speaker kevin mccarthy said the talks are, in his view, making headway. >> i think we're making progress. >> we're all working together to find a solution. >> the new concessions first reported by cnn include what was once a red line for mccarthy, agreeing to propose a rules change that would allow just one member of the house to call for a vote to oust the sitting speaker. we're learning this morning that the new concessions are not going over well with some gop moderates who mccarthy cannot afford to lose. he needs all those votes. we're following all of the latest developments on capitol hill this morning. let's begin with cnn chief congressional correspondent manu raju. so a lot of talks underway last night. you had a late one. more talk this is morning. where does everything stand? >> reporter: highly uncertain at

the moment. it may happen or collapse. we simply don't know. he still doesn't have the votes to become the speaker of house. last night re reported about the key concessions that he made to a handful of conservatives opposing his speakership, allowing one individual member of the house to call for a vote to oust a sitting speaker. that is something that he has opposed in the past. but he came down and agreed to that. that is caused a lot of angst within the ranks of more moderate members that it could make it unstable and make him a short-lived speaker. and he got support from conservative outside groups but in a significant change that could impact how the chamber operates, policy and the bills that come to the floor, agreed to add some members of the far right house freedom caucus to the house ruling committee. that is a very powerful committee in congress. and that essentially dictated the terms of legislation and what comes to the floor and

agreed to put some of the members on there so it will raise questions about how they'll be able to govern on some key policy issues in the new congress. assuming he becomes speaker. and that is still uncertain. if he does those proposals and if they do win over support, it would only be with maybe ten members. he needs to win back 16 members of that 20 group -- 20 pooppones who have voted against him. six times he's been rejected by the full house. can he get the other members, that remains unknown because some of the members have other concerns. this morning he did meek with congressman self who opposed kevin mccarthy, and they met in the speaker's office and he walked out and declined to comment. and it is uncertain whether he will win him over. and his goal is to go one by one to get them on board. but the challenge is there are four republicans dead set against him and he can only

afford to lose four votes. so that means he essentially needs to win back every own one of those 20 opponents in order to win the speakership. so it is a very, very narrow path. mccarthy is still believing that he will get there and at noon today the house reconvenes and it will go to a ballot if they don't move to adjourn to allow the talks to play out. the house is in a complete state of paralysis, and they can't do anything, not even getting national security briefings which is raising major concerns on the impact of the government if they can't get a deal here. >> we do have comments now from the incoming democratic minority leader in the house hakeem jeffries. let's listen in. >> -- but we need a willing partner on the other side of the aisle. it is my hope that today the house republicans will stop the

bickering, stop the back-biting and stop the back-stabbing of ae each other, so we could have the back of american people. that is what we were elected to do. that is what congress should be doing. in the face of a global pandemic, that continues to be with us, in the face of inflationary pressure all across the land and throughout the world, and in the face of a dangerous conflict in europe, the biggest conflict since world war ii. these are serious issues that require the attention of the united states house of representatives. it is time for the republicans to get their agent together. and we as democrats are ready, willing and able to partner with them to find common ground

see kevin mccarthy be elected based on leadership and policy and our commitment to recruit candidates to have our back-to-back pick up in seats in the last two congressional elections and selecting the right people to be on the right committees. so those conversations between leader mccarthy and those who are not yet yes votes continue yesterday. >> and mccarthy has agreed to have a single member to force a floor vote to remove the speaker and other concessions among them agreeing to allow more members of the freedom caucus to serve on the rules committee. and those concessions, and they are big ones, have they won any new commitments to support mccarthy as speaker. >> i think that is the kind of discussion still going on this morning. which is after leader mccarthy's good work with members of the 20

that were voting no as of yesterday, he made a lot of give and take yesterday. as i said, very constructive discussions on rules and spending and budget reform and who would be on what committees and the question now is who has gone to yes and that is what we await for the report this morning. >> so you're saying that no one despite the concessions has committed to voting yes, to reversing their vote? >> no, i'm not saying that at all. i'm saying the discussions continue because you have a few people engaged in discussions anz you have a lot of people that have to be explained to, met with and have more detail with before they get to that final conclusion. >> okay. the issue here of course is given the slimness of the margin, mckacarthy needs not ju the right wing members to support him, he needs the moderates as well, including those like don bacon has

expressed real criticisms of some of the concessions here. are you certain that moderates will support, continue to support mccarthy with these concessions that they very publicly oppose? >> well let's see how that rules package ends up in detail and in writing. let's see what the budget and spending reforms end up as. and let he's s-- let's see what the committee does. and mckacarthy knows this conference well, and what it takes to move forward so we could create a contrast to the proposals and policies of joe biden. >> you have been in congress a long time. you know the issues of getting anything through under normal circumstances. if you have this new dynamic where just one member could raise his or her hand and call for an effective vote of no confidence in the speaker, how did you get anything else done.

