as a former prosecutor i think there's sufficient evidence to charge the president. the evidence seems plain to me. >> good morning, everyone from washington d.c. poppy is off today. welcome to our special coverage of the january 6th committee's final meeting. hope you had a good trip. >> back to my hometown. >> she's blowing this morning. we're here for serious stuff. in hours a committee will take up criminal referrals against donald trump. what's at stake and who in his orbit should be worried. >> also, elon musk is asking his 122 million twitter followers if he should step down as ceo following a chaotic 48 hours for the social media site. plus this. >> yes!

>> goal. that's argentina, winning the world cup in penalties in an epic finale. we'll begin with the reason we're in d.c. today. the january 6th committee set to hold the final public hearing this afternoon. they plan to announce highly anticipated criminal referrals against former president, donald trump. sources tell cnn the panel is considering multiple crimes, including insurrection, and conspiracy to defraud the federal government. we want to turn to cnn's paula reed joining us this morning. good morning. there's a lot to deal with today. today is the culmination of big days. >> it's a historic day on capitol hill. this is a culmination of over a year and a half of work. investigators are expected to

release most of their findings today but the list making the news is the list of people they're recommending for criminal charges and sources tell cnn former president trump is at the top of the list. the january 6th committee will hold its last public meeting today. >> this is crunch time for the committee. >> reporter: to roll out the results of its nearly two years long investigation into the capitol attack. during the meeting lawmakers are expected to vote to approve their final report. >> if the evidence is the there that donald trump committed criminal offenses in connection with his efforts to overturn the election, there's sufficient evidence to charge the president. >> reporter: lawmakers are also expected to announce they will refer at least three criminal charges against former president trump. including insurrection, obstruction of an official proceeding, and conspiracy to defraud the federal government,

a source tells cnn. >> this is someone who tried to interfere with a joint session, even inciting a mob to attack the capitol. if that's not criminal, then i don't know what is. >> reporter: committee chairman benny thompson also told cnn the panel is looking at different types of referrals. in addition to referrals to the justice department for potential criminal prosecution they're also considering referrals to state bars for possible disciplinary action to the federal election commission for campaign violations and the house ethics committee. today's meeting is expected to not only name people being referred but also lay out a legal basis for those decisions. among those who could face referrals, a handful of trump's former aides and as dvisers. >> this is about donald trump. >> the state election officials ignored or violated state law.

>> mr. clark, how are you this morning? >>. >> reporter: including former white house chief of staff, mark meadows, lawyer john eastman, former justice department official jeffrey clark and former trump attorney, rudy giuliani. also on the table possible action against fellow members of congress who stonewalled the committee's work. >> we have weighed what is the remedy for members of congress? is it a criminal referral to another branch of government or better than the congress police its own. >> reporter: as the committee is rushing to tie up nearly two years of evidence gathering. >> we want to make sure no one slips through the cracks. we want to make sure that the key organizers and movers of this attack don't escape the scrutiny of the justice system. >> reporter: but these referrals are largely symbolic. special counsel jack smith is

investigating the former president, his associates for their role in january 6th and will make the final charging decisions. if you're wondering why they would release this criminal information this week, the holiday week, the committee is under a deadline here, they're trying to release what they know to the public before republicans take over next year when they're expected to dissolve the committee. let's bring in cnn legal analyst attorney general elliott williams and law enforcement michael finone. thank you very joining. the significance of these criminal referrals. >> number one they don't matter. but they're significant in that it's congress, which investigated over the course of a year and spoke to witnesses and issued subpoenas and so on it's congress making a statement if not the former president people around him committed

crimes and on behalf of the american people, which is their role, it's significant, but it has no teeth. >> it's no teeth but it's congress making a statement. but does the justice department have to rely on that step? no, legally in court it doesn't hold up. >> what do you want to see in court today? you have a different account on january 6th so i wonder what you want to see the committee do today to send a message? >> i want them to do anything other than make recommendations based off of what the facts of the investigation were. i understand the fact that congress is a legislative body and they're looking for a legislative solution to january 6th but in really what they are is a group of americans who are using whatever tools are at their disposal to try to put a stop to a criminal president and the threat he poses to our

