>> if he comes over i'm going to punch him out. >> i would pay to see that. >> we're waiting for this, for trespassing on the capitol grounds. i wan to punch him out and i'm going to go to jail and i'm going to be happy. >> reporter: i'm going to punch him out and i'm go to go to jail and i'm going to be happy. those are remarkable words from the speaker of house talking about president trump at that time. but there is one other part of that document that we just saw, that footage and that was the moment between pence and pelosi. you hear her asking him how he is. being concerned about his safety. which really is interesting to note is that what we learned what was going on at the white house, at pence's white house with trump, the president who picked pence. he was sitting there ignoring the fact that pence was in danger and instead tweeting out that pence didn't have the courage to what do should be done. so looking at the two of them side-by-side, it is really remarkable to see those reactions. >> yeah, it really is incredible footage. kristin holmes, thank you.

let's discuss all of this, join me now, jim schultz, and senior editor for the atlantic john brownstein and jennifer rogers. could i start with you, ron, because the republican narrative for so long following january 6 was that nancy pelosi was nowhere to be found and she wasn't doing her job. what we saw in this video was that she was there, she was on the phone with everyone. chuck schumer sitting with her. but many republican leaders there as well. so that argument was based on i guess a lie. i don't know how else to to describe it. >> yeah, you see the urgency in -- on the part of so many leaders of congress, as you say in both parties. and the difficulty they are having getting the trump administration to respond. kind of reinforcing from the other side the testimony that the committee obtained of trump sitting, watching for hours and

resisting doing anything to undo the riot, telling kevin mccarthy these people care more about the steal than you do. this is just a powerful moment. and in an additional angle. it is like seeing the same events from the other angle and getting that kind of triangleation of vision that underscores the portrait and makes the point clear that trump turned away and effectively abet abetted at tack by allowing it to persist without intervening. >> and the commit unanimously voting to subpoena the president. so i'm going to ask you this question. two questions actually. one, if you were still the p president's attorney, would you advise him to comply with the subpoena and speak before the committee and aside from my advice you may offer, do you think he would do it any way. >> i served in the white house and was a white house counsel lawyer. i wasn't a personal counsel for

the president. i believe the personal lawyers for the president will likely begin negotiations of some kind with congress in terms of whether he's going to testify ott all, what the scope of the testimony, those type of things. that is what i believe his lawyers will be doing today. and in the coming weeks. i've heard rumblings that he -- he's said things like he's -- he would like to appear before congress and have his say. i believe that he should -- if he's doing anything, he should be listening to his lawyers and taking their advice before he is going off and speaking out of turn. >> jennifer, we also know that this is a president who likes to kick the can down the road and buy time and time is not on this committee's side now with the midterms coming and house leadership likely to turn over to republicans. >> yeah, i mean, personally i think that the house's request for him is just to say that they've done that. they've given him the

opportunity now to respond and to be heard on the record. they know at this late date there is no way in the world, even if he were willing to testify, that it will happen. i think they're going to start talking about scheduling and potential privileges before you know it, it is all over and he didn't make it. >> what were some of the other big takeaways from the committee yesterday. >> i thought it was another impressive hearing. i liked the pelosi footage. i thought the information about the secret service and the specific threats of violence was important and i liked the way they refocused the center as trump. first he is the center because he's the beneficiary, but they made the point he's the center because he was the primary actor. he conceived of the plot and he was operationally involved in all of the different trands of the this plot. i think they did that effectively, particularly the juxtaposition of when he would be told by someone like a bill barr specifically we saw that testimony, this fraud that you're claiming happening, did

not happen, for example suitcases stuffed full of ballots and then the very next day he's out there again in public talking about suitcases full of ballots. so i think that juxtaposition was effective. >> and ron, you did hear roger stone and tom fitton and there was a plan hatched prior to election day to declare victory no matter what the outcome was that night. >> yeah, that was another brick i think in the most important wall that the committee built over the course of the hearings. i think it fundamentally changed the frame in which we understand the events of that day. i think originally a lot of the focus was on the idea that the president -- then president trump in a fit of peak or anger or kind of recklessness ignited, inspired this crowd to go down and tear apart the capitol for in -- kind of no purpose other than anger and peak. but in fact what the committee has done i think

extraordinaextraordinarily is show there was a come binati of a multi-prong attempt to over turn the election and this evident pointed out that it began even before the votes were counted, even before the votes were cast they were planning to declare that they won no matter what and discredit the result and then they worked through multiple avenues over multiple months through an incredible range of actors within the republican party that were willing to participate to do that. >> and to that point, most of the witnesses, they were all within the president's inner circle. they were republicans, they were working closely with the president. and to hear, again, repeatedly that the president, his narrative had been that he thinks he wins. he won and no matter what evidence is presented to him, he's convinced he won. but now we heard from two witnesses just yesterday that behind the scenes, you knee that he lost, he called it, quote embarrassing. i believe he told alyssa farrah

