tomorrow, morning members say committee will meet, which means that by this time tomorrow, night we could learn more about the deals that kevin mccarthy made, which include key committee positions, in exchange for this party needs to -- some are not known, even the members. joining us is cnn capitol hill reporter, melanie zanona, what do we know more about these so ideals of the speaker movement? >> anderson, gop leaders are not committed to making a list

of every concession kevin mccarthy made in his quest to become speaker. despite the fact they have called for a more open and transparent government. now, some of these concessions were explicitly spelled out and a house rules package, which republicans did pass last, night with the support of every republican except for one. but some of these other promises that were, made ridden through more of a handshake deal. gop leaders are insisting that there is an official master, list and wasn't aside, deal they tried to walk members through what some of those verbal agreements were doing conference meetings this morning. that includes time -- is a hard line for democrats, and could to have a fiscal showdown. it is also promised to put more conservative members on key committees. but, some rank and file members -- take a look what nancy mace told our colleagues today.

>> there are still some questions i think many of us have about what's the ideals may or may not be -- what handshakes for made. >> are there any other side deals for chairmanship's? >> so republicans will meet tomorrow morning, where they will begin to actually populate these committees with members, after that shares get to elect their subcommittee chairs, so we should start to learn more in the coming days but the full extent of mccarthy's concessions. >> some of them already been implemented, what has been implemented so far? >> one of the key concessions that kevin mccarthy agreed, to those to create a special committee, to investigate this quote, weaponization of the federal government. so the house did pass a resolution to create that committee earlier today, there's a party line vote, and the resolution included specific language that will allow members to look into ongoing criminal probes, including some of potentially involve former president donald

trump. so, the next step, says kevin mccarthy, you will get to five members to that committee. we are expecting some of the kevin mccarthy critics to be a part of, that democrats will get to appoint their members, but the big picture here is that this was probably going to be the central avenue the republicans use to protect donald trump, defend donald trump, and go after the biden administration. >> melanie zanona, appreciate, coming up right, now has majority leader steve scalise was asked about giving c-span cameras greater access to the house floor, the way they had last week during the speakership saga. he replied, quote, i think that we. great earlier today, matt gates followed measure to do just, that and mark polk and says he is introducing similar legislation, -- which included mike rogers launching a congressman kate saying, where they have an oscar. more today from cnn's tom foreman. >> republican congress members nearly coming to blows in the battle over the speakership. congressman shown often. newark freshman republican george santos who told reporters and donors a string of lies during the campaign about nearly every facet of his life. today, two democratic members of the new york delegation went to the house ethics committee with it, we will speak with one of them, right after the cnn report from jessica d.. >> george santos'problems piling up. >> was the best outcome here? >> you have to send a message that if you defy the voters who can be held accountable. >> congressman richie thomas and, gomez launched a request for formal probe into his disclosure reports on tuesday, this after a campaign watchdog group, filed a complaint against him with the federal election commissions, and have concealing the source of more than $700,000 that complaint also alleges santos's campaign falsified how it unspent campaign funds. santos told reporters today

he's done nothing unethical, house gop leadership told reporters tuesday they would address santos in private. >> this is something that's being handled internally, obviously there are concerns about what we have heard, and so we're gonna have to sit down and talk to him about it. >> all of this as santos faces international federal and local investigations into his past. including a revived investigation in brazil, where according to documents obtained by cnn, he admitted 2010 to sunday checkbook 2 years prior there wasn't his mother's possession, and using it to purchase clothing and shoes. >> i was very frustrating. being deceived is a terrible feeling. >> according to brazilian authorities, this rio shop clerk at the time was a victim of santos's fraud, losing over 1300 u.s. dollars when santos forged the check. bruno recounted it to the

hill. joining us now is dan, goldman one of the two members who fired the ethics committee complaint. so if republicans can control the house, and leadership saying that santos will be handled internally. are you confident at all that there actually will be an ethics investigation? >> well i don't know what internally means, but the ethics committee is required to investigate members for potentially unethical or illegal behavior. and it's a bipartisan committee that has equal members republican and democrats and non partisan staff. i've heard from several republican, members including one in new york who went public with it, that there is support on the republican side for an ethics committee investigation. and, so i would hope that if republicans do care about members of congress following the laws that we write, that they would also support an ethics committee investigation. >> is that something that a sitting congressman can use campaign funds, to pay for attorneys to defend against, or

