institution. >> he's not alone. kevin mccarthy is now agreeing to major concessions overnight as he tries to appease the group of gop hard liners who are standing between kevin mccarthy and the speakers gavel. we have an update this morning on damar hamlin still in critical condition but showing signs of improvement. we'll talk to his close friend, indianapolis colts safety rookie

robby tomlin who just visited him. first to the speaker drama on capitol hill set to continue for day three as republican leader kevin mccarthy is seeking the job but apparently no closer to it after two days, six votes in which he has failed to secure the 218 votes needed to become sp speaker. the stalemate has rendered the house of representatives useless. no business can be conducted until a speaker is elected. mccarthy insists he is making progress, giving concessions to the 20 hard liners. the question is will it be enough. right now mccarthy does not appear anywhere ready to give up the fight. jessica dean joins us now. these are huge concessions he's made overnight. >> um-hum. >> what we don't know is if it's enough to get him the votes. >> that's the important question. you can give and give but if it doesn't get you to 218 or where you need to go, what's the actual point? here's what we know.

overnight, the early morning hours he has given some big concessions. you're looking at them there right now. chief among them, limiting the number of people to call for a vote for his ouster down to one. that used to be half of the gop conference. this is a huge swing. something a lot of hard liners had pressed very hard for. also allowing more of them on these more powerful committees on the house. he is giving away and playing the cards he has left to play, kaitlan. but the bottom line is, even with all of those he doesn't get to 218. he has to get more concessions, do more negotiating. so what is interesting is, i did talk to him after that sixth failed vote, there was a huge scrum on his way to the speaker's office, i'm optimistic, it's going to be fine. i said why are you optimistic? what makes you optimistic? he said, i have 90% of the votes and i've never seen anywhere where 10% rule dd the 90%.

mj lee join us now live from the white house. mj, good morning. listen, we've been saying embarrassing, the president saying embarrassing, but there are -- there's probably a word that's more ap a po that we haven't used because it's unbelievable what's playing out. good morning. >> reporter: good morning. that word embarrassing he actually used three times yesterday by my count. he said it's not my problem what's doing on on the house floor but yeah it's embarrassing it's taking this long for there to be a house speaker and there to be a functioning house of representatives. and one theme i noticed he touched on multiple times throughout the day yesterday is the idea this is so embarrassing for the u.s. in the eyes of the rest of the world. if you think back to the fact that going back to the 2020 campaign, president biden has been pretty focused on this idea of how the united states looks in the eyes of the rest of the world. you know, he'll often say when i

travel to other countries, world leaders are coming up to me to say what is going on in the united states? sort of referring to the events of the trump era and asking are all of those events, everything that happened that has been so unusual and strange, are those things in the rear view mirror? i think it's clearly the fact that january 6th is on the president's mind. obviously the two-year anniversary is tomorrow. he said we're just getting settled and moving on from the events of january 6th now we have an entire government arm that is just paralyzed. >> it was such a split screen yesterday afternoon on cnn with half of it was like biden and mcconnell come coming together to celebrate something -- together on the bridge. very symbolic. >> i did a town hall with president biden and he said that bridge is going to get done in the town hall. >> there you go. that, mj, with the dysfunction

on the house side. so the president will have the cabinet meeting today, no speaker, that throws off the line of succession, right? >> that's right. so much of what we have been talking about is the political drama. but i think we shouldn't forget just the real ramifications for just the functioning of the u.s. government. i know we've talked about the fact when there's not a house speaker you can't swear in members, some committee folks will not get paid and then there is the presidential line of succession. the first person in line as everybody knows is the vice president and then the second person is the house speaker, but because there is no house speaker right now, the second person in line to the presidency is senator patty murray, who is the senate president protelm, this is all stunning when you think about the fact we have a president 80 years old, the oldest person to serve as president. >> let's hope we don't get to that. >> our kids are going to be reading about this in their history books. mj, thanks very much.

