top the hour this friday morning. i'm jim sciutto. >> and i'm bianna golodryga. we're following several stories. happening right now, the january 6 committee holding a key meeting to review the final report and to discuss potential criminal referrals of former president trump and republican lawmakers who refuse to cooperate with their subpoenas. plus crisis averted. now that the senate has passed legislation to avert a railroad shutdowns, the president will sign that legislation into law. we'll bring that moment to you live. and also expect the president to comment, however after a stronger than expected november jobs report. the nation added some 260,000 new jobs even as the federal reserve continues to raise interest rates intended to cool inflation. but first we begin with the january 6 committee happening today. cnn's evan perez joining me now. big question, do we expect them

to decide on criminal referrals and do we have any sense how that goes. >> they've been talking for months that they do expect they're going to do some criminal referrals. they know that the justice department doesn't need the referrals but think members there who believe that they wanted to make sure that people who they believe lied to them, obstructed the investigation and tried to intim date witnesses, that this is heard. and the other thing they want to tackle is lawmakers who refused to cooperate with the subpoenas that the committee issued. because there were obviously a number of members who were deeply involved in the former president's efforts to overturn the election. of course, the majority of the incoming leaders, incoming speaking, rather, kevin mccarthy and jim jordan who is a powerful chairman, and scott perry and andy bigs and mo brooks. these are all people that they're looking at.

and the consequences, there is a number of them that they're going to study, including a referral to the ethics committee, holding them perhaps in contempt, running out of time to do that and they could choose to do nothing about it. they are running out of time to do anything in the next couple of weeks. >> and evan, just this morning, pat cipollone was seen entering the grand jury area in the district courthouse in washington. this follows your reporting that a judge ordered him and his deputy to testify. there we see the video. >> yeah, this is a -- another losing battle for the former president. he's been trying to claim executive executive privilege and attorney client privilege to prevent the testimony from some of the former top aides. the two top lawyers in the form he trump white house and they have appeared back in september before the grand jury and they declined to answer certain questions because of the former

president's claim of executive privilege and fought out behind the scenes in a secret court proceeding and the judge rule in the recent days that they had to come back and answer additional questions and very key here, the former president has the option to -- to appeal that, but as we've seen in other cases, it appears that they couldn't get their stuff together in time to get that appeal and you could see the justice department bringing in pat cipollone to do that testimony today. >> big day today. i imagine a criminal referral for an incoming speaker of the house would be remarkable. evan perez, thank you so much for your reporting. so joining us now to discuss the significance of all of this, john dean, served as white house counsel for president nixon. mr. dean, good to have you on this morning. thank you so much. >> a pleasure. also a former committee counsel at the house judiciary committee. >> indeed. and also a former star witness in another investigation of a president. if we could begin first on the

news about the white house counsel, given your own past, the pat cipollone and pit rick philbin will have to testify to the d.c. grand jury. they are rejected the former president's wide claim of executive privilege and attorney/client privilege. they were in the room at the key moments, how significant could they testimony be. >> it could be very significant. they have a lot of knowledge. they have been before the grand jury before. the grand jury that they are returning to. they invoked some sort of privilege. it is suspected it was executive privilege. grand jury proceedings are not spread on the record but that is what the assumption is. and they've been told executive privilege is not going to apply here. the current president is not going to invoke it. the prior president doesn't have the authority to invoke it. so they have to give full and complete testimony. so that is where they were headed this morning. >> john, there had been some frustration, we know from reporting from among democrats

an the administration itself as to the pace that merrick garland and the and the doj were pursuing these cases. now we have a special counsel and from everything that we've heard, he's very much up to speed and we're hearing significant updates to these investigations. how soon, in your view, do you think we could have a potential indictment? >> well i think in the mar-a-lago case, the abuse of documents case, that could be sooner rather than the other january 6 case. it is a pretty plain vanilla case. the government has prosecuted these cases for years. and they're just now are saying that a president isn't above the law. he is subject to the same restrictions that everybody else is been prosecuted for misuse of classified information. and that the the way it should be. so, i think that could be even before the end of the year, it depends upon how much they need to put before the grand jury as

to his aides and people who could testify as to his state of mind. so of the actions are known, some are not known. so, somewhere between the end of the year and next year i think that is going to happen. >> >> you look at history here, even nixon, when faced with possibility of impeachment and criminal activity. he resigned. former president trump, he has announced he's running for president again in the midst of multiple investigations here. set aside the politics for a moment. but in terms of history here, the possibility of indicting a standing candidate for the presidency of the united states. what will the reaction be in this country? how significant of a moment might that be, if it happens. >> well i think it is a big deal with his base and his most avid supporters. but you know, jim, as a result of all of the litigation he is

