to you, i'm jim sciutto. >> and i'm bianna golodryga. we are following several major stories for you this morning. soon family members and the memphis community will gather for tyre nichols' funeral to celebrate the life of the 29-year-old whose brutal death at the hands of police sparked protests across the nation. the families of george floyd and breonna taylor who have experienced similar losses are expected to be there. vice president kamala harris will also attend after an invitation from tyre nichols' apartments. we will bring you the funeral live when it begins. right now house republicans say they're talking strategy ahead of president biden and house speaker kevin mccarthy's meeting over the debt ceiling this afternoon. both sides are standing firm so far. republicans threatening to bring the country closer to defaulting on its debt as they demand spending cuts. the white house vows there will be no negotiations when it comes to paying the nation's existing bills. president biden's challenge to the gop, tell the american

i love you all. >> heartfelt. yeah. >> yeah. in the last hour the man many consider to be the greatest football player of all time, let's just call him the g.o.a.t., he said he's stepping away from the game after 23 seasons. this comes exactly one year to the day, jim, i was with you that day when he announced that he would retire for the first time, only to unretire some 40 days later. cnn's sports ankle andy scholes joinls us now. andy, brady's legacy truly is unmatched here, seven championships, that's more than any one single team has, which is at six. he is still the greatest football player of all time and though this may not come as a shock, like the first time he announced his retirement, this still really did surprise many in the sports world. >> bianna and jim, it's such a sad day because as you mentioned we have had tom brady in our football lives for 23 years. think about how many football

fans there are that don't even know the nfl without a tom brady in it. he had been to ten super bowls, won seven of them. think about that. so 43% of the time that tom brady played he ended up in the super bowl. it's just greatness that we've never seen, it will likely never be watched again. even if you break up brady's career by his 20s, 30s and 40s, he won three super bowls in his 20s and then he won two more in his 30s and two more in his 40s. he always said he wanted to play until he was 45 years old. you know, the saying in sports is there is no beating father time. in terms of beating him, i mean, tom brady came the closest. he had the tb 12 method working all the way to the end, still threw for a ton of yards even in his final season with the bucs. he owns so many records, guys, i mean, this is a career that we're never going to see again. and you have to just go back to the way it started. picked 199th overall in the 2000

draft in the sixth round. he came into the league as a true underdog, as a guy who wasn't expected to even make it and he turned into the biggest champion we have ever seen. it's an incredible story and like i said at the beginning, such a sad day that we are not going to have tom brady anymore. >> i don't like to bring this up for pats fans but without the giants he would have had two more super bowls. let me ask this because the last retirement didn't happen. are we confident that this one is for real? >> you know, if you watch tom brady a lot this season you could tell it was a little different. at 45 years old he maybe didn't want to be getting hit like he used to. he even said this time it's for good. i'm going to take him at his word for that because, like i said, he always mentioned he wanted to play until he was 45, he got there, you know, he probably didn't go out the way he was hoping, a losing season, 8-9 record with the bucs even though they did make the playoffs but i would have a hard

time him reversing this one. it's like déjà vu, we did that last year and now we're doing it again. i think this time it's a final time. >> a mediocre season for tom brady. >> for tom brady. >> it's amazing to see him passing interceptions, but also you would see the players that caught the interceptions come and have him sign the football for them, giving you a sense of where he stands in football, legend and history, a bittersweet day. and 45 years old, jim. 45 years old to have played the way he did. andy scholes, thank you so much. well, now to the critical meeting this afternoon between president biden and speaker mccarthy over the debt ceiling. cnn's lauren fox is on capitol hill and cnn's mj lee is live at the white house. lauren, to you first. what are you learning as mccarthy prepares for this very important and first face-to-face meeting with biden with him as speaker? >> reporter: it is a day heavy

in messaging and optics but light in resolution of this issue with the debt ceiling and that is because we are still months away from the critical deadline. up here on capitol hill it usually takes several months, you have to inch really close to that deadline before there is a final resolution. what we know is that kevin mccarthy has been doing extensive preparations in his effort to prepare to sit down with biden. in those preparations he's been meeting and talking with key chairmen, including on ways and means and financial services as well as talking with folks outside of the hill. former house speaker newt gingrich. he is expected to meet with his conference this morning to have a broader discussion about what they can expect and what they can really get out of these debt ceiling negotiations, but kevin mccarthy said yesterday this was his goal of the meeting with the president. >> the white house is saying they're going to want assurances the u.s. won't default on its debt. >> you know the best way they can do that is to say they're

