top of the hour. i'm jim sciutto. in short, it is cold. the powerful winter storm battering the u.s., expected to grow even stronger and colder today, covering nearly half of the u.s. population. parts of the country could see the coldest christmas in decades. sub-zero temperatures hitting hard out west. here is the owner of a local towing company in montana speaking with cnn this morning. >> it is cold up here. if you ain't prepared for it, it could be really bad. i've been here 20 years and this is the worst i've ever felt. >> wow, tough time to be a towing company. right now hundreds of thousands of people are without power. that is tough in the cold. many of them in the southeast. travel plans upended for many going to the holiday weekend. more than 3500 flights canceled

are -- [ inaudible ]. i ask my colleagues here to just show you what the conditions are like here on the ground in buffalo. what we've seen is this restrictions put if place by authorities because of the concern of these white-out conditions. we started this morning at about 6:00 a.m. with barely a drizzle. temperatures in the upper 30s. and boy did the situation just begin to deteriorate extremy quickly. officials here have instituted a travel ban meaning only essential travel is allowed on the highways and roads right now. many concerns, one is that supreme will get disoriented and get stuck on the side of the road and lead to tragedy. and this storm as it continues to barrel eastward, it is bringing these just wicked winter winds and with it basically pushing the water in nearby lake erie, which is less than a mile from where i'm standing and where the pictures

are being taken and sourcing much of the water closer and closer to some of the coastal communities and that is why there are some of the communities where they urge residents to evacuate leading up to the storm and recommending that people continue to stay vigilant and keep an eye on water level because this is a storm, according to local officials here, that is unlike anything that many folks who lived here have ever seen before with the lake levels expected to be really just extremely high. some of the highest they've seen in perhaps decades. but again these pictures give you an idea of what the situation is like on the ground and this is really just getting started authorities say that this is going to continue into tomorrow. back to you. >> goodness, and well sad to see that some folks seem to be disobeying that no travel order, folks, listen to the warnings. they're important. polo sandoval, thank you so much. pete muntean is at chicago's o'hare international airport.

pete, there is nothing worse showing up at airport, you packed your bags and brought the kids and you see canceled by your flight. what do the numbers look like now? >> reporter: the good news here, jim, is that airlines in large part are preemptively canceling flights. meaning that folks are finding out on their phone before they get to the airport which is one of the reasons why we've seen the numbers dwindle here. 3576 cancellations nationwide. we're almost more than a thousand over what we saw yesterday. 2600 nationwide. we've dwarfed that number as the storm not only effects the midwest but is moving east. we're seeing new airports pop up on the list. it was o'hare and detroit, a big hub for dealt you and now new york, philadelphia, and washington, d.c. and boston, those airports will be impacted by this storm. the faa said that the delays will be driven by how airports

handle the ground game, how quickly they deice planes and get them on their way and it is a needle in a haystack, if you get rebooked, there may be not be enough seats. passenger volume has gone up to pre-pandemic levels. but scott of scott's chief flights said there aren't as many seats available from the airlines these days. take a listen. >> we hear how travel volume is down 10%, but the number of the flights in the sky is down more like 15% or 20%. so the planes that are flying are more full today than they were pre-pandemic. >> reporter: it is not just passengers, it is also packages being transported by airplanes and that is effecting shipments at ups and the fedex. and some of the packages, are expected to arrive on the

doorstep on christmas morning. may be delayed now because of this huge weather system, jim. >> goodness. so much to factor in. pete, thank you so much. and let's go to denver where wind windchill are in effect throughout the day. lucy kafanov joins us now from denver with what she's seeing there. so what is it like and is relief expected any time soon? >> reporter: relief is expected soon, jim. and while the worst of the storm is over. >> you could see the city getting back to normal. it doesn't feel like it is getting back to normal because of the windchills. we've had now 37 consecutive hours of below freezing and below zero temperatures. that is not going to change until after around 11:00 a.m. local time here in colorado. this is normally a very busy downtown area.

you could see a lot of the snow has been plowed. we've got about four inches of snow at the height of the storm, businesses are reopening, folks are slowly getting back to normal. but this was a painful experience and some historic temperatures swings. we were talking on wednesday it was nearly 50 degrees farenheit. that swung down by 75 degrees. we saw minus 24 degrees temperatures on thursday morning. the windchill making it feel a lot worse, a lot more dangerous. the critical thing that authorities have been asking folks to do is not be outdoors. so folks are being urged to stay at home. there have been shelters and warming centers opened for anyone that needs to get out of the cold, but there is good news on the horizon, jim. we are expecting the temperatures to climb by christmas. it could be nearly 50 degrees. i know that is not the case for the east coast, jim. >> can't go soon enough. lucy kafanov, thank you so much. and joining me now is the mayor of denver, michael

hancock. thanks for being with us this morning. >> thank you for having me. >> and the recommendation had a been don't go outdoors. tray to stay safe and warm at home. are people heeding those warnings? >> absolutely. for the most part. dangerously cold here and with the windchill, making it even worse. yesterday i woke up it was minus 17. this morning right nows it minus 5. so it is not safe for anyone to be outdoors. we know there are some essential workers that have to get out and move. but denver, though it doesn't typically get this cold, we're familiar with the slick streets and horoads but it is not safe be outdoors if you don't have to get out, we ask people to stay indoors. >> and denver is familiar with cold weather. what in particular was tough about this one? was it the drop in temperatures?

