yes, see you at 11. ♪ 1111 masters blvd. please. that'll be 11 even, buddy. really? the clues are all around us... some things are too obvious to be a coincidence. ♪ we leave you tonight with something heavenly and majestic and hopefully a break from the earth and cares if only for a minute. new images of the planet jupiter. they come to us from nasa's space wept telescope. they were taken with an infrared camera, but the level of detail is extraordinary. at the top and bottom of jupiter you could see stunning images of the planet and the southern auroras with that famous great read -- essentially a giant storm. it's white here from the sunlight that it's reflecting. the 2nd image is this wide field -- check that out. you could see faint outlines of jupiter's rings, and 2 of its moves. one is very bright on the left of your screen, and the other a

little fainter to the right where the rings are. nasa says the fuzzy spots and the lower background are likely other entire galaxies. that's it for us here on earth. the news continues. let's hand it to laura coates on cnn tonight. a new grandeur subpoena to the national archives for more documents as part of the january six investigation. now, let's pause, they're okay. let's give you some perspective. because that's also part of what we do here. because this former president has managed to launch not one but two justice department investigations. that involves the national archives. won into january six, the one with the subpoena today. the latest time the doj is broadening its investigation to the potential world, but then

white house staff may have played in the lead up to the attack on the capital. and, another investigation into the removal of classified documents to the former presidents private beach and golf club. and, yes there is news on that tonight. two sources are telling the new york times that investigators are seeking additional surveillance footage from mar-a-lago as we investigate how classified documents were handled by the former president and his staff. now some footage reportedly showing people moving boxes in and out. and in some cases, appearing to change big container for some documents were held in. more on that in just a moment. so standby for that. then, as the trump legal team is asking for a third party attorney to go through mar-a-lago evidence and determine if there are private documents that should be returned. but that's not all, they also want the judge to pause the investigation until the special master's review is done.

and for those of you who have been around for a long time, we did not just fall off the turn of the truck. that's right out of the trump playbook. delay, delay, delay. final lawsuit, devotions and you know that's how it goes. it has been two weeks since the search ended and they're only calling for a special master now? why? the former presidents legal team also confirming that he tried to pass the message to the attorney general few days later. morning people across the country, who are not angry about the surge or were angry about the search and going on to say, quote, whatever i can do to take the heat down to bring down the pressure, just let us know. which, you know let's face it he could've done all of that on his own. without sending a message to merrick garland. that as we're just days away from the deadline to explain everything in the search warrant. they say it needs to be kept

packed the boxes. the brouhaha from trump allies shows you with the judge and doj are in right now. -- the calls for more. let's bring in all the former fbi deputy director andrew mccabe, and former watergate prosecutor nick akerman. thank you so much. doug he didn't see any evidence that he was asked for the documents? andrew, i mean in january 2020, two after they got a narrow retreat of 15 boxes and february of 2022 february 18th of 2022. may of 2022, may of 2012, june of 2012, all of these about documents, him being asked, the lawyer saying there was no more documents. he didn't see any evidence? that was odd. anyway, good evening. >> good evening.

>> andrew, am i off on that? i >> know, john, you're absolutely right. i don't know with crenshaw is or is not looking at, but there is a mountain of evidence of repeated requests for the documents here. it started, as you mention, with the national archives. they spent seven months requesting the documents back, and eventually they got back about a third, apparently, of what was there in january. and then the justice department enters the scene. they convene a grand jury. subpoenas are issued, so i would count that is requests for documents as well. there is of course the june meeting where the head of counter-intelligence section of the department of justice goes to mar-a-lago with agents. they see documents. they take some documents with them that day. they followed up with letters and an additional subpoena for surveillance video. lots and lots of requests. i would add, don, that at any point in this process, prior to the search warrant, had the folks at mar-a-lago simply given back everything they had, it is my strong suspicion that the government would have collected their documents and gone away, and the whole thing would have essentially gone

away. but it seems to be the indications that there was resistance and possibly folks were not playing straight with them from mar-a-lago in terms of the request that would have -- to pursue the search warrant. >> odd. meaning that someone would say that. nick, the new york times is reporting that investigators are seeking additional surveillance footage from mar-a-lago, including the weeks leading up to the august 8th search. what does it mean that authorities are still scrutinizing how these documents were handled? >> i think it's all part of this espionage investigation. they want to know who had access to, who actually saw these documents? why were documents being taken in and out of this room? was it coinciding with requests that were made by the

department of justice? i'm sure that all of these documents are also being fingerprinted right now. the department of justice wants to know who handled these documents. it's all part of the bigger investigation in terms of what happened and who had access to these documents. >> there are many -- i shouldn't say others. there's been lots of speculation, and legal analysts say they believe it, it's but do you think that more people could have some sort of exposure for possible aiding and abetting, or helping of this potential crime? nick? >> absolutely, because there were so many people involved there. there were people who brought the documents there. people who had to know they were there. there were certainly people that basically snatched on trump. i'm sure some of these people aren't listed in that affidavit describing what documents were there and what they did to try and keep doj away from these documents. >> andrew mccabe, the times also reports how mar-a-lago had surveillance footage going back

