top of the hour this tuesday. i'm jim sciutto. >> i'm erica hill. happening right now, a dangerous winter storm bringing sleet, snow and ice to several areas. schools are closed in some area, and officials are urging people to stay home. as of this hour, more than 1,000 flights are canceled and the number of delays as well. we will take you to some of the most impacted areas ahead. >> secretary of state antony blinken is in the west bank finishing up a trip to the middle east.

blinken is called on both sides to ease tensions after an outbreak of deadly violence in the middle east not seen in years. back here in memphis, two more officers relieved of duty as part of the ongoing investigation of the killing of tyre nichols. new details thef how the initial police report contradicts so clearly all we saw in those videos, and it is alarming. we begin with the deadly weather in texas after one person is dead after a 10-car pile-up in austin. >> correspondent ed lavandera is joining us in austin, and the weather has turned in the last hour. emergency officials must be warning folks definitely not the time to go outside now. >> things have gotten real now, guys. we are just getting what feels like pelted by an onslaught of snow cone machine ice just getting thrown at you, and it is starting to hurt.

so if i stumble through the live shot, it is because every one of these pellets of ice is starting to sting on my ears. but you see that the roads are starting to change dramatically here as the sleet and the freezing rain is starting to fall at a more steady pace here in the dallas area, and this is what the forecasters have been warning people about for the last 12 hours or so, and urging people the stay off of the roadways, because of the office closings, and the school cancellations across the region, you are not seeing that many people on the roadway. but it is treacherous, and you can see here on this pass up to the highway interchange here, there are several cars here struggling to make their way up to the hill as the icy conditions continue to worsen, and it is deadly. in austin, we are hearing reports of one fatality and the winter weather warnings, and the advisory stretching from san antonio all of the way to oklahoma and arkansas as well.

these are the kinds of conditions that we will continue to see throughout the day and well into tomorrow as well. in fact, some forecasters are saying that the worst may not be over until thursday morning. so that is what people here in the north texas area are dealing with as these conditions continue to worsen, and we are seeing the brunt of it now, guys. >> that is really something. ed, good luck out there, my friend. we need to get you a hat. >> uh-huh. >> yeah, i will go get one actually. >> and ed will get a hat, and we will turn to chad myers, and so as you know there is one death there in austin, but that is just a concern of what it could lead to for the rest of the day. >> i have news for ed, it gets worse. probably three times worse about three miles to the west and it is heading your way. so, an umbrella or inside of the truck, ed, because it is about

to get really, really real here. at least a half inch of ice, and the good news for ed and in the area around that north dallas and towards richardson is that a lot of it is sleet. sleet has a little bit more traction than the wet ice. that freezing rain. freezing rain is rain that comes down as liquid, hits the ground and freezes. sleet freezes on the way down. the farther you get to the north, the more likely you are to get to sleet. now, this is not a snowstorm. this is an ice storm. ice storm warnings here, and why? why would it sleet or why would it rain at 26? because it is not 26 at 2,000 feet in the sky. it is 33 up there. it is liquid. then it falls down into this shallow layer of cold air and then you get the ice, the ice into dallas, and the ice causing the accidents. this is freezing rain. and then it looks like black ice

and the roads are turning white where ed is, and this is the swath though and hours and hours more of this. not only that, but i am going to change the colors and get you to what the real radar looks like. it is convection in here, and not only is it sleeting, but it is lightning as well. thunder sleet out there at this point in time, and this is going to start to pile up very, very quickly. that entire system is going to move to the northeast. this is the one through yesterday. and it is the one coming through dallas right now, but it is moving up into arkansas and places like kentucky and paducah and evansville, you are about to get into middle of it into arkansas and hot springs and across the ozarks, and difficult travel today. then the break, and then look to the west of dallas. another batchf this is coming in for tomorrow. right on top of the same places. i just looked. there is really not very many

