good morning to you, a day of vote counting here in washington. i'm jim sciutto. >> vote counting part deuce, i'm erica hill. good morning. we are keeping a close watch on washington for just that purpose. a few short hours from now the gop controlled house set to gavel in for a second day as they try to elect a speaker because of course remember without one not much is happening. new members can't even be sworn in. after three rounds of voting presumptive front runner kevin mccarthy not only failed to corral his caucus and secure the 218 votes needed to become speaker, he actually lost support as the day dragged on. we are live from capitol hill. and we will be talking to a member of congress who is central to these negotiations, plus buffalo bills damar hamlin remains sedated in critical condition on a ventilator. this after experiencing that shocking cardiac arrest during monday night football. his uncle tells cnn that he had to be resuscitated not just once

on the field but twice. and the man charged with first-degree murder in the deaths of four idaho college students could be back in idaho very soon. we are already learning more about how officials found bryan kohberger in pennsylvania. there's -- there he is right there. we do begin on capitol hill this morning where congressman kevin mccarthy now faces the task of getting 20 votes back on his side, those are republican votes back on his side as speaker. cnn is following this all around the capitol building this morning as lawmakers arrive. >> let's bring in cnn congressional correspondent lauren fox. lauren, in that last round of voting, 20 republicans voted for congressman jim jordan who, of course, had nominated kevin mccarthy. what is he saying this morning? >> reporter: well, it is such a remarkable moment on the floor yesterday, erica, where you had jim jordan actually nominating kevin mccarthy to be the next speaker, meanwhile, he is getting complete unity from that group of hardliners who are voting for him on the floor for speaker. now, he did tell our manu raju

yesterday that he is not interested in the job. >> is there any chance that you may be speaker of the house. >> no. watch yourself. no. i'm being clear, i want to chair the judiciary committee. >> reporter: and jim jordan could be a very important linchpin to trying to deliver these votes that kevin mccarthy needs because he is so close to the house freedom caucus, he's close to many of the hardliners, the hope being maybe he can help negotiate some way forward, but right now just not clear what that path is. erica? >> lauren fox, thanks so much. cnn's jessica dean, she's also on the hill this morning. there's still negotiations under way, there's also theorizing about another adjournment. where exactly do things stand? by the way, as i ask that question i know things are changing by the minute. >> reporter: they certainly are. and these negotiations are happening as we speak, jim and erica. this is very much ongoing. it went late into the night. we saw various mccarthy

emissaries going into and out of his office. we know they are reaching out to these 20 hardliners. at one point one of them saying that this is going to be a longer process of negotiations, that they can go to some of these -- they said they know they are not going to get all 20 but they don't need all 20 but they do need a large chunk of them. again, he can only afford to lose four. we know that mccarthy and his allies continue to negotiate, that he's still trying to give concessions but remember he's given away a lot of concessions it i point, he doesn't have a ton of cards left to play. we also know that this group of 20 is talking amongst themselves, that they are also seeking out who might be a consensus candidate of sorts, someone that they could get behind. congressman byron donalds was on cnn this morning just a little bit earlier today, he talked about what that process might look like. listen to this. >> i'm not going to reveal names. there are members who are talking about different alternatives, people who might be able to find a pathway to get to 218 and then from there, you know, we will have those

discussions between members one-on-one, between groups of members, caucuses and see how that shakes out. i don't think there's going to be anybody from outside the house. >> reporter: so, again, the stage is set for later today at noon. they come back. will they adjourn to have further meetings and further negotiations? there will be another vote? that is what we are waiting to hear. we're hearing that it is likely there will be another vote, that's what our lauren fox was told just a few moments ago but we have to wait and see. that's several hours from now, so much can change in this situation in several hours. >> no question. we will keep watching. jessica dean, thanks so much. joining me now is someone deeply involved in all of this, republican congressman don bacon of nebraska. nice to have you back on the show. >> thank you, jim. always an honor to be on with you. thanks for having me. >> first let's begin with the vote. kevin mccarthy actually lost a vote over the course of those first three yesterday. based on what you know, can he turn that around?

