>> i thing it is justified. the question is recognized internationally by us. i thing it makes for a very strong point. >> for that was go to cnn chief international correspondent clarissa 40 got the exclusive interview. she joins us from the hague. clarissa, a historic interview for you? >> reporter: historic interview for us and a historic day for the international criminal court. the icc. when we sat down and had an extensive conversation with the chief prosecutor. khareem khan is of the first on the sitting head of state of a permanent member of the united nations security council has been issued with an arrest warrant by the icc. and it is all the more significant because this is not happening years after the war in ukraine finished, jon. this is happening months after it started. and what khan is hoping is this will set a new president to show that the wheels of justice can

turn quickly. take a look. quick this feels like a historic moment? >> i thing it is a very important moment as the president said his words have been issued. and sh>> and shows that individuals, whatever that possession. that don't have a free pass. and that the law binds us to basic principles. i thing it is important for that reason and many others. >> reporter: what is the next step, what happens next? what the next step is that laws have to be circulated and states would have to consider whether they can enforce those warrants. but also continue our investigation since many of these crimes in ukraine we are looking at give us other options. if the warrants are not complied with for confirmation hearing in absence of the future. >> reporter: do you believe it is possible one day we will see president vladimir putin?

in some cases. in many cases. but i thing the icc has been pedestrian in some respects and we need to accelerate. i thing that is important if we feel the law is for us as prosecutors, as judges, as defense council, victims, lawyers. and we don't feel the weight of responsibility with people in refugee camps, crossing borders with plastic bags and gun pellets. and fleeing with fear we are not fulfilling our responsibilities under the law. it also as members of humanity as well as we should. >> reporter: this is about justice for victims not geopolitics? >> absolutely it must be. the law must be especially criminal law must be about victims and survivors of humanity. >> john: such an important discussion, clarissa. what has the reaction been from the kremlin from these charges?

>> clarissa: perhaps unsurprisingly, jon, it has not been positive. we heard fromdmitry dmitry pesks of course president putin's first person. he said essentially that the warrants are outrageous and unacceptable. we also heard from maria za zahazarev, is that they have no meaning because russia is not actually a signature of the icc royal statute. and therefore does not fall under its jurisdiction. and we heard from the woman herself. the high commissioner for children of women maria lvova-belova what a sarcastic response and it is great the international community appreciates our work. so sardonic but beneath that one can be sure there is an understanding that is the very least this is an irritant that certainly will have some concrete impact. whether or not we see president

putin in the dock it is a significant day, jon. >> john: in theory, or on paper it limits where putin can go around the world. explained that. >> clarissa: basically there are 123 that. >> clarissa: basically there are 1 that. >> clarissa: basically there are 123 nation states. that do participate with the icc and the royal statute. that is about two thirds of the countries in the world. some very big ones do not, not just russia. chyna, india and of course the u.s. can president boudin to go to the g-20 in india coming up? he still can. can he potentially go to the united nations general assembly in new york city? potentially, yes he could. and also, it is important to underscore even for those countries to our signature that does not mean necessarily that they would have to enact those arrest warrants. was on the back in 2017 from south africa.

positivity, unsurprisingly. ukraine is also not one of the signatures of the icc. and yet they have opened up their country and said they have given full jurisdiction to their territory. because they understand the importance of having some of these crimes paid attention to. the chief of staff of the presidency said this is an important first step. but it is just a first step, basically. a lot more needs to happen. this is not one single war crime being investigated. that is something also important to emphasize, john. the icc is looking into multiple allegations and has multiple investigations going on. this is just the first step, john. >> john: will talk more about that next hour. clarissa, thank you. we will see much more of your interview coming up. but this warrant, as we just mentioned and you see on the map. in theory narrows president boudin's world two thirds which may not matter to him.

on the other hands it is a moral signal. it is a signal that the west is taking this is seriously. that a lot of democraticomar al-bmany non-democratic governo and signatories are taking this seriously. and so it as a certain kind of moral pressure. but i thing you need to understand the international cour t is not like a regular court. >> john: the united states, what do you thing the u.s. connection will be to this? how much will the u.s. help here? >> that is a really good question, jon. the u.s. is not a signatory to the court. and generally has been wary of getting too involved. in this particular case the state department wanted to provide american intelligence to the court to help them. the pentagon did not because the pentagon worries that if an american soldier, you know, is taking part of some military action. what if that soldier or that battalion is brought to the court to alleged crimes.

so the pentagon has always been much more wary. i thing the administration on the whole has decided directly that this is a case where the moral pressure puts on boudin. the moral box it puts him in his worth the cost of cooperating. >> john: it is interesting there is more nuance from the u.s. perspective that you might thing. let's talk about when this is happening. this is happening days before chinese leader xi jinping would meet with vladimir putin. is this the fact that putin has been charged with war crimes by the tribunal. that have any impact on these meetings? >> it won't have much of an impact but it has an impact of the optics. the chinese are trying to make it out as this alliance is solemn and unyielding. there is a reality of the public atmospherics behind it. and the fact the guys have just been invented by the international terminal court

does not help. chyna is trying to present itself is both neutral and an ally of russia at the same time. neutral what i want to say they are the ones not wanting to take sides. and from the alliance. i thing public matters xi. for. >> john: you brought up the number one question we get from the international criminal court which is okay, how will they enforce it? what difference will it make to vladimir putin's life? do you thing there would be a country he would be able to go to? some conference he would not be able to attend because of this? >> there are probably countries he could not go to but he would not go to them anytime soon. he will not come to the united states anytime soon. in a sense it punctuates the reality that the world really has been divided.

