consider yourself to be more of a supporter of donald trump or the republican party. the former presidents numbers have actually gone up since may from 31% to 41%, where's general support from the republican party has gone down. do you think these investigations are helping the former president? >> well, they may be helping him within the republican party. i think it's riled them up. it's not helping him over overall. his numbers are not improving overall. 57% of the american people in

in ukraine and the country is under heavy sanctions, it has become increasingly important to display patriotism. at this event, the organizers have brought together hundreds of people to create a giant russian flag. flags in public spaces and on moscow's streets. at this massive nighttime convoy, many of the drivers flashed the z symbol of the russian invasion forces fighting in ukraine. our commander in chief and the army are doing everything right, this man says, as the pro putin convoy circles moscow in a display of power, trying to show that russia will not be deterred from its current course. fred pleitgen, cnn moscow.

>> fred, has there been any signal from the kremlin about what could come next after this attack? >> it's very clear that all this is extremely important to the kremlin. in fact, an hour and a half ago we got an email from the kremlin press service that darya dugina have been awarded the order of courage from the russian federation, and we also heard vladimir putin in that condolence telegram that he sent. but it's also the case and very clear that there are a lot of prominent people in russia who, as brutal as things are in ukraine right now, want russia to hit ukraine even harder than it already is, and taking more ukrainian territory. one of those people is actually aleksandr dugin who has been advocating that for a very long time, but those voices have now become even louder. you hear that from the top echelons of russian kremlin control media, for instance, where there have been people who have been called and 4 strikes on kyiv in response to this, and also hitting kyiv's decision-making centers, as they say. whether or not the russians have the capacity to do that is of course a whole other thing, but there certainly are a lot of prominent people here in moscow right now, calling for an escalation in what is going on in ukraine, anderson? >> fred pleitgen, i appreciate it. let's go back to sam kiley. he's in ukraine, and also cnn intelligence and --

bob baer. sam, you heard friends reporting. what is ukraine seeing in response? >> well the ukrainians are rejecting out of hand any suggestion that they would go after that civilian targets anywhere, they would say. that said, let alone inside russian territory, rejecting absolutely both from the military and the president, obviously the presidency, all saying that they are not responsible, and we heard that from fred, suggestions that this may have been part from the ukrainian few, the counter argument that is part of a squabble potentially in russia, again that's probably as much propaganda chaff similar to the stuff that's coming out of the kremlin so frequently, but as far as the ukrainians are saying, officially, and privately, this is not the ukrainian operation, but that does not answer a question as to who done, anderson? >> what's stands out to you about the method that was used in this killing?

>> anderson, it looks professional to me. it was done on a road, no cars nearby. it was undoubtedly remote controlled. it takes skill. it took some casing of the parking lot, to following the car. someone had to watch. it was very well organized. if it had been a car bomb alongside the road, it could have been kitchens or anybody, but clearly, to my view, and this is speculations again, it was a professional job. >> and, does ukraine have the capabilities, bob, to operate in near moscow? >> we haven't seen it so far. not to this sophistication. there could have been some small attacks that would have been echoed, but i don't think they would. another thing is why would they pick this target?

the ukrainians have a lot of military and intelligence targets in moscow, which are vulnerable, which they could have gone after, and they didn't. so, this is so mysterious, this attack. and she was not particularly a valuable target politically, nor was even the father, because there were a lot of russians that were urging the invasion of ukraine for years and decades. so why her? is it mafia related? it's always possible. >> sam, is there a concern in ukraine that putin will, i don't know if he needs a pretext, but use this car bomb attack as a pretext for it general novelization and escalation of the war? >> it's very hard to read who's telling who to say what. because as fred was reporting there, there are a lot of high-level people calling particularly in the media for and even more violent response, that very difficult to see how

the russians could get more violent, and less as you suggest, they go for the general mobilization, but the general mobilization would be an indication that the russians are even further on the back foot than they already would appear to be. there was a danger that this war faces. the 6 month anniversary in a couple of days, or day and a half. it all looks like a stalemate, but at the same time, there are profound fears because of the anniversary of the war tha t there could be some kind of spectacular attacks or big gestures, big military gesture is already in the planning. this would certainly add to the energy behind that. it wouldn't appear to be some