>> it's crazy. we'll be all right. >> kaitlan? >> remarkable moments playing out. the white house is watching all of this. let's bring in ohio republican congressman of the house freedom caucus. he was on the floor yesterday nominating mccarthy on the fifth ballot. >> the root issue is this, they do not trust kevin mccarthy. what can heal that divide? right now, there are a lot of colleagues that don't trust 20 or more of my fellow republicans. i plead with all, all of my republican colleagues, let cooler, more rational heads prevail. >> so, do you think cooler and more rational heads will prevail today? >> i think so. i think for some people -- the reality is, there are some people who, in their estimation,

there's no way they're going to be able to support kevin mccarthy and some of the people who, you know, may have been willing to get behind kevin mccarthy at some point maybe the week before or the day before, and for a few people, maybe even the morning of that first vote on january 3rd, kind of hardened up to say there's no way they're going to support kevin mccarthy. the tough part is i think the number that will never vote for kevin mccarthy is more than four. >> then that means he's never going to make it to 218. >> he may never make it to 218. he may make it to a majority of the house, there are a couple procedural paths that can pull that off. >> going to the plurality, which is the nuclear option. >> the plurality would be hakeem jeffries. so i don't think that would be a good idea for anyone to do that. whether people change their votes or don't vote, don't

participate, there's a way to change the number. nancy pelosi won with 216. so during some of our vote series yesterday, a lower number than 218 would have won a majority of the vote. so, for example, when we move to adjourn, that was 216 to 214. >> but would that include some people voting present, some democrats not voting, what would that look like? >> it comes down to how can you put that stack together so ultimately the whole number becomes a majority? i don't think present covers it, i think you have to not vote or vote for kevin. >> he's still trying to get to 218, made major concessions to the 20 hard liners voting against him. do you think the concessions he made overnight has softened some of the hard liners and will they support him? >> i talked to people who came out of those notions. for some people it did make a difference. they're meeting this morning at 8:00, they're going to have a discussion amongst themselves to say how many of this does it move? is there anything left to

resolve, and then the real question is, are we going to hang together as 20 solid in a block to get the remaining things or is it at the point some of us are never going to get there, some of us are there, everyone go vote their own path. and after that they'll talk to leader mccarthy and hopefully close up a deal. we'll see at noon and either we'll have the votes at noon, which is a tough challenge, or there will be another adjournment and say we have signs for more progress. >> be even if he peels off 15 of the hard liners, you believe it's still not going to get to 218 with that. at what point do you think it becomes necessary for kevin mccarthy to withdraw his name? >> i think that's really for the conference to decide. and at some point for kevin. you know, it's been a long week but kevin has got a lot of support and, you know, people are growing frustrated with the process, but they are encouraged by the dialogue.

i think it's a sign of hope people are back at the negotiating table hoping to resolve it. broadly the rules that people are pushing forward. some soft speeches given on the floor yesterday, chip roy, for example, people could have stood and applauded across the con fence said we agree with the points you're making, but nevertheless, why can't we get to resolution? it seems like there's always a way to not quite get there. >> would it be easier if mccarthy withdrew his name and someone like steve scalise ran? >> the 20 people are saying there are a range of other people we could get to yes on, we just can't get to yes on kevin. >> sounds like you're saying yes, it would be easier if kevin mccarthy withdrew his name. >> but then you have people on the other side saying i'm only going to support kevin mccarthy. there are a lot of people in our conference who look at the race we had behind closed doors as

essentially a primary election. it was uncontested at the last minute andy biggs through his name in there, it wasn't close, it was 86% for kevin, the number on the floor is 92% for kevin. it's like why won't you abide by the results of the previous elections? now look, i will say, kevin's done a lot of work. as i listed off some of the compromises that have already been made, shrunk that number, he was at 188 in november, he's at 201, 202 on the floor right now. and after today he might be at 212, somewhere in that range. >> but if he's never going to get to 218, is the window closing for him, do you think? >> i think at some point in the dialogue across the conferences if we're never going to get to kevin we can go through the coping phases and everything else and be mad about it but at some point we have to have a speaker. >> warren davidson, thank you very much. you have a big day ahead of you.