>> absolutely. 30 degrees drop in a matter of minutes. you could feel the temperatures dropping just -- this was on the wednesday where i was sitting somewhere i could feel the temperatures drop. i was indoors but next to a window and i could feel it. so yeah, it is very dangerous. and when you add snow to it in denver, the snow will melt 24 hours after an event but with these temperatures it will be around for a while. >> i got in the morning it was 44 and it is supposed to be 10 degrees by the time i leave the office. and you had asked for help due to an influx of migrants. are you getting the help that you need? >> we've had conversations with the federal government, right now the best the federal government could do is the emergency food shelter program that we could all apply for. we've also had conversations

with state, we'll receive some financial resources there. denver as a city has already expended in excess of $2 million of its general fund since just the month of december. it started and we declared our emergency operations center and subsequently declared an emergency. we've had over -- over 2,000 migrants come to denver. you know, during the fall and winter months, we're 1500 just this month alone. and of course we're dealing with a challenge across this nation with homelessness. so this is a really difficult situation for all cities around the country. i'm there conversation with mayors almost on a daily basis across this country and it is a challenge. cities are bearing the brunt. and i've said this all week long, the inactivity and the lack of leadership coming out of washington on this issue. we have this as a nation because of the unfortunate partisan politics in washington that has put us in this situation. >> you had roughly 1300 migrants

arrive in denver just this month. what do you say to a phenomenon we've seen which is some of the southern governors, border state governors deliberating sending migrants north to cities like yours. what is your response to that? >> you know, i believe that those governors, obviously they are caught in the partisan web of politics again in this nation. that is unfortunate. but their responding to the stress and pressure they're feeling because they don't have the tools to respond to these surge of mikgrants coming to th states because the cities don't have any tools because we have not been aparted any physical or financial resources to address this issue out of washington. this is a national problem and when we have such a surge like we've seen if denver, certainly not on the level that el paso has seen, but we're certainly seeing a challenge in our

resources, that becomes a real problem because we're beginning to have opportunity costs where we're taken away from other services that we are working to respond to in our cities. we want to be inclusive and open. we want to be -- act humanely but we need the federal government to assist this and i think that is what the governors are reacting to and what we're reacting to here in denver colorado. >> i've heard that from democrats and republicans. a fix needed on the hill. we wish you luck and the city of denver in the coming days. >> happy holidays. and we're follow the storm as it brings bitter cold and sub zero windchills and blizzard warnings. later we'll head out near lake michigan. plus the highly anticipated final report from the january 6 came out said the capitol could be blamed only on one man and

the final report from the house select committee investigating the january 6 attack lays the blame firl firmly on one man, president trump. and it came out last night after a year and a half of investigations. with it testimony hearings it reads, quote, that evident has led to inform overriding and straightforward conclusion the central cause was one man, donald trump, who many others followed. none of the events of january 6 would have happened without him. evan perez joins me now. this is been a year and a half of revelations.

some of which we've had live through testimony and leaks. what did the final report tell us that we didn't know. >> they had over a thousand witnesses who came in over this months of investigations. and one of the biggest things that you come away from is the amount of evidence that they found about the efforts to get these fake electors in the states to try to support the idea that the former president would remain in office despite losing the election. we'll show you a few. there were 200 attempts to try to overturn election results and keep the former president in power which is something that is at the center of the criminal investigation that the justice department. so we're going to hear more about that in months to come. they also found that the president's decision to falsely claim victory was something that was premeditated. obviously that is the thing that ended up causing thousands of

people to come to the capitol and eventually cause the situation that it involved. millions of dollars were raised by the former president and his allies as part of the effort, even people at the rnc knew there was a line that they couldn't cross on some of this. and that, you know, even internally trump was calling some of the ideas of some of his allies, people like sidney powell, he was calling those ideas crazy even though he was going publicly supporting this idea that he had won the election and, of course, ended up getting thousands of people to come here to support this idea. so what is next? the committee makes a number of key recommendations and one is that the former president should be barred from ever holding office again. that is something that congress is going to have to do. criminal referrals have already gone to the justice department, we saw that this week. the justice department is looking at a number of things including the possibility that

