but you have the opportunity to do so. >> i will tell you again, that i respect this court. i am innocent. i would never under any circumstances hurt my wife maggie and i would never under any circumstances hurt my son paw-paw. >> and it might not have been you. it might have been the monster that you have become when you take 15, 20, 30, 40, 50, 60 opioid pills, and maybe you become another person. i have seen that before. the person standing before me is not the person who committed the crime, though it is the same individual.
7:01 am
we'll leave that at that. before announcing sentence on these cases with regard to all of the other pending cases, are any of them here in kco collite? >> i believe some of them are, and have been in buford and other places. >> we may have worn out our welcome here. and i will thank all of the
7:02 am
sheriff's office, and i know that mr. harpootlian has sacrificed many, many things, and to have the attorney general here, mr. alan wilson, to be here along with everyone else, it has been quite a sacrifice, but there are other victims whose cases deserve to be heard. and this case has jumped some of those other cases, perhaps
7:03 am
jumped it because of the case assaulting the integrity of the judicial integrity of our state, and even in this trial, the law enforcement have been maligned for the past five or six weeks by one who had access to the wheel of justice to be able to deflect the investigation and as the evidence has pointed out in this case, looming storm that mr. waters talked about.
7:04 am
i can just imagine on that day june 7th when a lawyer is confronted an confesses to having stolen over half a million dollars from a client and he has a tagger like mark tinsley on his tail pursuing the death of mallory beach and having a father for the most part on his death bed, i can imagine, or i can't really imagine, but i know that it had to be quite a bit going through your mind on that day. but amazingly to have you come
7:05 am
to testify that it was just another ordinary day that my wife and son and i were just out enjoying life. it is not credible. it is not believable. you can convince yourself about it, but obviously, you have the inability to convince anyone else about that. so, if you made any such arguments as a lawyer, you would lose every case about that, and cases that you will not have the opportunity to argue anymore except perhaps your own as you sit in the department of corrections. anything further? >> no, sir. >> all right. mr. murdaugh, i sentence you to the state department of
7:06 am
corrections on each of the murder indictments in the murder of your wife maggie murdaugh, i sentence you for the term of your natural life. for the murder of paul murdaugh, whom you probably loved so much, i sentence you to prison for murdering him for the rest of your natural life. those sentences will run consec consecutive. under the statute involving a crime where there is no other involving indictment of other crimes, you are mandated to the
7:07 am
department of corrections. and officers may carry forth on the imposition. yes, sir ? we have just witnessed quite a moment in an american courtroom, the judge in the alec
7:08 am
murdaugh case delivering two consecutive life sentences for alec murdaugh, one each for the murder of his wife and for the murder of his son, and he said in these words that murdaugh would spend the rest of his natural life in prison for those crimes, and quite a preamble to that sentence, twice, alec murdaugh said he was innocent, and i would never under any circumstances hurt my wife, and i would never under any circumstances hurt my son paw-paw. and the judge said that he would not believe him, and he said that throughout the testimony, and many or most, 99% of the people would not believe him, and would continue to not believe him. let's go back in to listen. the order was concerning the
7:09 am
order of the jurors' identity rema remaining anonymous, and except for the jury leaving the courtroom yesterday, and the jury leaving courtroom while the jury was still seated. erica, it struck me and he did raise the point, and judge clifton newman before he got to the consecutive life sentences, the crimes qualify under south carolina death penalty statue that two people were killed, and it struck me for a moment that the judge might be going another way, but it was notable. >> when he was talking about it, he said clearly, that i don't question the state's decision,
7:10 am
but he referenced and we have talked about this a lot in the course of the trial and the last year and half or so since maggie and paul murdaugh were killed, the impact that this family has had on this county in this area of south carolina. and from the perspective of the judge over the past century that this family has been prosecuting people in this courtroom, that people have received death for lesser conduct. >> and how about the detail that he had to have the accused's grandfather's portrait taken down in advance of the trial to help it to be a fair trial. >> absolutely. joey jackson and sarah ford back with us. joey, to continue to pick up with this point so if you are joining us, consecutive life sentences for his wife maggie and son paul murdaugh.
