>> the top of the hour this thursday, i'm jim sciutto. >> i'm erica hill. this morning, cnn learning details about a disturbing plot about a man looking to kill jewish elected officials. and the suspect could be in court as early as today. we will walk you through what we know. and also, the double murder trial of disgraced attorney alec murdaugh, and we are learning that a juror has been removed of discussing the case with people outside of the court, and all of this as the defense has just begun the closing argument. and today, a pennsylvania man is in court after he hid explosives inside of his luggage for a flight destined for orlando, and the latest on the case and the suspect's long criminal history. and we begin in michigan where a

man is accuse of plotting multiple jewish officials in that state. we go to polo sandoval, and andrew mccabe, and polo, begin with what we know about the suspect and what led to his arrest. >> good morning. we have been digging with more beyond the zen pages laid out by the federal investigators and more on what we could potentially learn from a.g. nessel saying that she has taken to twitter saying that she has been notified by the fbi when she first learned about this shocking potential threat here, and confirming that she was the target of a heavily armed defendant in this matter. the a.g. goes on the write that it is my sincere hope that the federal authorities take this offense as my hate crimes and terrorism units take plots to units against the hate crimes

and domestic terrorism unit takes plots to murder elected officials. and so, michigan officials, this man wrote, i am heading back to michigan to carry out the punishment of death to anyone who is jewish in the michigan government if they don't leave or confess. the very next day, the fbi working with the michigan state police working to track him down to texas and made contact with the mother who shared with investigators that he had potential access to three p pistols and a 12-gauge shotgun and two rifles and the investigators tracking him down to the fort worth area, and he is scheduled to appear in court soon and then trying to find out more about who this man is. >> in terms of what we are

trying to find out who this man is and there had been a protection order against him and not clear what he had been previous arrested for, but at this point knowing what we know now, and what are investigators looking at? >> certainly the past, and trying to get my hands on that order that was signed on february 9th, we know that he was arrested this past december and charged with assault, and also had at least three handguns registered with the state of michigan and also the fbi quickly found out that michigan state police were already in contact with him and investigating him as well for alleged handgun theft, so it is somebody who clearly had a history with state investigators and now that he had made it on the fbi's radar, they are certainly working together to find out more as he remains in custody. >> andy, the fbi has said for years that the domestic violent extremism is the biggest threat in this country and certainly

not the first plot in recent years plotting jewish individuals and officials and synagogues, and what is the state of that threat in this country? >> well, jim, this is right in the wheelhouse of what the fbi and director wray have told us that they believe is the most dangerous and the most concerning threat that they face on the counter terrorist site which is the threat from the extremists and predominantly lone offenders motivated by racial animus, and anti-semitic feelings and anti-immigrant feelings and charged with sometimes political grievance and then motivated to act violently on their own. so i think that this guy, he fits that picture perfectly as someone who is, you know, he is heavily armed and he might be mentally unstable, but nevertheless, he has decided to act out the animus and the

jewish a.g. >> and what could we learn more today and where is the focus today? >> well, there is no question, erica, what the fbi is doing today, since they did not have awareness of this guy until the reporting of february 17th, they are doing a deep dive of who is he, who does he associate with, and communicate with, and they are no doubt looking at the twitter account and any of the social media that he might have to understand more about the motivations, and also any planning that he might have been involved in, and who exactly was he targeting, and it seems with the victim notification to the attorney general in michigan, the fbi has awareness with the folks that he may be targeting or planning to interact with or violently towards, and they are trying to develop anything they can about this guy. >> and to say the least, they appreciate both of you being

here to help us with this story. thank you. and now, we are also learning that the defense attorneys for alec murdaugh started the closing arguments a moment ago and started later than planned, because the judge dismissed a juror this morning for allegedly talk about the case outside of the courtroom. >> quite a moment for that to happen. dianne gallagher is outside of the courthouse, and diane, it is not the first juror, and others with covid among them, and walk us through how long you expect the closing arguments to take, and who stepped in to fill that juror's spot. >> well, let's talk about this juror to be dismissed with, because we are down to one alternate juror at this point, and five of the original 12 have been replaced with alternates, and this is a surprise this morning and the judge came in and announced that they had been having interviews with

