since 7:30 in the morning. the older tells her not to film, asking her if she has kids. why are you so shy? why did you park yourselves here? the soldier telling her to calm down. pretty incredible, right? loitering in an apartment building lobby to grab men on their way out. a top u.s. official tells cnn's kevin lip take like things like this draft, it's not putin running out of men, what we are finding out is that putin is running empty on tanks, weapons, ammunition, too. since the start of the war russia has lost more than 6,000 pieces of equipment, we're told. 6,000. that is no small thing and because of the crushing western sanctions, russia can't get the parts, crucial circuit boards, the things to replace them. let me show you this grach because numbers say so much. this is a graph from the ukrainian defense ministry and it shows russia's stockpile of high precision missiles. this missile is in orange. it shows you that they have 124

escander missiles left. they started with 900. to be clear, that means they have lost 86% of those missiles. now if you add all the missiles up on the screen there, that shows you at the start of the war they had 1,844 of these conventional missiles. they now only have 609 of them. it gets more dire. today ukraine claims it took out a significant number of weapons. russia not only losing the vital equipment but the ground. fleeing after leaving equipment behind. let me show you an image we got in a city near kharkiv that was occupied by russian forces. that writing on the wall. there it reads, putin is our president. tonight that town is under ukrainian control. despite the setbacks for putin, he's not backing down on his

decision to invade ukraine. >> translator: i have no regrets. what is happening today in ukraine is unpleasant but this is all the same result we would have received later only much worse conditions for us. >> much worse conditions for us, words so vague no one can truly know what it means. it all comes as the pentagon is in talks with elon musk's spacex about the critical satellite terminals called star link. that technology is credited, as it should be, with changing the course of the war in ukraine. now as we first reported, musk's company is threatening to pull the rug out from underneath ukraine's military unless the u.s. pentagon starts paying tens of millions of dollars per month to musk for the service. we have much more coming out from alex marquardt.

fred pleitgen has the story. >> reporter: it's so interesting to see the depleted missile supplies that you just showed. one of the things you're showing is a lot fewer strikes here in kyiv and in other places as well. at the same time on the front line, the war is still in full swing. now you have the russians gaining some ground in some places in the east with the ukrainians making a lot of headway in the south, in the area around kherson, and that clearly has a lot of pro russian officials very worried. here's what we're learning. even as russia has been bombarding ukraine, ukrainian forces have been pushing moscow's troops back in the south of the country raising their flag in newly liberated areas like in this village. >> translator: the boys worked for six, seven months liberating our area. they are raising the flag of the free and united ukraine.

>> reporter: the kherson region is one of the areas recently illegally annexed. ukraine's army is inadvancing so much that russian installed officials are asking for civilians to be evacuated to russian territory. >> translator: because of this, the kherson administration has decided to organize opportunities for kherson families to travel to other regions of russia for leisure and study. >> reporter: kyiv announced the move saying russia is deporting people rather than saving them. ukraine has vowed to take back all the territory russia has seized. the country's president said at a celebration for ukraine's defender's day on friday. >> translator: by defeating this enemy, we will respond to all enemies who encroached on ukraine, on those who lived, who live, and who will live on our land. this will be a victory for all our people. >> reporter: but in the east, a different story.

civilians fleeing the russian advance on the industrial town of bakmut. these photos showing the troops on the ground in the areas surrounding the area. on social media wagner forces have taken a small town outside of the at the. i want to emphasize there was not a single person from other units except the employees of wagner group in ivangrad. wagner group has been known for tactics. the group's mercenaries committed massacres in libya, sue dam, mozambique and the central african area. he's seen recruiting convicts from prisons admitting he owns wagner and even attending

