tonight, he doesn't believe the former president is a racist, or a bigot, although it does it make you wonder about the company that he is keeping. given the statements of condemnation that you just heard from president trump. a white nationalist, a holocaust denier, and the rapper formerly known as, or now known as yay, tweeted that he's going to go death con three on jewish people. not sure that qualifies for someone to be called bigoted, but we'll wait and see i guess. for that from mike president. pence and the shooter that killed ten people, and the super mike it in the mostly black neighborhood in buffalo, pleaded guilty today. some of the men and women who were killed, said that they think that he was treated

president pence saying something. i wish he would have also said something as strong in charlottesville, when you had neo-nazis marching through the streets. also, saying antisemitic things. so the fact that you have somebody who says that they are running for president in 2024, who was the former leader of this country, sitting down with somebody like yay, who is problematic on very different, but also ye has no political analysis here. and an antisemite is troubling and we need to pay attention to it, because you cannot ignore this type of behavior. it allows it to continue to fester. >> what's new about this

tonight is that the former vice president has spoken about this very issue. you are right, he has been infamously mute on a number of issues. still, never going all the way to distance himself completely from donald trump. the question is why. because, i, mean it is likely that he has probably aspirations to be president of the united states. whether that's a viable aspiration? we do not know. but he is now coming around,, alex and you have other top republicans who are condemning his behavior. and actually, having an open conversation about, in fact, here is senator and corey ernst talking about these issues. senator said it is a bad idea to every level, i don't know who is advising him on the staff. and i hope whoever it was got fired. cory saying that it's, bad there's nothing about it. joni ernst thing it's difficult, that's all i'm saying about. it other saying it's difficult to expresses those views.

interesting and very deliberate choice by pence. it advances the conversation further. i don't think pence is eager for a long, drawn out fight with donald trump. but it does mean that it's not necessarily quite so easy to just say your piece and move, on and hope that the media cycle moves on. soon enough. to i think more than anything though, this is an indication of at least, a sense among republicans, and that is a pretty decent cross action of the party, you're not just talking about the never trum p folks are the ones who voted for impeachment once or twice. he really is a politically weekend fourth. why are you hearing a joni

should be asking is, is sitting something about -- the answer on that is emphatically, yes. he's at the qualifying act to sit with someone with those views. you should not be able to be the head of a major political party, or president of the united states, and that should be the question that they are asking. and quite frankly, i would be sitting here rhetorically and i would be asking myself that question as an elected member, and the leader of the party. and i say in faculty, he's not qualified to be president. >> and i say for the long list of things that people try to disqualify trump on the basis of. it's pretty, long you see senator jamie, very intent on his qualification of being tied to january six for example. but the notion, here and i don't want to give him necessarily an olive branch in, this but his statements have been, president trump, has been, listen i don't always know who i'm sitting with. kanye brought the people with, him which given security questions about the people you don't know who's coming around, the former president the united states. i wonder if the obamas or clinton, or jimmy carter for that like our, saying i don't, know who has no with me this days, that's a cop out. but that's with the statement as. ben >> yeah, but he does cop outside the time.

>> well, the gunman in that horrific, races shooting at a buffalo groceries story that happen in may, pleading guilty to the state charges today, 19 -year-old peyton pleading guilty to one count of domestic terrorism, motivated by hate, ten counts of first-degree murder. three counts of attempted

murder, and a weapons possession charge. his plea now ensures that there will be no state level trial, but he does still face federal charges, which is obviously already pleaded not guilty to at this point. now some of the victims family members expressed some frustration with the outcome today, calling out the system that we have for being overly sympathetic towards the gunman. >> his voice, showed me, made me feel sick. this country is inherently violent, it is racist, and his voice show that to me today, because he did not care, he did not even, you couldn't hear him and his voice, he was just a robot. >> so in court today, a lot of anger, anger was over my body, i was angry how the judge was constantly talking to this gentlemen like he was a little, priebus and six great boy, i was angry that they didn't have to look at the faces of the

eisen is joining us as well, norm when you look at this, again, keep emphasizing, state charges versus federal charges. we know full well of course that federal can often be that backstab, first sometimes failed state charges. but just the idea of the anger and the frustration of the families, you have been a defense council, and a prosecutor, we've been in this courtroom cinci the frustrations of so many. what is your reaction? >> laura, i've worked bet penalty cases defending those who are accused of these heinous crimes. and my first reaction is not as a lawyer, it's a human, one and my heart is breaking for these families, there is nothing that can bring back the precious lives that were lost, or ever fully heal those scars, that's a scar that never heals. i do think that killing, him

for the terrible things that he, did this is not a case where this is a crazy man. this is the stone cold killer, he made up his mind and he did it on races grounds, still, life in prison, is a severe penalty for that, killing him is not going to heal those wounds, those victims, the families will have a chance to impair in court and talk, and i think as a nation, i returned to the question of, he legally bought a gun, he illegally modified it, we need to make it much more difficult, if you look at the statistics, the last thing i'll say, if you look at the statistics internationally, or even in the united states where it's easier, and more difficult to get guns to do these kinds of modifications, where it's more difficult, there are many fewer mass killings, we must address this, as a society to prevent this horrible pain that we are

