good to have you. we're following several develops stories for you. as we enter the holiday shopping season, the u.s. could soon face a crippling economic setback, a

freight rail strike. leaders of four railroad unions and management returned to the negotiating table today after members from the largest rail unit rejected a tentative labor deal. if no deal is reached, a strike could happen as soon as december 5. >> vanessa, a lot at stake here. >> reporter: and including the u.s. supply chain 30% of freight moves by rail and when you take one transportation mode out of commission, that is crippling for the supply chain and also impacts inflation. but as you said, the four unions that voted no on this deal are back at the negotiating table today with these rail companies trying to get some sort of deal done in the next two weeks. now, three of the unions have agreed to a december 9 strike date while one union is looking at a december 5 strike date. but this all centers around rank and file members saying that they are unhappy with the lack

of paid sick time in this deal despite record wage increases. here is president jeremy ferguson, head of the rnl la he is union of conductors that voted no on the deal just yesterday. take a listen. >> members aren't necessarily voting on the money issues. it is the quality of life and how they are treated. respect while they are at work. when big corporations cut too deep and they expect everybody else to pick up the pace, it becomes in-toller only. you don't have the family time, you don't have the time to get mental rest from being on the road, being at the away from home terminal, all the issues that we have to deal with when we're keeping america moving 24 hours a day 7 days a week nonstop. >> and there are three possible outcomes here. the two sides could reach an agreement on their own. they could extend negotiating period pushing back the strike dates. or congress could get involved, they could impose a contract or

extend the cooling off period. we have heard from major retailers in just the past two days on this issue and they are calling on policymakers to get involved to avoid, quote, what they are calling self inflicted economic disaster. but remember, guys, if just one union can't come up with a deal before the deadline, all 12 unions will head on strike. it could be a very significant development ahead of the holidays and into next year. >> yeah, and congress has a legal avenue to intervene, but they would like the sides to work it out amongst themselves. and a michigan man has been charged with threatening to kill fbi director christopher wray and a california congressman. >> evan perez is covering this for us. what more can you tell us? >> this is part of the overall threats that you haefr the fbi and homeland security warning a

lot, constantly about, because these are coming not only against members of congress, you saw the recent attack on paul pelosi. and in this case this man is neal walters, from michigan, and he is charged with leaving threats not only in voice mails to a member of congress but also online in the case of the congressman from california, he left a voice mail saying, quote, hey john, you're going to die, john, you're going to die. in the case of christopher wray, he left a comment on a live stream of the director's testimony to congress and he said i will kill you, director wray, you will die, i will kill you in self-defense. it is somebody that according to the court documents is clearly troubled. he had an interaction with local police in which he was holding a handgun and continued to make these threats according to the

prosecutors, they also found that he made threats on facebook as well. and so he is facing these charges now, guys, and as i mentioned, you know, given the fact that you have these threats against not only the speaker of the house representatives, but members all over the country, it is part of what drives the concern that you hear from the fbi and the homeland security department. >> very dangerous time reading some of the posts on facebook that he left online for this congressman. and evan, thank you for the reporting. this afternoon president biden called one of the heros of the attack on the lgbtq night club in colorado. the president offered thanks and support to veteran richard fierro who stopped the gunman with two other. the attacker shot and killed five people before fierro took him down with his own weapon.

>> i lost my kid's boyfriend. i tried. i tried for everybody in there. i still feel badly that some people -- some people didn't go home. and this guy, this guy, i told him you killed my friends, my family was in there. as soon as i got done with that guy and the cop came in, i went across the room and started first aid with my friend who was shot in the chest and the legs and the arms. and i told joanne, stay with me, look me in the eye, stay with me. and i moved her head so she wouldn't see him because he was shot. and she was right there, her husband reaching for her. so i put her hand in his hand so that they could be together. i didn't know if they were going to make it.