bringing, trying to stall things and losing those cases, the public is getting aware where he's engaged in misbehavior, even his base can't defend some of his action, and courts are telling the people, this is a president who is breaking the law. when the 11th circuit ruled yesterday, where he was using it as a stall tactic, that is going to play out in the public's mind, well he has to be like everybody else. like the court said. they're not going to write special rules. so i think that they're getting braced and it is less likely to be chaos that he wants to provoke. he put out a message to his base saying this is all terrible, it is a weaponized, it is a weapon of justice, this is nothing unusual. this is standard operating procedure. >> john, before we let you go, the january 6 committee is wrapping up its investigation and a report is due imminently before the end of the year. are you concerned at all that their finding could be

overshadowed that we have a republican leadership into the house at the start of the year and kevin mccarthy promising to start investigation into the committee itself, investigating the january 6 insurrection. >> i don't think there work will be forgotten. i was looking across my office at my bookshelf and noticed the ken starr report is still sitting up there very prominently on my shelf and i have drawn from it from time to time to look at it. and this is a historical document they're preparing. it will have a big impact. it will have a short-term and long-term impact and i think it will not be for gotten or overshadowed. >> john dean, thank you. >> thank you. well this week's explosive volcano eruption in hawaii has led to concerns that the lava flows could threaten the main island's main -- the big highway. >> it is literally explosive. just look at pictures there. remarkable. opening up the earth. local officials are working on a

plan to shut down the roadway if the lava gets too close. close enough to become dangerous. david culver is live from hawaii now. david, first, i mean, we could see the light behind you, maybe you could describe to folks just what you're witnessing there and what it means for the people who live around there? >> reporter: i've been trying to find the words to give the perfect description. it is striking. it really is. we were landing in the dark of night, made the drive on the main highway that you referenced that is being threatened by this potential lava flow that could come into it, and as soon as we turned the curve and saw that glow behind me, i mean, you're without words. you can't really describe it. but i will step out of the way and greg and maybe we shut off the light here and we're going to give you a better focus of this, jim and bianna. and you could see it for yourself. this is what folks are coming along this side of the road off of saddle road, the main thorough fair to just get a

glimpse of and people will come over and take photos and stand in silence and let it seep in, the majesty of it all. and there is concern. and officials held a press conference with the latest update and while the slow of the lava flow is something that they're happy about, they still don't know where this is going to go and they say it could pick up speed. and it is headed right now in the direction, although a few miles away from the main thorough fair it will be a nightmare for the folks that live on this island. so they are hoping this doesn't get to that. they are monitoring that and it is moving slow enough that they feel like they have a day or two heads up should it threaten the roadway. and if we could push in and if we pan up, you could see the smoke. that is not smoke. that is what the officials will warn. it looks like it. but that is actually acid gas. so there is concern for folks who are respiratory illnesses

. any minute now president biden will sign the new legislation to avoid a nationwide railway strike at the white house. they're be making some remarks about that and the new jobs report this morning. we'll bring that to you live. and later today the president will travel to boston to raise money for georgia's incumbent senator raphael warnock ahead of

the election against republican herschel walker. >> while in boston, he will meet with prince william and princess kate in the u.s. for a charity event. m.j. lee is at the white house. a lot going on today. >> reporter: a whole bunch of things on president biden's calendar today beginning any minute now with the bill signing you mentioned to avert that rail strike. and in those remarks we do expect him to mention and talk about this new jobs report that came out this morning. but soon after that, he is going to depart for boston where he has a full day. first of all, he's going to be meeting with the prince of wales. he isn't going to be meeting with the princess of wales, we're told, for any royal fans. but it is going to be because they are in town to be promoting this big climate change initiative and that obviously is a big issue for the president so i would expect that that is going to be a topic that comes up in this meeting. and then his second stop is a phone bank with union workers before he goes to headline a

dscc fundraiser where the funds go toward helping raphael warnock as the white house and democrats are closely watching this georgia runoff happening next week. they're keeping control of the senate but they would prefer to have 51 seats over 50. >> so president obama campaigning for warnock yesterday on the ground. and the president is proposing changes for future democratic primaries, elevating the state of south carolina which famously helped elevate him. what more could you tell us about that? >> reporter: yeah, this is a big, big 2024 development. you know, think about how much time we have spent in iowa, covering iowa, as the first state in the presidential primary and that all could change very soon. what the president has proposed to the dnc is a change in the calendar where iowa is no longer first. what he wants to see is first up south carolina, followed by new

hampshire, and then nevada second and then georgia which is obviously a state that we have talked about so much in recent years. you know, the choice of south carolina is so significant and personal for this president because this is the state where he semly turned things around in his 2020 campaign. this was sort of his launching pad in the beginning of him being able to clinch the nomination in his presidential campaign. and then it also is a recognition of the diversifying democratic base. there has been such a robust discussion in recent years about whether iowa really makes sense given that it is a largely white state and democrats are consider it very important to appeal to people of color, voters of diverse backgrounds. so that is what is at play here. and if it all goes through and we do expect that it will, because the president endorsing this plan is very important, it is going to be a huge, huge shake-up in the way that we cover the presidential primary. >> m.j. lee, that is a big

