reached a fever pitch last night. a source is telling us she is planning to address everyone this morning in a floor speech, she took two versions home last night but it's still up in the air how it is. part of t it, speaker pelosi has been overwhelmed by calls from friends, colleagues, and supporter. the speaker plans to address her future plans tomorrow to her colleagues, stay tuned. of course, nancy pelosi, looms over the capital, the house, and has been a monster figure guiding the democrats for years. and passed an enormous amount of legislation through the house in her last term as speaker. all eyes are on her as to whether she will continue forward in a leadership position. if she will continue serving here in the house speaker. what exactly her plans are. of course, don, lingering behind in the back of her mind has to be the attack on her husband,

paul pelosi at their home in san francisco a few weeks ago. >> and in the senate, same-sex marriage protection cleared a critical hurdle in the senate. can you talk to us about this, jessica? >> this is something they were trying to get done before the midterms. i say they it's a bipartisan group of senators that were trying to get the legislation through. we're through the midterms we saw this vote yesterday that moved it forward. 12 republicans joining all 50 democrats in voting for this legislation. so that tells us this is a good indicator it's on a glide path forward. but the question is procedure, something they get done before the thanksgiving break or finalize once they get back. it doesn't enforce same-sex marriage legalization across the country. instead it forces every state to recognize another state's law. if you're legally married in one state, that will count and be

the eyes of the law and the constitution grants them that right. this morning there is a new balance of power, republicans have flipped the house by a slim majority. it's a victory that falls short of their red wave hope. president biden wasted no time saying he's ready to work with republican lawmakers, congratulating kevin mccarthy for winning control. here is how kevin mccarthy reacted. >> we are the only republican entity that can stop this disastrous biden agenda. think for one moment, it is official. one party democrat rule in washington is finished. we have fired nancy pelosi. >> the victory allows house republicans to claim subpoena power, set the agenda, and they have already promised to make investigations into the biden administration a top priority. former vice president mike pence is weighing in on trump's

2024 bid for the white house saying he believes the voters may have better choices than his former boss. he left open the possibility that he might seek the republican nomination himself and revealed how he dealt with the events of january 6th calling it the most difficult day of my public life. we're live in washington this morning. what else did we hear from pence as he was opening up about what that day was like behind the scenes. >> reporter: the former vice president was very forthcoming about his feelings about being in the capitol on january 6th describing the moments for him. but about the big question that is now facing him, if he will launch a presidential campaign, he played it coy, essentially saying stay tuned. >> i think it's time for new leadership in this country that will bring us together around our highest ideals.

>> will that be you? >> i'll keep you posted. >> reporter: former vice president mike pence looking ahead to 2024 but stopping short of announcing his own presidential bid after former president donald trump declared a third run for the white house tuesday. >> i think in the days ahead whatever role i and my family play in the republican party, whether it's as a candidate or a part of the cause, i think we'll have better choices than my old running mate. >> reporter: pence said it was a great honor to serve alongside trump at a town hall while promoting his new book "so help me god". >> in four years we rebuilt our military, revived our economy, appointed conservatives to our courts at every level. but in the end our administration did not end well. >> reporter: pence said those final days of the administration were the most difficult he's had in public life. he supported the trump campaign's legal challenge after

the 2020 election but said he urged the president to accept the results when those concluded. >> he was hearing different voices. and frankly there were some legal experts that were allowed on the white house grounds that should have never been through the gate. >> reporter: pence spoke of the tweet sent out by the president urging him not to certify the presidential election on january 6th. >> when i read a tweet that president trump issued saying that i lacked courage in that moment, it angered me greatly. but to be honest with you, i didn't have time for it. the president had decided in that moment to be part of the problem. i decided and was determined to be part of the solution. >> reporter: the former president also spoke about rioters calling for him to be hanged. >> hang mike pence! >> jake, it saddens me, but that day it angered me.

i must tell you. when i saw the images of people smashing windows, ransacking offices, and creating the mayhem that ultimately cost lives i was filled with a simmering indignation. >> reporter: pence said he's disappointed with the partisan nature of the january 6th committee on capitol hill and believes he should not testify because he believes it would violate separation of powers. the leaders of the committee are out with a statement responding quote the select committee has proceeded respectfully and p responsefully in our engagement with vice president pence. keep in mind it was only a few months ago, back in august, when pence said he would consider testifying before their committee. >> and some of his top aides when he worked in the white house already have but he's not going to.

thank you for summing that town hall for us. jake tapper is going to join us live later in the show. and twitter employees have a choice to make. commit to doing and i quote here, extremely hard core work or take three months of severance and get out. that is from elon musk, who continues to keep his staff on edge less than a month after taking over the social network and after laying off half the company's workforce. cnn obtained a copy of an email he sent to employees where he stressed staff will work long hours at high intensity. and high performance will get a passing grade. sarah fisher is here with us this morning. good morning. he's been there a short time. i know it's a tough job but is it insulting to employees? i wonder how it's going over with them?