democracy, at personal cost both pre personally and within their personal lives. >> you have a different experience you were up close and personal with these guys, you were assaulted on january 6th what would you like to see come from this? this is basically a statement from congress, the justice department doesn't have to act on this, what would you like to see happen, michael? >> what i would like to see is i would like to see the department of justice indict the former president and with whom their investigation determined that criminal statutes were violated. i would like to see those individuals put on trial and then again, as i've said many times as americans we should accept the results of those trials, even if it includes a guilty verdict for former president donald trump and jail time. >> speaking of that, you know, and the significance of what

these referrals look like, it doesn't mean the justice department has to act, that will be up to jack smith, the special counsel. but does it have any impact on trump's campaign? he is running for president and that's a factor, he is a 2024 candidate now. >> two different questions. one that depends on republican primary voters how they choose to respond to it. the question of can you still charge a candidate with a crime? of course you can. in the months immediately before election day, if there were a primary or the 2024 election, the justice department would not move forward with arresting somebody or putting them to trial but they can still investigate him up to that point and indict and charge him with a crime at any point between now and then. so this idea that some folks have that being a candidate somehow immunizes you from ever going to jail -- >> he has that idea. he thinks it's going to protect him somehow if he runs for president. that's why he did it early.

>> i prosecuted people before about what their thoughts should be -- >> every criminal suspect i ever participated in investigating ever. so donald trump thinks a lot of things and most of them are not true. >> are you holding out any hope? you've been through the trials. you did the proud boys, the oath keepers. what's your -- what do you think? >> i mean, listen, i see momentum building in that direction but again, i don't know. i don't know what's in merrick garland's mind. and yeah, i'm -- i am hopeful that the department of justice does the right thing and seeks an indictment against donald trump. >> i'm sorry, oath keepers and proud boys you have these groups with these names on them. and many of them were members of law enforcement. as a member of law enforcement, you should have some experience with this, what possesses someone who join any group like

this with the name oath keepers or proud boys on it? because they're -- >> we had this conversation before the show and you're going to make me say things that are going to get me in trouble on cnn. you know, i -- listen, if you look into the interviews that were conducted with many of these guys, you know, they are, for lack of a better term, pathetic morons. people who were susceptible to the type of manipulation that donald trump and many of his allies utilized. many of them are, you know, not well educated, they are of not -- you know, not of means, and then a lot of them harbor sexist, racist ideology. and that's kind of what binds them together in those particular groups. as well as harboring some pretty extreme anti-government

sentiment. >> and that jury selection gets under way for the proud boys trial today. the other aspect i'm going to watch is the republican lawmakers who defied subpoenas from the 6january 6th committee. there's several of them. i warned what you both think of this. i know you said if you defy a subpoena a regular person would be arrested. this is what adam kinzinger who was on the committee, had to say about his party as a whole. >> the once great party of lincoln, roosevelt and reagan has turned its back on self-governance and instead embraced lies and deceit. we shelter the ignough ignorant racist.

>> there are a couple things going on. congress doesn't have a ton of time if they wanted to go after them with contempt and lock them up in jail and so on before january 3rd when the next congress comes in. there's an argument to be made for letting them walk and let next year come and when republicans want to issue subpoenas to democrats, don't show up for them. it gives democrats in congress now an opportunity to not comply with the next congress. so play by their own game. that's what i as an attorney on the hill would advise by boss to do. >> i thought you were talking about kinzinger and cheney, who did defy their party. but it's going to be interesting you have this and the proud boys and what's happening on capitol hill. it's going to be interesting. i know you'll both and watching it. sources tell cnn the special grand jury that's investigating efforts by trump and allies to

overturn the election results in georgia has largely finished hearing from the witnesses and is largely finalizing writing the final report. the fulton county district attorney has been digging into trump and his associates since early 2021, after this phone call became public. >> all i want to do is this. i just want to find 11,780 votes. which is one more than we have. >> that was trump pressuring georgia secretary of state, brad raffensperger, in what trump still claims was a perfect call and has insisted he did not do anything wrong. the investigation has been big. it's included false election fraud claims made to lawmakers in the fake elector schemes. and bonnie willis has informed the 16 fake electors they're targets of her probe along with