griffith that he couldn't believe that he lost to this blanking guy, meaning biden. so what does that do to his story? >> i think that is all very damaging testimony. and the the thing to be concerned about is you heard jed that mark short, the vice president's former chief of staff was heading in the grand jury once again. i think that is what the president should be most concerned about. what is the justice department is doing, not what congress is doing. congress collects everything in generalities and they don't nail down the specifics. in the grand jury you tart seeing the specifics and that is when it really -- the rubber really hits the road. other thing i would like to comment on is vice president pence that day hunkered down there, didn't get in the secret service vehicle and served in a strong leadership control and communicating with other leaders from congress in a way that the vice president should have been so he could get in there and do his job that day. >> he did his job.

cnn has learned that house republicans are holding back their rebuttal to the january 6 select committee final hearing before the midterms. marking a shift in strategy after responding to a previous hearing in a quick and aggressive fashion. melanie zanona joins me more from capitol hill. what is next and when will the house gop issue a rebuttal. >> house republicans have been working on their own investigation that has been focused on the security failures on january 6 and does not look into donald trump's role. we're expecting this role to try to blame speaker nancy pelosi for some of the security failures. but i'm told that the report on that is complete but republicans are saving it for whenever the select committee unveils their final report so this could serve as a counter effort. but as far as the select committee, we may have seen the

final public investigative hearing yesterday. but they are still planning to investigate in the weeks an months ahead. and one big area that they plan to still look into it trump's interactions with the secret service on january 6. and particularly whether there was any obstruction of justice related to some of that testimony. as you may recall, cassidy hutchinson testifying that tony ornato, who was at the head of trump's security detail told her the story about a heated exchange between trump and his secret service on january 6 where he demanded to go to the capitol and then tried to lunge toward the steering wheel. but pete aguilar was asked about this early today and he didn't quite buy that story. >> i think they were less than truthful and i think that they should come in and talk to the committee again. we said in the hearing yesterday that we would recall a number of witnesses.

i think i'll leave it at that. but i'll say what i've said before, which is that those two individuals either have the foggiest of memories, or they were less than truthful. >> reporter: now, pete aguilar was referencing tony ornato's denial of that account that he told had cassidy hutchinson. so they're going to bring in any new information likely included in the final report. and other big question looming over economy is whether they will issue criminal referrals for donald trump or anyone in his inner circle. that is something that is certainly a possibility but has not been cited yet. >> it is something that at the end of the day for the doj to decide on. melanie, thank you. well let's bring back our panel of the experts. so jennifer, what did you make of aguilar saying that they may bring back some witnesses and requestion them. the questions about obstruction

perhaps, of witnesses, and what could they make of that and what more could they be learning. >> the committee has been so impressive, the way they've been able to gather information with the not very strong tools at their disposal. we know their subpoenas aren't as possible as doj subpoenas. so good for them. they're really trying to get to the bottom of this with a limited amount of time they have left. i don't know what they'll be able to learn but what we've seen is they've been able to give doj avenues of investigation and we don't know what is going on behind the scenes but we've committee look into something and provide evidence and then you've seen hints coming out that doj is looking into the same thing. so good for them for continuing to work hard. i'm sure that anything they are able to collect, doj then could pick up on when they move forward with their much more powerful tools of investigation. >> jim, were surprised to see that the hearing end with the committee subpoenaing the former president? >> no. there was no down side for them to do thatti -- to doing that.

that wasn't surprising at all. i think it will continue to boil for sometime between the president's lawyers an congress. and i do agree someone said this earlier, that this is going to be delay, delay, delay. no doubt about it. that is the tactic from the former president's side. so i think that is what we could expect. i don't think we'll see the former president testifying before the election coming up. and once congress swip switches in january, if the republicans prevail, you'll probably never see him testify. >> what do you make of the committee not issuing a subpoena for former vice president mike pence? >> well i think they want to keep the issue as focused as they can. and if you look at the larger question of where we are, people who study threats of democracy internationally and you know this as well, talk about the importance of prosecuting, holding people accountable for actions that undermine democracy

that are against the rule of law. and that -- committee has made a pretty powerful case that donald trump needs to be held personally accountable for what happened in this month's long plot to over turn the election. the challenge is, it seems the threat to democracy has metastasized way before this individual. if you remove donald trump from the equation, we go back to a pre-2016 state before wr both parties are equally committed to both of functioning democracy. there are over 200 election deniers nominated for office in republican primaries and in multiple states. there are election deniers who are in position to win control over the administration of the 2024 election. so whatever happens to donald trump, this challenge is not going away and the willingness of the republican leaders to stand up against it within their own party is the big question.