prepare to for an ethics investigation, do you know? >> i don't actually know, but if you can use campaign funds for attorneys generally, i'd assume that you're able to at least use either campaign funds or some of your member budget, but i'd expect george santos would also want to be cooperative, if it's truly did nothing unethical, as he said, the nation turn over documents and materials related to his financial disclosures, and his campaign finances, to the ethics committee so they can examine them and making a determination whether or not he did do anything unethical if he's right then there should be an issue and if he's wrong, then he should be in congress. >> we obviously saw during that battle over the speakers, gavel just how narrow the margins are for house republicans -- status for is obviously critical to his victory. if mccarthy continues to need that vote, do you think santos likely remain safe? >> well, it's very clear that

the republican leadership has, not at any point, rebuked or condemned santos's conduct, his web of lies that is come out, more and more seemingly every day, and every week. in fact, there is reporting last month that, it was perceived to be a running joke among republican leadership, so george santos is essential to kevin mccarthy getting the speaker's gavel, he's essential to continuing their majority, and what's clear is that gop leadership has wrapped themselves around george santos, a serial liar, and complete fraud, as part of who they are. >> what do you think the consequences should be for santos? based on what is already known about the lies he told. there are those who say deny the committee's assignments are expelling from congress. this also those who stayed low to voters do with him at the ballot box in two years. >> one of the reasons we file this complaint is that there are no specific ethics laws prohibiting deception that we

know of, i should say. so he lied about his ethnicity, his religion, his education, his employment history. the list goes on and on. but what we filed this complaint as a committee, to look into his finances, and there are very specific and clear but. and, so that's why we are pursuing this angle, is that his financial disclosures, are incredibly suspicious. he had a windfall for several million dollars, after being in debt and making almost no money, and he gave seven several hundred thousand dollars of that windfall to his own campaign. that yellow lights all over the place here, let's see what's in them, and that will make a determination what the proper recourse should be. >> i've heard that in the past, some embers of congress have been investigated by the house ethics committee, has spent millions of dollars on attorneys trying to defend themselves. and if they, resign -- investigation would stop.

the first time tonight, on the discovery of classified documents, ten of them in a private office use during his time as vice president, speaking in a prepared statement at the end of his visit in mexico, he said his lawyers did what they should've done, and quote, when they realized what they had and immediately called the national archives, according to a source familiar, matters among the classified documents or intelligence memos, and briefing materials covering topics including ukraine, iran, and the united kingdom. separately, cnn learned that attorney general merrick garland have been briefed met multiple times, there's political dimension to this. we'll get some perspective from manu raju at the capitol. what are you learning more about the new oversight -- regarding these documents. >> that's james, comer he's a new chairman of the house oversight committee, and he's wasting no time into digging into this issue. he sent out two letters, both the white house and national archives, asking for a wide range of records and communications, including the records that were retrieved in biden's private office. he wants that all by january

24th, among the matters he's looking into is whether or not other people have handled these records, their security clearance as well as other issues. the question will be whether the biden white house decides to cooperate. biden tonight suggested that they would fully cooperate. so the new republican house, whether that means if they, don't how that perceive? dan without proceed to a subpoena? fight will that lead up to the weeks ahead? there are other ways that republicans are hoping to get some more information, including 1000 telegrams committee, mike turner who's new chairman of the committee, issuing a letter to the chairwoman of the director of national intelligence, asking for a damage assessment of those records. one worrying this could lead to potential national security breaches, and one area that is simply the case. so we've seen republicans

wasting no time, digging into this issue. the question will be, how much did the biden administration cooperate, and if, not what happens next, anderson? >> is this comparable request what house democrats asked of the national archives in the match national archives documents inquiry? >> in some ways, yes anderson, as a matter fact is some democrats right now asking for similar questions. senator mark warner, who is the chairman of the senate intelligence committee, ask for a briefing himself. he wants also that briefing about what happened with mar-a-lago. there are also democrats there saying this is a completely different situation than the mar-a-lago case, in which donald trump had far more records, apparently tried to obstruct investigation, and they also battled back and forth about this, and people take durban say, this is different. joe biden, cooperated, apparently turned over these documents, told dick durbin -- also said the merrick, garland the attorney general's handling is thoroughly and professionally. i should also say, anderson, that a lot of democrats are just simply keeping their