seeing in buffalo. >> and ashley, thinking about this, norm is right, the human element of this, the pain, and this is on the backdrop of how many mass shootings occurred even since this happened in may? it is horrific that we are still, i've reported on so many, as we all have in our time, but he is right that there will be a time for a sentencing opportunity where the victims impacts statements can talk, and i found interesting part of the frustration of the families was that they wanted to be able, through a trial, to have information come out, knowing that there is a spotlight on what has happened and wanting to address what all of the evidence and just thematically that he sought out this particular community based on demographics and based on the intersection of race and income, and geography. there was an intersectional story here. >> yeah, i mean, i am just like norm and i'm sure everyone, here in everyone watching. i go back to that day when we heard about the shooting in buffalo, and as a black american, it hit differently. there are many shootings, but this one hit home, and you never want to tell a victims family how they should feel like justice should be, served

because i think you can never fully empathize until year in somebody's shoes, and i am not a supporter of the death penalty, but that doesn't mean that that shouldn't be what those, if that's what the family won, it should be able to have that, but i also think that what you heard was the racial implication that they felt that this system was unjust. that they felt like if this was a black shooter, that he might not have had even the chance to plead guilty, because he would've been dead. if they might have had more transparency, it sounds like they are just learning things today, and they need that transparency foreclosure, to norms point, i do think that

there are some measures that we can take around assault weapons. but also, there are some things on monitoring without invading privacy, about chat rooms that people were in on social media platforms, where he was quickly early espousing some of this hate, and his intent, and that should be addressed as well. >> let's be clear on one, thing and again, i agree with you i would not dare to suppose i knew what justice look like for a family member. at the state level in new york, the death penalty was not an option, it was life without possibility of parole. but they are federal charges could possibly bring that about. there is a moratorium right now on death penalty, cases actually attorney general merrick garland talked about not being support of the death following -- but i can't help but look at these cases kevin, on the backdrop of, we see what happens when families don't believe that, the trial is not taken, place there is not the semblance of justice in some parts, meanwhile here in washington d. c., we've got the oath keepers trial is going on, and for many it's clear as mud, maybe as day depending upon your view points about the evidence before the jury, in

washington d. c. the jury is still deliberating, and many look at this and say, well what could be taking so long, i thought they were all these discussions about an expedited result. what do you make of the fact that the oath keepers trial, as of right now, we are on verdict watch, has not yet rendered a verdict? >> well, without going into any of the details of, that because there are a lot of details involved i evidence involved. i think one of the big challenges here about both of these cases, is that we oftentimes have them driven on a public policy conversation, or a political conversation, or a larger sort of conversation in society. they are often time driven just by events, and so many of the questions and problems that we face in the day-to-day, and management of the judicial system, and the legal system, things like equity, things like fairness, so much of that as a conversation that can't take place just around one event. we remember buffalo happened, then uvalde happen, then we finally saw some policy action. but the conversations, and the address, addressing these issues go to a very deeply rooted problems in the system. and in society. those conversations have to be ongoing. beyond any trial, beyond any one event, it becomes newsworthy that everybody that turns the cameras on and reporters show up. that conversation probably has to be very much more methodical, and very much more systemic. >> we are very reactive nation when it comes to policy, that's one of the complaints. we often hear about discussions about gun control, when a mass shooting occurs. not the sustained conversation,

but before we got a break. i'm curious norm, from your perspective, are you surprised from having not yet gotten the verdict from the oath keepers trial? >> no, it's two days. they had one before the holiday now they've had a second day, they sent a note out of the jury. >> it wasn't a good note. the prosecution i'll tell you that. >> it wasn't a terrible notes, they wanted to understand what prevent hinder delay, as you, know in this case, seditious conspiracy. has to be a agreement to prevent the delay of any execution of the united states by. force and they wanted to understand how that related to laws governing the transfer of presidential power. and, judge mehta, when he was a, lawyer we practice together in the firm, judge made us sent back and instruction how the two interacted, that they're gonna have to find an agreement to interfere with the transfer of power by force, i think there's a lot of evidence of that, i represent the d. c. ag in a civil case against these

malicious. i know these are not easy, cases and i appreciate that the jury is taking their time, but come on, we tried a bunch of cases, the jury was out longer than two days. the jury sent multiple notes and then they convicted in the end. so i think the evidence is strong. >> my jury is really liked me, and justice, so i gotta tell you. >> -- >> i'm getting. it was always on a reasonable doubt. laura coats. >> despite not being as likable as laura coats, they still root for me. >> i will say, prosecutors respected, if i have a jury that's asking questions about clarifying, and definition that was the meat of my case. i'm worried about what i may have faltered, on but we will see, and everyone is extraordinarily likable, in court and out. there we go. look at the smile. >> i hope my family is watching. >> there, not my kids, no one watches me either in my family, but not personal, look, we are eight days away from what everyone is watching, that is a critical senate runoff in the state of georgia. and now we're learning that the former president, donald, trump he is not gonna appear in a campaign for herschel walker in georgia. plus, lava is flowing down the largest active volcano in the

