speakership if he can pull this off. >> manu said at the end, you've been trying for two months to get the votes. i think it speaks to why wasn't there a bigger push like this a month ago to avoid a scene like this on the floor. >> i think it's remarkable he went to the floor knowing he didn't have the votes and it never felt like the momentum was moving in his direction. this is back to 2015 when he bowed out of the speaker's race, folks got paul ryan to run, a reluctant speaker, he didn't want the job either. i think mccarthy looks back at that, seeing that ryan had some of the same problems he's experiencing now. so what is he going to do, step aside and let someone else get the job and in six months they're the enemy of the freedom caucus, the hard liners? >> last night one of the hard liners said whoever is going to be the speaker has to agree to

and communicating but writing. his first question asking, did we win the game? and doctors here at the university of cincinnati medical center say that update fans received yesterday goes back to the quick response on the field monday night. the doctors crediting the bills medical team for recognizing that something was seriously wrong. injuries happen on the football field often but doctors here say it is rare to have a quick response and that response prompted physicians to be at damar's side within minutes. listen in. >> i don't like how he went down. >> we're going to need everybody. all call. all call. >> call, bring everybody. we need everybody. all of yous and get woods out here.

>> go ahead. i need another medic in the back, please. medic in the back of the bus. >> affirmative, we are right outside the gate. >> i'm on my way. >> critical moments but that team remains so calm. doctors also sharing with us that there was prompt recognition that damar lost his pulse which led to immediate by stander cpr. and if they had waited minutes or seconds longer, the outcome could have been different. >> way worse. thank you. we have an update on the suspect accused of murdering four idaho college students making his first appearance in court since being extradited from pennsylvania. this comes as a police affidavit tells us a lot about the evidence authorities say connects bryan kohberger to those killings. seven weeks it took, a little

over seven weeks to find the suspect and now we know how they got to him. veronica miracle joins us live. >> reporter: so many disturbing details and what police say happened that morning and in the weeks to follow in the affidavit that was released right before in court. one of the families was there in the front row and they hardly ever took their eyes off of bryan kohberger. bryan kohberger, clad in an orange jump suit, appeared in an idaho courtroom thursday. >> all rise. >> reporter: the 28-year-old is charged with the brutal stabbings of four university of idaho students more than seven weeks ago. >> mr. kohberger i'm going to advise you of the rights you have in this case. >> reporter: in newly released court documents, investigators detail the evidence that led to his arrest. according to the affidavit, kohberger's dna profile obtained from the trash at his family's home, matched dna on a knife

sheathe left at the crime scene, laying on the bed of one of the victims. one of the surviving roommates said she was awoken at 4:00 a.m. heard crying from xana kernodle's room, heard a voice say it's okay i'm going to help you. she described him as 5'10", not muscular, but athletically built with bushy eyebrows, saying he walked past her as she stood in a frozen shocked face. but questions remain why no one called 911 until eight hours later. the document details multiple s sights of a suspect vehicle showing a white hyundai elantra like this one that led to kohberger's arrest. about two weeks after the murders, police from washington state university flagged his vehicle later seen at a traffic stop in mid december in indiana

while driving with his father to pennsylvania. and before the cross country drive and five days after the murders, kohberger received a new license plate for his car according to washington state licensing documents. cell phone records also show that kohberger's phone was near the victim's residence at least a dozen times since june, including about five hours after police believe he committed the murders according to court documents. kohberger seated with a new court appointed attorney listening to each count of the murder. while no evidence was released that connects kohberger to the victims or any indication of motive. the pain for the victims' family is all too real as some sat in the courtroom. >> it's an emotional time for the family seeing the defendant for the first time. this is the beginning of the criminal justice system and the family will be here for the long haul. >> reporter: and there was an entire page redacted from that affidavit so there are still

questions to be answered, including why this happened. what was the motive. he is next due in court on january 12th. >> veronica, thank you for the update. coming up in a few hours, 8:00 a.m. eastern, you're going to hear from the father of the victim kaylee goncalves, why he said the suspect was afraid to look him in the eyes when they were in court. to ukraine where a russian declared 36-hour cease-fire is in effect. vladimir putin ordered the truce to coincide with the russian orthodox christmas. ukraine for its part hasn't agreed to its part calling the move hypocrisy. scott mclean is in crukraine f for us. is this cease-fire holding? >> reporter: it has not.