more about this plan and the decision. >> yeah, this is first sign that george santos has recognized that he could be in trouble here. he has been defiant here all along and saying that he has nothing to hide and moving forward as a normal member of congress despite admitting to lies and questions about the campaign finance and new revelations that are coming out daily that have hurt this embattled congressman and threateded the career here in congress, and now he is telling the conference behind closed doors that he is not going to be serving on two key committee assignments that were given to him by the speaker of the house and the top allies despite the pushback and concerns that he would sit on these committees, and he made it clear to the conference that he would step aside until the legal issues are resolved and the house science committee and the house conference committee will be

where he is stepping aside. and marjorie taylor greene who i just caught up with said how his message was received. >> he just felt like that there was so much drama really over the situation, and especially what we are doing to work to remove any more embarrassment, and he said that this is a decision that he made on his own. >> now, that was in reference to the effort of the house republicans who tried to remove ilhan omar from the house affairs committee over her past remarks and there has been criticism from the democrats that they are allowing santos to serve on these committees and trying to remove omar from hers, and they want to make sure that they don't remove omar and that is going to vote a entire vote, but all of the questions

swirling from the past, and even members from his own district, voters from his own district want him out according to a poll today, and santos is going to continue to serve but not from the committee appointments that he was awarded just a couple of weeks ago. >> interesting. and now, joining us is errol louis and kathy powers. what does this say about george santos? >> it says that he is in more of a pickle than he can talk his way out of, and the reports are getting more serious, and getting away of things like are

personal like when you lived in brazil and territorial college, and more like fake donors and did you assign contributions to people who have never heard of you and did not want to contribute to your campaign, and the federal probe is serious as the state probe here in new york, and not something that he can continue to run from reporters here. so he is trying to clear the schedule, and talk to his lawyers and accountants and investigators here in the near future. >> and kristen powers, you have a strategy of two powers of the biden talking about the infrastructure gains passed in the last term, and then you have economic issues of trying not to default on the debt with budget cuts going forward and so which is the smarter political strategy? >> well, i think that you know the ideal would be if we could

return to the old days of raising debt limit just being a kind of nonevent. it is for money that has already been spent, and we have to always explain this over and over again, and we keep going through this, and so it is for money that has been spent, and so it is not a negotiating tactic, but it is the job of the congress to raise the debt limit, and we need to get back to doing that. so, you know, biden has said that he won't negotiate with them, though he has asked for them to basically send over what they are thinking, but i think that, you know, the people who ultimately will be held responsible for this if it is not lifted is congress, because it is their job. at the same time joe biden as president and what happens to the economy matters very much in terms of what people think hoff the president. so, this is in a difficult situation. especially because kevin mccarthy made it as part of the negotiations to become speaker, and he said that he would not

take up the debt limit without having the cuts going along with it, and the negotiation with the white thousands make cuts in the budget. so i think that it has to be handled delicately, and to the extent that biden can keep the focus on the fact that it is their job is important. >> and the focus, errol, it is a list. so give me the list of what you want to cut, and kevin mccarthy, have that list at the meeting, and is that working for the democrats as a messaging standpoint, okay, maybe if you want to have something to actively discuss, we can do that, but without those line items, errol, we can't. is it is effective? >> well, look, it is a reasonable thing to say, but of course, the democrats and president biden, and chief among them, they are making the offer with a great big smile, erica, because they know as anybody who lookst this issue knows that you cannot move the needle on the

federal budget without touching entitlements like medicare or medicaid without touching third rail, and the republicans know that they can't be touched without the deep cuts, and if you take the three off of the table, it is difficult to see how you can cut trillions of dollars from the federal budget. i don't think they have a list of cuts. they don't. we'll see how this works. if you fall into the trap of saying that they want to tamper with medicare or social security in any way, shape, form, it will be the biggest gift they could have given to the democrats going into 2024, and president biden knows that. and i assume that speaker mccarthy knows that, and so we will see who blinks first. >> as m.j. lee reported last hour, with president biden out thing the infrastructure wins, he is laying the groundwork for 2024 announcement of a run. trump has announced his intentions, and who is more likely to be the party's

