a grand jury -- as we wait to see if there could be an indictment soon for former president donald trump, and today is expected to be a pivotal day in court, and today, a former attorney to michael cohen is expected to testify, and he says that he has handed over a number of documents to back up the story. and we are watching the stock markets after serious banking fury, and the stock market is up, but the banking is down for credit suisse are down 50% after the swiss government had to pick up some risk. and xi jinping is meeting with vladimir putin in moscow, and sending a strong message of support despite the invasion of ukraine. we begin with the latest on the trump hush money investigation.

and the legal affairs correspondent paula reid is here with the latest, and lot going on with robert costello testifying, and we have details surrounding this testimony, paula. >> what is interesting here is that even though prosecutors are running the grand jury, this is witness that was requested by the trump team, and they have asked robert costello who is an attorney, and well known in trump world and he has represented other trump allies like rudy giuliani and steve bannon and at one time he represented michael cohen, and so he wants to go to testify to undermine cohen's credibility, and that is essential because he is an essential witness in the testimony and credibility of

michael cohen, and at the same time, michael cohen is going to be there with his attorney, because he does not like anybody to call into question his credibility. >> and so what does this mean? >> well, trump did not decide to go before the grand jury which is probably wise ly said for hi by his attorneys. but in terms of optics it is not great for the team, but over the weekend he said that he would be indicted tuesday, but then his own team said that he has no legal notice that it is going to happen, but it does appear that the investigation is moving into the final stage, and we don't know the strength of the case, and we don't know why after five

years it is heating up, but we know that this is not the consequential case that he faces, and we will see if he is indicted. >> we don't know of any other witnesses testifying besides one today, right? >> exactly. and we knew that this person was coming, and we were surprised to find out that it was a defense witness. of course, we are working sources to find out if there are any other witnesses, right, john? we are turning over the rock and calling every source, but there is not any other witness, but in terms of timing, there could be developments soon, but there is a question as to whether or not he will be indicted. >> we have kept you here long enough, and you go do your reporting and find out what you can and see where it goes. paula reid, thank you very much. and now,s is richard painter, and cnn analyst

jonathan rackcrow and what we are seeing from the grand jury is feeling unusual, because a grand jury investigation by definition is run by the prosecutors and the defense attorney is not in the room, and how is the questioning of robert costello going today? >> well, we don't know what is going to happen and what he is going to say to the grand jury, and this investigation has been going on for years. i submitted a amicus brief to the supreme court to allow the subpoenas to go forward for the manhattan district attorney's office and we don't know what is going on with the grand jury, but we should keep in mind that michael cohen was charged and convicted, and was guilty in connection with the payoffs on behalf of the individual number one, and it is highly unusual for individual number one not to be indicted, so i expect that to happen sometime soon, and how that is going to be playing out,

i don't know. >> stick with me for one more, richard. everybody is trying to read the tea leaves here and figure out what is going to happen, and part of that is because of what the former president put out over the weekend and what going to happen, and as paula said, his own attorneys refuting that, but the fact that the narrative is out there, what does that do? how does that weigh on the prosecutors at this point? how does that inform any decisions at all knowing what could be coming in terms of the reaction? >> donald trump is going to try to play this to rev up the base, and cause unrest, but the prosecutors should continue to do their job, and that is what they are there for, but the problem is the much more serious charges are in the hands of the department of justice, the charges for sedition and

insurrection around the election, and we have a problem of the district attorneys in new york and fulton county, georgia, are ahead of the investigations and impaneling grand juries without the doj without taking action. and the seditious actions should be the first charges to be brought because it would disqualify him from running for public office. and without the air support from the department of justice, the district attorneys have to be subjected to very vicious attacks from donald trump and his supporters which i believe could feed into more civil unrest. it is very, very precarious situation right now. >> jonathan, i want to bring you into the discussion, because talk about unprecedented, and the possibility, and again, we

don't know if it is going to happen, but the possibility of a former president being arrested is bringing all kinds of security concerns, and yes, he called for protest, and security concerns there, and what should we be looking for, and how would this work, and the agencies from the state and the city and the federal government might be involved with this? john, great question. listen, a lot of uncertainty, and we don't know exactly what the prosecutors are going to do, and we have sight of what the law enforcements are doing, and the backdrop of the actions of january 6th, they are hypercoordinated around the efforts and the efforts are across law enforcement entities at the state, local and federal level. what is interesting, john, is the roles and the responsibilities around all of the different law enforcement entities that are involved are different. they have a different remit of