willing to negotiate. the only irresponsible way is to play a political game and say we're not going to talk about it. sounds childish to me. it's irresponsible for the leader of the free world to say he's not going to negotiate. i hope that's just his staff and not him. >> reporter: and the goal for republicans is really if they can come away from this discussion with any cracks in the foundation of the white house's message that they are not going to accept spending cuts as part of these debt ceiling negotiations. bianna and jim? >> thanks so much, lauren. mj at the white house. the white house doesn't call this a negotiation, they call it brinksmanship in effect here. what is their strategy? >> reporter: it definitely might be too generous to call this meeting this afternoon a negotiation because the white house has been so consistent and emphatic in saying when it comes to raising the debt ceiling there is not going to be a negotiation. that they will not be making any concessions. whereas mccarthy and lauren just laid out is very much seeing

tore negotiate, he has been fielding requests from members and there are members of his caucus who are pressing him to get these deep spending cuts in exchange for raising the debt ceiling. so needless to say the two sides are pretty far apart as they go into this meeting and the expectations are pretty low. there was one interesting moment from last night when president biden was at a fundraiser in manhattan when he talked about kevin mccarthy and i just wanted to note that he said that in order to become speaker kevin mccarthy had to get commitments from some of his colleagues that were just absolutely off the wall. those were the president's words. and then he turns to chuck schumer, who is the new york senator and said, chuck, i can't imagine you making one of those commitments. so several seemed like a bit of a jab at mccarthy where the president was sort of indicating that, yes, he is speaker but also realizes that politically he is a pretty compromised one and his role is diminished and that he is sort of very much beholden politically to many of

these colleagues as they go into these negotiations or talks i should say. i will finally note, too, the issue of course is that they know they have until early june to get this sorted and that is a long time in washington. >> mj lee at the white house. thanks so much. joining me now republican congressman dusty johnson of south dakota. thanks for taking the time this morning. >> you bet. first on the budget demands of your party here, what specific programs are you putting on the table to cut? >> that's not how a negotiation works. in fact, the law says that the president needs to step forward with a budget first. his team is going to miss their february deadline, they say they are not going to get that done until march. here is what i think is step one, today we need to have the president and the speaker in the same room, that's going to happen and we need to have president biden agree that he will negotiate over the reckless spending that our country has been engaged in.

>> but as you know the debt ceiling relates to budgets already passed by congresses including with republican votes. what are the positions because a negotiation as you know if you want to call it that involves two sides presenting their positions. can you name a single program that republicans would be willing to cut money from to make a deal? >> see, i think that's ridiculously unfair and here is why, the credit card pill comes to our family, we have maxed out our credit cards. of course, listen, we are going to pay that credit card bill, we're legally obligated to do so, but rather than force all of the onus on the republicans which i know y'all love to do, what a responsible, reasonable and sensible family would do is sit down together -- >> by the way, i'm not doing that, sir. i'm not putting all onus on republicans. that's the law. the law puts onus on congress and the nation to pay its bill. please if ahead. is there a program that you can name that you personally would be welling to see money cut

from? the president point is i'm not going to negotiate against the republican party on cnn. we're asking for president biden to be responsible, seasons i believe and reasonable and willing to come to the payable paragraph table and negotiate. mj injure reporter she is great. how is kevin mccarthy spending his time today? he's getting together with his republican team to talk about how do we bend these curves away from $32 trillion in debt. >> our manu raju is reporting that defense budget cuts are on the table. can you name a defense weapons system or program that you would be willing to cut money from? >> if wedge out of 800 or $900 billion in defense spend ago year that there isn't anything that can be cut i would tell you i think we have to be willing to

roll up our sleeves. i get what your goal is today, your goal is to get republicans to negotiate against themselves -- >> my goal is to find out what your positions are when you're going into a budget negotiation. presumably you have problems that you would be willing to cut so i'm asking the questions. >> step one is to have the president of the united states be which will to have this negotiation. in the world would republicans when the president has the statutory obligation to break his budget forward first why would we bring forth these admittedly difficult to discuss cuts. let the president off the hookment he has shown a total unwillingness -- >> the debt ceiling is about budgets already passed and i should note that when republican presidents were in office, george w. bush and trump, democrats did not push the country to the brink. by the way, republicans did not push their own republican