60 days for some areas of the property, and some footage shows that people were moving boxes in and out and in some cases appeared to change containers the documents were holden. when you hear how these government documents were being handled, how does that sound to you? >> it sounds like there was more activity around the documents and people with access to the documents, and people moving documents, and what was possibly represented to the department of justice about that june meeting. and that likely caused great concern on the part of the investigators. you have to remember, don, this is essentially like any other investigation in which you would access video surveillance. so let's say you had somebody who attacked someone on the street in new york, and it happened right in front of a story that had video surveillance on the sidewalk. you of course would see the action happen. but you would then do is look at the video surveillance on

either side of the store and up the block in each direction and around the corner to find out where did that attacker come from and was he with someone else? did he have anything else in his hand? it's the same thing here. if they have video surveillance from outside the room where the documents were being stored, and you have activity coming in and out of that room that you're concerned about, you might want to see where those people who were captured on that surveillance camera went after they left that area. that is my suspicion of what they may be looking for here. >> i want to ask you about this other new thing, nick, about donald trump's legal team asking for federal judge to appoint a special master to go through the mar-a-lago evidence. they also want the judge to pause investigators work related to the evidence until the review is done. is there a merit to this? >> no. there's no merit to any of

this. i mean, if you compare this to what happened with trump's two former attorneys, michael cohen and rudy giuliani, both of those situations, search warrants were searched on both of those people. lots of documents, lots of data was taken. and there were both lawyers who had a real privilege. i mean they had arguments of privilege over these documents. so it made sense in those cases to appoint a special master. here, trump has no privilege. even though his document that he piled today claims they're trying to protect executive privilege, protecting conversations between trump and people who worked with him. and none of that makes any sense. he has already been there. he's done it, and he's washed in front of the supreme court 8 to 1 on that issue. there is no executive privilege that belongs to him. head belongs to the executive, the current executive, and this entire brief, i mean, quite frankly it looks like it was written by negligence or insurance lawyer, because they just don't understand the privilege issues here. if trump really had an issue with attorney-client privilege, if he was concerned that something in there was a

palmieri. cnn's political commentator, all the suffers and alice stewart. hello. good to see all of. you let, see i'll start with you tara. trump initialize would love to convince the american people that this is a political hit job. they're following these two documents in court now. two weeks after that search, this is what you heard that nick akerman said it's not a thing. do you think this is all about the court of public opinion? >> i think, so i think that they want to sell seeds of doubt and what the department of justice is doing. they want to fight back. this is trump's tactic. delay, attack the messenger, trying to suggest that there is some sort of bias, it's a political witch hunt. all these tactics just to delay the inevitable, but a lot of people are saying that with the right legal minds this is probably not going to holdup. i did think that it was interesting that ron desantis who may end up being a political rival of trump in the

2024 presidential matchup said on fox news, to stop calling it a rate. it was a perfectly legal seizure. and i think what we are seeing is the gop, as we get more information about how many documents they were looking for, over 300 as the new york times reported, how many months they went through trying to get these documents in the long process and that this actually may have been a legitimate investigation. >> that's why i was so plummets when i heard, gosh what was his, name who was gone, anyway who said that they were complying, especially they were seeing no evidence that they had asked for crenshaw. and then they just started in january 2020. two and all of this, this list that i have here -- >> right, they're all the interactions. what are they talking about? >> i exactly right, in terms of him using this as a tactic to flood the zone, dominate the narrative and also he is already fundraising off of this request here.