can he get the votes to be speaker? >> he can, but we've just got to be honest with what's happened here. a small group, a handful, have made demands over the last two months. every demand they asked for was given. i didn't agree with these demands, i thought we should have demanded some kind of quid pro quo back for demands -- these are unilateral concessions that kevin made, but then they never came back to support him. so they keep changing the goalposts. i think these folks will be very hard to get to yes. that's just the way they are. they love gridlock, they love chaos and that's what we see going on here. i hope kevin continues to work, he should hold firm because 91% of the conference supports him. he's done more than anyone else to help regain this majority, worked hard for four years, been in every district. i encourage him to continue but he may also have to start looking across the aisle to determine if there could be some compromises made on committee ratios and things like that

because if the small handful refuse to be part of the team, you cannot let them hold you hostage and that's what they're doing right now. they don't think we have the wherewithal to do anything without them. we need to show them otherwise. >> you noted this yesterday, this idea of reaching across the aisle to find a consensus candidate, that is, reaching across to democrats. are there any such talks under way right now with democrats? >> there are preliminary talks but we don't want to go too fast on this because that then high jacks what kevin is try to do and we want to support kevin, he's worked hard to get this, but if at some point the small handful of folks who refuse to be part of the team after the conference overwhelmingly voted for kevin, if they make it clear that they cannot be team players then we have to look somewhere else. in the end we have to govern. this is about leading the greatest country in the world and we cannot let a small handful of folks that are on the extreme part of our conference, one of the smallest caucuses that we have, we can't let them

control the entire house of representatives. >> i understand the desire to keep the content of such talks under way private at this point, but let me ask you this, you say you need a consensus candidate in your view is that consensus candidate mccarthy or someone else? >> well, we should -- i think we should absolutely start with kevin and as long as kevin has his name in the ring, we should be working to get him 218 votes. i also think at some point he needs to work with hakeem jeffries to talk about committee ratios, office spaces, how we're going to do various rules that could open up some doors for the democrats with like motions to recommit and things like this. there could be some ground there where he could work across the aisle and maybe achieve 218 votes that way. there's different ways to do that. some folks could vote absent or present or just not vote. there's different ways to go about it. if at some point he can't get there and these folks refuse to

be part of the team, they're trying to hijack the team, trying to run the house with a handful of people and that's unacceptable to the rest of us, then we have to work across the aisle. in the end you have to have a bipartisan capability in the house because you have to work with the senate, you have to work with the democratic president and i'm not sure that this small handful is willing to do that. >> let me ask you this, folks at home might not know this, you are unusual, you are a republican you've won in a district that is competitive. most districts are not and you have a lot of folks who are here in districts that frankly they hold these hard line positions, they will be just fine, but what you're talking about here would be republicans in effect defying some republican voters here. i mean, are those votes that they could survive down the line, right? i mean, do folks say this is something they would be willing to do to get to a speaker and cooperate with democrats? >> we have to be americans first and to our freedom caucus friends -- by the way, it's a minority, the freedom caucus that is doing this, the majority

of the freedom caucus supports kevin mccarthy. by the way, most conservative commentators are supporting kevin. it is a small group, they're demanding their way or the highway and they're hurting the party, hurting us in 2024. i listened to the news last night, i was sick to my stomach. the small group is putting mud all over all the republican party at this point. to hear the other side mocking us during the votes yesterday, that's all on these 20 people and i hope they see that, but, you know, i commanded air force squadron in combat, i commanded five times, deployed four times. you have to be a team, even if it's only 08%, 58% perfect team, you have to form a team. that's how you get things done. nancy pelosi was able to do it with 222 people last time. we've got to be able to do the same thing and this small group is hurting us, hurting the gop nationally. >> we did hear this morning from trump, didn't hear a lot yesterday from him, but this morning he is reiterating his support for mccarthy as speaker on his truth social app.