this guy, man, this whole thing was a lot. it is a lot for any human, man. he was kicking another human in the head and i told him to do it. >> i've watched that few times and still gets so emotional listening to that pain in his voice. you heard from fierro and he mentioned his daughter's boyfriend who was just 22 years old. and we're also learning about the other lives that were cut short. >> kelly loving was visiting colorado springs from her home in denver. a close friend said that kelly had been a resource for other trans women. and 28-year-old daniel aston was a bar supervisor. and he worked with derrick rump. he also tended bar. and a co-worker said that they both had big hearts, family

members say that ashley paugh also had a huge heart and her 11-year-old daughter was her whole world. last hour colorado attorney general told me that the suspect should face hate crime charges in an acknowledgement of all those impacted by the attack. the slain and those who survived. >> my prosecuting this as a hate rhyme, we are honoring the victims who were victimized because of who they are. and that is something that colorado is committed to protecting everyone's right to live as their best authentic self. so even if there is not an additional sentence consequence, we believe from a message and from honoring the victims, it is important to go forward with hate crimes as well. >> and rosa flores is in colorado springs for us. so i know you spoke with a survivor of the shooting who was right by some of those who consider killed. tell us about that.

>> and he speaks about those intense moments. and like you were just mentioning, emotions are still very raw here. a lot of these survivors are still very much in shock. i spoke to ed sanders in the hospital, in his hospital room, and he described some of those moments, but he said that it all started like a normal day. e7d he said he was ordering a drink at the bar, he could see people dancing, the music was going. and then he says before he got his drink, the shots rang out and he says that he didn't get a good eye at the shooter, but he could see that he was shooting from the waist. he said he remembers two volleys of fire, first he got hit in the back and he didn't even realize that he had been shot. and the second hit him in the leg and he fell down. and he could remember how people

were just helping people. he could hear those around him. he couldn't get up obviously, but he could hear those around him trying to help each other and also he said that he could hear people asking for tourniquets for the people that were there. and he said that officers arrived very soon there after, but he says that he could not be more thankful to those heros that intervened. and what he wanted to tell them is god bless them. >> rosa flores, thank you. governor hochul announced new plans today to fight domestic terrorism and extremism in the state. >> and this is after authorities recently thwarted a planned attack on a new york synagogue. the suspects were caught with a knife, guns and nazi arm band officials said. >> we have the power as individuals, as a government, as

anti-semitic attacks in full force. did he give you any specifics as to what that entails? >> well, thank you for having me on. and when director wray was kind enough to speak with us, he talked about this anti-semitic oig that we're seeing in the country and it is quickly becoming the priority of the fbi. as a former fbi agents, those are not words used lightly. that means that there is a high degree of concern that this head tore rick, these rising anti-semitic thoughts are going to translate into violence. and i hate to say it, we've seen some of this weekend, some of the issues that you described that we've been dealing with as a society. >> and the investment in protection, the security of some of these places that like many synagogues as we've discussed for some time, the risk of attack, balancing the protection with the pre-spvention as we se with the new federal money going

to different groups and the governor of new york says that people convicted of hate crime, they have to undergo machine todayer to prevention. is there any way to know how effective the deradicalization programs and this training is? do we know? >> it is a two part problem. the first one there are monies available for people and i just spoke with several of my colleagues in the nonprofit space with these community members who said what can we do. specifically looking at houses of worship, how do we pardon it, how do we protect ourselves there so that we can gather in safety, which is a terrible thing to have to think about. these are houses of worship where people want to get some kind of relief or practice their religions. and we don't want to make these castles with armed guns. but the money and expertise is available. as far as the deradicalization, this is something that is still in its thnaisant stage.

does it work. because proving it works means nothing has happened, but is that proof enough. so the whole idea to protect ourselves and understand society of this threat growing and identify those threats as quickly as we can. >> and as you know, hate crime is not isolated to one group, to one community as we see sadly with what just unfolded in colorado and lgbtq safe haven as well as the night club. can you talk about what you think some of the best ways to prevent these types of attacks are barring having law enforcement at every single establishment? and the reason i'm asking is because we speak with spokespeople from these communities that say, yes, the vitreal online, the misinformation online, all of that is really bad and leads to violence, but then also point to some of the lfof the legislatio

specifically lgbtq legislation and laws, hundreds out there that have been proposed. they say it also leads to this type of hate. what do you make of that? >> i think that we're seeing it grow again, this growing rhetoric in the social media platforms who have to maintain some responsibility for this because they are amplify going these messages. and it is not good enough to say it is too difficult to police it. but i get tired of saying my hearts and prayers are going out to these people because it is just another tragedy that we've seen. and people like mr. fierrovente more horrific, average citizens just going out for a night out and they had to instantly turn into combat veterans attacking and assaulting somebody to prevent them from killing people and providing first aid to strangers on the ground.