7:11 am
we heard throughout from the judge talking about who alec murdaugh was in his view prior to these moments in court, and who he was today, and he said, maybe you weren't the person who killed them, and maybe you were not the person because you had popped so many pills, and maybe you weren't in that moment, and i have had people who stood before me who committed the crime, but they were the same individual, and i found that interesting, joey that he would lay it out that way. >> remarkable erica, and even the personal connection that the judge would say, hey, i have seen you at events, and known you as a member of the bar, and i have known you and your family to be a beautiful family, and i have known you have to be a nice person, and what happened? and then going back to the point that you made which is compelling that the judge talked about, that, yeah, perhaps it was not you, but maybe it was
7:12 am
the individual who was so strung up on these pills that it happened. big picture, erica, looking at the sentencing issues, they are about punishment, rehabilitation and deterrence, and the judges look for them, and this is clearly a person who could not be rehabilitated, and the judge has to look at what is the appropriate punishment under these circumstances, and is there anything that anyone would believe other than life sentence, and the deterrent fact, that anyone should be able to get away with this, whether you have a portrait hanging on the courthouse door or anyone else. so the judge was thoughtful, and spoke to the sacrifices of the attorney general and the sheriff's department, and he did what the justice demanded and required which is the two consecutive life sentences. >> it is clear that the judge did not believe the denials or
7:13 am
the stories, and he said, that you seem to be lying still here. i want to get to dianne gallagher outside of the courtroom, and you have been following this case for some time, and what is the reaction there? >> well, silence and some gasps. i wanted to add some context here, and you heard him say, i am sure that you loved your son very much. i am sure that you have to see paul and maggie in your sleep. and then he said, all day and every night. and he said, i am sure that you have to see them in your eyes. and he is known for being even
7:14 am
keeled, but as a grieving father, his son died right before this trial began unexpectedly, and he has gone through this listening to alec murdaugh talking about paw-paw and his friend discuss that they had heard him there and identified him there. so he pulled no punches, and we talk about the prominence of the murdaugh family, and the century of them controlling the law as solicitors here, and talking about the portrait being taken down, and creighton waters the gave condolences for his father noting that he had worked with him, and the judge pointing out that they had argued cases before them, and pointing out
7:15 am
how involved everybody in this community is, was with this family, and that alec murdaugh had fooled everyone, and most tragically, he had fooled maggie and paul. i have never seen something like that and i don't know if alec murdaugh has ever had someone look him directly in eyes and dress him down and hold him accountable for the things that he had done. and judge newman acknowledging that he is presiding over the 90-some charges that he is still to answer. and he said, we are still going to pursue those, and this is maybe two life sentences for maggie and paul, but there are still some other victims out there who want to get their justice as well. so there are additional pleas
7:16 am
going forward that are dealing with alec murdaugh. so some of the people coming out, they are coming in from the area, and their fascination with the fall from power. i spoke with an attorney who represents ten of the alleged financial victims, and he said it is not a fall from grace or power, but it is a jump. just to see how quickly this has unraveled with alec murdaugh admitting on the stand with a decade of lying and stealing on the stand. it is important to note that he has been convicted and that he has never hurt maggie or paw-paw, and obviously, the jury is not convinced by the testimony. >> yeah. such important context, dianne. and we appreciate the excellent reporting over the days and
7:17 am
months as we bring you back in with the panel. sarah ford, we were waiting to see whether there would be any victim impact statements, and not a single one. was that surprising to you? >> i don't think that it is surprising. the victims have an opportunity to speak if they want, and they have the opportunity to choose not to. because there is a fine line, and there is no distinguishing between the victim's family, and the defendant's family. buster is the son of maggie, and the brother to paul and also the son of alec, and hearing him speak or certainly creighton water's office did an excellent job advocating for maggie and paul asking for the life sentence which the judge newman did sentence alec to.
7:18 am
but listening to judge newman, the words were chilling and poetic, and so thoughtful, and really poetic to hear. >> and briefly, sarah ford, could he have ordered a sentence greater than life in prison? could he have gone beyond? >> the state would have had to file a petition for that, and the second nature of that which the judge did impose. >> and dianne brought up the comments of the judge, and i almost stopped taking notes at one point when he said, i am sure that maggie and paul visit you at night, and he said all day, everyday and you must reflect on the way they look you
7:19 am
in the eye. and from what we heard from that juror and the prosecutor at all, and alec murdaugh, and when people would look him in the eye, and what they are seeing in the moments of the courtroom as they look him in the eye, and all of those words, joey, they paint such a powerful picture of this man in this moment. >> you know, they do. and it is an interesting point, because the prosecutor would say that when he would eye him down, he would see the cold-blooded killer that he is. and even the testimony would say that his partner would come in and say he was theatrical in the courtroom and knew how to put on a performance, and that was his way to say, don't believe what he is saying to you, because it serves his purpose, but now that
7:20 am
it does not, this is the cold-blooded killer. and the last point, erica, and pivoting to what the judge said about the lies. the defense filed what is called albino tis. what is that mean? the client is going to have a alibi defense, and then, oh, nevermind, there is evidence that says i was there. so that harkens back to, maybe you didn't kill him, but the person you have become killed him, and the judge did what he had to do which is to issue the two concurrent life sentences. >> and the time he denied being there and then admitted to being there, and sarah ford, that shows how ingrained the family
7:21 am
was in the community, and the fact that the grandfather had a picture there in the courthouse, and the judge knew him, and they saw them at events, and this is a family for a century deeply involved meeting outside of the law in the counties here. and in your experience, have you seen a case like this, where a lawyer who argued case likes this is now in the docket and now convicted and going to prison. >> i have never seen a case like this of someone who is so prominent, and alec was the president of the south carolina trial lawyers association. and so prominent and successful trial lawyer. and to see him trying cases in
7:22 am
the kolcolliten county courthou is a not a fall from grace, but a jump from grace. >> and he did reference when talking to the beginning of the sentencing, he said that you have no obligation to say anything other than not guilty and i would not expect a confession, but in terms of the appeal, how do you see that playing out? >> there is an appealable issue, and that is a large one whether the judge should allow the financial issues, and whether it
7:23 am
is so prejudicial, and that is a term that we lawyers use that even if the jury doesn't believe that you didn't murder anyone, that it affects your character so much that even though he was not on trial for the financial crimes, it was fertile for the judge to admit it. so there is grounds for the judge to admit it. because it went to motive, and the crimes were being exposed and the family was learning and it, and the progs cushion said we should be able to introduce this, because it was toward the motive. >> we have learned some court history here this morning. quite a decision. >> joey jackson with us this
7:24 am
morning and throughout the trial as well. we do want to get you caught up on a number of stories this friday morning. the justice department rejecting president trump's sweeping claims of presidential immunity when it is coming to civil lawsuits for january 6th, and what the doj is now noting in an appeals court. and the plot to kill jewish lawmakers thwarted, and what a judge is expecting to hear later today. and what nikki haley is planning to pitch to the cpac group. and what jill biden thinks about giving older candidates mentala competency tests. and how you enjoy life. it changes your smile and how others smile a at you.