and he has masterfully, i guess that is a word for it, been able to dictate the narrative. because he was out, they're right out of the gates. he was portraying himself as a victim. but here's the key. the truth will come out in the end. and that will be the day that -- here it, is one of the things that his attorney said is that we are talking to the people and the mood of the people in this country is angry. well i talked to several republican congress, members and the general notion was, look, if you want to talk about the mood of the country a third of the people are mad, a third of the people are sad and a third of the people are glad but 100% of the people want more information. and we just need to sit back and wait. >> that's the key, what was so bizarre about all of this and it speaks to donald trump staying power within the gop, unfortunately, is how many elected republicans came out immediately once this rate took place. and they, said it is unlawful. we need to defund the expedia.

they were criticizing without the. facts and by the, way we still don't have the facts. the gang is requesting to see what the classified documents actually were. but when donald trump does masterfully, as he wins the pr game. here we, are we are not even talking about what might be in these documents. but we're lowering the bar to say maybe they're not classified. maybe they're not new color secrets. when the government official said we walk out of a government official with the top secret documents, they wind up in person. >> we are playing on this tariff. >> that was my point, when i got from vacation, people were saying that it's gotta be something really. bad it's gotta be something like this. the fact of the matter is it was a classified document. and it was taken from the white house. it should've gone to the national archives. the rules were broken whether it is, i doubt that trump did not pack it himself. but he is still responsible. the buck stops with. him every other president before him right had gone and follow the rules. they want to the national archives if they wanted

something. someone went through to make sure, right? they make sure was okay. >> just very quickly, i think that on the classified issues, a lot of time, the average person is not trained in handling state secrets and national security secrets. looking at a document, they might not understand why it's sensitive. it may not seem like something significant. but it could be the sources, methods behind it. it could be that it signals intelligence, and that's it shows that marking, we are going to nowhere listening to this adversary. there's a lot of very specific things about why we can't allow these things to be in the public space, and they cannot just be sitting. >> a lot of it is identifying people that are supposed to be confidential in the work that they do. and here is one of the things -- >> we'll get to this before, but go on. >> i unclassified all these documents as they left the white house before they came to me. well, our colleague has talked to nearly 20 people with knowledge of whether or not that happened. and they said that did not happen. >> they also said that, i spoke

to a professor who was an expert in all of this and they said that that is not a. think that is not how you declassified documents. i think that this is the most important news to come out. because usually we always say it's the economy, you've heard that right? everybody is worried about pocketbook issue. this is a new nbc poll, that they find a threat to democracy is the most important issue for the motors even above cost of living. it is just one poll. but do you think that pouring cold water on this idea that people who don't care about what happened on january 6th, they don't care about the efforts to undermine our democracy, it really shows that people have this is a huge concern. >> i think actually the january six committee have really elevated the story about defending democracy. and maybe it wasn't top-of-the-line, but after seeing those hearings, after hearing the story of people and how there were real attempts to try to take over the government or not or hand over the power,

i think it sort of made people think for a second, while this was just a few angry tweets this was accorded needed effort and i think if all of that it means that the january six hearings are working. yeah, the breaking. two and you can't avoid the threats to democracy your day-to-day life. i think it is breaking through. i still think kitchen table issues are going to be more significant then this poll shows. at the end of the day, 60% of republicans believe the election was stolen. every american going around having a conversation with differences having conversations about, was the election legitimate? that's not something that is. normal >> i just want to respond to. the trump's allies -- as you know, right. they investigate the investigators. that same poll finds that 57% of voters say investigations into trump should continue. and a country this polarized, that is a surprisingly clear cut number. >> we will be number skincare. elected 57 and you look at the cross tabs. the breakdown of that. look, we've all known this has been a rorschach test, republicans who support him are

fully in sync with him on thinking and think that this is wrong. democrats think that this is the right way to go. of a 57%, if you look at the party ideology. nearly 90% of democrats say this investigation should continue, about 20% of republicans. but the key moving forward to 2024. 61% of independents support this moving forward. that is a number that should be extremely disturbing. because those are people that are wanted to see where this is going to go. and many of them want to see this continue. >> this is tough i want to talk to. but something i heard over the weekend. someone who's watching our conversation last week. where there he's going to run or not. that and more. everyone stick around. about the midterms. we want to tell you what he says. and then i want to hear from all of you right after this. we'll be right back.