far from a to tell brian kemp how to win an election in georgia. it's a very convincing victory, but what we heard him say the ad is not quite true. the fact that it's a turnout election, the fact that it's a bizarre sideshow, up there sideshow. about what brian kemp and raphael warnock showed in the midterm elections is that that is a persuasion game also in georgia. right? that you have many thousands of people turned out to vote in this november election and cast their ballot for a republican governor and for a democratic senator, and what herschel walker badly needs to happen in the runoff, is that a lot of those people who put their ballots, either switch back to just voting straight ticket republican, meaning only for him this time or they just stay home, and not that many people show up. it doesn't really look like from the early vote that folks just staying home is a great bet on this land, but you don't, you know, what you see in that ad is herschel walker trying to getting to the republicans who

>> there's a really rare events happening in the white tonight, you've got dueling, dueling irruption from two active volcanoes on the big island. for the first time in nearly 40 years, mauna loa, the world's largest active volcano is sending molten hot lava streaming outside of the mountain. it began late sunday night, and right now there is lava, and what is known as their northeast riff son, according to officials. that have little effect to residents, in the time being and i hope that remains the case. and also, nearby, is the ultimate volcano erupting nearly 20 miles away, and in 2018, it destroyed more than 700 homes.

joining us now, current-elect and lieutenant governor josh green. you've got both the titles right now. it's good to see, but we're learning a lot about what is happening down in hawaii right now, i mean, right now i'm wondering, is there a big risk to the residents of the areas, i mean to erupting volcanoes? it's crazy. >> it is crazy, but there is not a threat to our people right now, thank goodness. it's interesting, this is the area where i took care of patients as a physician when i first came to hawaii, and we are a vulnerable community out here in hawaii. we've had so many different storms and disasters, you described the other volcano erupting in 2018.

and now, mauna loa. which it has been a long time, it's been 40 years since mauna loa ruptured. but because going to the northeast rough, so that is a better way for the lava flow. it goes into a flatter, area the lava becomes quite viscus, and it slows down before going near our people. which would be he low, he low is the town on the big island and it's where my in laws live and it's just a week away and we hope that it won't make it out of town. >> wow, the idea that that would be like the prospects, feeling about the time, but as and -- although the lava might not present this urgent threat, i'm

wondering about the air quality posed by the volcanic ash in the air. i understand it's pretty, minimal but that could have impact on those with respiratory conditions, and might create them. is that right? >> that is true, there is more hot air coming out of the georgia election -- but i'll tell you it's not without consequence here, we do have a thing called hague. that's volcanic smog, and that has peoples lugs. and people are twice likely to have aspirations are copd when the volcanoes go, off and also there is a thing called police glass, or police hair which is shards of volcanic ash that the carbon forms into a glass like fiber and people breed that in

but right now it is been very, minimal it is been safe, and we are encouraging people to wear masks if they are concerned, and monitoring it for equality, so there's no where is traveling to hawaii. it's a big island. but it's a concern always, we worry about these things. >> but so i wonder how you prepare, obviously with certain national exhibitors for a hurricane, were wondering what happens there. is there a way to prepare? because i think from the u.s. geological survey, has reported earlier in the summer that is been some seismic activity at least near mauna loa.

is there a way to prepare or is there really a wait and see approach that must be taken? >> we do monitor things constantly, there were a lot of earthquakes so we knew it was coming, we stratified, risk we do a lot of science here in hawaii, as you, saw with covid. u.s.. science we have good results, with the volcanoes we use silent, we get people prepared. if the lava had actually broken through to the other side away from the northeast, into the southwest. it's more worrisome because you can't predict where these lava flows will go. and then it goes downhill really quickly towards kona and -- , which are other areas of the big island. that would be more disconcerting. also, whenever we have earthquakes we have some concern about the shelf moving, that could cause things like a tsunami. if the shelf moves into the ocean. i know a lot of this freaks people on the mainland, out but these are very rare instances. we follow them carefully with our geology folks, and we are okay. but we appreciate all the concern because everyone loves, hawaii and these are pretty unusual, things you don't see this in the mainland. >> you certainly do not, we're thinking of everyone out, there and it's hard not to fall in love with a place like hawaii, so we wish you the best out there, as well lieutenant governor, governor, electoral screen thanks for taking the time to be here. we'll follow along. >> thanks for wearing about us. we care about you guys too. >> thank you. well, jay leno everyone. he is returning to the stage and he is cracking some jokes. although, probably not good as the governor elected about georgia. but we'll give them credit as well. the comedian is back at, it after some serious burns from a gasoline fire? so what did he find funny about? it will tell you next!