been released and new reporting from "the new york times" which saw a photo of the police report about what was filed. >> now, if you have seen the video, it shows the officers kicking, beating, shouting at nichols, but that report reflects none of that, and the initial police report instead casts nichols as a violent suspect saying that he reached for the officer's gun, and nick valencia joining us, and nick, so many contradictions of the video and what we saw. >> yes, i was just talking to the shelby county police report, and verifying that what we saw is accurate, and we at cnn are learning that the original police report is contradicting what we saw in the video, and it was written hours after the tyre nichols stop, and it mentions not one to officer kicking or

punching tyre nichols, and none of what we saw on the video. it says that he was violent and actually a suspect in an aggravated assault and lists one of the five former officers now charged with second-degree murder as a victim. what we don't know is who authored the police report in the police department, and that is what we are trying to figure out this morning, but we can verity from the district attorney's office is that the report from "the new york times" is correct. we do see that the fallout is continuing, and three member of the memphis fire department is continuing as two paramedics are fired because of their inadequate assessment. these personnel were told that they were responding to a pepper spray incident, and it is much, much worse than that, and they said that the expectations of the fire department official were not met that day on january

7th, the day of tyre nichols' incident with police, and this with two other officers fount administrative leave as the same time of everyone else and we are learning weeks later and it is a question that we asked the memphis police department, and they did not respond, but they said that they are committed to transparency and we should expect more personnel actions in the coming days. jim and erica. >> wow. it is raising more questions. thank you, nick. and now, to discuss this more is councilmember, and also, a professor from the howard school of law, and councilwoman, based on what we have learned overnight, not only the contradictions of the report that is contradicted clearly from the video that clearly shows the beating of mr. nichols but also the fact that there were seven officers is initially placed on leave, and we were

told, and the transparency has been touted and we have discussed it over and over again that the initial transparency, and we were told five officers, and what is this doing in terms of the transparency that has or has not been there in terms of the police department? >> yes, erica, we on the council experienced same thing. we were told the same thing to the public before the release of the video, and even though council did get to view the footage before it was released, we have the same exact question. so we all are surprised and also discouraged that we were not given this information from the beginning, and we want to see on how it is really going to play out in the true perception of justice throughout the tape. is there more that we don't know that is still unraveling from what we snee the footage. >> right. it is leading to more questions. and just when we are learning that the two other officers who we now know about seven officers

put on leave at the same time, and what is interesting is that in the chief's interview with don lemon live last friday morning, she was clear in noting that the five officers who had been fired and ultimately later charged the fact that they were also black in her words meant that race is off of the table. we now know that one of the two officers who again were put on leave at the exact same time, one of them is white. so, i am wondering if the chief's comments still hold up this morning? >> thank you for inviting me. those comments never held up even on the face, because we understood that it is very unlikely that a white young man would have received that sort of attack, and so race was a factor, but of course, now with this added element of this seeming process of hiding the one police officer who was not black from the public in the beginning, it is a very problematic situation, and this

is going back to what we saw with the derek chauvin case of a huge gap of the police report, and acts that came out later and this issue of believing police reports on the face when they are released is something that we need to reconsider. >> and also, we need to reconsider when we are looking at each of the events in some cases that is a much more convenient narrative of those who want to take grace out of the equation, the fact to your point that it never was out of the equation, but it did make it easier on its face, and i think that you know what i mean by that. this does change all of that, and why are we still at this point in the country, and it is a tough question to answer, but we are still at this place where it is so uncomfortable to call out what is seen and what has a marked record here, and it is still so uncomfortable to have that conversation and why didn't we know about those two other officers and should part of that