alyssa and alice. alice, last week, mitch mcconnell was talking about candidate quality, and there's polling that shows that masters, walker, oz and johnson are all in the red hot unfavourably. it's up in the air now. it should be a good year for republicans. what happens? >> donald trump happened. and all of those people you just showed were backed by donald trump, supported on all trump, election deniers, and that is not sitting well -- >> -- >> he is -- like it or not he is the titular head of the republican party. he's the one that can galvanize voters for the base in a primary. he can raise money for a primary. the problem is, that doesn't always translate well in a general election. i wish that would have been thought about more on the front and, the what's harming these people that he put up backed by trump, many of them are election deniers. we have herschel walker, had some personal issues. we have odds with some

residency issues. so these are things that they're going to have to answer to, and again, i go back to when you are the party and you are looking at who's the best candidate, it can't just get through the primary line. it has to get through -- >> you said this. we were ablate covering -- waiting for the returns to come in. who said the same thing. this is about qualified candidates and many, if they want to hold the senate, even the congress, many of these candidates are just not qualified. they're not good candidates. >> this is why we saw the democrats contributing money to some of these candidates, because they knew they were the weaker candidates, and they wanted them to be the nominee for the gop, because they knew that they would be easier to beat in a polling that reflects the. >> on his social media platform, alyssa, trump is calling mitch mcconnell a broken down act for his -- for trump's endorsed senate candidates. they have gone through this before. they've gone back and forth. but what happens of these

candidates lose? >> listen, mcconnell is absolutely right. the candidates do matter and these are not a strong roster of candidates. all of we mentioned with the exception of ron johnson our first-time officeholders running statewide, and j. d. vance in a very red ohio is doing significantly worse than he should be to tim ryan, a popular moderate democrat. listen, you can't, alice, to her point, nominate to how much they appeal to the base, you have to think about how they're going to fare in a general election. mark my words, and it's already beginning, most of these candidates who have previously criticize mitch mcconnell -- now want the senate leadership fund -- the political arm to come in and bail them out. my car little's gonna come out fine. there will be no ditching mitch. this is just going to be kind of like the language of trump attacking him and it will take credit when they win when it's reality it's mcconnell's playbook. >> would if they don't win? >> that's another question. could he escape blame for not

regaining the chamber? >> that's a good question. who will they blame? will they blame donald trump who basically chose these primary candidates who all vowed that they would not vote for mitch mcconnell for leadership, or are they going to blame the national republicans editorial committee for not doing the candidate recruitment. these people were all first-timers. they were untested, unvetted, backed by trump, and mcconnell couldn't say anything, because in fact, if you are hated by mcconnell, that helps you in the gop primary, and they all came out and said we don't care about mitch mcconnell. we are not going to vote for him. we'll see what happens when they actually get the senate and they would have to answer to the constituents. >> and trump lost georgia republicans -- in the senate didn't get the blame for that. he managed to blame everybody else. he tends to be tough on them. >> tara, let me ask you, there's an nbc poll finding that democrats have closing enthusiasm gap heading to the midterms. that's another problem for republicans in these statewide races. did that change when it came to

roe v. wade? >> absolutely. it's the dobbs decision that i believe has changed that. i think for my experience, talking to republican strategists, i'm sure you noticed as, well we are working on major campaigns right now, some of which are up in the senate races. they don't know how to deal with abortion issues. they just don't. >> it's so much different when you talk about it as the hypothetical. you're pro-life, but roe v. wade -- now this is a completely different ballpark. i've heard the same thing from republicans. >> let me ask you, the manager and all constitutional is reporting that herschel walker said this about the new -- i quote here, he says they continue to try to fool you that they're helping you out that they are not because a lot of money is going to trees. don't we have enough trees around here? >> let me just say this. i'm a georgia bulldog. i love herschel walker. i will give him the benefit of

the doubt. he was specifically referring to the 1. 5 billion dollar urban forestry provision of this act. he reiterated that on twitter. he said yes, i said when i said, 1. 5 billion for trees, and it's coming out of the pockets of taxpayers. that was not his solution to the climate change. >> it honestly was not his biggest gap. >> it's one in a series of, you know. i gotta ask. so, when i'm hearing from sources is that he was not going to run. you can tell me a few things and then mar-a-lago changed all of that. >> -- gonna run so long as the legal walsh kept closing, and i think mar-a-lago was the most significant thing that could have happened to make him just begun ignorant. >> look at the voters. the voters were at the point where they were ready for him not to run.