kind of ultra violent response to this killing, we'd be seeing in russia as a positive and patriotic move. whether the russians actually have that capability though, remains an open question, anderson? >> bob, a little over a day russian security services announced they had solved the bomb attack. they killed dugina, they had a name for the alleged attacker. a video. and she supposedly took when she left russia. does the speed of that same thing to? >> it's absolutely impossible to piece back together and like this in 24 to 48 hours. it's impossible. putting cctv camera together, the pieces of the bomb, to figure out how is exploded. it's impossible to come to a conclusion. the fact that they claim that this woman lived in the same apartment makes no sense at all. the fact that she was traveling with a child -- it just makes no sense at all. when the fsb, russian intelligence is never released the forensics of an attack like this. would i'd like to say, anderson,

is when a bomb goes off in a suburb like this in moscow, high-end suburb. putin in some sort of trouble. i don't think we're gonna know what kind until it actually happens. >> sam, ukraine's president said today that russia is gonna be planning something nasty, something particular cruel ahead of independence day. which as we point out, is on wednesday. has there been any indication what he or they are anticipating? >> well, it's very interesting there's been an anticipation of quite widespread celebration on independence day, very important day for this young country in terms of its independence from russia. which of course ultimately, has provoked the view of the russians, this russian invasion. but even though they have for example, line the main streets here in kyiv, with destroyed russian vehicles ahead of the event celebrations. there is now a country wide ban on all celebrations, and in some cities even in overnight curfew to keep people off the streets because of this fear that they could be target. they step well back from any kind of massive public celebration for fear that would attract military attention. >> sam kiley, bob baer, thank you. two deputies are suspended when officer only vector incredibly disturbing video captured two of them punching, needing a subject during an arrest on sunday. we'll show you more and have the latest, next.

three arkansas police officers are under investigation after a bystander video showed two of them repeatedly beating a man outside a store during an arrest. we're learning more today about the suspect they were arresting, cnn national correspondent natalie romero has the latest. >> this is bad, we gotta get out of here. -- after this disturbing video was posted online, showing them beating a man at a convenience store. arkansas state police have now opened an investigation into use of force by all three polasek for's and the fbi is also investigating. the crawford county sheriffs officers identified them as zach keane, deputy levi white, and mulberry officer phil riddell.

cnn's reached out to all three, so far hasn't heard back. >> they will be punished they'll fan to be in violation of anything, light -- anything like. that the incident happened sunday in mulberry, arkansas, 140 miles west of little rock. on the video, you can see at least two officers punching and hitting the man and seeing him repeatedly as they try to arrest him. that's when a bystander off camera yells at the officers. >> [inaudible] >> arkansas governor says that the officer responds was inconsistent with the training they received. >> that is reprehensible conduct and which a suspect is beaten in that fashion. we saw a glimpse of that, it's under investigation.

>> police say the man videos 27 -year-old randall ward chester of south carolina. an attorney representing them says that war chester was allegedly -- nearby town. no crawford county says the officers located when he was cooperative at first, then got violent try to attack the officers. >> we've all seen the video, i don't think the believe the assessment amount of for -- justified if my client didn't fact spit on somebody. i think it was above and beyond what the officers were trained to do, what they should've done in that situation. >> police say war chester refused medical treatment, he was taken to the hospital as a precaution. he's facing charges, assault,

battery, and resisting are. that war chester is out of jail on 15,000 -- there are multiple of rage into the face, he did complain of pain to his head, he was only able to sleep on one side, because then eisen injuries to the other side. >> natalie and joins me from arkansas. what more are you learning from the attorneys representing this man, this other video justify what happened? >> anderson, the sheriff says that the officers involved weren't wearing body cameras but there is dash cam video from at least one of the patrol cars and it hasn't been released to the public but it's part of this ongoing fbi investigation i did speak with the attorneys representing the suspect in a turns out -- that she made an excessive come four -- against one of those now suspended deputies. she says deputy levi white, use excessive force against one of her other clients back in an incident in july, she believes there's a pattern there. anderson, i asked the sheriff on was the last time your deputy had use of force training he says that he didn't really know about these are that likely back when they were in the academy and for some of those deputies, that would have been several years ago. >> nadeau romero, we appreciate. it coming up, a dark conservative group that was unheard of has now become one of the most well funded in the country. next cnn's drew griffin gives us the idea -- the man that runs up his name is leonard leo, but whose influential reinstein --