president to the brink on the debt ceiling although i should note for viewers you noted against raising the debt ceiling yourself but the republican leadership did not. why that difference? why push this president but not trump? i love this revigsist history. after eight years of republican control in the house discretionary spending was lower at the end of that eight years than it was at the beginning. so why didn't republicans go to the brink? it was because they had republican presidents who were willing to work with them on some of these much needed spending cuts rather than a joe biden who says he refuses, he refuses to negotiate. if we are going to get this done it's not about cnn or joe biden putting all of the onus on republicans to identify cuts. it will be two responsible men who should be the president of the united states and the speaker of the house sitting down to begin the negotiations rather than onus all being on one party. >> i'm asking the question because you represent the republican party. i've asked equal questions of

democratic lawmakers on this broadcast which you are welcome to watch. i do want to ask you about your position since you are on the china select committee, it's an issue that i follow closely. earlier this week we had an air force general the commander of mobility command say that he believes the u.s. will go to war with china in two years, the year 2025. i know from speaking to military officials that's not the u.s. defense department assessment but do you share that assessment that the u.s. and china are on the brink of a hot war within two years' time? >> i do not share that assessment but i would tell you lots of reasonable people are concerned about a kinetic engagement between china and the united states in the next few years. that's why our work on the china select committee is so important. the three things, our work will be bipartisan, it has to be, number two the chinese people are not our enemies, the chinese

a day of mourning in memphis, tennessee, as the parents of tyre nichols prepare to lay their son to rest in just a few hours time. last night the nichols family spoke from the mason temple pulpit where martin luther king jr. delivered his mountaintop speech one day before he was assassinated. nichols' brother urged those seeking -- to do so peacefully. >> my brother was the most peaceful person i met in my life. i never lifted a if i think or raised his voice to anybody. he would tell us to do this peacefully. >> vice president kamala harris is on her way to memphis to attend the funeral. she spoke to nichols' parents

yesterday offering the family her deep condolences. this morning the city of memphis says it plans to release even more video footage from the incident as we're learning some of the officers charged in nichols death had a history of violating department policy. cnn's ryan young is in memphis this morning. what is the latest specifically about the timing of the funeral? >> reporter: yeah, so much up in the air right now. we are told that the funeral will start here 1:00 local, 2:00 eastern. the reason why, honestly s just how bad the weather s we weren't covering this, we would probably be talking about the winter storm that smacked this area. there is ice all over the trees, all over the streets here. it's not impassable but it's very hard to get to several different locations throughout this area. you can understand with all the people who were expected to travel in for this funeral they have to wade through this. the people showing up right now a lot did not know that this funeral has been delayed. when you think about what the focus shdould be, you understan

the focus here today will be about this young man who lost his life and all the people who were involved in a struggle who want to see change. take a listen to one of the moms who said she wants to see something happen moving forward. >> this is a national crises that need to be addressed if we are to stop this killing. we're tired of hashtags, we're tired of justice for this loved one, for that loved one, but we're asking -- we are demand that go change be made at a national level if we are going to stop this heinous and egregious killings of our loved ones. >> reporter: for a few days we've been showing the images of tyre in the hospital, we've sewn the terrible video of him being beaten by the officers. i want to show you him sk skateb skateboarding, this is when he was full of life. the family will focus on this joyful young man who had his

life taken and so many people want to know why. we will get into this investigation as the day is coming, but the focus on this funeral is supposed to be on that nung man who loved skateboarding and his brother said was so peaceful. >> i'm glad you showed that. he turned some pretty good tricks there. >> the focus on him, the focus is on his family as well today on this very, very painful day for the community. i'm joined by memphis city council vice-chairman j.b. smiley jr. thank you so much for joining us. first of all, how is the community doing this morning? >> they're grieving. in addition to grieving, a lot of folks are still angry. although the weather may be bad there's folks out still protesting, there is what they call a day of action aimed toward the federal building because they want to see charges brought from a federal level as

well. they're angry, some are grieving but they're focused on what they believe to be reform that should be coming. >> the whole country is there with you grieving in spirit. do you have any update on the other officers who were relieved of duty and have you been kept informed about where the investigation stands right now? >> well, the city's administration that's the mayor and his team they've been pretty tight-lipped as it relates to any investigation that is going forward. what we've done on the memphis city council is listen to concerns of the community and doing everything we can to hold the administration's feet to the fire to fire officers who were involved but also the district attorney which is to bring charges related to everyone who should face criminal culpability. >> there has been some disturbing new information that has come to light about the history of some of these officers now that have been charged with second-degree murder. they had a history of violations