people were obstructing the committee's investigation which could be a crime. lawyers involved who are involved we're seeing this, they're getting sanctioned by the bar association and many of them may not be able to be lawyers again because they played such a key role and they're working on trying to overhaul the electoral count act which is something congress has been working on for some time. the idea being that you can't just try to overturn elections by using members of congress to do that. >> and that is one thing that made it into the omnibus bill. evan perez, thank you so much. joining me now to discuss, michael moore, a partner at moore paul in atlanta. good to have you back. >> good to see you, jim. >> the big questions here is did they establish evidence, did they find evidence that, particularly as a lawyer, would say okay there is a crime here. if you connect the dots, i mean 200 attempts to pressure state officials to overturn results, that it was premeditated, that

they made plans for this and that trump himself was saying some of the fraud ideas were crazy, seems to get to the question of intent here, right. when you connect those dots, do you see a viable case? >> well, i'm glad to be with you. i think there is evidence in the report that will be used by the special prosecutor. but i also thi think it is longn smoke and short on fire when we got here because trump has done a remarkable job of keeping a buffer between himself and the courtroom in the criminal process. so, forrin instance, there wil some first amount challenges. people decide they're going to do crazy things like oath keepers and proud boys, is it responsible for that if he gives a political speech. that is an issue that will be litigated in the appellate courts. >> we saw him on that ellipse that day. he said the election was stolen. he said theft. we're going to the capitol and i'm going with you.

i know that we've got a first amendment in this country from a legal perspective, does that verge towards inciting the crowd to do what it did? >> i think it will verge that way. and i think they'll be a real question about political speech and first amendment protections. that get raised in the case if that is the way this go. it looks like probably the cleaner case are things like efforts to -- witness tampering, if some people could be flipped to say that trump told them to do that, whether there were efforts to put if a slate of fake electors, will people flip to say they were told to do that. we also know this is a gift to the prosecutor to have these kinds of statements and investigation. notes and reports to him before he begins. at the same time, he's now under a duty to report inconsistencies things that may be exculpatory. and casey hutchinson's

testimony, whether he attacked the driver and that was not corroborated. >> but we should note that the report should say that she doubled down on in sworn testimony and said that tony ornato referenced that story two more times afterwards. >> she did. >> yeah. >> but those are inconsistencies that could cause problems down the road in a criminal process because the burden is proof beyond a reasonable doubt. and it may not be the same in one setting as another. those are things that could raise doubt for jurors and they're you're electorates so these are what prosecutors will have to take into account and look for the strong elements of a case that he could prove in a criminal case, in a criminal prosecution. >> the standard for that is much higher, right, beyond a reasonable doubt. >> that is right. the standard for the prosecutor is beyond a reasonable doubt. this report is a letter to him,

at the bottom of the hour. a brutal winter storm is moving across the u.s. bringing blowing snow, bitter cold to millions and it is strengthening throughout the day. in the south, tens ever thousands without power. andy bashear, kentucky governor, warned to avoid roads altogether. >> people need to stay home and people need to stay off the roads. if your travel plans change, your family wants your home for

christmas but they want you alive a lot more. >> out west, sub zero windchills moving through today and tomorrow. but parts of the country will experience their coldest christmas day in decades. in memphis, tennessee, a dangerous amount of ice is now blanketing roads and sfrandling vehicles. jeremy pierre from whbq has more. >> reporter: we're on walnut grove, which is very popular for people to get to and from work. and already there morning we've seen people be defeated by this hill here. in front of hope church on walnut grove in the city of memphis. on the way tolt the area, we s ten cars that had been abandoned or wrecked. you could see it right here. already this morning in this section, we've seen four cars

spin out of control, that car right there, that vehicle, that suv is the lone one that is just stuck. it can't move because of the ice. not only is this ice on this road hard to drive on, but it is absolutely impossible to walk on. i got a chance myself to see for myself that it is ice. ice for sure. and for the most part, people are having trouble going up the hill, also down the heill as yo see this crashed out car right here. and people coming down this hill, people are ending up, up that hill. >> wow. goodness. it looks like an ice rink. well whmichigan knows cold weatr but this is unusually bad. 9 degrees in detroit right now with a high of 21 today. add in blowing snow and wind gusts, nearing 50 miles per hour, it gets a lot worse. joining me now from the other side of michigan, lauren

edwards, reporting for wxmi in grand haven. i'm going to tell you, it looks cold there. >> reporter: you know, today is festivus. i keep reminding myself of that. i have a long list of grievances and this 50 mile per hour wind is exactly on that list of grievances for today. it is brutally cold out here. it is even cold to even talk to you for the short amount of time that i am. buff the wind continues to blow and it hurts. it really does hurt. even when we're staying in our hotel you could hear the wind pounding against the windows. but i could tell you eve been out about here in downtown grand haven for the past day and a half and we've seen the snow build up and the wind pick up and people driving slowly, which is a good thing. we don't want any more gr grievances on the list this year. and cars coming down with headlights on and we've seen

