>> good evening everyone i'm alison kara miranda. >> and i'm orchids, this is cnn tonight. we've got news hand from the debate happening right now, tonight, and florida, between rhonda scent and charlie crist. and tomorrow, it's going to be john fetterman up against doctor mehmet oz. and pennsylvania senate debate. with the question we're really wondering is to what extent these debates are persuading people. do they still matter to you out there or they somehow a victim of are already polarized politics and just political theater? >> i saw phil prophecy, who knows. >> meanwhile, what are armed men in tactical gear doing had ballot drop boxes in arizona? take a look at this? with this intimidate you as you drove up to drop off your ballot? if he saw guys dressed in maxed and tactical gear. is even legal? tonight, we're gonna talk to a lawyer who just filed a suit to stop this. i know they say, the truth is out there, somewhere.

but then we are also polarized now that there are times when people go into watch a debate and they're more set than they might have been in the past. there aren't as many persuadable voters watching it. however i do think on the margins and depending on the race they can have consequences. i know talking about florida, ron desantis can charlie crist. maybe it won't turn the tide in that race down there. but ron desantis wants to be doing things. maybe other things a few years from now. maybe something that would happen on the station tonight. we have some impact down the line. >> and i persuade people, right. for 24 days alluding to? but in terms of what he's doing right now i think this one of the first times in recent years for the governor's race that has been at least of elite any candidate frankly in this moment in time. i wonder given that it seems to be the trajectory that it is. is this and it's he's additional with 2024 earth are still something to lose right now. >> he is auditioning for 24.

but in debate if you make a bad mistake. amongst make any big aspirin hearse, it's not to change the trajectory of the race. desantis is going to win, but is on the stage, he's looking at 2024. >> he was asked directly if he would serve a four-year term as governor. >> you're running for governor. wanted to look in the eyes of the people in the state of florida. i stated them, if you're elected, you will serve a full four-year term as governor yes or no? yes or no, broad? will you serve a full four-year term if you realize the governor of florida? it's not a tough question. it is a fair question, but he won't tell you. >> did not agree on the candidates addressing each other questions. >> governor it's your turn. >> i know charlie is interested

in talking to inform joe biden. but i wanna make things very very clear. the only worn out old don campbell can put out the pasture is charlie chris. >> that's a harsh line. >> does that help him or hurt him that he won't answer whether not -- >> actually think with his base to probably helps them. because everyone who loves around desantis loves the fact that he is now this national figure, they think it probably brings more prestige to florida, it will give him more power if he does get reelected. and so, i think this debate tonight probably didn't change the trajectory. but it is also going to be one of those who are checked asked. you talk to the desantis campaign. they think your bladder rated chris. you talk to chris campaign they think he obliterated desantis. but it did indeed to be one where did change the trajectory for chris. given where he is in the polls.

but i do think from what i hear in a live scene. chris did do well. i think of the places where he really need to underscore the extreme nature of desantis's agenda in terms of abortion, and in terms of lgbtq, in terms of denying history for the african american community. all of those things where things that chris did a really good job of underscoring. and maybe it does matter in the margins, i think the margins are going to be big enough for it to change. >> take a step back. if are out of florida for moments, and what does a lot of focus on select races. more broadly, are we really saying that we are, as an electorate, we are so entrenched and our heels are dug in. that we, essentially, think of these races and the debates as an opportunity to forgot the tester talking about. that people have already had their mind made up. but that's the case, what is with all the ads. the ads are come out the woodwork. to make sure they're thinking, hold on. i can maybe get this last person to change their mind.

>> i've been update a lot of election nights of the last two, four, six years. that have turned into election weeks. because some of these races are wicked close, as we like to say embossed. and so i think even though 96% of the people showing up at the polls may have been dead set on the vote. there's still this tiny sliver of the voting population out there who is waiting and watching and can be swayed by something. but some people don't watch senate and gubernatorial debates the way they watch gubernatorial debates. the numbers for these debates are not going to be what they are the national stage. >> but early voting numbers arriving more presidential elections already. >> but it seems the headlines of the local news. a seeps into the headlights the paper for a few days and it could be a good thing. i think we're tomorrow that could be divided by more than 10,000 votes. which, you guys know, they can be.