and merry christmas eve to you. the ukrainians have given no indication that they'll observe this cease-fire and of course the russians have given o easily improve their position along the front line. even just now since the cease-fire has been in effect my colleagues have witnessed incoming and outgoing fire along the front line in eastern ukraine. and just about 25 minutes ago the air-raid sirens went off here in kyiv. the head of the ukrainian orthodox church said that is evidence that the russians had no intention of honoring the cease-fire. the former president of russia said the ukrainians had rejected the hand of christian mercy. spoken to plenty of soldiers who said there's nothing christian after russia's invasion of their

this morning police in albuquerque are looking at five shootings that are possibly connected and targeting the homes and offices of democrat elected officials. the most recent shooting involves the former campaign office of new mexico's attorney general. >> it's very scary. you know, as a mom, it's just -- it's something that you never want to experience. >> right through the front door, five shots straight through the front door, my front window. went straight all the way through my house, through my living room. my back window. >> both my husband and i just sat up because of this noise. it felt like somebody was using their fist to pound on our door. >> it's very disturbing that we have -- that people think it's okay or they feel emboldened to

do things like this. >> lucy has reporting on this and joins us live this morning. that is very scary. five different incidents. >> reporter: yeah, poppy, good morning. not as good of a morning in albuquerque where detectives are investigating these multiple incidents where homes of leaders have been targeted in the past month. all five are democrats. the shootings all taking place on separate days. three in december, one before noon yesterday, another on january 3rd when at least eight shots were fired at the home of state senator lynda lopez. these of those bullets passing through her 10-year-old daughter's bedroom. while no one was hurt or injured this was scary. police are investigating this as a top priority and working with federal partners, including the fbi, and asking the public for

hour, donald trump sued by the fiance of brian sicknick, the capitol police officer who died responding to the insurrection, today marks two years since the insurrection. also the house speaker drama now raising the alarm over the debt ceiling. christine romans is here to break it down. also some really significant news out of prince harry's new book. we'll tell you what it includes. as poppy mentioned today marks two years since the attack on the seat of america's democracy when pro-trump rioters stormed the capitol of donald trump's 2020 election loss to joe biden. now the estate of brian sicknick is suing the former president. here with the details is paula reed. good morning to you, what ado yu know? >> reporter: good morning. we're getting news about special counsel jack smith we've learned he recently returned to the

united states. he had been working abroad following a bike accident and now he's back he's staffing up. he's going to need all the help he can get because we learned he has a mountain of new evidence to sift through as he decides whether the former president and his associates should be charged for january 6th. >> we cannot afford to brush political violence under the rug or turned a blind eye when others encourage it. >> reporter: while president biden commemorates the second anniversary of the january 6th capitol attack by presenting medals to michael fanone other law enforcement officials who responded that day, the justice department continues the biggest criminal investigation in its history. already more than 950 people have been arrested for their alleged participation in the deadly riot. roughly half have pleaded guilty

and 40 have been convicted at trial. just one has been acquitted. the house select committee that also investigated january 6th believes that prosecutors should charge former president trump and his associates as well. >> we want to make sure that the key organizers and movers of this attack don't escape the scrutiny of the justice system. >> reporter: that decision is now up to special counsel jack smith. appointed to oversee the investigation and efforts by trump and his allies to overturn the results of the 2020 election. >> based on recent developments, including the former president's announcement that he is a candidate for president in the next election and the sitting president's stated intention to be a candidate as well, i have con included that it is in the public interest to appoint a special counsel. >> reporter: attorney general merrick garland promised smith's