and not just for the speaker, but for the republican majority, things like spending bills, you know, raising the debt limit? >> well, look, speaker pelosi had a very narrow majority. she worked very hard at crafting a unity plan for house democrats in the last congress particularly. and kevin mccarthy has the skills and abilities and the ways and means to do that in this congress. >> about but he can't get elected speaker. she was elected on the first ballot. we're six votes in. >> i think he will be elected speaker. there are 200 members standing firm behind kevin mccarthy. we put emphasis on the 19 or 20 that have not gotten to yes yet and the vast majority of this conference, 200 people including center right and more than half of the freedom caucus support kevin mccarthy as being speaker and i think we'll get there and get there soon and i think yesterday was a good day and i

hope today is an even better one. >> you're an experienced politician. you saw the results of the midterms. there was expectations of a red wave and it didn't happen and in large part because a lot of more extremist candidates lost their races. is this good politics right now for republicans having just gained the majority in the house to be giving in so much to a wing of the party that has not fared well for republicans in recent elections? >> democracy is messy. would you remind you a hundred years ago in 1923 house republicans went through precisely the same unrest, only at that time the insurgency was from the left and not from the right and it led to one of the most product congresses for the next probably eight years led by nick longworth and president calvin coolidge. the budget was balanced and the debt was paid down and it was a good time for republican leadership in the house. so we're going through a messy

president and the white house see as essentially having been heroes coming out of january 6 and the 2020 election. so we are talking about law enforcement officers, as you said, including capitol police officers many of whom got injured and harassed and assaulted as they tried to protect the capitol from rioters. some of the names include capitol police officer eugene goodman and people might remember he played a role in diverting the rioters away from the senate chamber as lawmakers were in the process of evacuating and has been heralded a hero for those actions. m michael finnon and carolyn edwards who testified before the house january 6 committee that she had lost consciousness at some point and then when she reg reg regained consciousness she

decided to run back into the chaos. a number of people honored tomorrow are also election workers. including some other names that again viewers might be familiar with because of the committee hearing, including the mother and daughter shay moss and ruby freeman. they gave emotional testimony before the committee saying president trump and his allies attacking them for their work have been incredibly traumatic. so this is a big moment for this president and the white house. of course, the events of january 6 is something that the president has talked about a lot including leading up to the midterm elections. jim and erica. >> seeing officer goodman stand there again in those harrowing moments is just a reminder of the day. thank you so much. officials say that buffalo bills safety damar hamlin is in critical condition after suffering cardiac arrest during the game on monday night. overnight the nfl chief medical officer said the league is investigating every possible cause for the incident.

information on a important message from damar hamlin's dad? >> reporter: yeah, the team got a very positive message yesterday. i was told the bills were visited via zoom call in a team meeting yesterday by damar hamlin's father, conferenced in and the players were encouraged to hear from his father that he is making progress. a glimmer of hope that this team no doubt needs as the first of the final regular season games are set to kick off just 48 hours from now. will players be ready to play? there are huge playoff implications. one player needs two catches for half a million dollars and another needs one sack to reach a million dollars incentive. regardless, it is a challenging time mentally and emotionally for players and coaches along. here is joe burrow who was on the field when damar hamlin was on the field as to whether he thinks players will be ready to play this weekend.

by as bryan kohberger, the man charged now with murder in the stabbing deaths of four idaho college students is likely to make his first court appearance in moscow, idaho. >> he's facing four counts of first-degree murder and one count of burglary. veronica miracle is following this story and outside of the courthouse for us this morning. there is anticipation that we could learn more today because the affidavit will be unsealed. >> reporter: that is right. that is certainly what the hope is today. the doors just opened to the courthouse, media members are lining up and now what we're waiting for is that docket to be released to see if the suspect bryan kohberger is in fact on the docket. and if he will be in front of a judge today , at what time. and the probable cause affidavit that has so much information about the reasons for his arrest, that is supposed to be

unsealed and that is up to the judge and he hasn't made a decision on the timing of the release, after his first court appearance or sometime before. so we're still waiting for more information on that. but bryan kohberger is here. the courthouse is in the same place as the jail. and he was brought over and booked here last night for four counts of murder and one count of burglary. after a very long flight from pennsylvania where he was extradited. that flight had multiple stops and he finally landed last night at the pullman regional airport and we video of him coming in being handed over from the pennsylvania state police to local authorities and at that time you could see in the video that they put a helmet and a vest on him. the entire time authorities have been very tight-lipped about the transition process across the state lines. and they said it is because of security reasons and you could see in the video extra security being taken. the reason why he was in pennsylvania is because he was on a cross-country trip with his father from washington state back to the family home in

pennsylvania. and during that trip they were in the white hyundai elantra that place were looking for. they were pulled over twice, once by hancock sheriff's department and the other time by indiana state police and we have new video from the hancock sheriff's department when they pulled bryan kohberger and his father over. take a look. >> is this your car? okay. cool. you're coming from washington state university? and you're going where? >> we're going to pennsylvania. >> so you work at the university there? >> i actually do work there. >> reporter: both of those times he was let off with a warning. we're still waiting to learn more information about those pull-overs and meanwhile here we're still waiting to see if and when bryan kohberger will be in court today. jim and erica. >> veronica miracle with the latest for us in moscow, appreciate it.