powder dry. they don't know where this is gonna go, senate democratic leaders and house democratic leaders have been mostly quiet about this, just trying to time to assess what comes next. >> all, right entourage, appreciate. it dries, now former about -- also cnn political correspondent, and inside politics anchor at the phillips. ben, what do you make of this? obviously, there's an investigation underway, democrats are very quick to point out the differences between what happened with the vice president, may or may not have done to what the former president's done, what do you make of that? >> well, i'm proud of joe biden, somebody on his team made it mistake, as soon as we figure, that raises hand, turned his stuff back over, that's where you're supposed to do. can we just be honest here, there's a bigger problem which is the overclassification and under monitoring of documents. this is not the first time this

is happened... your public library does a better job of keeping track of library books, then the federal government is doing keeping track of these classified documents. so sometimes people makes mistakes. the key is when you make a mistake, do you own up to it and try to get it right? where do you hide it and do all the stuff that trump has been doing? so joe made a mistake, he admitted to it, ordinarily this is tied for the, thing it's not a crime, it's a mistake, unless there's criminal intent and you see no intent. >> abby, today he takes them seriously. he was surprised to find out that there is any documents in the office, is that can be enough explanation for republican members of congress? >> it's certainly not gonna be enough of an explanation for republicans. i think that they see this as a political gift for them, as a way of inoculating themselves against the allegations against former president trump, who by the way, had hundreds of documents in his possession, and the issue, really there, was that he wouldn't give them back when the government asked

for them back. that is a key part of all of this. now, you know, one of the challenges for biden is that he, in commenting on the trump case, seemed to sort of, say i don't understand how in any way these documents could ever end up, as side of where they ought to be. i do think there is an argument to me, made that a times, things can get mixed up and people can make mistakes. this is to give the archives, back and answer those comes as soon as possible. i think biden is going to have to answer for those comments that he made in the past, is not gonna be enough for him to say i didn't know there are there. it is his responsibility, and out of his staff, to go through his belongings, and give everything back when he leaves office. six years, later doing that is

not just a mistake, but it's something that i think, you know, he knows should not have happened. >> and, then look, democrats are very quick to defend the president, and pointing out these differences, they also be concerned about why they're classified documents, or files mark personal and then vice president's office. >> that's why there's a lot against that stuff, and his team screwed up. i think we will be in a situation where we have more information going forward. i think the most important thing we can say tonight is that perfection is not a job requirement for the president, the vice president, anybody else works in the executive branch. people do make mistakes, the question, is do you hear those mistakes. we get yourself into a bunch of trouble when you have a chance

to cure the mistake and you don't. let's take you do not purpose. that's where the contentious, up that's why people are more concerned about what trump did in what biden did. look, if it turns out the biden's hiding a bunch of stuff in for some reason is not cooperating, we should treat in the same way, but we should not treat biden in appropriately harshly, to justify treating trump appropriately harshly. >> abby, obviously house republicans, who are looking into what they say is the weaponization, were concerned about the weaponization of the federal government against conservatives, and particularly the justice department or the fbi, the certainly plays into, that these documents were discovered a week before the midterms last fall. , there have been questions by

republicans in the house, areas about why users information held on to for so long, why is it only lead now. >> well, i think by that same token, you can argue that the justice department could've made it not a spencer currency is politically damaging to trump, prior to the election and they don't do that either. the justice department has a long-standing policy of trying to avoid making moves before an election they can have an impact on that election. remember, after the last midterm election they announced a special counsel to take over the trump, case they could've done it before the election and they didn't. i think that this cuts both ways. so, you can attack the justice department for waiting, and certainly there are some questions about why we're learning about this now in january when these events happen in november. but i don't think that is much of a surprise to me or really anyone else before the major midterm election. nation know that one of these individuals, on the house side, the oversight chairman james comer is now looking into this issue when it comes to biden but just a few weeks ago he