appointment wouldn't delay the investigation. >> he promised to the american people in his own statement that there would be no pause or hiccup in his work. >> reporter: but smith is still in the process of putting together his team. bringing on two long-time associates who specialize in public corruption cases, a source tells cnn. smith also must comb through a massive amount of evidence, including what the january 6th committee recently turned over and discovery collected from lawyers from trump allies late last year, some of which hasn't been opened yet according to sources familiar with the probe. smith himself fired off a round of subpoenas to officials in seven key battleground states and received a trove of documents and this voice mail from someone claiming to work for trump's post election legal team. >> i'm a lawyer with rudy giuliani's team working for the president, and we need access to

some dominion machines which we understand may be something you can help us with. >> reporter: federal prosecutors have been focused on trump's state of mind after the 2020 election but in an interview with cnn, trump's lawyer said they are not worried, at least about the evidence gathered by the committee. >> they've outlined a few charges here, all of which are completely legally insufficient. so yeah, we kind of look at it as, it's political noise but doesn't have any effect as of right now on our defense. >> reporter: the january 6th committee ran into obstacles with key witnesses like mark meadows but the justice department has additional tools like going to court to compel the witnesses to cooperate. but there is concern this could go too far into the election cycle. so smith is under pressure to move this along and maez make these decisions as soon as

possible. >> here we are two years out and now this is what we have in washington, kaitlan. >> yeah, it's remarkable to see this playing out on the two-year anniversary. we'll see president biden speaking today, don, obviously happening on capitol hill, lawmakers are going to resume with still no speaker in place and without a speaker, the house cannot convene and cannot begin official business. that means among other things that no classified briefings for lawmakers who oversee the nation's national security agencies and there are some of them who are raising concerns about what that means for the period of time that we're in right now. >> technically, i don't have a clearance. i'm a member of the intel committee, i'm on the armed services committee, and i can't meet in the skiff to conduct essential business. my point is, we have work to do. that we couldn't do right now. >> one of our three branchs of

government is off line right now. that's dangerous, and can't happen much longer. we oversee all 19 intelligence agencies we are currently off line. >> joining me is a member of the house intelligence committee, congressman jason crow, saying this is undermining lawmakers' abilities to do their jobs. thank you for being here. what kind of concerns do you have about the real effects this gridlock is having on the ability to do things like monitor national intelligence and security and look at those matters? >> i sat on the house intelligence committee and the house armed services committee in the last congress, i made national security a focus of my work here. we're not receiving briefings, not able to have discussions with the administration. i tried to go to the white house and they wouldn't allow me in because i'm a member elect and not a member of congress right now. there's a lot that's happening that's preventing oversight, the normal work. that's not good. the work of the national security apparatus on the hill

has ground to a halt at this point. >> because of this, you had issues getting into the white house? >> that's right. >> has that ever happened to you before? >> never happened before. i'm going into my third term in congress, if i learned anything there are unprecedented things every term. >> last night we saw they adjourned until noon today. some of them want to keep adjourning until they can make sure that mccarthy has the votes or however this ends up. democrats are they going to fight to stay here throughout the weekend, do you think? >> we will. we're here, ready to do the work. i'm entering my third term in congress and every time i started a new congress, in 2019 when we had the nation's longest shutdown, 2021 when we had the insurrection and now 2023 when the republicans are unable to elect a leader and convene a congress. democrats have been here. we've been ready to do the work. our sleeves are rolled up, we're here. we're ready to go. i have a whole slate of legislation that i have for my

squ constituents and the american people. >> there are questions whether or not democrats could ever support a moderate republican if that name was put forward for speaker. do you think that's a scenario that could happen? >> i'm not going to support a republican for speaker of the house. >> no republican. >> no republican. i will support hakeem jeffries because he's in the best interest of the american people. i'm a proud democrat. the republicans have proven at this point they are unable and unwilling to govern for the american people. regardless of who they put up, they have acted irresponsibly, until they have the personal reckoning they need to have and find principle again as a party they' i'm not going to support them. >> one thing we did see happen yesterday is someone put forward former president trump's name. i think that's not going to happen. what does that say to you as