texas which has hit by widespread outages during a winter storm last year. joining me now is travis houston, assistant emergency management coordinator for the city of dallas. good to have you on this morning. >> thanks for having me on. >> so first question, we covered it and i have a sister who lives down there, i remember the freeze of february of 2021 and the whole power grid shutdown. is the grid any more protected today? do you have any fears there might be a repeat of that? >> i feel like we're in a lot better position and i feel that this event has a lot of differences from the february of '21 event. it is going to be under plfreezg for a lot less time and we don't have the precipitation this time but from our perspective, we're always planning for the worst case scenario and making sure we're able to adopt to that. and so right now it looks like we're okay. but we're ready to change things if we need to. >> i wonder about preparations,

too. because this is not normal. are the homes built to with stand that? do you have the salt trucks necessary to keep the roads from icing up. do you have what you need to respond to this? >> in general, i think that we do. you're right, a lot of homes in texas are not exactly designed for this type of weather. but i think that if people are taking the right type of preparations like making sure that their faucets are dripping, that their outdoor pipes are covered, all of those things, that will go a long way and then for our unsheltered guests, we're making sure that we have a warm place for people to go. >> i've been speaking to city and state officials in a number of places around the country today, and they've been saying, folks, just stay home. it is not worth going out now. and i know it is the holidays. and i wonder are things bad enough there that year issuing similar warnings? >> you know, i would say that considering the fact that we don't have the preparation

happening today, a critical vote on capitol hill. in the next few hours, the house is expected to vote on a $1.7 trillion spending bill. lawmakers hoping to avoid a government shutdown before and then rushing home for the holiday break. senate passed the measure today ahead of the funding deadline tonight. that includes a bill to extend the deadline by one week allowing enough time for that bill to be formally processed and sent to the president's desk next week, waiting for the house to vote as well. joining me from the house, mike quigley from illinois.

here. in your view, if it fails to hold donald trump responsible for this, and in effect only the lower level rioters pay a legal price for this, what will that mean for the country? >> you know, it will be another jolt to our democracy. obviously january 6 was a traumatic event for our country, for our democracy. certainly for those of us who were in the room where it happened. we all have different reactions to it. you referenced with an earlier guest this morning the president's speech that morning, that morning i walked around the capitol, rode my bike and walked around, i heard what the insurrectionists were saying. i went into my office and heard the president's speech and at that moment said, the president is inciting an insurrection. he just sicked 20,000 people on us. so at that moment i felt he had committed a crime.

life-threatening cold to almost the entire nation. the elderly and young particularly at risk. the truth is anyone susceptible, tom foreman is at the magic wall to share some useful tips for how to stay warm and also safe in your home but also how best to prepare yourself if you do leave home. so tell us what is smart to do? >> start with the obvious things. wrap our cover all exposed pipes and the ones behind the washingtoner and lets the tap trickle. find the main water shutoff so if it starts thawing and water is springing you could shut off water to the whole house. and keep the heat in. block the windy windows and doors and don't open the door a whole lot. fireplace and the stoves are ineffective. fireplaces don't warm a move very much. and stoves don't do that. you run into risk of carbon monoxide. same issue with generators,

outside of the house or gauge. did not put them near the building. space heaters and look out for fire danger and have your food and water and flashlights and ready and know where they are and don't wait until the power goes out and then try to figure it out. if you have to go outside in your car, full tank and full phone plus your emergency sup supplies in the car and ready to go. clear off your windows and lights and doan try to sneak along, drive slowly and brake gently, yes, headlights on, no cruise control. do not pass plows or emergency vehicles if they are going slow, it is more dangerous in front of them. give people plenty of room because they can't control their cars either and if you get stranded. stay in the vehicle. you're safer unless you could easily see the safe place you're going to. and last of all, if you yourself want to protect yourself, stay sheltered, some of the cold

temperatures could really hurt you and i mean fast. it could get after you quickly. wear sufficient clothing, plus shoes and boots with good traction. it is an old saying, there is no cold weather just people who don't know how to dress for cold weather. so put on the warm stuff and keep it on. use handrails when you're walking. do not overexert yourself trying to shovel snow. people have heart attacks all of the time and people get hurt and get all wet from too much exertion. that makes them colder. and most of all, limit your exposure. you cannot out there as long as you think you can without getting hurt. and i'm a big believer in getting outside and enjoying the elements but these are simple real rules to keep you and your family safe and the last thing you want to do is to get hurt. to suffer from kind of exposure and then have to get to a hospital or emergency room which is another risk level. jim. >> you just described a lot of conditions where wee see people getting hurt in storms like this.