will that win over -- do you believe that can win over mccarthy's opponents? >> it may with some of these folks because they're pretty, you know, hard core in president trump's camp and, you know, i think we need all voices to speak up on this. when you get 91% of the vote you should coalesce around that team instead of demanding what you want. jim, if i may, they demanded a month ago a whole list of concessions, they got them all. about a week and a half ago they did a whole another list, they got almost all of it, if they didn't they got halfway on one or two. monday night they demanded to have chairmanships on various committees and more seats on ways and means and the rules committee. that's unacceptable. these committees and the chairmanships are merritt based. they want an affirmative action program for the freedom caucus and the rest of us think it's unacceptable. >> you mentioned conservative commentators, one of them, hugh hue wet and others have said

mccarthy should start taking concessions back, as you said, he made these concessions got nothing in return. when you say he should hold the line, should he go that far? >> i believe so. i believe some of these concessions were unacceptable but they could not even get to yes with these concessions. to vacate the chair, figure out how many people you need to try to bring the speaker back and recall him, we had it at 121, you know, as of last month, they wanted one. they wanted a single republican to have a gun to the speaker's head on every vote. kevin mccarthy negotiated it down to five. i don't think that was smart. i think we should take all of that back now because he made these concessions with the intent that they would meet him halfway and they have not done so at all. i agree with hugh hewitt, take these concessions back. >> congressman don bacon, thanks so much for taking the time this morning. >> thank you. lots to dig into this that conversation. still to come here we are live

support, meantime, we have just seen it exploding, continuing to grow for hamlin after that horrific moment when he fell after going into cardiac arrest on the field after a tackle. that of course during monday night's game against the cincinnati bengals. you probably heard a lot about the gofundme that he had started, it was for a toy drive. it is now at more than $6 million in donations. pretty remarkable. cnn correspondent adrienne broaddus live outside cincinnati hospital where he is in intensive care and i know, adrienne, you have been speaking with his family. >> reporter: yes, i spoke with his uncle, dorian glen, outside of the hospital last night and he told me he and his brother will not -- and the rest of the family, quite frankly, won't be able to rest until damar is out of the intensive care unit. he also says the next step that doctors will be focusing on is getting damar to breathe on his own. i want to share with our viewers

more of my conversation with his uncle. listen in. >> his heart had went out so they had to resuscitate him twice, this he resuscitated him on the field before they brought him to the hospital and resuscitated him a second time when he got to the hospital. i just want to show my gratitude for the medical staff that were on hand because if not for them my nephew probably wouldn't even be here. we were all in tears, man, i'm not a crier but i never cried so hard in my life, man, just so know like my nephew basically died on the field and they brought him back to life. >> reporter: an abundance of gratitude for the team inside of this hospital working around the clock to help damar hamlin recover. outside of the hospital we've seen an outpouring of support, there's what i like to call the get well soon corner. there are balloons with wet well soon messages and there's also a

single golden balloon with the number 3. that is the number damar wears on the football field, but he is number one in the hearts of his family and they tell me because of the community's outpouring of support and those prayers, that's what is helping them to get through, but as you can imagine the unknown is terrifying. jim and erica. >> it certainly is. adrienne broaddus, appreciate it. thank you. also joining now to discuss dr. barry marin a cardiologist and professor of medicine. good to have you with us this morning. i was struck when i heard damar hamlin's uncle tell my colleague adrienne broaddus that he had to be resuscitated a second time. we know how important every second, every moment is in these instances. were you surprised at all when he mentioned that, that this had to happen a second time? >> well, only in the sense that

commotio cordis which is the condition here is typically in individuals with normal hearts, structurally normal hearts without disease. and it's the blow, the chest blow, that elicits an arrhythmia that can be reversed, as it was eventually here. why there should be the implication of damage to the heart resulting in a second cardiac arrest later, i'm not sure. >> okay. we've also learned that he had been turned onto his stomach to alleviate some of that pressure on his lungs. just based on what we know publicly and based on your experience, what are your concerns this morning? >> well, i can't really comment about the -- you know, the events and the treatment that are taking place after the