someone here on january 6th for that to happen the day before the two-year anniversary on that day. >> i was there as you know, trapped in the house gallery surrounded by that mob who killed a police officer and brutally beat over 100 others. it was a terrible day. what i've learned right now is that you have a group of republicans who have fore saken their oath and duty. they're more interested in power, supporting a -- frankly a sociopathic ex-president than doing the work of the american people and they're sitting in the house. that's the reality. i've been sent here to do the work, a job, and that's what i'm going to do. >> people said mccarthy brought this on himself because he went to mar-a-lago after trump was condemned by a lot of republicans after january 6th, is that the case here? >> when somebody foresakes

principle in the pursuit of power, eventually that catches up with them. that's what i think. i think that's what you're seeing with kevin mccarthy. he has a reputation, on both sides of the aisle as someone interested in raw political power. when you don't have principle and don't stand for anything, you don't have a foundation. i think he is floating around in space without any base of support right now and you're seeing that coming back to bite him. >> do you think it's odd he's in the speaker's office given he is not the speaker? this has been a complaint some of the rebels, the hard liners have raised, but in practical terms is it odd for him to be in the speaker's office. >> i think it's odd. but one thing i learned in washington, ego and hue bris can explain what happens here. certainly putting the cart before the horse not something i

what i truly worry about, besides the internal dynamics, i worry about the debt limit. everything else is going to be messy, government is messy. the debt limit can be an impact. look at 2011, what the stock market did when we approached the debt limit. >> he's right, that's former republican lawmaker adam kinzinger on what worries him about the divide in the house. lawmakers unable to decide to vote for a speaker. earlier in december, goldman sachs warned the effort to increase the debt ceiling could be worse than the crisis in 2011

that cost the united states the perfect triple-a rating. let's look at what was then, that chaos. the treasury secretary has vowed to take, quote, extraordinary measures the allow the u.s. to continue paying creditors, including borrowing from federal pension plans. the u.s. will not default on its debt immediately. >> we are one week from the deadline that could wreck america's economy and reputation. >> leaders in both parties, both chambers have reached an agreement that will reduce the deficit and avoid default. >> stock prices take a nose dive today dow jones closing down more than 265 points. this losing streak now continuing in its eighth day, even after the federal government avoided default on its dealt. >> they downgraded the u.s. to double a plus rating. >> this has never happened in the history of the united states. >> they feel fed up with

washington politics, even on this side of the planet because it's having a true economic impact here in asia pacific. tokyo is the largest stock market here in asia. it is also the second largest holder of u.s. debt. >> the guy from s&p said, washington couldn't get their act together fast enough. >> and the question is, could it have been avoided if washington had? >> it could have. and it can again be avoided. christine romans is here with more on what we can expect. i think people don't get what the debt ceiling is. >> this is america's credit card borrowing limit. it's important here. we have raised it 11 times since that crisis in 2011, 20-some times since the beginning of the 2000s. we go over and over again, there's a debt ceiling that has been set to keep borrowing in control and congress keeps spending and cutting taxes and so, spending just keeps rising and then they thrash about how

to -- what to do with that debt ceiling and it gets raised again and again and again, but that uncertainty every time they try to raise the debt ceiling or fight about it causes a loss of reputation for the u.s. our treasuries are the gold standard to mix a metaphor for the rest of the world. it's not good. this is not a washington story. this is a main street, wall street money story, it is an international story, a loss of american creditability. to play the game is dangerous. the question is, if we can't get congress started, how are they going to handle the big stuff. >> that was 2011. again there was another standoff two years later, 2013 over the debt ceiling. we were around the clock covering it. in the middle i interviewed warren buffett. here's what he said about weaponizing it. >> i think the first thing that should be done is that both sides should say we will not use

the debt limit as a weapon anymore. in fact, we should get rid of it entirely. we can't just keep playing this sort of game. it's detrimental to the economy, worries people unnecessarily. if they want to keep the debt down, just don't spend more than they raise in revenue. >> if you want to keep the debt down, don't spend so much money, don't cut taxes, don't do the things they have been doing to run up that limit. >> he said it a decade ago and said get rid of it and they've done neither. >> this is what happens if they don't raise the debt ceiling. it's dangerous, it can hurt the economy, jobs, the u.s. credibility. it drives up interest rates which makes it more expensive to fund the debt. we run on credit in this country, spend more than we bring in.