>> and elie honig is with us. they have been seeking the tax returns for two years now. how soon can they get a hold of them now with this ruling? >> well, it is over, first of all. those tax returns are now going over to the house ways and means committee as soon as they can obtain them and there is no further recourse. the supreme court said it will not interfere with the ruling. and there is a federal law that says if the house ways and means committee files a request with the irs for an individual's tax return, then the irs, quote, shall furnish those returns. and trump took it to the district court, and they said no, shall furnish means shall furnish. and ways and means agreed. the committee does get the returns and today supreme court said we're not taking this case. and so the ruling stands and

ways and means gets those tax returns now. >> let's turn to the fight over the special master. the doj is arguing that it is improper for the special master to be involved. but they have been working on the documents seized from mar-a-lago for months now. what happens if the court determines, yes, it was improper and the work is already done? >> well, first thing i believe donald trump will do is exactly what he did on the tax returns case is go to the supreme court and say i'd like you to intervene which will drag out the time line. but you're right, there is a practical side of this and a legal side of this. as a practical matter, the special master may finish by the time the legal dispute is finished. but regardless of the pract practicality, they have gone to the courts and said this strict court judge in ordering the special master overstepped her legal authority.

>> and it was interesting in the doj filing yesterday, the doj made clear that the newly appointed special counsel jack smith had reviewed and approved their arguments in that case. so what does that tell you overall about how quickly he has come up to speed with these cases given that he was just appointed on friday? >> yeah, that jumped out to me as well. we're talking two business days after the appointment of jack smith and doj is saying he agrees with these arguments and so that tells me that jack smith understands the need to move quickly here to not waste anytime and to get up to speed as quickly as possible. it doesn't mean that -- he is not super human, so he can't be completely up to speed this quickly, but he learned what he needed to know in order to sign off on this and this does tell me that jack smith intends to be true to his word that he will move quickly here.

>> after months of fighting it, senator lindsey graham testified before the special grand jury in georgia investigating donald trump's attempts to overturn the election results. remind everyone of the value his testimony brings to this grand jury. >> yeah, lindsey graham we know was involved in coordinating with the trump campaign in interacting with and pressuring state and local officials in georgia. keep in mind lindsey graham is from south carolina. he received a subpoena, he went to the courts, argued he should not have to testify but the courts said you have to testify except about legislative activity. so he did have to testify about virtually everything that he did. >> elie honig, thank you. more news just into cnn, three employees of the camden county georgia sheriff's office have been arrested in connection to the beating of a detainee.

>> and ryan young is with us now. get us up to speed. >> yeah, breaking details. when you think about it almost a week and a half ago five members of this unit was disciplined. and at this point three have been arrested. and i want to warn our viewers, the video you are about to see is quite disturbing. but you see what takes place in this facility that has so many people asking questions. take a listen to the screams coming from one of those jail cells. [ screams ] [ bleep ] this is late september. jared hobbs, 41, he was in that facility and at some point there was a scuffle and you can see several members around him and they are punching him several different times.

now, at some point this video got released and the lawyers for this man say that he was in some sort of distress. and the employees took it way too far. and once this video was released, the georgia bureau of investigation started doing an investigation to n. to exactly what happened inside the cell. we now know that they have moved to arrest three of these employees. in the next 25 minutes or so, we're supposed to learn more information from the gbi. but this is the video that so many people found disturbing of showing these three as they call them employees at this point reacting inside that cell. so so many questions that we hope to get answered from investigators. but you can understand why people in the community were trying to figure out, one, why did it take so long for this to come to light and what was the investigation going to lead to. now we know three members have been arrested who were inside that jail cell at that moment. and so hopefully we'll get more information the next 30 minutes. but you can clearly see this was

major news for those saddled with student debt. president biden is going to extend the freeze on paying back student loans. >> you will recall biden has a plan to forgive millions, but the relief program has yet to be executed since it is now tied up in the courts. le let's go to jeremy diamond with more.

