good good evening, three big evening, three big stories stories tonight tonight, nuclear saber rattling in, there's more saber-rattling a military escalation from from vladimir vladimir putin. putin, as a quarter billion dollar well as civil lawsuit a 12 million dollar civil against former president, lawsuit against the three of his grandchildren and ex president, three of his his company, grown children, and just before and his airtime, a major court victory in the company. -- justice department criminal probe of criminal probe of classified documents classified documents from mar-a-lago. from mar-a-lago. that is where we begin, that's where we with cnn's jessica begin with cnn's schneider. jessica schneider. this this just just happened, what more can happened, what more can you tell you tell us us from this by ruling by the 11th circuit -- court of appeals? >> >> this is this is anderson exactly what the, what exactly that been fighting justice department has been fighting, for four weeks for four weeks. . they tried to get they tried to get this this result in the district court result in the district court -- now they've had a victory at the 11th circuit this is from a unanimous panel of judges, two of them trump appointees, --

that they've been restricted from using, in their ongoing criminal probe into these classified documents, that were seized from mar-a-lago last month. the appeals court is saying here, they are really agreeing with the justice department, saying that yes, in fact, national security could be harmed if the justice department can't continue its probe here. they set the doj has argued that the criminal investigation, and then national security investment is inextricably linked. the appeals court saying, yes, in fact, if we don't let the doj continue to use these classified documents, there will be real and significant harm on the united states and the public. notably, in this opinion as well, anderson, the 11th circuit is really faulting trump's lawyers, for not better explaining what seems to be their argument, the trump may

be declassified -- [inaudible] his lawyers, his allies, but they've not offered any proof in court filings or in-person. so the 11 circuit tonight criticizing trump's team, for not being forthcoming here. >> what does this mean for the special master? >> interesting, lee this 11th circuit opinion also touches on that. remember, the next thing the doj was asking for here, was to allow the special master to look at these 100 classified documents. they wanted it kept out of view, for the special master and trump's legal team. they got that last night with the 11th circuit opinion. what this means is that the special master can continue his review, because remember there are 11,000 documents in all that he has to review, before november 30th. however, he is now restricted from looking at those 100 classified documents. so that is like a second win for the doj this point in the

night. >> can the ruling be appealed? >> it could be, we heard from the justice department in that hearing before the special master yesterday, that they would appeal it if they lost. presumably, the same goes now that trump's team has lost this. they could potentially appeal, -- so for now, doj has a win here, they can resume using those classified documents. they'll be kept out of the u.s. special master in trump's legal team. trump's team can move to appeal, this but doj is free to go about the investigation. -- >> there has been some concern among the doj, and i guess elsewhere. it was considered more conservative, or conservative court. what is the makeup of that court? >> yes, so that was a gamble here, because when doj was deciding whether or not to go to the 11th circuit, six of the

11 judges on the 11th circuit are trump appointees, but it turns out in this case it didn't matter, because a three judge panel that ruled in favor of doj tonight, two of them were appointed by trump, one of them appointed by president obama. so they took a gamble here by going to the 11th circuit. remember, they tried it first of the district court, trying to get that initial judge to overturn part of her original opinion, she wouldn't do, it so they had to go to the 11th circuit, and they appealed in a very limited way, only asking for two things. tonight, that gamble paid off, because they have a victory the 11th circuit tonight, anderson. >> jessica schneider, appreciate, it -- cnn political analyst, maggie eight haberman, she's also the off or of the new book out october 4th, titled confident man, the making of donald trump in the breaking of america. political commentator david urban, who served as a campaign strategies for the president. paul, obviously, this is a big win for the department of justice, does it surprise you, what happens next now that they

can continue using these classified documents? >> it really doesn't surprise, me because this ruling by judge cannon that the doj couldn't invest in what was going on with these classified documents, it is really kind of shocking. sources and methods, spies that we have in other countries, who knows who were affected by these records. to say the doj couldn't look at, them was really a surprising ruling. i think the appellate court decided that this was the right way to go with it, and they left the rest pretty much alone. >> the three judge panel, and the 11th, circuit lambasted the prior judge, judge, cannon is that the district court abusers discretion in exercising equitable jurisdiction here. explain what that means, and how unusual it is never rebuke like that? >> it's very unusual to get a rebuke like that. the reference to equity has to do with what is called injunctive relief. when it judges ruling not that one side has one damages, or the summit has to go to jail,