funerals of one of his fallen fighters. wagger units have already been prominently involved in russia's campaign in ukraine. it seems they are now the spearhead of vladimir putin's invasion force. erin, you just saw that statement emphasizing that it was only wagner soldiers or wagner troops who are near that town near bakmut. there are a lot of people who believe right now he's trying to orchestrate a power grab in moscow, that he's trying to help possibly oust the defense minister of russia as obviously russia's campaign is going very badly and himself grab power among those under vladimir putin, erin. >> thank you very much, fred pleitgen. i want to go to the former cia director, john brennan. author of "undaunted, my fight against enemies at home and abroad." let's start with the wagner group. you have the power play trying

to challenge putin's defense ministry, described as the spearhead of the russian war effort. what do you read into that? >> well, i think, erin, as reported the russians have done so poorly on the battlefield, putin is looking for new options and tapping into the wagner group, which was noted, is a very brutal organization, paramilitary. they have probably 8 to 10,000 paramilitary troops. i do think there is some jockeying among the various senior leaders of russia trying to take command and control and because they have done so poorly. just last weekend he appointed the general of syria who really engaged in some brutal tactics, massive attacks and assaults in syria. so i do think as putin's options are narrowing and as the russian

forces are doing so poorly on the battlefield, especially kherson. they've been there for six months. the fact that they weren't able to fortify it enough to withstand a ukrainian assault is telling how incompetent they are. >> it's interesting. you've had a chance to meet with many who know putin and are close to putin, when you talk about a power grab, it raises bigger questions. from the people that you've met and seen operate around putin, do you think that whether it's because they want more action or less action that there could be a threat to putin? >> i think putin thinks this is consequential to his survival. there's no way he won't be able to survive if he can't credibly claim victory. with the people around him,

these are people that are very worried. the question of whether or not the soviet union may try to make a move against putin. he does have a monopoly on power. the next several weeks, couple of months i think are going to be very dynamic and i think very telling of where this conflict is going. >> i was talking about the incredible dire straits, 86% of the escander missiles are gone. there's the nuclear elephant in the room. we're seeing the video that i showed of draft officers waiting in the lobby of an apartment building to grab men, we're hearing from some of them. >> translator: we've got this [ bleep ] for training, who knows what kind of house we're at.

ukraine or fund the existing terminals for an indid he have net period of time. musk highlighted costs of around $20 million per month and echoing a ukrainian diplomat's statement to musk to f off musk said, quote, we're just following his recommendation, at least how musk sees it, to leave ukraine. that outburst coming earlier this month after musk proposed a peace plan which many ukrainians saw as pro russian giving russia official control of crimea and encouraging new u.n. supervised elections. >> this is a challenge for all of us, for the administration who wants to see ukraine succeed for elon musk acting in mercurial ways where frankly the only acceptable outcome should be that ukraine continues to retake its territory from

russian invaders. >> reporter: musk has denied a report that he told foreign policy expert ian bremer that he's spoken directly to russian president vladimir putin about ukraine but concerns about musk's support for ukraine has only grown and they said they couldn't reach the star link. >> i think they're very concerned to the ukrainians. they know it will make it much more difficult for them to advance so star link is a unique capability. it is incredibly helpful for the ukrainians. >> ukrainian officials trying to play nice with musk. one praising him as a top donor and an aide to volodymyr zelenskyy, like it or not, elon musk helped us survive the most critical moments of war. the pentagon confirmed they got

the letter from spacex about star link funding but they declined to say where that stands. a spokesperson says there are other options besides star link and they will make sure they get what they need. >> alex, thank you very much. with that update, director brennan, you know, star link is crucial. you hear zelenskyy, crediting it as crucial in this war. there's the reporting musk has contacted putin directly and you heard much of what putin's put out there. what do you make, director, of the fact one person who is a nontechnical person is so highly involved and essential here. >> his company, star link, as you point out, has been absolutely essential. i hope there's some way to figure out how to continue it. he is the world's richest

