a good evening everyone, this is cnn tonight. it is almost election night, again. we are just four days away from the final election of the midterm. raphael warnock against republican challenger, herschel walker. early voters have turned out in droves. in record numbers. now, democrats are holding their breath until tuesday. they are waiting to see if they will win a 51 seat majority. plus, two of president trump's white house lawyers testifying today to a federal grand jury in the criminal investigation of efforts to extract the peaceful transfer of power. they testified for more than five hours. we do not know what they said behind closed doors. but, we can all agree, five hours is a lot of time to answer a lot of questions. he wonder how many times you

can really have a conversation about pleading the fifth and still go five hours. we are waiting to see what actually happened there. we know that the biggest moment get for the world cup at least for team usa is yet to come as the underdogs take on the netherlands tomorrow. we will talk to someone who knows all about being a world cup champion. one of the biggest stars ever on the women's team. brandi chastain is here and joining us soon. a lot to talk about tonight. here with me tonight is our political gators, ashley allison and scott jennings. cnn political analyst, alex burns. i to have you all here on a friday night. you are probably experiencing some deja vu. it is election night, or election season for georgia in a runoff again for being a balance of power issue. you would think that people would say we have been here before. we have seen this movie. we are moving on. no, it said the opposite of happening. the record number of people that are turning out. even though they do not have a big-ticket person meeting a

governor or a full ballot. they have one election and they are still turning out. what do you make of it? >> a lot of money has been spent on this race by both parties. both in the general election and now in this runoff. both parties have all of their biggest all-stars as it relates to voter turnout . democrats certainly do. income, the governor, he has won re-election, he is pretty popular. he put his shoulder to the wheel for herschel walker. everyone is all in from both an organization. this race became nationalized among all of the other senate races. it became one of the highest profile things. >> even before it was in a runoff capacity it was a big thing. >> i get the feeling that georgians are relishing their newfound status as some of the most important voters in america. georgia is one of the closest most purple states in america which was not the case very recently. maybe the voters there are excited to sort of the high

profile. >> they are the place to think about where obama is always going know at this point in time. michelle obama, lieberman -- before first lady did not do a lot of campaigning the cycle. i do not want to call it a robo call. she had a call where she was reaching out and telling people to vote, as well. on the flipside, your lindsey graham, you have cotton who turned out. you have more people like rick scott and beyond. there are a lot of interests. i think for different reasons but on the one hand for republicans, it is, look, this is the balance of power for the committee's sake. democrats have a different philosophy. what is your take? and what i do think georgians are excited about being paid attention to and being thwarted for their vote. i think every senate race. it should always be like that. every voter should be like their vote mattered. i also think this is some forecasting for 2024. what happens in this runoff, 2020 the roads were surprised

you're going to do it, pick a qualified black men to put up against raphael warnock. >> the president of the united states was asked why was he not in places like georgia talking about president biden campaigning. he mentioned he will be in boston tonight. the prince and princess are there, in the fundraiser, we do not have the some pretty naughty fundraisers are. the fundraiser for senator warnock tonight. he called walker a different breed saying he does not deserve to be in the georgia race. i wonder how that ultimately will pan out. what do you think? >> it is the line that we have heard from biden. these republicans say they are a different kind of cat then your dad's republican. it is pretty boiler plate from him in a lot of ways. but, i did get is pretty interesting that he is touching that race from boston. right? you were saying that on the

weekend, both parties are there. you talked about all of the circuits going into the drive turnout. the leader of the democratic party is not there. it is because it will probably be bad for the democratic incumbent running for re- election for the de facto leader of the republican leader, donald trump, is not there. brian kemp is the republican herschel walker wants to be seen with. there are a whole lot of democrats with brock obama. right now joe biden is seen as a risky proposition. he is not a popular man in the state. even though the most senior member of his party in the state seems like he is going to do pretty well but i think to ashley's point about how this is a preview of 2024, i think it is going to be a pretty good temperature check on how jordan is a swing state to state. i don't think it answers the question of whether or not that state is ready to break hard

from one party or the other. even if the democrats do a sort of continue to win any senate races there, i am not sure how encouraging that is for biden specifically. >> interestingly enough, the idea, after the roadway did not materialize the fact that he is a bit on the other side of the 10 foot pole . maybe you should not come here. meanwhile, kemp who won re- election in georgia is not persona non grata. but we are still reacting to the idea of a different read. it is a different commentary, but maybe it is the way he speaks. it has a bit of a cringe factor when you're talking about it. the idea that race has cast a very big shadow on the joys of being made between these two candidates. i wonder how does that play for either of you? >> i stopped on that word. we do not have audio but, i guess. so, maybe it would sound a