with that police department. let's go through some of them that's stood out to us here. demetrius haley was reprimanded after a suspect he helped detain suffered a dislocated shoulder. desmond mills jr. was reprimanded for not documenting that he used physical force during an arrest, but that was sustained after a hearing. what do you make of this now in the context of what has happened with tyre? do you think that these charges and violations should have been taken more seriously? >> absolutely. i think it's a situation where the police department has essentially been neglectful, dereliction of duty to supervise and oversee officers related to to this incident. also i think the council has to take a more active role in reviewing body cam footage. i'm proposing an ordinance to that the city council would have the authority to receive body

cam footage whenever there is an allegation of excess force, we will ultimately put pressure on the memphis police department to bring about change. >> let me ask you about the discrepancy that we have seen now from the initial police report and the video that have been release the. what questions does that raise not only about the initial report but perhaps other instances in the past that maybe now needed to be revisited? >> i think it calls into question number he have report we have seen? quite some time. whether every report has opinion interested and a narrative that is untrue. i do believe if there was not a sky cop cam i do not believe we would be hoar. if you pay particular attention to the body cam footage the officers were covering their cam cameras, turning their cameras off. without that sky cop cam we

would be having a different conversation, probably accepting the police narrative as true. i think we have to do a better job of watching the watchers. >> let me ask you about police chief davis, in her description of what she saw on those tapes. that having been said do you think that she still now should hold the position? does she have the support of the public? does she have the support of the council to continue to be police chief there of the city? >> i believe it's changing every single day. what i tell people is if we watch the chief of chief davis when she speaks on the incident i think she's done a better job than any other police chief. you can sense the sip sarty in

her voice, but when it comes to where we are now i think she has a very direct duty to make culture changing decisions. the clock is ticking. the clock is ticking. we will have a mayoral election this upcoming year. the question posed to every mayoral candidate is what will happen for chief davis and your administration. for a lot of them i think the answer is we would go a different direction. >> councilman jb smiley jr. obviously the investigation will continue and we will continue to cover it, but today it is for remembering tyre's legacy and obviously being there and comforting his family and the community. we will be thinking of you today. thank you for joining us. >> thank you. just moments ago the college board released its new framework for an ap african american studies course, a class that florida's governor banned from being taught at his state.

right now parts of texas are getting hit with heavy freezing rain, this is texas, mind you. it is round three of icy weather that's already killed at least two people in the state. they say travel will be nearly impossible through tonight. >> this video in oklahoma it shows how daek rouse the roads can get. a state trooper's dash camera captured a semi-truck driver losing control. no one was hurt in the video. nor than 248,000 people are without power across the state of texas and nationwide more

than 19300 flights have been canceled. ed, this is not weather people are used to. what are conditions like right now? >> reporter: a colleague of mean said the reason they live in texas is because winter lasts three minutes here. this has clearly gone way beyond that. this is a situation where really you look at the l. map and you look at the vast expanse of this wintry mix and freezing rain, sleet, it goes from far west texas, big bend, all the way to the east texas as well. it's a dynamic system moving through the state and how the dallas-fort worth area is snuggled in this pocket right now where for the last several hours it's been relatively dry but all indications are that that will continue to range in the afternoon hours. here at dallas-fort worth international airport we have seen some planes taking off but it is a fraction of the flights

placement course on african american studies that florida governor ron desantis had earlier denounced and banned from the state's classrooms. he claims the course imposed a quote, political agenda. >> now the government says he intends to ban state universities from spending any money on diversity, equity and inclusion initiatives known as dei. leyla santiago live from miami with more specifically on the fame work for this ap african american course. i wonder can you explain that to us and perhaps explain to people what the governor is attempting to betray as biased or political. >> reporter: all right. so let's go over this official framework over this advanced placement course on african american studies. just released in the last hour. it's about 230 pages, i have read through t want to go over what's in it and what is not in it. what is not in it in terms of requirements are much of the

objections that the state mentioned last month in a letter to the college board, the nonprofit that oversees ap courses in the u.s. as its objections for rejecting the course in the state of florida. they have looked at an initial proposal dating back a year ago, not the official coursework that came out today. let's review what their objections were when they listed them off. the department of education saying they were concerned about unit four, which included studies, black queer studies rvlgs the, the movement of black lives, black feminist literacy thoughts, reparation, listing concerns tied to the readings and the ausers mentioned with those units. none of those authors are mentioned in the official coursework that came out today. now, i will say what is mentioned but not required, they have a list of black lives matter origins impacts and

critics, also mentioned reparations, debates in the u.s., the americas, queer life and expression in black communities. i want to put how it's mentioned in context which it is mentioned sort of listed as some of the topics that students can consider for their research projects in this course. and that same list they also mention black conservatism, the role of religion in african american resistance to enslaven. it's a pretty broad list. the things are mentioned in the curriculum but it is mentioned as a suggestion as to what students company choose to research. >> let me ask you a question here because the reparations debate or black lives matter, these are real things that happened. his argument seems to be it's stating these things as fact as opposed to matters of discussion.