>> it's not going over well. if you're not part of the 3,700 laid off, you may quit because of the new rule. remember, this is like a 180 for them. you have people who are told you have to work hard core, long hours, come into the office every day. i would expect 10 to 15% of the remaining employees to quick or decide they don't want to take the new package by 5:00 p.m. today. >> is it defined what hard core is? >> by elon musk standards it's sleeping on the floor overnight. it's dedicating all of your mental space towards this company. but the challenges, you know this, any company needs to have a healthy work life policy balance so people can work their best. elon musk has built two successful companies with this culture but this is a new era. >> he built them.

this is something we talked about last week. everything he's run he's founded or co-founded. he's like, you know, parachuting in here, it's his right, he bought the company. changing the culture of the work. i think missing there is we're going to pay you more, by the way. and he testified, he did this testimony because tesla folks some of them are mad. he said on the stand i'm not running twitter that long. >> tesla shareholders are frustrated right now. he's supposed to be running that company, but he's sleeping on the floor at twitter. so they're saying do we deserve to pay you over $50 billion in comp if you're putting your attention towards somewhere else? and elon musk in that moment his defense was well, i'm not going to be running it for long. did he give a time line though? no timeline. >> we were talking in the break what kind of product twitter was when he took over it. can it operate effectively if

you expect 10 to 15% of the employees not fired to quit because of the policy can they operate with such a reduced workforce? >> regulators don't think so. if you talk to people in europe where strict privacy rules, they're concerned. there are advertisers pulling their ads out of twitter because they don't think they can enforce the policies and keep content moderation under control. so i don't think it'll be to the point where people expect to do business with it, regulate it effectively. i'm hopeful the product will improve, the user experience hasn't changed in the past decade. >> he's not wrong that they needed to make money. >> he's not wrong. but you don't make money by scaring your advertisers away. i know he said he wants to make twitter more subscription based

welcome back to cnn this morning. new this morning, cnn has learned that the city of uvalde's acting police chief is expected to be fired at a meeting this saturday following a cnn report revealing the veteran officer failed to act despite being told by his fellow officers that students in the classroom were calling 911 during the shooting. shimon prokupecz joins us this morning. this is a result of your reporting, what have you learned? >> reporter: yeah, so following our reporting earlier this week the city council and mayor in uvalde, it was the first time they were learning some of this information. certainly the fact that he received information, the lieutenant received information

about the 911 call and then all this video showing the lieutenant walking around, leaving the school hallway, crossing the street. so as a result of all of this information, the mayor has basically told us he wants him removed from the uvalde city police. the lieutenant has been on paid relief but they want him fired. they're giving him until the end of the week, if the decision is not made by the end of the week. the mayor said they're going to have a hearing, we're told at that hearing, a rare saturday hearing they're calling for, they would move to vote and fire the lieutenant. >> let's talk about the family members of the uvalde shooting victims, they called for this lieutenant to be fired at a meeting yesterday. what are families saying to you? >> reporter: right. so this is at a county commission hearing. he's an elected official, he's also an elected official serves as a county commissioner. he was just re-elected last

week. they want him removed from the county commission, it's complicated, involves a lot of steps but they want him removed. but they're continuing to be upset over the information coming out. we spoke to a grandmother of one of the little girls that was killed. take a listen to her reaction. >> he was trusted to protect and serve but not only did you turn your back on the 911 calls for help but you washed your bloodstained hands and walked away. for years your badge was unblemished, almost perfect. the worst decision of your life took that all away. >> reporter: so the frustration here continues for all the family members here. they're not getting the information they need, they're not getting the accountability they need. so this is the reaction we're seeing from them. >> you can hear the frustration

correspondent mark stewart. i'm going to let you start this ms. law student. >> i have a clear bias. >> you're a lawyer. >> i'm not. i have a masters. i went to yale law school last year. i think what the dean is saying here, it's appropriate. it's notable it was ranked number one law school saying we don't need that ranking. right. and all law schools are so different. >> they are very different. i think that what the dean of yale said reflects what many universities have felt. i reached out to a number of people in the world of academia and no one is a fan of these lists. education in general means very individualized, even law school is individualized. i was talking to one source last night who brought up a point if you look at the broader college rankings, which are very popular, they look at some

pretty finite factors, including percentage of alumni that gives back. that is significant, because it's not the amount that they're giving but the percentage. if you are a school where a majority of your student base is first-ever -- first generation college graduates, they don't have this history of giving that perhaps a more established school would have. so is that more important in ranking than perhaps classroom size? >> no, it's not. >> yeah. and teacher accessibility. that's why these lists get a little bit amermurky and uncomfortable. >> i think the important number is the student's number. what is right for the student. we have a student debt crisis in this country, people going to schools they can't afford that they don't match. it should be the financial reach school is what people should be really looking at here.

and also, i feel like it's the 100 best songs of all time. we'll have a different list all of us. how can you rank the 100 best anything when the students, whether they're first generation going to college, they have money saved, don't have money saved they'll be getting loans, there are so many factors. the list is too simplistic. >> you take out these massive student loans and you think you're going to the number one or two law school and it's 15 in reality. i think people want a list, i want to go to the number one law school in the country. >> it's just bragging rights. >> yes. >> and universities, as much as they condemn them, if they have a good ranking i'm sure it's active in their marketing portfolio. but we do like lists. whether we're talking about colleges or micro waves, it makes things easy. >> here's where i think the danger is and what makes this a good move. companies often only recruit at

certain universities and certain law schools. and they just go to what's the best on the list. then you miss all these amazing people at other schools. my husband made this change where he works saying why aren't we going to these schools, talking to these students? and the people he's hired have been remarkable. so it's dangerous for people who aren't going to those top schools. >> the bias is baked into the system. >> totally. >> i worry about the people who take on a whole bunch of debt because they're going to a number one or two school and take a year off or god forbid they don't make it. and you're stuck with a number one not degree and pile of debt. also we know that harvard and yale are the best -- we know they're really, really good. not being on that list is not going to mean that people don't want to go there. those are very good schools. >> i heard from a recruiter last night who talked about the point you brought up. she feels now that companies are looking -- they really don't care where you went to school.