rudy giuliani. a long list of trump allies have testified, despite trying not to, including lindsey graham, rudy giuliani and michael flynn. in georgia, special grand jurys do not have the authority to issue indictments but they make recommendations. so it's up to willis and a new grand jury to decide whether or not they're going forward on legal charges. experts have said that case would not be a slam dunk but it's still a significant step. listen to what the former u.s. attorney in georgia told cnn just yesterday. >> i think it's likely you'll see a recommendation come out from the special grand jury to pursue or at least to recommend criminal charges against people involved. i think you'll likely see trump in that because he's essentially given a confession on tape. well, new this morning the democratic mayor of el paso declaring a state of emergency, migrants are setting up camp

waiting for title 42 to expand, that's a policy that allows agents to expel migrants at the border. now they're bracing for a huge wave of people. texas republican governor greg abbott said if title 42 is lifted there will be total chaos. and joe manchin adding his voice for a bipartisan push for intervention. >> the president needs to use every pit of power he has as an executive to find a way or ask for an extension. i think president can ask for an extension, his administration is doing that, i hope they do. >> straight to ed lavandera in el paso. good morning to you. what are you seeing? how officials preparing? >> reporter: across the southern border, communities are bracing for what could be a logistical nightmare in transportation, feeding migrants, and shelter. all of this expected to happen

in two day's times in hopes of avoiding a humanitarian catastrophe. >> one more? >> yes, sir. >> reporter: el paso's mayorhe's 4 to 6,000 migrants to be released into the city every day if title 42 is lifted on wednesday. >> i believe today our asylum seekers are not safe as we have hundreds and hundreds on the streets and that's not the way we want to treat people. >> reporter: city officials have started moving hundreds of migrants camping out around downtown area bus stations into hotels or newly opened shelter space. >> we want to make sure that everyone is safe. we know the influx will be huge. >> reporter: in the last week we're told more than 1,000 migrants have found refuge in the family center shelter in

elpa so. she came from eccdare with her husband. sarah like every migrant we've spoken with said they were kidnapped and held for days in mexico before they paid their way out but they arrived at an uncertain time and winning asylum in the u.s. is far from guaranteed. are you worried you're going to be deported? he said they're looking for anything. would like to request asylum or humanitarian visa, anything that would let them work and earn a living. one of the thousands who entered el paso in the days before title 42 expires, which allowed border officials to expel migrants nearly 20.2 million times since 2020. >> reporter: not everyone is

crossing to cross over. the people you err seeing behind me don't want to cross. they're waiting for title 42 to be lifted. they're worried if they cross now, they will be deported. some sleeping under the cover of this car wash and others in this shelter called the hope center where hundreds sleep on the floors every night. kelly and her husband have waited here two months. waiting to decide when to cross into the u.s. why are you waiting to cross? they're waiting to cross because they've heard so many other venezuelans who have been deported. they don't want that to happen. so they're waiting for title 42 to get lifted and then they'll decide whether to intenter the

united states. el paso officials know the spirit of compassion will be put to the test this week. the county judge says this area has never experienced a moment like this. when and if title 42 gets lifted on wednesday, what's it going to look like here? >> everybody agrees it's not sustainable. there's nothing we're doing right now that's sustainable. everything is addressing and reacting to a situation. >> reporter: and, don, here in el paso this morning where we've seen so many migrants camping out on the streets at the bus station, after the emergency declaration this weekend many people have been cleared off the streets and moved into other shelters or hotel rooms, so a dramatic change in the streets of el paso this morning. >> ed lavandera in el paso, thank you very much. now this. >> these scenes will live forever as lionel messi and

and everyone on her flight was watching the game. it was amazing. >> reporter: yeah, it was amazing. when i was handed this yesterday, the world cup final ticket i was pinching myself. it's obviously a great sporting occasion but world cup finals are rarely great matches however i think this is a collector's items because i think i witnessed the greatest football game ever played. this is the moment that lionel messi fulfilled what many considered to be his destiny. but during an extraordinary world cup final in qatar on sunday, the trophy was within his grasp and then almost slipped through his fingers. in soccer obsessed argentina, tears of joy, celebrations spilling into the streets. >> messi scores! >> messi put argentina ahead

against france with a first half penalty. and shortly afterward, 2- nil. france were being played off the park and seemed to be out of it until a penalty 10 minutes from time. mbappe scoring from the spot and in a minute he had equalized with a stunning volley. the world champions had picked themselves up off the floor and it was game on. in extra time, messi scored again putting argentina 3-2 ahead and two minutes from victory france were rewarded with another penalty dispatched by mbappe for his hat trick. >>. the game had to be settled by penalties, and france missed two spot kicks. and it was settled for

