in the story. i'm live in memphis, tennessee this morning. poppy is in new york, kaitlan is on assignment this morning. here's what we're waiting for any day now the video of tyre nichols being beaten by five police officers it could be released. this as we learn more about the man his family called a free spirited soul. plus this. the should have never happened. it was preventable. but had the school administrators acted in the interest of their teachers and their students abby would not have sustained a gun shot wound to the chest. >> the school superintendent has been ousted and the assistant principal has resigned. more fallout after a virginia teacher is shot by her 6-year-old student. this morning we're learning what was in the classified materials found at the former vice president mike pence's home. >> the department of

transportation is looking into what caused southwest airlines travel meltdown last month. this is what we begin with. memphis on edge this morning, the city is bracing for the release of police body cam video of officers beating tyre nichols after a traffic stop that turned deadly. we're waiting to see if officers involved will face charges. i have a warning for you, we're going to show you a photo of tyre nichols in his hospital bet before he died. his family has seen the body cam footage they say it's horrific. they demanding murder charges. they say officers beat tyre like a human pinata for several minutes. sara sidner joins us this morning. they're bracing for the video in memphis. the chief condemning what happened to tyre. this is an awful sorry all around. >> reporter: it is. because we have not seen the video and the public has not

seen the video, there is great concern here about what the response is going to be. but we do know that this was a vicious attack really on the part of these five officers. and there are a lot of questions. we heard from community members who told us that they're worried this place is going to blow. but the thing that has tempered some of this is the police chief's reaction that she quickly reacted, she fired the officers and the community and family are demanding charges. and those two things may tamp down emotions to see that something is finally being done in this case. the memphis police chief speaks out in a recorded statement making clear there will be absolute accountability for those responsible for the death of 29-year-old tyre nichols. >> this is not just a professional failing. this is a failing of basic humanity towards another individual. this incident was heinous,

reckless, and inhumane. >> reporter: tyre nichols died earlier this month after a vie lent arrest by five roofficers, five memphis police officers and two members of the memphis fire department have been terminated. the community anxiously awaits for the camera footage to be released. >> the family wants the most charge that they can bring and what they want are murder charges. >> reporter: attorneys for the family have already viewed the footage and an independent autopsy paid for by the family reveals tyre nichols died from, quote, extensive bleeding caused by a severe beating. >> i hate that us as black people are out here killing each other. >> that's right. >> for what? i don't know why. what happened to the humanity and kindness -- >> that's right. >> reporter: nickels was a

driver for fedex. he'll be remembered as a loving father and son. the baby of the family with a tattoo of his mother's name on his arm. >> nobody is perfect. nobody but my son was near. >> reporter: he liked to go to starbucks every morning where he befriended an unlikely group of people. one of those friends tell cnn he was a gentleman who marched to the beat of his own donalrum. a friend said this of him, he was his own person he didn't care he didn't fit into what a traditional black man was supposed to be in california. he had a free spirit and skating gave him his wings. >> for this to happen to him in his way, the pain is just -- it's just -- i have no words.

>> reporter: so we also heard from the police chief who said that, you know, the reason for the firing of the officers was use of excessive force, duty to intervene, they failed to do that and duty to render aid. there is a question about the two members of the fire department because if they were there as emergency services their duty is not to enforce the law, it is to save lives. the question is, why were they fired? if they were there to save lives and that's not what they did, they didn't take part, that leaves a nasty taste in people's mouths. last night i was able to go into the church where they are going to have the funeral on wednesday s . and the senior pastor of the church said their hearts are so heavy after sort of hearing about all of the details of this, and he's very worried about how the community is going

to respond, but they have been trying to be there for the community so they have an outlet for their emotions. >> there's a reason why they're waiting to release this video, why they're being so cautious about it. i think they're giving people time to absorb that it's going to be emotional and as you said, horrific, vicious i think were your words. so we'll see. and then to get some answers not only on the beating but also why these two members of the fire department. that's important. >> yeah. >> sara sidner has been covering this for us and will continue. we'll get back to new a moment. at least one person has died and two injured in kyiv, ukraine this morning after russia launched more than 30 missiles at the capital. that is an air-raid alert. it remains in place over the city. moscow's latest attack has forced many people there to seek shelter in the underground metro

system. remember the beginning images of the war, that is happening again. around 20 of the missiles have been intercepted and destroyed. the attacks come less than 24 hours after the united states and germany announce they would both send the battle tanks to ukraine. >> poppy, school officials in n newport news, virginia, failed to act after being notified a six-year-old had a gun. that's what the lawyer for the teacher who was shot alleged in a press briefing. watch. >> abby and these other teachers tried to do the right thing on january 6th, the day of the shooting. on that day, over the course of a few hours, three different times three times, school administration was warned by concerned teachers and employees that the boy had a gun on him at the school and was threatening