event, okay? it's probably very complicated and it's hard to imagine. i can only say that the fact that there was a second cardiac arrest implies that there may be heart damage. >> okay. >> that could be part of the resuscitative measures and all that, but at this point i don't think anybody can really speculate about a complicated situation like that. >> and hard to know if we don't know the condition of his heart, to your point, what it was prior or perhaps what the impact was of that event. when we look -- and if we pull out broader here, the sports institute says 1 or 2 out of every 100,000 athletes can experience sudden cardiac arrest annually and i think people when we think about this we think more about what we've seen in other sports in football, in basketball, for example, when this happens suddenly to someone in the middle of a game, not necessarily and exactly the way that we saw on monday night.

a number of states, new york, maryland, texas, have passed or proposed laws which require to have these external defibrillators, the aeds in schools. i see them increasingly in a number of public spaces. can you talk to us when you are not the nfl and don't have medical teams ready to go how important is it to have these devices readily available? >> well, it's critical. i'm not sure they weren't here. >> no, i don't mean in this situation. i mean broader. exactly to your point, the fact that there has been such an important push -- i mean, i've done stories on it with the family of a 16-year-old who dropped dead suddenly playing a -- a basketball player and their push to get aeds in more schools and we are seeing this legislation and these proposals more. can you speak to the importance of those devices across the board in different situations when, again, you are not dealing with a professional football situation where they do have medical teams at the ready.

this just into cnn, house republican leader kevin mccarthy we're told is empowering five republican congressmen to negotiate a deal for his speakership. that list includes congressman brian fitzpatrick, gary graves, patrick patrick mchenry. joining us to talk about the prospects of a deal molly paul and doug heiss. doug, i spoke to don bacon a few minutes ago on this broadcast, of course, republican who has been involved in some of these negotiations.

he said preliminary talks are under way with democrats about the possibility of finding a consensus candidate. i'm affair how much of a long shot that is given that you would have to have both parties helping each other but is that at least a possibility that they might not get anywhere and therefore they have to work together on a speaker? >> it's about as small possibility as there is, but as they said famously in a movie, so you're saying there's a chance. there's a chance, it's a very small one. what's interesting now is this group of five people and patrick mchenry from north carolina is i think maybe the smartest member of congress that i've worked with, are looking at options as to negotiating with the troublemakers within the gop conference, potentially democrats if it comes to that pass and as congressman bacon hinted at earlier one of the options is for this group and or kevin to say directly, quoting the godfather, here is my offer to you, nothing. to pull back from some of the concessions that he has made that disappointed some of kevin's supporters. that's a possibility as well.

we are at a kitchen sink moment right now. >> two good movie references there. >> i was thinking the same thing. >> godfather and dumb and dumber in the same answer is also an achievement. >> no pressure, molly. no pressure at all. but in all seriousness if we look at where we are at here, i can't help but wonder how kevin mccarthy, molly, got this so wrong. >> yeah. >> yeah, that's right. and i think there's a lot of questions, a grumbling among kevin mccarthy's coalition right now whether he failed to take this threat seriously enough over the past month and a half as he was projecting confidence, you know, the talks they are having now where they're sending emissaries to seriously listen to his dee fact tractors and figure out what they want and find a way to accommodate them, where wasn't that happening the last month and a half. seemed like yesterday there were more no votes for kevin mccarthy on the floor than people expected going in. he's losing support and that was

why he decided to come off the floor. so i think today there is going to be a lot of those conversations, they're going on right now, they're going to be going on until the hoaouse come at at noon and as doug said, you know, anything can happen. we are in uncharted territory. we are already in a situation that -- where nobody knows what could happen, anything can happen. so some of those talks about a potential unity speaker while i still consider them far-fetched so gain momentum if there continues to be a stalemate. >> when i asked bacon so who could that candidate be he seemed to imply kevin mccarthy for now but not exactly a public full-throated expression of support, doug, you've been involved in a lot of vote counting in your life, in your career. do you see kevin mccarthy being able to turn this around? >> i think we will know really with the first vote. where does that number go? if it stays the same, okay, we will go to a fifth vote but if that increases, the 20 turns to 21 or higher or decrease that is