person. despite that, i think he looks at things through a very, very narrow personal financial prism. he can afford this but maybe there are some countries they're going to help to underwrite this link, but he's made a number of very harmful statements about ukraine and russia and china and taiwan. i think it demonstrates the power and influence individuals have when they have a platform due to their financial wealth, because they are an influencer an how that can be very disruptive. i'm hoping we're going to be able to resolve this issue so star link can continue. i do think elon musk needs to be very, very careful with what he's saying because the future of ukraine can hang in the balance. >> director brennan, thank you very much. >> thanks, erin. next, the justice department making a major move to end the

new tonight, the justice department officially appealing the appointment of a special master in the mar-a-lago classified documents case. the doj argued that district court judge eileen cannon had no basis to ever grant donald trump's request for a special master saying trump, quote, failed to meet its burden. indeed, a substantial number of them aren't even his or in establishing any irreparable injury in their absence. that special master has already been going through the documents for weeks now. evan perez is out front. evan, to be specific here, dearie started on september 15th. the next deadline in the appeals process is not until november 10th so how does this play out in that window? could this all be moot by the time the case gets through the system? >> it really could. keep in mind, he's going through

about 21,000 pages of documents and what the justice department did today in its brief, erin, is to quote from this very appeals court, the 11th circuit, which overruled it in part allowing the justice department to have access to the 100 classified documents that she had earlier said they shouldn't have access to. so what they're doing now is they're saying, hey, appeals court, you've already ruled against her. now you need to throw out her entire ruling. they point out what trump has been doing is essentially trying to delay a criminal investigation. they say this special master process, he should not be able to use this to stall a process. they're due to have their reply a week later.

december 18th is when the special master is supposed to wrap up his entire review. so it is very possible that we're going to get a ruling from the appeals court which, again, given the fact they've already ruled against eileen cannon's earlier ruling really could be that they could throw out this entire thing by the time judge dearie is done. >> let's go to ryan goodman. ryan, what are the implications here? why are they choosing to do this when essentially the way the time line happens, it may be moot win or lose? >> i think in part because judge cannon has been a bit of an unpredictable figure. issues might come up. do they leave them left in her camp, in her control where things can go haywire or do they try to get this out of her control? also, they couldn't let her

decision stand, it's such a bad precedent. >> they want to up end the precedent of the whole thing? >> yes, set it aside. >> but obviously when you look at what they're saying, what they're saying is true, he didn't even try to prove harm or injury in any way, shape or form, as you said, he left things blank. what they're sort of pointing out seems to be a statement of fact. >> yeah. there's sort of a game over at one of the first pages of their document. they say he has to prove that there was a callous disregard for his constitutional rights and even judge cannon said he did not have a showing of that. she did something kind of unusual. she said, oh, that's not an essential condition but the 11th circuit says it's indispensable. >> by the appeals court own logic, this is an open and shut case. it comes as we saw the january 6th committee yesterday asking for the -- to subpoena donald trump. he sent this letter to bennie thompson, chairman of the committee. now i just want to ask you about

this. it's a 14-page statement. the greatest hits of his grievances. debunked claims state by state. the 2020 election was stolen. this is written to express our anger. even though it was written by donald trump. greatest hits, it talks about his crowd size. the massive breaking crowds, pictures of his crowds for his rally. what does this tell you about his state of mind, this memo? >> unhinged, i would say. rattled it seems. even to do the pictures and talk about his crowd size again as though that's relevant in some way is almost like a caricature of him. if there's a "saturday night live" skit they would have it in there and he does it himself.

mentioned, one of the moderators did address the republican candidate, herschel walker, asking him to explain the circumstances around the allegations. he said once again as he has for the past two weeks that it was a lie and went on to say he felt he would protect life as a senator, referring to his position on abortion. he is against abortion access and abortion rights saying he supports the so-called heartbeat bill here in the state of georgia. now, look, if you were to ask if there was a third person in the room, you might think there was because joe biden's name has been mentioned almost as much as the democratic incouple dent, senator raphael warnock. he's trying to play this as he is the only one who is prepared or ready and able to represent georgians in the senate. trying to play off just the inexperience of herschel walker and, again, many of the allegations that have swirled around him from the start of his campaign. both candidates were asked if