people. >> abby's attorney says just after 11:00 a.m. on january 6th,zwerner told an admi administrator the student threatened another student. and by noon, an administrator was told the 6-year-old had a gun in his backpack. at 12:30, an administrator was told a student reported seeing a gun at recess. following these allegations, the assistant principal resigned and the school board voted to sever fies with the superintendent. straight ahead on cnn this morning we're going to speak to a mother whose son was at school the day of the shooting. how it impacted her family and what she said needs to be done. also this morning the

transportation department said it's in the early stages of a probe into the southwest airlines holiday travel meltdown. pete muntean joins us. what investigation? >> reporter: they say this is going to be a rigorous and comprehensive investigation. up until now they were focus odd the back end meltdown of southwest. but now the focus seems to be shifting a little bit into whether or not southwest overextended itself in the first place and whether or not, by doing that, it broke the law, this is the new statement from the department of transportation. it says it's also probing whether southwest executives engaged in unrealistic scheduling of flights which under federal law is considered an unfair and deceptive practice. pete buttigieg said he's using the full extent of the

investigative and enforcement powers of the department of transportation. talking 16,700 flights cancelled by southwest between december 21st and december 29th. that means about 2 million passengers were impacted by this. the focus has been in many getting the refunds back to passengers about $400 million of 725 to $825 million this caused southwest to lose because of the meltdown. we're going to the out more today in a new financial filings from southwest airline. >> we got those numbers. they've posted a loss and warning more losses ahead. i know they said they'll cooperate, what is that mean? >> the interesting thing here is that southwest insists the skid yule and staffing were in the right place leading up to this. but southwest said our systems and processes became stressed working to recover from cancellations across 50 airports

is and we'll continue to operate with any inquiry. this is a really big focus by transportation secretary pete buttigieg he wants consumer advocacy here because passengers have dealt with so many cancellations and delays not only in 2022 but also 2021 and the question now is whether or not airlines recovering from the pandemic have overexcererted themselves. thank you very much. to a cnn exclusive this morning. learning more about the 12 classified documents discovered at mike pence's home in indiana. sources describe them as briefing binders prepared for pence's trips. sometimes they include basic information but sometimes they have more sensitive information. cnn is told the papers may have been overlooked as they would not have been visible unless the

packers went through the binders page by page. today president biden will try to leave the classified documents scandaled in the mirror here. mj lee is live at the white house with more. mj good morning to you. is this all one big move to distract from the document scandal? >> reporter: don, as you said, this is a speech that the white house is building the president's first major economic speech of the year and frankly one of the topics that the white house wishes the president could be talking about more. we know that in large part this will sound like a victory lap speech, he wants to be talking about, according to officials, things like job growth under his watch, the fact that wages are up, inflation appears to be moderating some and we know he intends to take on house republicans in particular as the white house tries to continue making that contrast between the

democratic economic agenda and what house republicans are wanting to do. we have to point out the political environment for president biden now for the next two years is incredibly different on capitol hill now that republicans do control the house. in order to get anything done, it is important that democrats at least work with some of the house republicans and the first big test of this that we are about to see is over the debt ceiling. house republicans have made clear what they need in return to raise the debt ceiling are deep spending cuttings and, of course, the white house has said we are not negotiating. so it is about to be crunch time come a couple of months because remember the treasury department said they probably have until only about early june or so for the so-called extraordinary measures to make sure the government is preventing itself from defaulting, essentially. this will be a major speech but, of course, the white house trying to turn back to bread and butter issues because the last few weeks they have been

for example. >> yeah. >> what did you take away from your conversation with nick clegg? >> they came a long way instituting technologies to make it harder for things like donald trump or any world leader to go post to go viral. so if donald trump does things not totally volatile of their policies but controversy facebook is building tools the make it impossible to reshare the content and even if you follow donald trump you wouldn't see it in your feet and potentially take away the ability to run ads. >> so no one is going to see the lies? >> no one is going to see them. but if you want to go and look at them, they'll leave it up for public reasons. part of it is because they have this policy a newsworthiness policy. if a politician says something that's crazy, do we need to make it so you can't see it? maybe there's a news value in seeing that policy.