tells us where these things are shifting in momentum. we've obviously had a new development here which is the statement by donald trump and so often we've seen republicans beholden to donald trump, i would say quite often have said to both of you way too much and way too frequently, but does donald trump hold sway with any of those 20 with his statement right now. it will say a lot about donald trump's standing in the party moving forward as well. >> speaking of holding sway, lauren fox was noting at the top of the hour here talking about the sway that jim jordan could potentially have. if you have jim jordan wracking up all of these votes yesterday as he's nominating kevin mccarthy, how much sway could/does jim jordan have with this group and is he fusing it, molly? >> well, you know, i think there is a feeling that mccarthy has already played that card by having jim jordan give that nominating speech, you know, figures like jordan and steve scalise have already tried to

make the pitch to the members that are the holdouts, trying to reason with them in public and in private. i'm sure those talks will continue behind the scenes and are continuing as well, but, you know, to your question earlier, in my conversations with staff and with members on the republican side, i'm hearing all kinds of different things. some of them are saying there is no way mccarthy makes t some are saying mccarthy is still inevitable, with he just have to wait it out. i think what that shows you is sort of an every man for himself situation where there is a lot of confusion and where a lot of people, you know -- at the end of the day this is a position of leadership and mccarthy's supporters a lot of them went into this hoping that he secretly had a plan or had some trick up his sleeve or some card to play. the fact that he didn't and is flailing around is causing him to lose confidence even among his supporters. >> by the way, a position that is in line for the presidency, right? there's a lot to this. doug heye, what kind of congress will the next two years be? at some point they will come to

a speaker but if you could have a battle like this and five members in effect plus the others they have been able to bring on board can cause so much trouble here, what does that mean for things like, i don't know, funding the government or any other piece of legislation? >> well, it shows why the omnibus bill passed last month because senate republicans -- and it's notable that mitch mcconnell will be in kentucky with joe biden today -- why they passed the omnibus, they didn't trust house republicans to be able to get this through. i have some sympathy here for kevin mccarthy because i don't know to some extent whether or not a deal will -- we will see ultimately if this is true but could have been cut. as he makes concessions and they have been agreed torques we talk about goalposts moving but they keep moving so much we don't know whether or not this is a caucus that is the nothing will ever be good enough caucus in which case the gop, whomever the majority and speaker is will have real fractures moving forward. >> i feel like i say this a lot, but often because it's -- you know, we need t buckle up, my

drive to pennsylvania. >> remarkable. they were tracking him. jean casarez is outside the jail in monroe county, pennsylvania, where kohberger is being held. jean, how quickly might we see him move to idaho and then what happens next? >> reporter: well, jim, we've just learned some brand-new information. the warden here at the monroe county correctional facility has confirmed with us on the record he is no longer -- bryan kohberger is no longer in this facility. he is now in the custody of the pennsylvania state police. that's what we know. that is all we know. they are being very tight-lipped of when he will go to idaho, when he -- how he will get to idaho, and this is because of safety concerns. but we can confirm he is no longer here in monroe county, northeastern pennsylvania, he is in the custody of the pennsylvania state police at

this point. now, it wasn't even 24 hours ago that he was in court right here in northeastern monroe county, pennsylvania. one interesting thing we learned was about his mental state, and this is important because the mental state may become an aspect of the defense once this case and the discovery gets going. he was asked by the judge -- and it was in relation to whether you are voluntarily, freely wanting to be extradited back to idaho, and she asked him, have you had any mental diagnoses or are you on any medication that could make you not be able to give a lucid, free and voluntary answer, and he said, no, i'm not. so that's in regard to his mental state. right now, not at the time of any crime that took place, but right now he says there is no mental diagnoses in his background. you know, yesterday his family was in court, i was sitting right behind them, and they were