election day two weeks away. but voting is already underway. for seventh million voters across 39 states have already returned a ballot. they've also been reports of voter intimidation. in arizona, six complaints, had already been referred to at the doj and the arizona 20 generals office. people report being photographed and followed at one drop off place. and to reportedly armed men, wearing tactical gear, or hanging out there a ballot drop

box in the d center of arizona. but a lawsuit was just filed trying to stop these tactics. and the plaintiffs alleging the group has violated the voting rights act, and the ku klux klan act of 1871. joining me now is one of the worst behind that lawsuit, democratic voting rights attorney, marc elias. thanks so much for being here. can just describe what this does in tactical gear and masks who are reportedly also have guns? what are they doing at these drop off boxes? >> they're intimidating voters. -- they are not there because they want to observe. they're there because they want to creighton environment. that makes people afraid for ballot drop boxes. ballot drop backs in our zone are entirely legal. there is nothing suspicious about them. and a group of election deniers and but --

advocates. have a range this. so that people are afraid to vote. >> who are those guys. but so we named the organization that seems to be the umbrella for this effort. and eight leader. we also name -- we and some of the people who are at these polling locations are masked, our armed, are otherwise active in a way that is hard to identify who they are. but if we identify who they are as defendants of the lawsuit. >> so, we just filed a lawsuit. it -- i would think that being with a gun, at the ballot drop box, and in tactical gear, and wearing a mask would be illegal. however the open county sheriff says that is not the case.

>> this is a free nation, the second amendment was at the first. and the porch of the gear that they wear. it this is why they're choosing. >> so more about that. maybe it is not illegal? >> thanks. first of, all with the sheriff they're talking about is whether it violates the criminal law of arizona. we're not alleging that violated criminal law of arizona. we're pointing at that violates the federal laws. the federal voting rights act. the federal ku klux klan act. that create a cause of action to prevent people from intimating people from voting. so whether it is a crime under state law, i don't know. i will take the sheriff under his word. but is certainly a violation of federal law. >> early two weeks away. who are already voting. how are you going to stop them as of tomorrow? >> so, tomorrow. my judge and our lawyers in

state representatives in the alliance for tired americans. i will hopefully convince a judge to issue what is called a temporary training order which is to prevent this while we sort out who's who and what's going on. because the right to vote, this report is that, it's fundamental and preserves all fundamental rights. but we have is just a sad and despicable instance of people trying to prevent people from exercising that right. >> have you heard from people who tried to drop off their ballots? >> we've had people reach out to us and we've had a process for vetting them. so i don't want to go too far in on what's in the complaint. but i think the complaint is a pretty compelling argument that there have been people who have come forward and have said that they were tailed. have said that they were questioned. said that they were intimidated.

and that is all it takes to meet the federal statutes. >> another couple of post on donald trump's social media company. but -- not surprising because donald trump is the original election denier and that his company, truth social, is a place where these elections and had buckets can share messages. you and i might on twitter. you might on truth social. and so attached screenshots of what they're saying on that website. about how they're encouraging and organizing these efforts. >> marcellus let us know what happens will be following your lawsuit as well as the early voting in arizona, thank you so much for your time. >> so that was informative. and it actually was not

necessarily can state law. but he's -- >> i used to, it's part of the voter infection of the rights division actually monitor election for the very reasons. we're trying to see whether somebody was actually trying to intimidate voters. we keep all that threat. and can you copy down their license plate. they're standing out there armed. they're trying to say anything to you. if they're trying something to make you feel less willing to exercise your right to vote. you've got an intimidation in this aspect. so the way to do it, but it's right, at the state level. it might be very different from what is proven for the voting rights in 1965. that's enough for some haven't seen that. we have different election cycles, we have people outside the polls, it's part of his frustration 2020 budget how close even officials zervos could go. to the voters. and so, i think this sends a very big message as to what can happen next. but we will see.

attorney general merrick garland now found doj cannot permit voters to be intimated before the midterms. frankly, voter intimidation is not the only concern as candidates are vying for a win. we're seeing plenty of miss directs and outright tricks trying to sway voters and the question is how effective are they going to be? we're back now with john berman, charlie dent, and maria cardona. before even think about the dirty tricks. there's intimidation to be part of that is. well the idea of trying to force voters to question whether it is worth it to vote. that is at the core. >> absolutely. and people are saying -- there's no better what he's doing in terms of protecting everyone's right to vote. that both the dinos are joining him in these lawsuits because, it is arizona. a lot of what we are seeing is