schedule change. that would be remarkable. think of the all of the years we focus so much on iowa and new hampshire. we'll see where it goes. thank you so much. all right. if you happen to go to the twitter account for kanye west today, this is what you'll see. twitter suspended the rapper's account this morning after elon musk said that he violated twitter's rules on inciting violence. this comes after just a remarkably disturbing appearance on the alex jones show in which kanye west said, quote, he likes hitler. he also posted an offensive altered image of a swastika wrapped inside of the star of david. we're not going to show that on cnn. this appears to be last straw for house republicans. they finally removed this tweet which had been up from two months ago praising kanye, elon and trump. i want to speak now to drew

harwell for more on this, a technology reporter for "the washington post." good to have you on. >> thank you. >> so west had just been invited back and now he's gone. understandably. i mean, in a -- we've seen a lot of offensive things said on twitter and elsewhere but to have someone openly praise hitler in an interview and then post a swastika inside of the star of david, i can't imagine what could cross the line further. tell us the significance of elon musk seeing the light in effect on this and banning kanye west? >> yeah, you know, elon brought kanye back to twitter a couple of months ago. kanye had posted that he wanted to bring death con three to jewish people. he was suspended for that. and elon brought him back, saying, i talked to him and i texted him specifically, i think he's changed his mind. and of course nothing changed. no kanye, double downed and said stuff yesterday that was

shameful really. that should be slamful for anybody to say in polite society. so elon has been saying he wanted to support free speech and that is why he's tearing down all of the rules at twitter and these are exactly the rules why -- why we have these rules. elon can't text every nazi on twitter and ask them nicely to follow the guidelines. so this is just kind of a sick sort of mainstreaming of extremism that you're seeing from one of our biggest celebrities. >> is twitter's policy on hateful conduct at all clear or definable at this point? because kanye west already said a whole host of hateful things and put back on twitter and that one went too far but elon musk has replatformed a host of people accused of inciting violence and sharing offensive content prior, is it an ad hoc policy, is there anything you that could discern from musk's decision so far that make it clear what the policy is?

>> yeah, at this point partly sunny whatever elan wants it to be. twitter system was never perfect. but they did have a rule book for what could be posted online, that is why so many accounts including former president trump's were suspended. elon came on in this bull in the china shop way and said out with all of the old rules, and in the last couple of days elon's ideas have been tested because kenye have been flouting every rule and with these nazi views and elon was trying to almost self-righteous way say this is not very loving, kanye, could we be a little more following the rules. but at this point, right now, with the suspension last night, elon has effectively said, no incitement of violence and what you have to post has to be loving. this is how messy this set of rules is. and twitter under elon is following the path that every

police in idaho are trying to clear up confusion about the killing of four college students after a series of conflicting statements. investigators now say there may have been a sixth person living at that address but even that is not confirmed. authorities are still scrambling tor clues after weeks with no arrests and no motive. >> and the confusion frustrating

for all involved. the four students you may remember were founded stabbed to death in a shared off campus home. it shocked that small college community and the country. families and many in the area are growing frustrated with the handling of the case and fearful with no suspect at this point. well new this morning, police in north carolina have released chilly new body cam video from a plas shooting in october. that is where a 15-year-old killed five people and injured two others while walking through a neighborhood in the raleigh area. >> investigators believe the gunman who is hospitalized killed his older brother first before going on the shooting rampage. cnn's ryan young has been folging this for us. so what more are you learning now? this is back in october. >> reporter: good morning. we walked through the neighborhood shortly after the shooting and people were scare and confused about exactly what happened in those minutes when the shooting started. this video gives us some sort of insight into what police were dealing with and you could hear how calm officers are even

police still haven't shared with us, that there is some information about a motive or something that sparked this because right now there are so many lack of answers that leaves so many questions that leaves united states kind of baffled about where this had to happen. >> that whole community just waiting for some sort of closure, some more information in this investigation. ryan young, thank you. all right, this next story, i mean, an incredible story of survival. when we're hearing for the first time from the man rescued by the coast guard after he fell off a cruise ship and somehow managed to survive for hours in the water. this is the video of the 28-year-old james michael grimes while he was still in the water. just bobbing there. he spent more than 15 hours treading water after falling overboard. he told abc news, he still doesn't know how he went over the side. >> did you have a few drinks? >> i had during the day and i had actually did an air guitar solo and there was a competition that they were doing and i had won it so i won a free drink.

this was a phase one study which is the earl ciest study that looks at safety and is there an immune response. and so researchers did was to 46 healthy adult volunteers and divided them up, about 38 of them -- about 18 in one group and 18 no another group and 12 did not and even of the groups that got the dose, one group got boosted and they looked to see what the immune response was and in 97% they did see an immune response and that is what we call broad neutralizing antibody precursors. the reason this is important is because these are the types of antibodies that we need to fight a virus like hiv which has a lot of different global vasriants. so we think it will help with hiv and other viruss that we've had trouble developing a vaccine for. as side as effects. there were no adverse serious