this video is disturbing. and it led to three arkansas believes officers being removed from duty. all three facing state and federal investigations after at least two of them were caught on camera punching and kneeing a suspect during an arrest this weekend. at one point, the video shows that one of the officers appearing to lift the suspect's head and then slamming it into the pavement. so before we play it, there's a reminder, this video is graphic and it's hard to watch. this is bad. >> we've got to get out of here. hey! >> i'm okay. that video is disturbing to watch, but let's talk about what is the procedure. what's okay. what's not. the officials say the suspect officially threaten a gas station clerk in the neighboring town and he was initially cooperative been any attacked officers. any of that video justified based on the information we have so far in your years as an officer? >> no. the short answer is absolutely not. i mean, i think it's important that we allow the investigation to play out before we start condemning police officers. however, based on the video and then the charges that had been brought, i can't see any way that you could justify those officers actions. >> even with his level of -- i think you're right. the investigation should play out, but it's certainly

disturbing to look at that video. even with his level of, quote, unquote, not complying? i'm not there. i just saw what was on the video. you still don't think that that was justified? >> used force policy varies from department to department. there is no universal standard in the united states, all the way believe there should be. but it's all predicated on the idea that a law enforcement officer can use the minimal amount of force necessary to effect compliance. and that is based off of the suspect or in this case, the defendants actions. however, that's not like a carte blanche check to your blank check to continue to use force each time and all through

uses force. whatever that force may be, whether it's physical, whether it's verbal. they have to reassess and decide whether there is an escalation needed in their force or whether they need to de-escalate the force they's off of the suspect's actions. but what you saw there looked more like a ballroom brawl and it did an officer using very specific, very, correct -- . >> so, the arkansas governor asa hutchinson just broke out on cnn. listen to this, mike. >> it still concerns me that a law enforcement officer with proper training has to be able to control the circumstances, and that was not something that whenever i talked to our training officials, it's not consistent with that. that was, in my judgment, excessive, but let's wait for the investigation to be

completed. >> listen, he is saying something like you're saying. let's wait for the investigation to be completed, but the officers have been removed from duty for now. what consequences should they face for not following their training? >> well, if they did violate departmental protocols, i mean there is a discipline system. i would assume it's in place to address that. and if the state or federal authorities decide that their actions were criminal in nature, that they exceeded the scope of what is appropriate by law enforcement officer, then they should be charged criminally. the one thing that the governor said that i did take issue with and i've talked about before, is when he said that this was outside the scope of normal, based on the training protocols that were put in place. i was a cop for 20 years. i will tell you right now that the training that's provided to

officers when it comes to use of force is grossly inadequate. when i trained, if you want to call it that, i refer to it previously as familiarization. use of force training took place by annually as far as qualifying with -- when it came to tactics, that took place every other year, and we spent about four hours on the type of physical tactics that would be applied and this type of situation, which to me is, i mean is nothing short of grossly inadequate. so, in a lot of ways i feel like we are rush it -- sitting up these officers for failure. >> i think it's a good point. you seem like you are criticizing, but you're actually trying to help the officer so they don't end up in situations like this so that

the people that they serve don't end up in situations like this. >> correct. >> so there is a moment. let's talk more about that video. there is a moment in the video, might, where it seems that one officer points in the direction of the woman who was taking a video. the clip and shortly after. so we don't know just how aggressive they are in the moments afterward. there were clearly witnesses there, though, when calling to get the men medicine. should that have changed the officer's behavior always appreciate your perspective. >> thanks, don. >> so he says he is not retiring, but he is moving on. what's up with doctor anthony fauci? that's next.

new details coming in tonight about the investigation into the former president's handling of classified documents. sources tell the new york times investigators want more surveillance footage from mar-a-lago.

was a period for going back to 60 days that investigators had reviewed, and they saw some things on there that raise concerns. of course, this is something that would explain, perhaps, why after the june meeting, where they came away with classified documents, they somehow decided that there was more information there, and that they were concerned about. that led to this extraordinary move by the fbi, by the justice department to conduct a search of the former president's home in mar-a-lago. >> peter strzok, the new york times is reporting some surveillance footage from mar-a-lago showing people moving boxes in and out and appearing to change containers some documents were held in. how will investigators get to the bottom of this? >> we've got a lot of work ahead of them. clearly there are a number of things that are really interesting in this new new york times reporting.

when as you indicated, there's some concern that between the first subpoena to get cctv coverage that there was something occurring in later days that made them think that there might be relevant information. the immediate concern i would have is of course, when people taking things in or out were either trying to hide them or move them somewhere else. again, that's in the context of a much broader counter intelligence concern of just who had access. clearly, the former president trump did, but any number of other people, particularly including those linked to foreign intelligence services might also have. that something investigators need to look at. there are a lot of questions as an investigator. this new information makes me think there is a lot more investigation ahead, and all of it is really concerning. >> evan, you broke the story tonight about a new doj subpoena. what is the latest? -- additional d