>> reporter: the plan had been approved for about 16 million americans. and today president biden has decided to extend the repayment moratorium, that freeze on all student loan payments for all federal student loan debt holders while those court challenges continue to play out. and that moratorium was set to expire at the end of this year. here is the president explaining his decision. >> we're not going to back down in our fight to give families breathing room. that is why the department of justice is asking the supreme court of the united states to rule on the case. but it isn't fair to have tens of millions eligible for relief to resume their student debt payments while the court consider the lawsuit. for that reason the secretary of education is extending the pause while we seek relief from the courts but no later than june 30, 2023. >> he is, quote, completely confident that this student debt relief forgiveness program is

wearing a rainbow shirt in support of the lgbtq community. >> i was told explicitly you need to take off your spirit. that is a political statement. and you cannot enter. they forcefully took my phone out of my hands for 30 minutes. they made me stand in front of a cctv camera, they continued to try to get me to take off my shirt. they stood above me as i sat and angrily yelled at me. only after about 30 minutes did a commander come down and let me through wearing my shirt and he apologized as did fifa. >> joining us now is a u.s. goalkeeper, two thiem fwtime go medalist and world cup champion. as one of the first out lgbtq players, what is your take on what you just heard and what if any responsibility does fifa

hold here? >> i'm very upset actually. i'm astonished. i know grant very well and i know that he is an ally for soccer, for inclusion, for the beautiful game and that is alarming what just happened to him. i'm sure he was scared. because he is in a foreign country and he doesn't know what will happen. i mean, i can't imagine -- i can't imagine having to go through that. and it bothers me a lot because i know him. and so it is very unsettling, very unsettling. and i blame feifa and qatar as well. but mostly fifa. when you choose the country, you choose the consequences. and guqatar has laws on the boo. homosexuality is illegal with fines and jail time up to three years. and so when you choose a country like qatar to hold a world cup,

you will have situations like this occur. and the pride flag is the universal flag for inclusion for the gay community, for the lgbtq community, and it is known the worldwide. and they were stopping him because he had the flag and pride colors on and it is stiktst strictly homophobic and upsetting with me. >> and you aare critical of fif and so is secretary of state antony blinken saying that they threatened players who wear an arm band that supports inclusion. here is the secretary of state. let's listen to him. >> it is always concerning from my perspective when we see any restrictions on freedom of expression, especially so when the expression is for diversity. and for inclusion. and in my judgment at least, no one on a football pitch should be forced to choose between supporting these values and

playing for their team. >> yellow card is a warning, too many of those a player has to leave the field. what is your take on this and how it impacts the game? >> i am so -- i mean, i've been around fifa for decades. and they have been known to pull a lot of shenanigans in the past. but this situation is astonishing to me. to threaten to yellow card captains of teams from wearing an am barm band and that is the sanction there is the most damning for the player. if you get like you said, if you get two yellow cards, are basically out of the next game. and because yellow card accumulation is a subjective ruling, you could be out of the tournament completely. they could rule that you have broken the laws of fifa by wearing an arm band and essentially eliminate captains

from their games and their teams for the rest of the world cup. so the sanction, the threat, is a big one and very, very, you know, heavy demand on players for just like you said just trying to show allegiance and be, you know, included and to just, you know, wear these colors not only for their country but for the world. and to show that they are in alignment with inclusion and diversity. it is really -- you know, i heard of fifa doing a lot of things. like i said, you know, stresses and all these different bribes that they have taken in the past. but this is the worst that i've seen so far that they have pulled by threatening players with yellow cards and essentially exclusion from the world cup that they have worked so hard, so very hard for so many years to get to. >> so let me ask you another question here in the limited

amount of time we have. are you more excited about team usa's prospects in this world cup or are you more shocked by what happened to team argentina and lionel messi earlier this morning? >> oh, my goodness. you know, i love messi. he is a champion in so many ways. and he is that player like in american football, that quarterback that you just want to win that super bowl just once, right? i mean, they have won everything but that. i am shocked about that. actually that is more shocking to me argentina losing to saudi arabia than usa tying yesterday because the usa had that game. and it is really unfortunate because if you win your first game, you have an 84% chance of getting through to the knockout phase. right now that chance is down to 30%. and so it is unfortunate, but i tell you, waking up this morning and hearing that messi's team had lost, that was astonishing.