better and signs that say pray for number three hamlin. he was number three on the field and that's where he fought to lead his team to victory. but this morning still fighting for his life, in intensive care, listed in criminal condition. also damar hamlin's collapse is not the first time, by a long shot that the nfl has seen horrifying injuries on the field. earlier this season, miami's quarterback, tua tagovailoa, lied motionless for several minutes suffering a concussion, his second in two weeks. he suffered a third concussion on christmas. in 2017, pittsburgh steeler's linebacker suffered a career ending injury after he was tackled. that injury left him partially paralyzed. ten years earlier, kevin everet's spinal cord was nearly

severed. but darryl stingily never walked again after suffering a broken vertebrae and spinal cord injury. the nfl now penalized hits to the neck or head of a defenseless receiver. in the final game of the '97 season, reggie brown suffered a serious spinal cord injury after a tackle, "the new york times" wrote, brown laid motionless on the field for 17 minutes, he stopped breathing, turned blue and purple. he survived but that injury ended his playing career. also wide receiver chuck hughes remains the only player to die on the field in a game, he was 28 in 1971, team doctors tried to resuscitate him but declared dead at the hospital. a short while later the cause of death was a blot clot caused by

a hardened artery in his heart. violent game but many people suffered many injuries. >> now it's not clear if the nfl will postpone or cancel the bills game this weekend. there's no thursday night football tonight so players return to the field on saturday for the first time since hamlin's hit. so here's how the dallas cowboy's head coach said how the team is handling it now. >> let's be honest, nobody is fine. we all have the tendency to say we're good. that's where our mind is, focus is, after great confidence we'll get done what we needed. but most importantly stating the obvious if we need to adjust we'll adjust. >> so joining us rodney thomas ii, a close friend and former high school teammate of damar. he drove from indianapolis to

cincinnati to visit him in the hospital. we're happy you're here, sorry you're dealing with this. obviously that damar and the family are dealing with this. you saw damar in the hospital following his on field collapse. is there anything that you can you tell us about your visit with him? >> just basically that family, family is in good spirits and he's getting better. he's progressing every day, that's all you can ask for. every day he's getting better. >> how is his mom? >> she's strong. she's fighting. and she knows her baby is in there fighting. and she's going to be beside him the whole time, until he walks out of there. >> also, if you're comfortable, what did you tell him when you two were alone when you got to spend some time with him? >> just basically that i love him and i got his back. and see him in a little bit. >> how are you doing?

>> i'm doing good. >> because i don't think -- you know, we -- i know we don't know the toll it is on you guys who risk your life every day when you go out there. >> yeah, it's just -- it's a dangerous sport. you kind of -- you don't just go around like every play thinking about like -- things like this, thinking about injury. just the same way you don't go around regular life thinking that way. it's just -- it's a freak play, a freak accident, it just sucks that things like that exist in the game. it just sucks that you have to see stuff like that. >> don was talking about you -- when you talked to him in the hospital, when you sat next to damar's bedside and you talked to him, i read you said you know he could hear you. >> yeah, i know he can hear me.

like i said, even -- i don't need no response, i don't need nothing. i just know what i said got across. like i said, i'm going to see him in a little bit. >> can you -- you know, the players had to witness all of this. they were there, you know, with him on the field and we've been hearing from players and they said finally they felt -- obviously it was awful what happened but they felt treated like human beings. can you talk to us about what the players are going through at this moment if you don't mind sharing? >> just like player wise, players now, football is a -- the world in general we're all one heartbeat right now. just all -- all just waiting for damar just to get healthy, just waiting for him to come out of there. and then just -- like i said we're all just together right

now. just waiting for him just to get better from this so we can just see what we have to do and what sense we have after that that we have to follow. right now it's just, everybody is on the same page we're trying to see him get better. >> it's not just this team, right? it's the entire nfl. do you think, are players ready to go back on the field? >> i can't speak for everybody, and i can't speak on behalf of everybody. but i know that each team, organization, different things like that, they need to trust that everybody will just make the best decision, whether that's playing, not playing, i don't know. i'm not in control of that. i do what i'm told to do, i can't focus on things like that. i know that me, like i just want to see everybody out there flying around, making plays,