thank you. joining us now to discuss further former boston commissioner ed davis. good to see you this morning. there is a lot of attention being played to the two stops, they happened so quickly and so close in timing to one another. indiana state police said late tuesday that said, look, in terms of the traffic stops at the time we didn't have information about the suspect or the license plate that would have made a connection here. people on twitter, boy there are a lot of experts weighing in who feel differently. i'm sure you're not surprised. but there is an implications that the stops were part of a broader tracking from authorities. is there anything that you would see that would suggest that to you? >> well, there is a police tactic called a pre-text stop. where police would plan out an investigative stop of someone using a minor motor vehicle infraction to justify the stop. it just doesn't make any sense

in this particular case. this is very unusual to have two motor vehicle stops in the same state, but it could have been a result of just egregious driving that caused it to happen. i just -- it is possible that police planned this. but i couldn't fathom the reason for it in this particular case. it just doesn't make any sense from an investigative perspective. >> you watched this video. what stands out to you in terms of what you're seeing in the behavior of both -- of all three, of the suspect, bryan kohberger and his father and also the officer? >> well i think the officer did a good job. he walked up to the vehicle and asked for paperwork and did the things that an officer usually does, which is where are you coming from and where are you going and the simple answer to that is i'm coming from the university and going home for the holidays. when they started talking about the different things that had happened to them, and invoked a story about the s.w.a.t. team,

well if you wanted to do something that is going to get the police to investigate more heavily, stop talking about stuff like that. you talk about guns and you talk about shootings and swat teams and that will pique the police but at some point in time i think you set out to father and son and we'll just, you know, just let them go. but considering the circumstances, it is beyond the way that they spoke to the officer. >> it does raise a lot of red flags in addition to its fact that the license wasn't run, the registration wasn't run and pulling someone over on a highway for following closely, and that is unusual. and another basic question and jim sciutto brought this up, is it strange at all to you that a person who lived an area where there have been gruesome murders likely knew that people were searching for the exact car that he is driving, would in fact get in that car and drive across country? >> it makes no sense.

especially something that was done by a person who had a criminal justice background. i mean, he had to know that they were looking for that vehicle. you would normally dump that car and get a rental car or take a plane or do something, anything other than getting into that vehicle. so it doesn't make sense on so many levels right from the get-go here. it is just a very odd story. >> what are your questions, after watching that video, knowing what we know today, do you have questions what the follow-up may have been that we may not know about between authorities? >> i can't say what the follow-up may have been but the question that popped in my mind is what was in the mind of the father here. the line of questioning and answers that he had, was strange. he might not have had a confession from his son. he might not have been absolutely certain that the son was involved.

this just into cnn, russia has declared a very brief cease-fire in its ongoing invasion of ukraine. this for two days beginning tomorrow. >> cnn scott mcclain is live in kyiv for us. so the kremlin's announcement coincides with orthodox christmas, correct? >> that is right. so in the orthodox faith, christmas eve is tomorrow and christmas day is the day after and this is one of the most important religious holidays in that faith and this originally came as a call from the head of the russia orthodox church who called for a temporary cease-fire beginning tomorrow at noon extending through the rest of christmas eve and then all of

christmas day up until midnight the following day. so 36 hours in total and it seems that the kremlin is going to take him on this proposal. so they've just put out this statement saying that russia plans to hold a cease-fire along the entire front line, the line of contact, as they call it, and they also said this, i'll just read two lines from this statement. it said based on the fact that a large number of citizens professing orthodoxy lives in the kbot areas we call on the ukraine side to give them the opportunity to attend services on christmas eve as well as the day of the nativity of christ. we don't have an official response from the ukrainians but i imagine soldiers on the ground are considering that russia has made promises and not kept them before. so we'll have to see whether this temporary cease-fire comes to any kind of fruition. but the timing here is quite interesting and that is because

turkish president erdogan has been working the phones today, he spoke with vladimir putin earlier today, urging him to unilaterally declare a cease-fire to try to get peace talks back online. something that hasn't happened for months and months. he was hoping for something more ambitious than just a temporary truce. the russians and the kremlin has said that, look, we're happy to have peace talks but ukraine needs to recognize that the territorial boundaries have changed and we're in charge of some of the territory that they used to hold and something that the ukrainians will not accept as a starting point for talks. erdogan also spoke with president zelenskyy today, and also offered his services to try to broker a peace deal. turkey has tried to use its unique position having warm relations with both kyiv and moscow to try to be the mediator having some success with