♪ we are back now, everyone. sorry we had a technical issue. we're live on location in memphis, sometimes that happens. so we turn to the looming release of this video showing a man being beaten by police, which proceeded his death. joining us is the executive director of the memphis naacp, she met with the members of the family. i'm so glad you could join us. you met with the family, you know the police chief. you're the perfect person to talk about this. i had to get some information from you. we have heard that possibly the officers are going to surrender. do you know anything about that?

long-time member of the community have you ever heard the police chief come out and do ha? >> no, i haven't. i think she told me that was something she wanted to do to let the people know how horrified she was of this crime. >> that speaks to the nature of what's in the video. >> yes. >> what are you told is in the video? you spoke to the family members. >> i did, but they didn't go into details because of tech techni technicalities. >> but the fact the chief is coming out and saying this, taking their time releasing the statement which i feel they're preparing the community for what's to come, because otherwise they would release it if it wasn't so bad. >> right. >> if it in some way was questionable about what happened or exonerated the officers in any way, the fact they're waiting and being careful about it speaks to the nature of the

video. >> that's correct. >> what are you hearing about the video? >> i heard it was worse than the rodney king video, if i can say that much. go back and think about what happened years ago to rodney king. it's worse than that. i heard even ben crump say this is probably one of the worst things that he's -- act of violence he's seen. >> when you spoke to the family members what is the sentiment? what they saying and how are they doing? >> they want justice for their son and i think some of the last words he said was, what did i do? what did i do? and that mother was saying, what did my son do? what could he have done to deserve whatever he got? >> i just wonder, they said that the family wants justice. but they believe there should be murder charges for these five officers. >> yes, sir. that is right. that is correct. that is what they're asking the da to do, charge them with first degree murder.

>> the fact that the officers are all black, what does that say to you? >> it hurt me. it hurt my heart. i was very, very upset when i heard that, of course, regardless any color but just to have five african american officers to do this to a young man that weighed less than i do. he only weighed 145 pounds with them, five of them, to savagely beat him -- >> and he was over 6 feet tall but he had crohns disease so he didn't weigh a lot because of the illness. he was tall and slight in stature. >> yes. >> but the fact there are five officers and all black, i heard one prominent member of the community say they're all blue, meaning they're all police officers, they have the same training. >> that's right. i don't think it has anything to do with the training. i think just like police chief

heard, expected to turn themselves in, 10:00 central time, 11:00 eastern. we'll be here reporting. >> that would be three hours from now. thanks, don. to the latest fallout in virginia after a 6-year-old child shot his teacher. the school board fired the superintendent in a 5 to 1 vote coming the same day the school's assistant principal resigned. the 25-year-old teacher was shot inside her classroom, the bullet went through her hand into her chest. she has been released from the hospital, she's now taking legal action against the school district. she claims on the day of the shooting, administrators disregarded multiple warnings that the child had a gun. >> on that day, over the course of a few hours, three different times, three times school administration was warned by concerned teachers and employees that the boy had a gun on him at the school.

and was threatening people. but the administration could not be bothered. this tragedy was entirely preventable. >> according to that woman, who is abby's attorney, just after 11:0 11:00 a.m., an administrator was told the child threatened another student. by noon another teacher said she believes that student put a gun in his pocket and had taken it out to recess. after 1:00 p.m. a third teacher reported a student said he showed him a gun. cnn reached out to the school district about those claims, officials have not commented yet. joining us is the mother of a

fifth grade student who was at school the day of the shooting. kasie, good morning. >> good morning. >> those officials are gone now, the superintendent and the a assistant principal. they are metal detecters at the school but with the level of complete disregard by the district, do you feel safe sending your son to school? >> we are trying to take it one day at a time. am i 100% comfortable sending him back, no. but i am hoping that the change in administration is going to make a difference, that they're going to listen to teacher concerns and take, you know, things a little more seriously now. >> you have a unique perspective. not only are you the parent of a fifth grader but you're an educator yourself. you spoke out at the town hall meeting about this last week. when you talk to your son -- >> yes. >> when you talk to our son

about this, how do you have that conversation with a fifth grader? >> it's a hard conversation to have. you never think that it's going to be your kid, your school. we've tried to talk about it and i don't push the issue. if he wants to talk about it, we talk about it. and i just -- i really want what's best for him and i want him to feel safe at his school. >> talk about what your child did that day. >> that day i was at work. i work about 45 minutes away from where we live. i got a text message from him that said mom there's a lockdown, i'm scared. i told him, hold on, let me figure out what's going on. i love you. then after that i started to get phone calls from family and friends, letting me know that there was a shooting at his school and at that point, that was the only information we had. so i left work to get here.

i called my husband and he met me over at the school while we waited. >> have you had any concerns about the school district and school officials not heeding warning signs about this child in particular who had, according to his family, severe behavioral issues, had to be for a long time accompanied by one of his parents within the classroom? huh had any indications that warnings were not heeded about him or any other threats? >> i don't think that the administration particularly, at that school, listened. i know there had been several complaints previously in regards to this particular student but i do know that other teachers have had behavior problems as well and they have not been listened to. >> kasey sypolt thank you very much. it's impossible to have to try to explain this to your child.