questioning be about one of those officer's race, because it then distorted the initial narrative, and how do you begin that conversation? >> you know, that is one thing that i took away from this entire experience is that, you know, that police officers make an average of 50,000 stops a day, and 18 million traffic stops a year, and black drivers are 40% more often stopped than white drivers and so race is more likely a part of the conversation, and so the police officer who was sort of at the end of the trail and point of the interaction, and looking at the race of the individuals involved and think that tells the whole racial story is a misunderstanding. we have to look at the structures in the systems, and not necessarily at the players in tone to understand how racial

injustice is working in our country. >> part of the system, and part of the structure that is unfortunately a part of all of this, too, is the repeated trauma, and not just on the family, although it is a major part of it understandably, but the broader community, and i recognize this is coming from a white woman, but i would think that specifically on the black community, councilwoman, where there is a repeated trauma of the videos shown, and i cannot help but think back of mrs. wells, and listening in the car of a press conference on friday and she was asked a question that i could not hear, and the words struck me, because she said to me, i have not begun the chance to grieve. and so we ask so much of the families and highlight their strength and grace in this moment, but i would think that the answer is no, but i would think are we giving them the grace and space they need to mourn and grieve that their

loved one was brutality beaten and killed, and how do we change that to acknowledge their grief and space to grieve. >> that is right, erica, we have not given them the space to grieve and we also learned that tyre has a small child, and that is something to think about policing in memphis, and even us as community and elected leaders, and i think that moving forward when we are going forward how to go about legislation, and moving forward and we can always first and foremost give our utmost respect and condolences and thank yous and apologies to the family and

as former president trump continues his third bid for the white house, his legal battles and yet another state are piling up. cnn has learned that the former "national enquirer" publisher davi meet with prosecutors about president trum. >> they are looking into finding out if paid hush money to stormy daniels to cover up an affair which trump denies.

that is to see if he paid money to cover it up. and prosecutors are moving forward. and the manhattan d.a. started to present to the grand jury yesterday. and joining us is columbia law school lecturer, carolyn, and this is the longest running legislation, and the payment hap happened years ago, and why now? >> this is conduct that happened in 2016 and 2017, and michael cohen, the president's former lawyer and fixer has pleaded guilty to the same conduct and served his prison time and is out, and the southern district of new york at that time, and we all remember individual one in that guilty plea allocution came to the conclusion that there was enough evidence to move forward

with the prosecution, however, trump was in office, but they did not move forward when he was in office. and then scy vance opened up a sprawling legislation, and then they didn't have the appetite to take on trump and the capacity and so much so that two prosecutors resigned from office, but now it seems that brag has more wind in the sails, and two more wins for him in criminal convictions against trump organization, and so alan weissleburg, the trump org ceo, and so perhaps he is emboldened by that and feels like he can get a conviction. >> and michael cohen went to jail for his involvement in that case, and it was trump who was listed although unnamed as a co-conspirator in that, and could the same happen to trump?

>> yes. so the interestingly that these are state charges, right. so the actual conduct that is being looked at here according to reporting is falsification of business records. so essentially writing the wrong thing on the line, and that is a low level misdemeanor in new york, but in order to kick it up to a felony offense which is punishable by four years is showing that it is in furtherance of another crime, jim, which is to mirror the campaign finance law violation which is what michael cohen plead guilty to which is campaign contribution in excess, and if they can prove those two lower, then they could possibly convict him. >> the former president is suing bob woodward for $49 million saying that the audio recordings that he made he never authorized

as part of the audio book, and woodward says they were made with his knowledge and with agreement, and does donald trump have a case here? >> erica, with that case, you read the headline you think that bob woodward secretly recorded trump without his knowledge and consent, and that is not the case. even trump admits that is not the case, and he made the recordings knowing that he was on the record and being recorded, and erica, as you and jim know being journalists when witnesses are on the record, it is sort of all or nothing, and you cannot pick and choose how you are going to be portrayed and this is a long line of the frivolous lawsuits that he is being engaged in, and he has a long one ongoing with cnn and this is one that is ongoing, and so this is a part of his