this morning authorities identifying the five victims shot dead in north carolina thursday by a teenager. five people were killed thursday afternoon a long standoff in raleigh, including an off-duty police officer and a 16-year-old. two others were injured. one of whom remained in critical condition. authorities praise the community's strength in the wake of the deadly gun violence.

undecided voters in the state. joining me now to discuss are patricia murphy, from the atlantic journal constitution and bill nugget from gbp media. welcome both of you. patricia, the one and only debate between these two. what will you be watching for? >> so first of all i'll be watching to see how herschel walker is performing. this is his ferst debate ever. he never debated running up there so. he has been working with a debate coach and been having fellow senators and policy experts fly in to his office for policy time to really help the issues. it is an incredibly difficult time to come out of the gate and start debating a fellow senator right away. so how he just clears that bar in terms of basic ability to get through this debate. i will also certainly be looking to see if, at all, and how raphael warnock goes into herschel walker's back ground.

we know he's made a point of saying herschel walker is not ready to be' senator. we'll see if he questions his credible or brings up his past. >> and bill, we know that senator warnock is an experienced, talented debater and it is interesting because it appears that the strategy for herschel walker, he himself has been setting the bar low saying he's just a country boy and not that smart and is that a wise strategy given that he might beat that threshold tonight and impress people in ways that he has not set the standard for quite yet? >> yeah, i think the fact that the walker campaign and walker himself as you pointed out have tried to lower expectations, really does work potentially to their advantage. it is fascinating, isn't it, how often you have heard a candidate for the united states senate say i'm not that smart. but walker, by setting the expectations low, can, if he just survives this debate, without making a major gaffe or

getting something in terms of a policy being dealt with in congress wrong, he could come out fairly unscathed. >> patricia there any risk that raphael warnock faces tonight given that he's been rather muted as the allegations continue to unfold in herschel walker's personal life. choosing to just focus on his views on abortion and not the -- the headlines in these allegations. if we do hear him address it now, will it seem too late and perhaps even a little too late at this point. >> i think he wanted to focus on his own record and what he said he's done for georgia. we know that raphael warnock is noing to be talking about georgia. herschel walker is talking about washington, trying to tie senator warnk to washington and

joe biden that has a 36% approval rating here in georgia. so, there are ricks for raphael warnock because of so much attention on herschel walker people have not been paying attention to raphael warnock. herschel walker is aggressive on the stump against raphael warnock. brings up raphael warnock's past divorce, brings up his past child custody battles with his ex-wife. so there is a lot in his background that herschel walker has talked about the stump. will he bring up it in the debate. this is his opportunity to do that as well. >> and bill, if the ultimate goal is to grab the undecided voters left in this race, what do we know about how many there actually are. >> according to a poll that the a.g.c. and georgia public broadcasting and a number of other number organizations released this week, there is about 6% of voters who are undecided in the senate race. that certainly is enough to make a difference in this race. which most polls show is about a

satellite internet terminals called star link. made by spacex, the rocket and satellite company founded by elon musk. according to spacex, there are around 20,000 star link terminals in ukraine. and they've been vital for soldiers' communication and flying drones and artillery targeting. >> it is the strike against russian positions. >> reporter: star link arrived in ukraine as the war started, earning musk global praise and thanks. now cnn has obtained documents showing that spacex is one part of a large international effort getting star link to ukraine's front lines, but now seven months into the war, spacex is warning the pentagon it is facing the difficulty of reducing or stopping service. >> why at this moment star link is raising this issue, it just it is really bad timing. >> reporter: the company said it

spent almost $100 million and, quote, we are not in a position to further donate terminals to ukraine or fund the existing terminals for annin deaf in the period of time. and they asked that pentagon pick up the tab, $124 million for the rest of 2022, a rate that would translate to close to $400 million for next year. >> spacex is not a charity and they're losing a lot of money right now as a business. so i'm sure that they're trying to recoup some of the costs. >> reporter: spacex's request came after the commanding general wrote in july directly to musk. the letter obtained by cnn. star link units provide exceptional utility, the general wrote and then asked musk for almost 8000 more terminals. instead spacex told ukraine to send their requests to the pentagon. adding we've exceeded our original agreement with ukraine. without star link, ukraine said it can't fight.