little bit different there. i paused on it. i wondered if it was going to make people uncomfortable. >> you wonder. >> this is an old , white guy talking about an african- american male. i stopped on it. he doesn't deserve to be in the race question mckee won the primary. he is as qualified as anybody to run. it doesn't mean he will win. but does not deserve to be in a race? what does that even mean? >> and president obama did not say those exact words, there were those moments just yesterday. i'm going to play it again. everyone was talking about it. we will get on to the point. we talked about the werewolf and vampire distinction for the way that president obama ends this that is to your point. listen. >> the last time i was here, mr. walker has been talking about issues. issues that are of great importance to the people of georgia. whether it is better to be a vampire or a werewolf. in case you're wondering, by the way, mr. walker decided he wanted to be a werewolf.

that is great. as far as i'm concerned, he can be anything he wants to be. except for a united states senator. >> the idea of what he deserves or not, it is a different take, but it is the same concept. >> that was a good line. he landed it perfectly. i don't think that it is concerning. he has a clear policy agenda. he does have some questionable things in his past. i don't see the militias attend to it. people are saying herschel walker was selected because he was a black man who won the husband who could win the football. he could take direction, but an intention. >> direction but not initiative. not the republican party. not because he does not believe it. but because he is a yes guy.

that is why it might be a little bit cringe worthy peer >> to your point, there is a new pull out tonight. there is a runoff election on tuesday because it was that close. even tonight. the poll for runoff, 52%, 42%. that is a narrow lead that has us where we are right now waiting in bated breath for tuesday to see what happens. it is being talked about by the former president. why is it so so close? >> georgia to all outward appearances is a senate right stated that the democrat can win under the right circumstances. it reminds me of a better way virginia used to be for so many years before it broke a much more strongly in the democratic direction or a republican can win by a whole lot, actually. the ceiling is much higher on the republican side. republicans could nominate the worst candidate ever devised

for the senate seat, i don't think raphael warnock would have a chance of winning by five or six points. right? walker was is not designed to lose decelerated >> they made that point that he stood in line for 4 to five hours only not to cast a vote. he said, look, is that what we are talking about? the vote in that race but a lot of the constituency on obama and biden speaking to them there. it may not be partisan democrats or partisan republicans. trying to find herschel walker embarrassing. they do not feel comfortable going out. they do not feel motivated to go out and vote for him. >> yet, we have record turnout. we have more to talk about here. it is the final election night of a surprising mentor and

honestly, i believe it has a lot of veteran qualities, even in their youth. so, i think they are feeling quite comfortable. now, you're playing one of the better teams, historically in the world cup in holland. but, this is a team that has not lost in 18 matches. they are quite good. they play around the world. but, i do not think this team fears anyone. this world cup team is full of drama and emotions and ups and downs. we are going to have to play at least 100 minutes if not more. >> a peerless underdog is going to leave it all out on the field is my kind of match to watch. we will all be thinking about that really important goal of the last game. although the netherlands is known as this really big powerhouse, i understand that they have been experiencing a bit of a flu outbreak. this is not that i am hoping

they have one arm tied behind their back. i want a legitimate win for a team that is playing the u.s. their coach should give them a day of rest but i wonder how that plays out. if the adrenaline is pumping and you were in the mind-set of a world cup tournament, does the day off help you? is it hurting? what is better, do you think? >> you know, honestly, i don't get is either one of those things. it could be good, and it could be just unfortunate circumstance. so, i think what teams and players now are used to us having to be agile and adaptable. i think that is one of the greatest qualities of our u.s. national team. i think the fact that this world cup is not during the regular summer months that it normally is and it is in the fall during these seasons. these players that had to adapt as well. i don't think the dutch side, i don't think that will be a big deal.

honestly sometimes, a day of rest is just what the doctor ordered. but, what i am hoping is they come out with the strongest line out possible and be match their physical play. the technical style. we find our comfort in the midfield who has done great this whole tournament. we have mckinney in our captain, right now, tyler adams, who is amazing. we feed our forwards and we get some goals. it i think we can put them under pressure. >> i tell you, i have two young kids, i don't have a day of rest to help you. it will make me feel like more of a zombie. got to keep going, keep my eye on the prize and make me confident at the end of the road. this is an important time. every time they are winning, it is not just the idea of a patriotic lottery. right? they are also, the further they get, this is a title 19. so, they are able to split and have chosen to. you have earned the right to

have the split divided. the further they get, i think $6.5 million as they get further and further, the prize gets bigger and bigger. what is the impact for you with the significance of that, knowing that this has been a hard-fought battle. >> i think this conversation about pay equity has been going on for 4 decades. that is when the national team was started. this is not something that has happened over the last seven years. so, obviously, i am thrilled that the team has pushed forward and has created the conversation and then push it further. we have a signed cda that allows this to happen. i think the men's team is actually quite -- they are a tremendous ally for the women's team. that is not what we are talking about. today we are talking about the men's national team in this historic opportunity that they have to further the future of the game here in america.