horrific school shootings in america, police say a six-year-old boy pulled the trigger on friday. his teacher was shot, and remains hospitalized, among the many questions are how this can happen, and who is to blame? cnn's brian todd has more. >> the mother of a first grader could face charges, police tell cnn, in the case of the teacher shot in the chest friday. >> i think tha it is certainly a possibility. >> it was the mothers, gun six -year-old intentionally shot the teacher, with police tell cnn. >> he put it in his backpack, and was driven to school by his mother later that morning, and then at some point it came out of his back that, and was concealed on him. >> failure to secure a gun from a child is only misdemeanor in virginia. [sirens] although it other cases, more serious charges have been brought. after failing a fatal school --

after the child found his loaded gun in a shoe box on the bed. >> if you leave a gun lane, around it's pretty obvious to most people, that's a dangerous thing to do. the question, is whether the parent can foresee this harm would come. there is where prosecutors get into some tangle. >> experts say the six year old now been evaluated under a temporary detention order is likely too young to be charged or tried. >> you can't form a criminal intent to maliciously wound someone and two, he's not competent at that age to understand the proceedings. >> the teacher of -- warner is in stable condition. her first question to the police chief, as whether the other kids are okay. >> hashtag teacher strong, hashtag richneck strong. >> i fell teacher calls her compassionate kind, but also mentally and physically strong. >> i've seen her resilience and love for what she does

heard about how heroic the teacher was by heard of some details in another employee. >> that's right, anderson, i really don't think that this part of the story has been discussed enough in this whole scenario. we have heard about the heroism with that teacher, abbies warner, getting out of the classroom, and be the last one to leave for she herself sought help in the school office. police say there was a second school employee, right after those children rushed out of the classroom, rushed into the classroom, restrained the six -year-old boy until police got, there and police say, that boy that moment became combative and struck that employee. the employee was still able to restrain him until the police got there. when you think about that, and the heroism that it took, after those kids get all that classroom, you rush in there you don't know what you're gonna confront. guns still had several bullets in the chamber, that child could've taken aim at that second employee, and fired. and you don't know any of that going into that room, that took

some real heroism, and i think that's an underplayed part of the story. >> right, todd appreciate it. let's get some perspective from joe, jackson colonel defense attorney and legal analyst. this is obviously just troubling, it's horrible. how likely is, it in your view, for the child's mother will be charged? >> i think it's very likely, anderson, for the following reason. i think prosecutors are not only going to look at the existing statute, of course that statute is well known, in the event that you recklessly leave a gun lying around and it gets into the hands of a child, we certainly know that can endanger others, but that is just a class one misdemeanor. virginia, not to get to, technical goes clause one, two, three, and four. and the class 1, when you're eligible for up to one year in jail. okay, so what? when it relates to a person that's been shot, in the stomach by the child. that's the more serious issue. so it's not just a misdemeanor, i think prosecutors will look to. i think they will look to employ other measures, right?

other measures, for example, where you are criminally negligent, in another way, such that it raises the specter in what the liability should be, this is happened in other cases. so i think prosecutors will be very creative, about using other laws to potentially get more criminal responsibility, beyond a class one misdemeanor, it's much more serious than, that and i think a felony -- for his deterrence value, and just a value in this happening, it should not have. >> how difficult might be for prosecutors or defense took attorneys to try to piece together, precisely what, happened given the shooter is a six year-old child? i mean, are there a lot of precedent cases for this? >> so, there's a lot of challenges in every, case with respect to noting exactly what the circumstances where the lead up to it. but i think there will be a full and fair investigation; where was the gun? obviously they've already look to determine how this was purchased, backs was legally purchased by the mom.

but what were you doing it with it? where were you storing? at how did he do not know that the child took the gun to school? what preventative and protective measures did you employ, so it's not just evaluation of the six-year-old, it's evaluation of all the surrounding circumstances. so, yes there are challenges indeed but i guess at the end end of the, day prosecutors and police will do a good job determining, so the best of their knowledge, how exactly this can happen, and preventing it from happening again. >> i mean at this, point notice adjusting the child would face charges. what would you expect the state to try to take some action, with those counseling, or some sort of intervention? >> yeah, i think that's important, and of course when you're dealing with a child, we talk about the mental state, right. adults can formulate. whether an adult person intentionally. where they reckless are careless. a lot different with the child really has other issues in terms of formulating. did they know, from an