but that you have to do something affirmatively. in this case, the affirmative thing was not look at classified documents, when the u.s. government has every right to look at its own classified documents. trump drive no right to do, that just because you took them to mar-a-lago, and of courses attorneys never even positive that he had declassify those documents. i think the appellate court was really destroyed by an egregious overreach by the district judge here, and sort of slap back the decision and said no, the doj can have the records. >> maggie, this former president receives a string of favorable decisions from that judge, do you expect he's gonna try to appeal this to the supreme court? i mean, there's also questions i guess about his legal representation, because it's been criticized widely, even by other justices. >> we don't know yet, anderson, what that response is gonna, be but it's certainly the former president strategy most of these litigations is to try to drag it out. i anticipate there's a strong

possibility that they will try to appeal to a higher court, and see how far this goes. you know, this hasn't been a great legal week for them, i know there's some people around the former president yesterday were insisting that the special master hearing yesterday was not that bad, and at the special master did not sound that skeptical, he did some very skeptical. what it means in terms of what he's gonna do remains to be seen. but this decision by the circuit, which is filled with a lot of trump appointees, i think it's just another setback. however, i will just stress, trump's desire is always to drag these things out, and dragging it out is not necessarily something is gonna be upset about. >> david, the 11th circuit also wrote that the former president suggested he declassify these documents but directly stated that witness didn't provide any evidence that we had this disclose these documents. what do you think about the fact that the former

president's legal team continues to not provide any evidence of the claim. >> anderson, it's what is exactly what it looks like prime if asia, given the opportunity, if your lawyers can produce, and then it didn't happen, most likely. i believe the judge said, you can't have your cake and needed to in this situation. you can't claimants declassified, and not produce evidence because vacation. you can't just mid wave a magic wand and produce the receipts, to show that it was actually put in motion, and the classified authority would declassify, they're the actual documents evidence in that. >> do you think the supreme court would take the case, if the former president fielded to them? >> i don't think they will, but you have a former president of the united states here, it's not an ordinary case, they could. there's also another option we haven't discussed tonight. they can ask for an on bank hearing. remember, only three judges made this decision. you normally have the right to ask the entire 11 circuit here the issue, and then you can go

to the supreme court or you can go directly to the supreme court. i think maggie is right that trump delays, delays, delays, antitrust over litigate everything, so he might ask for the full on bank hearing, because that will delay things even more. >> it's not the only bad legal news the president called today. what impact, if any, -- or do you think would have any decision on whether or not he would run again. >> you mean the condition in new york? yeah, i mean look. i think you can look at this in two different ways. number one, a lot of people have talked to the former president, and don't think that his court seems to be in politics and running the campaign in the way it once was. that being, said if he doesn't run he loses a lot of attention, he loses the ability to fund-raise, and he loses potentially, if he were to run, the protections that the office before the sitting president, in terms of an investigation.

all of that is something he's aware of. i think that the people i've spoken, too close to him, we are very relieved as they have been over and over, that there is no criminal charge related here. there is a criminal referral discussed, but this is a civil action. i'll think you'll see them fight those on the same grounds if he knew -- there were couple very new details related to trump's financial habits, in his filing, and there were certainly a lot of discussions that the attorney general used of his practices. she put together a comprehensive filing, a lot of it and this is what the trump folks are pointing to repeatedly, is stuff that is largely been known. the question is going to be weather gets her differently in a court this time. >> david, do you think the former president would be more or less likely to run again, given all the news today, and just the sheer volume of legal drama surrounding it? >> right, so if you stack them up there's potentially five

cases going on right now. so you have the criminal suit by >> which -- is ongoing, you have the civil suit now. you have the district attorney in fulton county, looking at the 2020 election. we have the january 6th committee doj, then he had the mar-a-lago incident, so there are five potential losses going on. but if the president doesn't run then he can't claim that is politically motivated. if he's a candidate, republican candidate for presidency, he can look at the new york attorney general say look, as maggie said, this is all been well known and out in public for a long time, we, all these claims of me inflating the value of my quality properties, if you look at the suit, none of the financials were certified. the organization didn't sign off. so the banks relied on him i'd

