that is a major blow to the justice department and to think? >> yeah. it's atrocious i think is not too strong a word. abhorrent, because the justice department said we just want to look at these hundred classified documents. that was what is immediately put forward to her. the only trump thing said in response. classify, who said they're classified except the government? how does something become classify, because the government the official authority marks and classified. she adopted his uncertainty and said well, i really like a third person to look at them to say if they're classified. bizarre and really incoherent, and then the second aspect he said well maybe he has possessor right because maybe he declassify them. but he didn't say that on the facts. she had undisputed facts to go one way. she went the other, and remember she was having to find a heightened standard.

>> so you think and appeal is coming in this could go all the way to the supreme court? >> yes and yes. an appeal is coming. they're right now huddling to decide what to make in that appeal but i think this task that judge dearie has been given to somehow call balls and strikes on executive privilege, which is never been done before and there's no legal standard. i think you will see them moving for a stay in the 11th circuit on the same basis on those 100 classified documents. >> he referred to judge dearie his senior judge raymond dearie. other ways put forward is a possible candidate by donald trump. how does this all 70? >> i'm most worried about the idea of whether it is a judge, i've actually heard things about judge dearie, but he's gonna be solely determining what is classified. there's been a hard and fast standard, if something has

classified markings on it it is. and i think we're giving credence to this mid frankly that trump is given that he class declassified things, he told norman in the doj or, that doesn't -- that to me is a very risky precedent that has been waded into right now. i can speak for legality, but if something is classified, the same way my party, was when hillary clinton allegedly mishandled classified information, we need to be concerned about the former president who did that. >> as the deadline of november 30th that's after the midterms that was given. that has consequences. politically. >> this is what the doj wanted. the doj one of the special master process to end by october less a higher court steps in. this is gonna move slowly? right >> yes, i think the question is whether the doj does try to get this all thrown

a, because a justice decision from the beginning is kind of incoherent. asking a special master as respective as this individual is with the background in the fisa court to make a decision. >> why do think it's encounter? >> it's encounter because you're asking somebody to review cops equal documents and nobody should be looking at. but you're asking about the raw politics of this right? so putting it aside doesn't make any sense at all. you are increasing the chance it'll run into a conflict with the former president declaring a new run. that will add all sorts of new political pressures and this it tempt to play the wrap by playing the delay game. this is setting up that

conflict. not for matters of coherence a national security law, this should be contested. >> you know the legal system it moves slowly. this is not going to happen quickly. >> and by the way, november 30th is really a phantom date, because when he makes any ruling that either party especially trump disagrees with, they bring it to canada, maybe the 11th circuit, and there are, i can't emphasize enough, no legal standards here, because no special master has ever been appointed for executive privilege. >> it is not possible to finish before november 30th? >> not the one she is prescribed. >> and my fear in this is that, of course we're gonna go into the era where trump is a candidate. i expected he's probably gonna declare in the next month or so. probably to fend off this investigation.

i hope the doj has been buttoned up throughout this investigation, and this was something that was foreseeable, because i've warned about this before, but if there's not a there there, it seems there is, seems very clear, highly classified documents mishandled. i hope the doj is ready for what the trump team is gonna push back with. >> which is? what >> i'm not making any predictions, but i worry because this was the unprecedented step of writing a former presidents home, at his residence and getting into what put a lot of people on edge. who is roundly condemned by republicans and i hope they have a they're there. i think that they do. but this could be a major loss for the doj. >> could be a major loss for the doj based on a pretty incoherent ruling by the trump appointed judge, was appointed after the election. >> you keep saying incoherent. new tonight, a federal judge naming a special master who will oversee and review more than 100 classified documents seized from mar-a-lago in august. the news comes after weeks of legal drama between trump layers and the doj over who should get to review these highly classified documents? joining now to discuss is cnn political correspondent sara murray, legal analyst and former u.s. assistant attorney, jennifer rogers, cnn counterterrorism analyst phil mudd and cnn's national security analysts -- good evening, everyone. sarah, bad news with the doj tonight that judge rejected their request to continue the criminal probe into classified documents while the review plays out. what more do you know? >> that is right. the judge basically said, one, i would not take the government

on face value that these governments are classified. she wants a special master to review them, and to, she does not think it will cause irreparable harm for the justice department to press pause on their ability to review the documents. she says you can still go forward in parts of your mastication. if you want to talk to witnesses about other documents removed or stored, you can do things like that, but when it comes to actually viewing the documents, you will be presenting them before a grand jury, which is the unhelpful thing to do when you're in the middle of a criminal investigation. you can't do something like that. she does say do that they can start brief congress, so we are waiting to see if that actually comes to fruition. she did put a timeline on all this, saying they have until this november 30th to complete the work. >> sarah, the judge appointing to shirk judge raymond theory especially master, what can you tell us about him? >> that is right. he is a senior judge in the eastern district of brooklyn. if you are a senior judge, you have more time on your counter, which is good becaus