determine whether or not he remains ceo of the social media site he bought for 44 billion. last night he asked 122 million followers whether or not he should step down from running the company following an especially chaotic 48 hours for the site. the majority say yes, 57%. of course he said he will abide by that. we'll wait to see whether or not he does. musk faced serious backlash after suspending several journalists including donie o'sullivan saying he doxxed him sharing links for his private jet and then twitter implemented a policy from sharing users names from other platforms. overnight an about face again from twitter as they deleted that policy less than 24 hours later. before he asked his twitter followers to decide his fate he says he'll abide by. he was spotted at the world cup with jared kushner. as you see here.

here to talk about this is the head of the former "the new york times" media column, ben simmons. but i think sometimes it seems like elon musk has made a decision when he posts something like this -- >> can you -- i'm sorry can you hear us? we lost ben smith. we'll get back to ben smith. look, i know how you feel. you use twitter more than i do, i'm not taking away from the seriousness of twitter, you know how i feel in people in countries with limited media. i think he should take it more seriously, and i think he's playing with us. doing what trump does. put out polls trying to change the news cycle, get more interest in twitter. i think it should be taken more seriously than he is. >> a lot has been the polls. one thing that -- i think ben is back with us this morning. one thing to ask about is this idea that elon, when he puts the

polls out there, he's decided what he's going to do. he's decided he's going to step down is the thing. ben what is your sense of whether or not that is what elon was doing here? did he decide to step down as ceo and does it have that much of an impact on the company itself? >> i don't think that he is -- he seems like he's living moment to moment. and, you know, he is -- he has this experience with twitter that is a lot about acknowledge l -- adulation and he is largely replying to people who says you are great. and a wise quote from elon musk. i don't know if he thought he would lose a poll like that. but it's been a huge run on twitter out of his pocket the last couple of weeks. you can tell there's no one around him who is able to say, boss, i'm not sure that's a good idea just based on the series of terrible ideas he's acted on and

backed off. totally strange situation. >> do you have something? i just want to say, can you put this in context for us? because i'm sure you heard kaitlan and i speaking. i think there is obviously a huge space in society for twitter, especially if you look at journalists, people like the women of iran, if you look at countries where people don't have a free press. like there is a huge place for twitter. i think that he should be taking it more seriously. i think these polls and the antics is just to -- it's right out of the trump playbook, which is what i feel. and that he is manipulating the media in order to get attention. so can you put this into perspective. should journalists pull out their trump playbook in order to deal with what elon musk is doing at twitter? is it a page out of the same book? >> you know, i think that's a really good observation. and there's one particular thing trump would do, he would violate

some long-standing norm in order to largely get attention and drive, you know, the keepers of the norms, including journalists totally nuts and get a ton of attention. and then sort of walk it back. and i think one difference, kaitlan you covered this with trump's first term in particular is that trump actually didn't know how to be an executive yet and he would say he was going to do something, cause massive outrage and then not do it. one thing about musk he knows how to run a company, in a technical sense, knows where the buttons and levers are. so when he's made an outrageous decision he's been able to implement it very fast and you've seen it ripple through the functions and it was not true of the west wing in 2017. it was more trump saying things, people being outraged and nothing happening. what you say about twitter's importance is certainly true, it's been a vital part of the

public conversation for ten years but not a rule of nature there has to be one social platform that everybody in the world is on. most of human history there has not been one and i don't think it would be that weird if there's lots of different places people express themselves. >> we'll see what it looks like and if he steps down. >> i remember during the trump years when you were there. trump would tweet something and then kaitlan to the camera, you get to the camera, report it, and then sometimes things would happen but most of the time nothing really happened but it did change the news cycle for the day and kept reporters w working and on their toes every single day, there was ten things that happened when trump was president. >> i think it's the ruling by twitter poll, and we'll see if he abides by it. he said in a delaware court testifying last month he did not plan to run twitter, he wanted to have a different person. we'll see if he does that.