that is really, for all of us, we want to celebrate them. to some degree, they have been in the shade of the women's national team, and they should not. they are good enough and they are going to compete to the very last whistle. they are talented. i want everybody here and everybody around the world to see that. soccer is living and thriving here in america. i wanted to be even bigger. i hope the best for them. >> in moments like this, watching what is going to happen tomorrow, hearing become battery. of course, you cannot help but think of the iconic moment from 1999 that everyone thinks about. i wonder, look at this. first of all, everything about this moment just brings me to a place of just, i am so in awe. but, i have got to wonder. b people stop you and realize it is you? is it a whole different ball game now? i need you to kneel down with

me. i wonder what they are asking. >> i have to tell you that the interactions that i have had for the last 23 years have been phenomenal. i am utterly thrilled to meet someone who is in the stadium but i want to know where they were sitting but i want to know what they were feeling. i want to know what they are feeling now when they see that moment. when they talk about it. how has it changed the way they look at women's sports for women in business, women leading the way. like, honestly. it was such a wonderful moment. very genuine, very organic, very relieved. that was a big, big moment in terms of just getting past china, it was incredible, two amazing teams. someone had to win at the end. >> it might as well be you. >> yeah. might as well be us. but, what has happened since then, i think, we have catapulted the game of soccer in to a different stratosphere.

>> there are news tonight of the many testifying the criminal jan grand jury investigation. the transfer of power. the january 6th committee is awaiting its final minutes as their investigation nears its deadline. so considering the possibility of criminal referrals. here with me now, elliott williams. back with us.

scott jennings and alex burns but let me start with you, elliott. it is a pretty significant moment that the former white house lawyers are testifying in a criminal grand jury. speak to the significance of this moment in a time when we use to think about things like impeachment as never really wanting to ever happen. the idea of no one being above the law. the white house and internal memos of doj whether to indict a sitting president was also an esoteric debate. we are in a whole different world now. >> part of the problem is there is a bit of investigation fatigue. i know scott will agree with me on this one. we have talked about it. this idea of because of the multiple impeachments and constant lawsuits against the former president that people, many people have become desensitized to it. this in isolation is profound. number 1, you have staff testify before a grand jury. you have lawyers testifying before a grand jury after being directed to testify because the objection that they were raising in testimony did not -- >> stop, stop there for a

second. let's unpack that to the idea that lawyers in general are testifying in front of a grand jury about contact they have likely had was somebody with these councils is already odd. but the added notion here that they were directed to do so. >> they were. a couple things. there is a third layer that they are also white house staff. right? so, there is executive privilege . attorney-client privilege questions. and then a court has ordered them to testify on account of the fact that it is just important testimony to get. so, legally, politically, historically, it is just a profound moment. you know, i am with you on this, scott, all of the investigations over the years leading up to this authority desensitized people with how profound it all is right now. >> you have got to wonder. we are thinking about the so- called fatigue. people that are legitimate with their fatigue and people that would like to be fatigue. would like you to be so exhausted. we have got a new congress coming january 3rd. they are going to get maybe

january 6 committee. the january 6 committee will wrap up. the laundry list of things that congress has to do between now and january 3rd though expanding how significant and how much we will pay attention do you think to this report. >> i think the january 6th committee is drawing attention to the checkpoints and activities. >> that is tv, not a report. >> it is up to them to decide how to roll that out. seeing what their tactics are for drawing attention to the material ahead. having said that, the burden is as it has been all along for them to deliver the goods in a way that makes it worth paying attention to. it is what we have seen before, but compiled into a couple hundred pages. it will have some major impact. but, look, the phase of this process of legal accountability

for people who were in the insurrection for that process is moving on at this point pretty testimony that we talked about today is way more important than the final, final, final act of that. >> political fatigue. we hear from a lot of republicans who are tired of carrying all of these bags. we see the polling that is coming out, we see desantis against trump. bc people that say they have kind feelings towards trump they are ready to move on. looking in a different direction. so, so, i don't know what people are desensitized to it, but i think they are getting tired of it. by tired of it, i mean, just tired of the grind of it all. this has been going on for so long. either on top of it, the flat announcement for the presidential candidate. this crazy dinner with these nuts. there is no expiration four. >> you will have to narrow down the knots.