doing what he loves. everybody just having fun out there, being safe. >> did i hear you right, did you say damar would want you guys to play? >> yeah. >> okay. >> he was just -- he was just one -- i don't want to say he would want us to play, but he would just -- i don't know. he would just -- he would just want us to be out really. >> can you talk to us about him, beyond the field? we have heard the most amazing things about this guy. like beyond the charity that he set up, just like what is in his heart, who he is, how he was since he was a child, what is he like as a man? >> yeah. i had mentioned this before, but it's just like the same. if you go back home, you just say damar's name, ask about damar, everybody will say the same thing, everybody will talk about like him, how genuine he

is, his heart, his passion, family man, he always just -- he puts everyone else above him, he wants to see everybody else succeed and do good and he wants to keep being the role model for his little brother, for other young people and then just for other people just in general in the world. he just -- he's the type of guy that you can look to. humble, just does whhas to do and take care of his. that's all you can ask for. >> i just want to follow-up on the team questions that i asked. because we had tim graham on earlier, a buffalo bills beat writer for "the athletic" he said it is top of mind for players that any hit on the field could result in something like that. do you think players will be thinking about that once they do get back on the field?

>> like i said, you can't -- you can't go -- especially in this game, you can't be on the field like expecting like to get hurt, worrying about getting hurt every single play. it's crazy and as dangerous as the game is, it's something that we've kind of like second handedly trained ourself to not really think in those ways and not even understand, like the situations and the danger that we actually are put into just by playing -- simply by playing the game. but i don't know. sorry, it's just -- it -- this whole situation like is crazy. >> say again. you said this whole situation is crazy? >> yeah. everything is crazy. just want to see him get out of there. >> is there anything you want people to know because we can't ask every question.

and i'm sure you've been watching this and things you want to say about the situation about damar and his family and so, what would you like to say before we let you go? >> just want to say that everything that everybody is doing, you see the support that the world has for damar, for his family, just everything just keep putting prayer, thought, whatever you do, just keep putting all the energy towards him, towards his mom, his dad, his family. just -- they're the ones that need it right now. and like everybody -- like everybody -- finally they're just understanding and getting like a glimpse just based off the situation of who, like you said, everybody is understanding who he is, and like the type of player he is and the type of person he is, but that's just -- we've always -- that's who he's

party leader kevin mccarthy for house speaker. leading some to wonder will democrats and moderate republicans team up to elect a mccarthy alternative. don't hold your breath. so joining us now to discuss, cnn senior political analyst and anchor john avlon. >> why you got to be glass half empty? >> i'm a realist. it would be great but go on. >> rose colored glasses here. >> that's why we love you. it's just a reminder that this kind of dysfunction or division is not inevitable. it's a choice. it's a reflection of the structures in our politics. but what's fascinating in contrast to this rolling disaster in washington is a couple of state legislatures have stood up in the last few weeks, really days, and offered a different path. let's look at what these folks have done in states like ohio, pennsylvania, alaska, pennsylvania convenes deeply divided, bitterly partisan

state, state lecture was 101 to 99 democrat to republican. looked like the far right was going to win. instead democrats nominated a centrist, moderate republicans stood with democrats to form a bipartisan governing majority. variation on the same thing happened the same day in ohio, a moderate conservative bounded with democrats to say we're going to govern in a more bipartisan fashion excising the far right. the og example is alaska is where you have a 20-person state senate and you had narrowly 11 republicans, nine democrats. looked like the far right, who were only three folks were going to dominate the state legislature. instead, moderate republicans said we're going to form a majority with the democrats. so that's what they've done. so you have three states this happened. >> okay, rosie sunglasses and

glass half full. that's great, that's in the states. once people get to washington they show their you know what -- >> you call them laboratories of democracy one of my favorite books. >> yes. >> because they're not all rosie in the states. the fact they could do this. >> it's a big deal. >> once you get to washington and the cameras are trained on you, you feel the power, people change. >> and yet you know what, maybe what's changing is the frustration. maybe this is a warning sign of how deeply dysfunction this division is and it doesn't represent americans. you have the majority of americans being divided and disempowered. i'm saying this remains a possibility. don bacon was on cnn yesterday and floated this option. i'm not saying it's likely, but saying it's possible. >> it would be great. >> if you look at the 2022 election, independent voters, moderates saying enough with the extr