be surprised, but if the president does isn't a candidate, he doesn't have a card to play. i think a mix of a bit more likely to run. >> also david, if he's not a candidate, he's a former president, but he's also just a guy in mar-a-lago, and a lot of the energy around him, and the sense of being in the center of the storm dissipates and you are just a guy that mar-a-lago -- without any of the kind of future potential out there. >> well you know, i agree with that, we but don't underestimate the trump fan base, there's a great deal of people who are not gonna stop following him because he's not the candidate, who they're gonna wait to see if he's -- still remains very strong, but if he's not a candidate, that he can't claim he's been politically victimized, and i think that's what would be important. >> take, urban mega him, and pat walton, stay with us, coming next more on that card

make you look at some of these examples, it's mar-a-lago, they're the new york attorney generals office said the trump had value the property is $790 million, when in fact the value was closer to $75 million. there's also a number of properties in new york, in washington d.c., as well as the hotel in las vegas. there, letitia james in her lawsuit alleges that they undervalued that property, in order to obtain a tax benefit. she also says that she believes she found some examples of federal crimes been violated including the specifically bank fraud she said she was making a referral to the internal revenue service, and the attorney's office for the southern district of new york, for them to potentially pick up the investigation. we've picked free shots both agency neither them had comments on whether they would look into the allegations but she herself is seeking some pretty steep penalties. 250 million dollar fine a permanent ban on the former

paul callaghan, how do you strong do you think the cases? >> it's a case that can be contested, some because remember the district attorney of manhattan was investigating the same thing on the criminal side, and decided not to proceed with the case. but in reading over the allegations, there's a staggering number of allegations. it's a 200-page story of what the attorney general describes as persistent fraud, perpetuated by the trump organization. and she's seeking what corporate lawyers call the corporate death penalty, which would mean the certification of the trump organization, so they couldn't even do business in new york anymore. it's a death penalty for a corporation, it's a very serious penalty if the ag wins the suit. >> david, that is a size and scope of this lawsuit, the breadth of the alleged fraud, does it surprise you at all, or does it line up with what you've learned over the many years about the former president's business practices? >> this lines up perfectly, anderson, this is how donald has behaved his entire life, the ag could've gone back a lot

further, but there's a statute of limitations on these matters. and what aj james does that is very important, if you put this right as donald doing it. donald off and will say, i was just doing what the lawyers and accountants says, and -- he said why. a good example of building was valued by appraisers 200 million trump said it was worth 527 million, and he says that's what the appraiser said, that's pretty hard evidence against trump. >> because, as you know, that is one of the arguments have been made in the past. look, new york rulers state, there's a history here of inflating values, and been fast and loose, is that an argument that would hold up in court, this was sort of how business was done, in the go go 80s and even now? >> are you asking me? >> yes, i'm sorry.

>> i'm sorry, anderson, it may or may not hold up in court. to me, it raises a different question, our banking systems in our insurance companies are clearly operating way outside of the legal structures, and they after all hold money essentially interest for depositors and premium players, so we're not enforcing the law regarding this. so the whole scope of big banking in america especially international level big banking, is just ridden with criminal behavior, and we just have a tiny law enforcement effort, and we don't really try to go after it. >> how does the burden of proof in a civil case like, this differ from a burden of proof in a criminal case. >> it's much lower, evan anderson, is by preponderance of credible evidence, which means that one side is just a little bit more evidence than the, other supposed to be on a reasonable doubt, which is what we have on somebody faces jail time. i think in this case, though, you'll have a very lengthy litigation, and the defense attorneys are gonna come in and

say hey, where are the victims? none of the banks complained about this to trump, and of course he's been under investigation for a long time, so where the victims here? and that's really what they're gonna say, and they're gonna harken back to what you open questioning about, is this what all these big real estate developers are doing in new york and other places. so that's gonna be the defense -- the district attorney said she was reporting this to federal investigators and to the irs. is that a real possibility of a criminal case? >> i don't, know my invite hesitation on that is remember the southern district investigated michael cohen, and he was trying to trade his own freedom for this case, that he could prove and produce evidence that trump did these things, and the southern district never indicted for trump on this. so has the attorney general come up with new material that michael cohen didn't know about,