>> got it. >> you have got reasonable alternatives rising to look like winners who are not going to force the average republican. they have to go to work tomorrow or the pta meeting and defend whatever donald trump is doing. this is all happening at a very, very rough time for him. i got to tell you, there are a lot of assets in his disposal. they are struggling right now. >> another issue is that the public does not really have a distinction between what is a state investigation, what is part of the investigation, what is someone suing the president and why is congress investigating the president. what are the very federal charges they might face. the justice department is looking at it. it is one big bucket of about being dumped on the former president. each of them in isolation is quite serious. especially the federal ones, as you know when we have talked about on here. i think it is just confusing for folks who do not live in

this world. now, to the point of about 1000 page report. i think having worked for elected officials, 1000 page report that folks are not going to read. if your communications and public strategy around to read it. the mueller report was like a bookstore. it was very lengthy. people were tuning in. but, people want to point it out. that baggage that you are talking about, peter baker at the new york times said that trump has continued to embrace extremism as he seeks to reclaim the white house in 2024. wondering if it will work. there is a moment where he is expressing support for rioters behind the january 6th attack. it was last night for capital writers in the video for a fundraiser hosted by patriot freedom project. it is a group that assists families with those charged in the riot. i want to play for you what he had to say and get your reaction.

>> patriot freedom is what it is about. that is not happening in our country. people have been treated unconstitutionally, in my opinion, and very, very unfairly. we need to get to the bottom of it. >> how is this playing, alex? >> well, first of all, it is not a new tune from the former president. right question with this notion that the writers on january 6th are the real victims here. there is a terrible miscarriage of justice against them. we have heard that from him before quite a few times. >> this is after the oath keepers. right? >> i am not playing down the gravity of what he is saying. the trajectory of the post residential career he is taking is pretty clear for some time. his standing with the country at large because scott was saying before, his standing with the republican party, i think sort of reflects the general electorate's and lack of interest. how many republican voters out

there, honest to god want the 2024 election to be about that part of it? there are certainly some of them, i do not think it is the majority. is it a critical mass in a primary with a lot of candidates in it? maybe. if i were a republican strategist, that is what would scare me. >> are you sure? >> if we nominate donald trump, i said on election night during the midterms. i will say it again. there is no path in my estimation to win a national election. he has gotten votes in the times he has tried, has it gotten any better for him since he lost to joe biden? since his midterm? since all of the stuff is happening? if you are an average republican looking at these excuses, how are these writers of the snow they were not supposed to storm the capital. how am i supposed to stop myself and having dinner with white supremacist? no one wants to carry these bags when there are viable alternatives that give you everything you want comedy fighting spirit, take on the media, fight for our values and against their culture. but you are not curing these ridiculous bags anymore. people have reached their

limits. >> i would just say, real fast, this is where the result of the midterm elections are so important. in the weeks before, would term elections, there was this narrative were the democrats are too obsessed with january 6th. democrats did not pay a price on election day by being too obsessed with january 6. seeing how it turns out for the canada to align themselves most closely with january 6. it is the leader on their own side. >> well, a lot to unpack there. still a lot more to try and figure out that i am noticing both of you have the embroidery initials. >> scott jennings often does. and what he did in tonight. that is why he does not get the last word. when we come back here, the issues, the major changes could be coming to democratic primary calendars. what does it mean for a future presidential race like and 2024. we will discuss next.

how will they react to anything he asks for that will advantage them. biden does not have this problem. he will do whatever he wants. he is the president. that is a difference. >> this is a proposal. right? they have a long way to go before it is implemented. i don't new hampshire law expects it to be the first. we have them explain to do in that respect. how do you see this playing out? >> new hampshire situation may be uncomfortable for democrats but if they do unilaterally move themselves to the front of the line, then you have the standup between the national democratic party, the dnc, the white house, and the state that is actually pretty important swing street in the general election but it does ascend democrats to congress, the house, the senate. when you have influential democrats speaking out against the white house. there are potential costs involved there for biden that do not exist in iowa, right? no, iowa does not look like the country, no, they do not run a tight ship when it comes to organizing the election. but, it is a swing state. it is important that they

compete there. they have spoken cycle after cycle after cycle. they are not terribly interested in what the democratic party is selling. i think it is the breakup that much easier. >> in 2020, for example, iowa was impactful. people think about, for example, president obama where he was alike did to secure the nomination. the impact of iowa on the trajectory to places like south carolina for almost a debate in some respects. did iowa make obama, or did south carolina make it possible for obama. there are all of these conversations that really repeat themselves now. >> sure, democrats for many years with a privately, not publicly, that one of the most things that barack obama did in his presidency was protected the heck out of iowa. it was responsible for his own rise. it was a very important launchpad for him. that was the last time that iowa played an arguably
