go have a listen. the a listen. the news news continues continues. it's time i'm gonna handed over to don lemon tonight. to head it over to don lemon tonight. >> this is don lemon tonight, and now we know. big developments. big developments in the mar-a-lago investigation special master named and the clock is ticking for him to finish his review of potentially privileged documents, his name is raymond dairy. he has a -- i probably don't have to tell you is after the midterms, splitting the difference, the difference between the doj which wanted him to finish up in october and team trump which preferred 90 days. that is a federal judge rejecting the justice department's bid to restart the investigation into the classified documents. which makes all but certain the doj will appeal. we could go all the way to the supreme court, lots more to
10:02 pm
come on the investigation. plus, you are tired, your hollowed massive, it's the wretched refuse of your team inshore. sydney's tempest tossed those words on the statue of liberty are pretty iconic. pretty ironic and their ironic in the face of what critics are calling a cheap political stunt, dropping desperate men, women and children, many with no other option in martha's vineyard in new york, and washington, including outside the official residence of vice president kamala harris. looks like a cynical competition to outdo each other and bus and flight migrants across the country. >> think about the governor of florida. one of the largest states in the nation, spending his time hatching a secret plot to ship up 50 immigrants here, families, here children as young as four and use them as political pawns
10:03 pm
just so he could get on tucker carlson and talk about how he's tough on immigration. he is a coward. >> more to come on all of that so stay tuned. but i want to get right to the news of the special master tonight. joining me melissa griffin, director of strategic communication the trump us, let known, and john avlon. that was a lot. >> congratulations! >> i'm thinking like who did i miss? i missed my writer that i've worked with john mccarthy, fox five in new york in the 90s he's on my team. and i didn't miss a chimney boss, chris late his. i think you so much. >> congrats. >> thank you so much. >> harry this is big news tonight, federal judge giving a special master to --
10:04 pm
that is a major blow to the justice department and to think? >> yeah. it's atrocious i think is not too strong a word. abhorrent, because the justice department said we just want to look at these hundred classified documents. that was what is immediately put forward to her. the only trump thing said in response. classify, who said they're classified except the government? how does something become classify, because the government the official authority marks and classified. she adopted his uncertainty and said well, i really like a third person to look at them to say if they're classified. bizarre and really incoherent, and then the second aspect he said well maybe he has possessor right because maybe he declassify them. but he didn't say that on the facts. she had undisputed facts to go one way. she went the other, and remember she was having to find a heightened standard.
10:05 pm
>> so you think and appeal is coming in this could go all the way to the supreme court? >> yes and yes. an appeal is coming. they're right now huddling to decide what to make in that appeal but i think this task that judge dearie has been given to somehow call balls and strikes on executive privilege, which is never been done before and there's no legal standard. i think you will see them moving for a stay in the 11th circuit on the same basis on those 100 classified documents. >> he referred to judge dearie his senior judge raymond dearie. other ways put forward is a possible candidate by donald trump. how does this all 70? >> i'm most worried about the idea of whether it is a judge, i've actually heard things about judge dearie, but he's gonna be solely determining what is classified. there's been a hard and fast standard, if something has

classified markings on it it is. and i think we're giving credence to this mid frankly that trump is given that he class declassified things, he told norman in the doj or, that doesn't -- that to me is a very risky precedent that has been waded into right now. i can speak for legality, but if something is classified, the same way my party, was when hillary clinton allegedly mishandled classified information, we need to be concerned about the former president who did that. >> as the deadline of november 30th that's after the midterms that was given. that has consequences. politically. >> this is what the doj wanted. the doj one of the special master process to end by october less a higher court steps in. this is gonna move slowly? right >> yes, i think the question is whether the doj does try to get this all thrown
10:07 pm
a, because a justice decision from the beginning is kind of incoherent. asking a special master as respective as this individual is with the background in the fisa court to make a decision. >> why do think it's encounter? >> it's encounter because you're asking somebody to review cops equal documents and nobody should be looking at. but you're asking about the raw politics of this right? so putting it aside doesn't make any sense at all. you are increasing the chance it'll run into a conflict with the former president declaring a new run. that will add all sorts of new political pressures and this it tempt to play the wrap by playing the delay game. this is setting up that
10:08 pm
conflict. not for matters of coherence a national security law, this should be contested. >> you know the legal system it moves slowly. this is not going to happen quickly. >> and by the way, november 30th is really a phantom date, because when he makes any ruling that either party especially trump disagrees with, they bring it to canada, maybe the 11th circuit, and there are, i can't emphasize enough, no legal standards here, because no special master has ever been appointed for executive privilege. >> it is not possible to finish before november 30th? >> not the one she is prescribed. >> and my fear in this is that, of course we're gonna go into the era where trump is a candidate. i expected he's probably gonna declare in the next month or so. probably to fend off this investigation.
10:09 pm
i hope the doj has been buttoned up throughout this investigation, and this was something that was foreseeable, because i've warned about this before, but if there's not a there there, it seems there is, seems very clear, highly classified documents mishandled. i hope the doj is ready for what the trump team is gonna push back with. >> which is? what >> i'm not making any predictions, but i worry because this was the unprecedented step of writing a former presidents home, at his residence and getting into what put a lot of people on edge. who is roundly condemned by republicans and i hope they have a they're there. i think that they do. but this could be a major loss for the doj. >> could be a major loss for the doj based on a pretty incoherent ruling by the trump appointed judge, was appointed after the election. >> you keep saying incoherent. [laughs] >> in co-here event. >> with the enunciation. >> but in all seriousness, i remember a lot of republican and initial defenders for the same for the ex president, saying look it's not like he has nuclear secrets in there. well guess? what >> apparently they were nuclear secrets in. there and apparently wasn't convinced harry, and pushing again investigation with classified documents seized at mar-a-lago that will put national security at risk. >> yeah, he wasn't she wasn't convinced. core she had undisputed evidence to say it was, nothing on the other side. judges are not supposed to capriciously flip coins. they're supposed to weigh evidence, and there was
10:10 pm
literally zero on trump side of things, and a really good affidavit explaining just why there was a problem. >> you think in appeals court will see it as she does? >> my best guess is no. even a conservative appeals court, i think it's too fundamental and too incoherent. >> [laughs] he's backing you up to. listen to alyssa's point, do you think it, does the evidence have to be there, i think their hope to prepare for what trump team is gonna come after them? in order to get it affective affidavit, especially for a former presidents own, do you think it has to be there initially and you think the evidence is there? >> yes and yes. basically what appeals court looks at things, they look as it was filed. i totally take your point, but i'm pretty confident having been there, they have anticipated it. we have seen this along the line, everything they've come up with. for example the argument that

he was gonna make it was declassified. they chose three statutes for the search for the don't require classification. i think they have thought through strategically very carefully. >> anything else for this and coherent conversation? >> the very coherent conversation. but remember that this is only one of the inquiries that is going on right now. takes place against all the backdrop against all the subpoenas sending out to dozens of trump people, trying to overturn the election, trying to raise money over. that's a totally separate and potentially far larger issue. so don't get confused. these two things are not the same thing. that of the process is moving. former >> we'll see if it will make any difference in the election. >> but i may not make a difference. cliff, we are like right there. thank you all. >> thank. you >> republican governors of