so, caitlyn, this is your reporting. what more are you learning about the conversations prosecutors want to ask about? >> they want to work around attorney client privilege. they talk to a frevan why they made the case for this exemption here is a wanted to ask him questions and not have them cite attorney client privilege which is what he did when he testified the first time. they are have been bracing for this to come down from the judge today. and the judge notified them essentially by this order saying she does believe that investigators have met the threshold for this fraud crimes exemption. which means essentially prosecutors can work around it attorney client privilege if they believe that attorney has use their legal advice or legal services in furtherance of a crime for the client. in this case obviously trump. >> john: question about what specifically and are there limits? >> there could be limits we

don't know the full scope of this. there not gotten the full order they will likely get that. that evan corcoran and his legal team himself he is hired his own attorney here they will likely get that next week. we may see them respond before then but obviously one of the assumptions they want to talk about his discussion with trump about these documents. because he has been involved in this since last may when this was all going down with the negotiations with the justice department. this is really significant they don't know how this is going to end up. >> ellen honey, to client privilege is a thing. how hard of a thing is it? what does the judge have to determine to allow these type of questions now to be asked? >> jon , it is both difficult and

rare to convince a judge to pierce through attorney-client privilege. i was a prosecutor 14 years i only ever did this one time successfully as it turned out. what you have to do is go to a judge and show by a preponderance of the evidence. meaning it is more likely than not that these conversations between the attorney here evan corcoran in the attorney and trump. the fact they were able to make that showing and a respected federal judge agrees with that i thing is a monumental decision. it opens the door for prosecutors to get that testimony. >> clarissa: maggie that gets you into the conversation. remind us where evan corcoran this in the ski timeline and where he fits in trump world. he is not a name we have known since 2015. >> evan corcoran got introduced into trump world by epstein, his on politics last spring when this issue was starting to heat up. evan corcoran was present when justice department came mar-alar to june 5th and this was after thiso subpoen had been for any outstanding lar to june 5th and this was after thiso subpoen had been for any outstandingmar-a-lar to was after thiso subpoen had been for any outstandinglar to was after thiso subpoen had been for any outstandingatolar

weakness it is a sign of strength. you only do this is a prosecutor you are confident you can get this showing. it is a rare thing for prosecutors to do and they did it successfully here. >> john: maggie and caitlyn want to talk to both of you of what happens in. the manhattan attorney could get indictments for donald trump on the stormy daniels matter. what is going on inside trump world? do they appreciate the significance of this? perhaps being under indictment within days? >> yes they appreciate the significance of it. i thing it crept up on them a bit. despite the fact this is been telegraphe d for such a long time this may happen. from their perspective trump has been under investigation for a number of years. it did not materialize into anything. it did not materialize because he was sitting president. that is why he would not get indicted. but that aside they are prepared for it. i thing it will become clear to us if an indictment comes out.

they are very much preparing on the political front and preparing to suggest this is of the cases the weakest of them. when people call this a weak case, they don't know what the evidence is it is a more trivial case i thing is what people are saying in comparison to the othe r cases trump is facing. and the law is the law. trump folks are planning to paint this as a broader conspiracy by democrats. although often without evidence suggesting this is about helping joe biden. and i thing you will see that immediately. >> trump has been watching closely, ellie is one of them. they do not believe for prosecutors it will be quite a difficult case. heward legal experts say they are surprised if they move forward with the indictment that we are expecting. that they would take that step because of the risk of what happened and they are not successful. if prosecutors go this far and take this unprecedented step of indicting a former president. >> john: ellie, maggie, reporting and political team.

chinese company that owns tiktok. after allegations it was being used to spy on u.s. citizens including journalists that cover the tech industry. and other majo r development after a tense standoff after the biden administration threatened to ban the social media app in the u.s. do to security and privacy issues. already the app is banned on government devices in the u.s. europe and other states. there's a new report that tiktok may have access to your data even if you have never used the. we will have much more of that in a moment. let's go to cnn tech reporter on the justice department report. bryant, what more can you tell us about that? >> reporter: john , this goes to a spying incident we learned about in december when forbes broke the news that a number of journalists had been spied upon by bike dance. bike density parent company of tiktok. tiktok later proved confirm this to cnn saying that they fired several employees who had been involved in improper data

access. now it appears through this report from forbes and new york times that the justice department is investigating to see if there may be more to this story. and we are seeing this is just adding to the concerns that the u.s. government has about tiktok. and whether or not it poses a national security threat to the united states. >> tiktok parent company admits to accessing the data. what are they saying? >> they are reiterating the earlier position on this. let me read you a statement we got earlier tonight. they said, quote, we have strongly condemned the actions of the individuals involved and they are no longer employed bytedance at it looks like tiktok bytedance and are

app on your phone. they will see when you are typing into the forum the are signing up. >> john: is there anything you can do? >> great question. one discussion is having change of ownership. i don't thing change of ownership. what is really making a difference is integrity. it is people who have access to the data who have control over the data. who can make decisions. i thing it is about having people who have trust like the pentagon. >> a tiktok spokesperson said, quote, like other platforms the data we received from advertisers is used to improve our advertising. we instruct advertising not to share data with us and work with partners to avoid inadvertent transmission of such data. what are the chances these