very emotional. i mean, very emotional. his mother when she heard that he would be extradited back to idaho to face four homicide charges she just sort of collapsed into her daughter's shoulder. they brought out the kleenex. he kept looking at his family when he could, but it was interesting. and the fact is the prosecutor in this county does have that probable cause affidavit that was sealed, but the chief public defender, his sole representative here, told me he never got it. jim, erica. >> he never got it, and there was some talk yesterday, too, that that was one of the reasons that he was waiving extradition, they want to see what is in that. jean casarez, great to have you. i appreciate the new reporting, too, this hour. cnn's security correspondent josh campbell joining us to talk about all of this. i have a question. we know that there was an alert put out essentially from idaho saying, hey, we're looking for this white hyundai elantra with

these years, it was about a week later that the suspect and his father were on their cross-country trip back to pennsylvania. he stopped twice by state police on the same day, on that drive in indiana, once for speeding, then he's given a warning for following too closely. in a statement yesterday the indiana state police said that at that time they didn't have suspect or license plate information when he was pulled over that could have helped make a connection. can you give us a better sense, josh, what is the protocol here? we send out information about this car, a similar car gets pulled over twice in a short period of time, but there's no connection made. does that surprise you at all or is it perhaps just par for the course? >> yeah, you know, in this case it is certainly chilling to know that this officer had an encounter with the alleged suspect here, that's something that's going to stick with that state trooper for a long time to come, but the fact of the matter is with very little information about the owner of the vehicle there's not police can do. if you go back and look to what

idaho police said, they were looking at some 22,000 white hyundai elantras that could fit the bill for the suspect car that they were looking for. so a lot of vehicles there. the way the process works is anytime someone is pulled over, think about if someone is watching this, you've been pulled over, the cop doesn't rush out to your window, they sit lack for a while and are running your license plate through the system, ncic, are determining if there is any type of warrant out for your arrest. at the time of the two traffic stops in indiana we know that the suspect wasn't charged. there was nothing that the officer could go on, but certainly a very chilling encounter, something that officers will be thinking about. >> josh, we just learned from jean casarez that kohberger is no longer there in pennsylvania, likely that he is now being moved to idaho, could be there depending on how he's going as soon as today and that means soon we will see the contents of this affidavit. how much would prosecutors need to reveal in that affidavit? in other words, so what should we expect to see in terms of

evidence there? >> yeah, this is interesting. it appears that this extradition process is now under way, this suspect will be rendered from pennsylvania back to idaho to face those murder charges and what happens in a legal setting, whenever an officer is trying to get a warrant, i've sworn out numerous warrants, there are two parts, there is the actual order itself, a judge saying, yes, go arrest this person, but there's what's called the probable cause affidavit, this is the rich detail that the officer or agent puts in there to say this is why we know this suspect is the person who committed these alleged crimes. they have to get into evidence. they have to actually convince this judge that, yes, this person should be under arrest. interestingly under idaho law that document, this affidavit, can't be released until kohberger is physically back in the state of idaho, but one thing that i will we will have to watch, the police chief in idaho says he expects this document will be released very quickly. he is not the only stakeholder here. the prosecutor will have to take this to trial if there is not a plea. we will have to wait and see

an intense storm, and what you're seeing is a massive bomb cycle occurring over the pacific. it's so intense and strong that it's going to bring in atmospheric river. i did tell you, the winds have started to pick up, the san francisco bay right here behind me is the bay bridge, also choppier, as we start to see the winds increase. we're expecting hurricane-force winds as the storm progresses into tomorrow. what it means especially after the new year's eve storm that really rocked this area, more flooding. we could see more mudslides, roads washed out. the other concern are trees. there's so much water on the ground right now the soils are softened, so that means more water can make trees loosing up and fall.