individuals and the juror herself about any discussions that she may have had with other people about the case. now the judge said that the juror denied that she had discussed case, but they had determined with other interviewers that the juror had contact or discussion with others with at least three individuals. it does not appear that the discussion was that extensive, but it did offer the juror offering her opinion on the evidence in the trial. he brought her in the room and dismissed her in the case, and asked if she had anything back in the juror room and she had a dozen eggs she needed to retrieve, and then there was an alternate for the panel, and then starting the closing arguments from attorney jim griffin and we told you that it would involve almost exactly as we suspected right now where they are going through what

reasonable doubt means. telling the jurors, if you have any hesitation, it could be reasonable. take a listen. >> some amongst you when you read in the paper that alec murdaugh was charged with the murders of his wife and son. and you thought, oh, good, they got him. but those opinions and in each of you when you filled out the questionnaire agreed and affirmed that you would leave those at the door of the courthouse. and that you would decide this case solely on the evidence. and that is what the law requires, and we will begin, the law also requires you to presume him innocent of these charges. >> reporter: now, griffin does not believe that his closing argument is going to take as long as the prosecution, but jim and erica, the state has a chance to do a reply closing as well. >> hmm, interesting. >> dianne, never a dull moment

for you there. appreciate i. and now to discuss is civil rights attorney, areeva martin. now, where we are at this moment, the defense is starting the closing argument, and the prosecution's went on for four hours yesterday after the site visit to the site of the murders. i wonder, if this isn't good for defense this morning to be starting with this fresh jury after what was likely a long day yesterday. >> yeah, jurors, erica, they are real people, and they get tired and fatigued and a four-hour closing argument by all standards is a very long closing argument, and i know that the prosecution felt that they had to point out at the point of him being a liar and they needed to go through the evidence to establish a time line, but you have to be sensitive to people's attention span. you don't want to lose their attention span, and you want to

hit them hard about the most salient points, but you don't want to hit them with overload. >> and now the closing argument and as expected zeroing in on the judicial system they only have to prove a reasonable doubt. what are you going to be listening for from them in court today to get to that point to establish that reasonable doubt? >> yeah, i think, jim, they are going to hammer in on this alternative theory that was put forth by their expert witness during the last day of the presentation of their case, and that is a theory that there were two shooter, and that there is no way that it could have been done by alec as one person, and that there had to be two people at the kennel at the night that the murders took place. and they are also going to be talking about the evidence presented by the prosecution may

be compelling by the financial fraud claims made against alec murdaugh, but they don't establish that he committed the heinous murders. yes, he may be a liar and yes, he may have stolen money, and he admitted to lying, but the evidence does not add up to the two murders. >> and we have heard the exact opposite from the prosecution as expected yesterday. what is interesting is that we heard from the former prosecutor this morning and she said that she felt four hours though it may have been, it was a strong closing argument, and the evidence was there to bring the case that they proved it. would you agree? >> i would expect a former prosecutor to say that. i would agree with that. i would agree with that and i am not surprised with that rendition of what she heard. no doubt, it was a very compelling that, and i will give the prosecution that, but there are holes in this case, and all you need is one juror to feel like the prosecutor has not

convinced her or him beyond reasonable doubt that the murder occurred in the way that the prosecution has alleged, and look, we don't have an eyewitness, we don't have the murder weapons or the bloody clothes and even though the circumstantial evidence can be compelling and enough to convict, there are some jurors at least oneer two that may be thinking, that i need more. i need more to convict someone who may be spending life of their life in jail. >> well, it is going to the jurors very soon. final moments of this trial, and areva martin, thank you so much. another case we are following today, a pennsylvania man accused of hiding explosives in checked luggage, and the court documents say that mark muffley's suitcase triggered an alarm at lehigh valley airport with powder concealed with plastic wrap consistent with commercial grade fireworks. >> sandy freeman is live in