what happened on a flight to hawaii that sent passengers to the hospital. we'll update you on that one. plus americans stranded in peru amid deadly protests. what is the u.s. doing to bring them home? and live from new york it's saturday night for the very last time ceciley strong says good night. 30 people have been injured on a hawaiians airline flight after a flight had turbulence. one taken to the hospital is a 13 month old baby. pete muntean is here with us. >> reporter: you can see the mess on board. this had to be extreme turbulence, this weighs about a quarter of a million pounds for airlines to say they encountered severe turbulence and all these people to get hurt this had to be extreme currents of air moving the airplane.

what we know from the airlines is that 20 people in total were taken to hospitals, 17 passengers, three crew members. this was an air bus a 330, this flight from phoenix to honolulu. we can tell that some of this happened only about a half hour before the plane landed. i want you to listen now to one of the passengers on board. she said her mom was not wearing her seat belt and was pushed up to the ceiling by the extreme force of the turbulence. >> the plane shook and went into a sudden drop like how you go into a drop on a roller coaster. my mom wasn't buckled. and so i turned to my right and i saw that she hit the ceiling and she hit the floor. >> reporter: hawaiian airlines is investigating this so is the faa. they'll inspect the plane before

it flies again. the ntsb has been looking into this for a long time, since 2019 about a third of all incidents involving airliners have to do with turbulence. this is a huge problem, a lot of causes to it, thunderstorms, rises in currents of air, so that's a huge problem here. they're trying to get a wrangle on this. but this underscores why flight attendants and crews tell you keep your seat belt buckled even if the air is smooth you never know when it's going to hit. they're trying to get better forecasting it. >> but it speaks to the durability of the airplanes. they can take a lot more than you think. >> a lot of comfort for people flying. >> i'm not a fan of flying and do not like turbulence. >> sorry, don. i love flying and i don't mind

flu season that hit the u.s. early and hard is showing the first signs of slowing in at least parts of the country, kaitlan, but will the trend continue as holiday travel ramps up? that is a question for our senior medical correspondent elizabeth cohen. good morning to you. so what's the answer? what are the numbers looking like headed into the holidays? >> good morning, don. i wish i could say the numbers are going down this is great we've seen the worst of the flu season, unfortunately i can't say that.

the cdc did just recently release numbers looking at the week following thafg and numbers were down week over week, down 10%. that could be a blip. it happens sometimes you get a blip of a one week de-reese and then it goes back up again. i can say talking to doctors, they are getting hammered, that's the word they use, they're getting hammered with the flu. there's still a ton out there. let's take a look at the toll the flu season has had here so far. there have been at least 150,000 hospitalizations and at least 9,300 deaths. i want to say, get a flu shot it can still protect you because we will have quite a bit of flu in front of us, even if it is really, truly going down. don, kaitlan? >> it's not just flu we're dealing with, don was saying the other day, one flu shot, one covid booster he got.

♪ this morning, deadly protests in peru left several american tourists stranded in machu picchu for days. the violent protests had erupted after the ousting and detention of the president there. now many highway are blocked, train services have been suspended. kylie atwood is at the state department. what's happening with the tourists but also on the ground at large in peru? >> reporter: good news over the weekend is that peru rail, which

runs trains out of machu picchu, which kaitlan is essentially the only way to get out of the town because you have to hike to machu picchu or take a train to this ancient world heritage site, they say they are running emergency services out of machu picchu. those services are just for folks who have medical problems, who have children, who are elderly. so we don't know the extent to which they are getting the tourists out of machu picchu. as you said, hundreds of them stuck there due to protests in peru right now. the state department said they are in touch with americans who are there. we don't have an estimated figure as to how many of these 300 tourists are americans. but the state department is in touch with them. they have updated them with information about how to get out based on what the peru government is setting up here in terms of evacuation routes. but they also said in a new alert about demonstrations just yesterday, i want to read this to you, quote, there are

unconfirmed reports of a general strike on monday, december 19th, which will affect transportation in the city and may impact airport arrivals and departures. it goes on to say avoid areas of demonstration as protests and demonstrations can be unpredictable and quickly turn violent. now cusco is the city closest to machu picchu that has an international airport. so the question here, the problem here is that even if folks are getting on these trains out of machu picchu, they may still have some issues getting to the airport due to these expected demonstrations. so the embassy is telling folks to really be careful as they make their way and try to get out of the country. >> how many people are we talking about? how many american tourists are there? >> reporter: we know the number of tourists are about 300, but we don't know if they're all