right? does the curriculum tell people that reparation right side correct or mention it as a movement as part of the broader course? >> reporter: it's interesting, i had a conversation with one of those authors who long after scholar, no longer mentioned in there and he pointed out he said, yes, these things are in there but nowhere does it say students cannot be critical of these discussions. much of this the department of education is saying against state law. remember florida last year passed the stop woke act which basically says a student dmt classroom cannot be made to believe that he or she should bear any personal responsibility or feel guilt because of actions committed in the past by the same race. that is what the department of education is looking at through the lens of their objections here. >> leyla santiago, thanks so much. the manhattan district attorney's office is now getting some help in its investigation

what do we know specifically here in new york? >> we remember this investigation began in 2019, started with the hush money payments, the financial statements and the focus has returned to the hush money payments. michael cohen went in and met with prosecutors two weeks ago, as he said, they asked for his phone and he said it in the interview this morning they wanted the recordings that he had on his phone with stormy daniels' attorney keith davidson. he is someone that the prosecutors have reached out to as someone that they want to talk to again. this week david pecker the former publisher of the "national enquirer" were involved in these catch and kill deals, he was talking to prosecutors. we know from sources that the grand jury will hear from other witnesses in the near future. starting to see them narrow down on the evidence and bringing it in before a jury. >> kara, we know the former president has been critical in the past in public of people who

$250 million lawsuit against the former president, his children and the president and the company. >> trump saying only guilty people take the fifth. here we are. thank you. all right. this breaking news just into cnn. cnn has confirmed that the fbi has searched the rehoboth beach, delaware, home of president biden just this morning. cnn's paula reid it following the latest on this. paula, what do we know and do we know why another search there? >> jim, this was very much expected. now that this is under a special counsel investigation it was anticipated that the fbi and investigators would likely go back to places that had already been searched by the president's personal attorneys and do their own searches. we saw this of course ten days ago when the fbi did its own search, nearly a 13-hour search of the president's wilmington home where additional classified material was uncovered. it was suspected that they could

go to the rehoboth home. it's not clear how early the search began today, but what appeared to be government vehicles were spotted by pool cameras and we just got this statement from the president's personal attorney confirming that investigators are on the scene, this is being done with the consent of the president's attorneys and what will be really significant today, jim, is whether they find any additional classified material. we know investigators are still combing through what they took from the wilmington house ten days ago so big question here is will additional classified materials be found. previously when the president's attorneys searched this rehoboth home they said they did not find any classified materials. that will be the big question today, what do they find? >> and this marks what we believe is the third known search by federal agents of a property belonging to the former president regarding classified material. paula reid, thank you so much. mj lee, i want to turn to you now and get reaction from the white house. we have that statement from bob bauer. what else are you hearing?

>> reporter: i think what is really notable from the statement that just came out from bob bauer, the president's personal lawyer who is taking the lead on the classified document situation, is, again, the white house -- the lawyer stressing cooperation, right? indicating that this search is being done because there is cooperation between the president's team and the doj and this has sort of been the white house's theory of the case all along. if you can call it a strategy that at every point they have wanted to stress to the public that everything that we are doing and have been doing from day one going back to early november when the first tranche of classified documents were found is that we have informed the right people including the archives who then that there's nothing that we are doing to sort of stand in the way of the doj now taking all of the actions that it needs to

take to find out whether there are more classified documents. now as paula laid out, there was very much expected there could be more searches coming. what we don't know for sure, of course, is whether there could be additional searches coming after today, certainly, we can expect there very much could be more searches coming a the other locations. we just don't know for sure. i think it's also worth emphasizing right now just how tight lipped and careful this white house has been in talking about this situation. you talked to folks in the communications office and other white house officials, they are just not commenting on this matter at all. they are deferring to the lawyers and saying when they have something to share and they feel like they can share, they will do that. but any other information share ed by the white house, otherwise would dpet in the way of of an ongoing doj investigation. that's why the search is