allentown, pennsylvania this morning. and what more do we know about the suspect both in terms of what was found in the luggage and who he is. >> well, erica and jim, we are learning more about the suspect including some of the past experiences with the law enforcement, and a criminal history there, and we will get to that in a second, and what we know so far, mark muffley 40 years old from lanceford, pennsylvania, and little less than an hour away from the airport here, and he is the one that the fbi said that he put the explosive allegedly in the suitcase and tried to check it to a flight back to orlando. you know the story, that this bag did not get far, and tsa flagged it, and i will tell you what was discovered in there. it was a small capsule with powder and consistent with the commercial grade fireworks and butane, and a pipe with white residue on it and a wireless drill and two outlets taped

together. a bomb technician saw it and he said significant risk to the aircraft and passengers and that is when everything stopped there. the bag actually had a luggage tag with muffley's name on it, and that is how the airport read his name over the p.a. system here, and then we saw on the security camera in the criminal complaint, there is a still image of him leaving the airport once his name came out over the loud speaker system here. the fbi apprehended him that night on monday, but i wanted to say that i have mentioned this earlier, that he has faced criminal charges here in pennsylvania before, but they have not been at this level of more intense federal charges and some accusations of a possession of a controlled substance and now, he is accused of federal charges of placing explosive materials on a plane and he is going to be faces charges in

target the suppliers who are responsible for the crisis and secondly to be just as aggressive in community to raise awareness about the dangers of fentanyl to prevent deaths. >> is this a border security issue? >> on the prosecution side and on the law enforcement side, we are targeting everyone from the cartel leadership to the drug trafficking organizations that operate at the border that bring the drugs into the united states through the southern district of california to the street level dealers, and we are making some progress on the prosecution side, and we are taking their drugs, and taking their money, and take their liberty and securing lengthy prison sentences from cartel leaders to the street-level dealers, but we know as a matter of security at the border and matter of public safety, we cannot prosecute our way out of the crisis, so we need to be in the community as law enforcement leaders, as

national tv and it is just that partnership with the media and community and leadership with the state and local governments to say just that. it is everywhere. the cartels are cutting their drugs as a matter of reducing costs and making profits and it is everywhere in oxycodone pills and adderall and in powder form as well. we have seen an unfortunate trend where the people in the depths of the addiction are seeking out the fentanyl, but it is continuing to be spiked in powders as well as pill drugs. so it is everywhere and there is no safe experiment, bottom line. >> you have mentioned the oxycodone, and i have spoken to so many families sadly where the path is in pain after injury. myself and members of the family young and old have somewhat mild

or minor operation and always sent home with oxycodone and that is in itself not a problem, but some folks are hooked on some injury and find their way down the path, and is that something that is a big part of the phenomenon and how the country manages pain and what doctors give out to do that. >> sure. i can't speak to the results of those studies, but i can tell you that a significant number of the seizures in the southern district of california are what we call the blues or the m-30 pills. and we have had three very significant seizures since november. over 3 million pills, over 1 million each, and they were fake oxycodone pills, or the m-30, and so there is a significant number of those pills being seized in the southern district of california. >> the concern is bipartisan and no matter the party, the folks are seeing the effects of this

understand that you like to go by quiz daddy, and i think that people do like this and remember it fondly. and my older one was fifth or sixth grade and his friends played it and it took off like a rocket. what was it about this game? >> well, erica, it was something new. it was fresh, and a live game show on your phone, and you don't have to be sitting on the couch locked into a television set somewhere and you could be mobile with it. out and about, and people were playing at basketball games and weddings, and i have pictures of people playing it anywhere. and you had to be in it to win it, and it was not like anything else, but you could play any time at your pleasure, but it was certain times of the day and 15 minutes and time element, and you could win money, and who does not want to win money, so we were giving away money. so a lot of factors.

rida every day, it is going to get old. >> so you are on the rocket ship and what was it like after? >> well, prior to h.q. i was underemployed semi struggling comedian in new york city for like 12 years i was on that grind. this was out of the blue audition they got and i did not think much of it in the beginning, right, game show on the phone rg and who wants to do that? but it quickly took off, and as it did, i was thinking, wow, this could be the future of media and the future of television, and i was getting really comfortable, and just as i was getting into my groove it started to come down around me, so it was definitely a roller coaster for sure. >> so i understand that you have questions for us to test us out and i wanted to say that i am not competitive at all with erica here. >> no, jim is not competitive at all, ever.