ext extremes. this would be a more representative outcome. no reason it couldn't happen, the math works. democrats could merge with moderate republicans. i don't want to play fantasy baseball here, although i am a fan -- >> this is obviously an aaron sorokin film coming up. >> it should be a function bipartisan governing majority to reflect the will of the american people. we don't need to accept this extremism. >> thank you john we appreciate it. back to reality, kaitlan take it away. >> it's quite a moment. we'll see what happens here, though, if it's anything similar to that. f former president trump has been watching closely what is happening here on capitol hill. he wrote overnight that the numerous votes and failed votes is making the process of electing a speaker bigger and more important than if it was done the traditional way. trump endorsed mccarthy earlier this week. there are concerns that's what's playing out is weakening the speakership.

matt gaetz, one of the never kevin republicans dismissed the latest bid to boost mccarthy as sad. he told fox news this changes neither my view of mccarthy, trump or my vote. he's a fierce ally, refusing to bend to the former president's influence when it comes to this race. one trump ally involved in the 2024 campaign said if he is ignoring you, that's not a good sign. joining us now is former acting white house chief of staff in the trump administration, mick mulvaney, also a former south carolina congressman and founder of the freedom can ucus. kind of every qualification to talk about what is happening here. what do you think is going to happen today? you've been talking to members. >> i think it's more of the same for the next couple days. as soon as i say that, there will be a break through in two hours and if i said something will happen in two hours, it'll

take seven days. no one knows what the schedule is. i know that kevin mccarthy's resolve is not waning. i know for example back in 2015 kevin went through something similar to this and then threw in the towel and stepped aside. last night i was at dinner at the republican club and bumped into 30 or 40 different members not all of them kevin supporters but most of them kevin supporters and there was no sense of desperation, no sense of chaos. they wanted kevin to ride this out. that seems to be the overwhelming altitude right now in the republican conference they want kevin to stick this out because they don't want to give in to what they see as extortion by the never kevin folks. >> is this something that just repeats itself? >> absolutely. if this happens then any five or six will be able to shir the will of the party every time. how would you like to become speaker knowing five or six people could kick you out of

office the next day. >> has mccarthy already weakened the speakership with the concessions he has made to them? >> i don't think so. the weakened -- the weakening has come from the fact that the majority is so narrow. they needed to have a 25 or 30 vote majority. and they didn't get that. keep in mind, nancy pelosi had the same position. it didn't get as much attention because she handled it a certain way. that was every single thing she brought to the floor had to have 100% support from her party and she did that. did that weaken the speakership? probably does. you have to go by the rule of 100%. didn't get as much attention but the same set of circumstances. it's the narrow majority that weakens the speakership not the concessions. >> you helped push john boehner out of power, you weighed in on this in 2021. i want to listen to what you said.

>> he would have been a great speaker in 1968. but was not a good speaker in 2010. you could not go into the tea party movement not realizing it was something different and if the leadership doesn't change it will be replaced. >> do you think you helped pave the road for what we are seeing play out right now? >> no. i thought about that lot. i get asked that a lot. when we fought with john boehner in 2013 and 2015, it was because we felt, rightly or wrongly, we felt he was marginalizing the tea party wave of the party. we couldn't on committees, get our amendments heard, get our legislation voted on, those things. you fast forward to today and kevin mccarthy has done more than anybody to bring conservatives into the fold. jim jordan, a member of the -- founding member of the freedom caucus stands to be the chairman

of the judiciary committee if kevin is speaker. some of the rules changes that kevin offered, offering amendments to prevent unfunded m mandates, those are things fiscal conservatives would have gotten on their knees and begged for in 2013, now they're here. so it was a principle, policy driven objection to the way john boehner was treating the conservative wing of the party. i get the feeling here, this is more of a personality thing, they don't like kevin. it's not driven on principle, it's personality. >> you said yesterday you were approached by some of them about being a consensus candidate. >> someone asked me a question to a reporter and apparently i accidentally confirmed someone said you'd be a great speaker. >> a republican lawmaker said that? >> yeah. we were joking last night 15