how they are addressing the issue. this is what we are looking at. the nypd are in charge of maintaining civil order, so they are going to be focused around the area of the courthouse, and also new york city at large. multiple areas where the protests could spark at a moment's notice, and remember, nypd has a dual role, because the protests are individuals who are exercising the first amendment rights, and they need to be protected in the execution of those rights burk nypd is keenly aware of any violent activity that may stem from the protests, and so they have a dual remit on maintaining the civil order. and the state officers are protecting the courthouse, the building itself, from any activity. the fbi, why? because they are monitoring for any violations of the federal law for protesters and asking

for acts of potential violence by extremists, and then you have to secret service, and they play an interesting role. usually, the secret service is a coordinating entity to come up with the plans for the rallies and speeches and any political events involving a former or sitting president. but in this case, that renot. they are in a protective mode, and viewing it as an administrative movement to protect donald trump from point a to point b and let him do his business before the court, and leave. they are not the active role that we see them in, and not providing the mag netometers tht we typically see. will they be working with the local law enforcement, yes, but they are not the controlling entity, and that is not something that we normally see the secret service engaged with. >> how much, if at all, have we

seen the events that unfolded there influence the preparations that are under way at this point? >> listen, they are heavily weighted, and i think that you have seen from january 6th, across a whole variety of different types of events both in new york, washington, d.c., and across the nation, law enforcement is reliant on the information sharing, intelligence, and preparedness, and they have to be. they have to plan for every eventuality especially in new york where there are multiple locations, where the incidents could occur, sparked by and fueled by social media posts from a variety of entities, and the law enforcement has to be prepared and coordinated and have the contingency plans in place. hopefully the calls for peaceful protests are adhered to, and all

international law. again, that was moments ago and white house officials tell the u.s. that they would reject any call that comes for a cease-fire from these talk, and the cease-fire for things to stay where they are, and it would give russia a chance to regroup, and also, it would be not in china's best interests to provide arms to russia. and joining us is the deputy secretary of state who is the author of "overreach." it is easy to see what russia wants, because they want as much chinese support as they can get, but what does china want this morning? >> well, i think that i know what xi jinping wants, but it does not necessarily mean that is what china wants. xi jinping sees putin as his

brother. they have a very close personal relationship, and xi was very much void by his role in br bringing iran saudi arabia together in the middle east, and he would like to bolster his own domestic support and international legitimacy by showing that he is a international statesman and peacemaker, and if he can get putin to make any positive proposals at all, he will claim that this is his great achievement, but of course, even more important is the phone call that he plans to have with president zelenskyy, and unless president zelenskyy shows any positive response to what xi

jinping has to say afterwards, then this whole thing is doing to be a big act that is designed to bolster the legitimacy of xi jin jinping. >> again, we will wait to see if the phone call between xi and zelenskyy is going to happen, but that meeting between xi and putin is happening. and now, the u.s. thinks that a proposal will be very much in russia's interest as things stand. do you think that or where do you think that putin would be a constraining factor, and not putin, but xi would be a constraining factor on putin at all? does he have any desire to hold putin back at all? >> well, yes, i do. i think that he would like to

see the war end with the pressure that xi jinping is under to appear neutral and in a way to support putin. going back to the beginning, putin really tricked xi jinping with the statement of friendship without limit on the eve of his brutal invasion of ukraine. and yet, even with that trap, xi jinping continues to express moral support for russia and for putin. and of course, if the two of them appear to be standing together on the side of peace, what they will want to do is to pit the united states and the west as the warmongers, the cold war yours, if you will, and this

will put a lot of pressure on europe in particular. europe has firmly stood behind ukraine up until now, but it's been, and of course, the winter has not been as cold, so it has not been, the pressure has not been quite as acute, but with time, it becomes more and more difficult for the europeans to stand completely with ukraine. if russia and china appear to be the peacemakers and they have some credible way of doing that, that will put a lot of pressure on the pro ukrainian side in the war. >> susan shirk, so great to have you with us this morning. >> certainly. and now, more missile strikes hitting eastern ukraine

this morning as russia is trying to cut off more supply routes in the donetsk region. >> and this is after vladimir putin made a surprise trip to the russian occupied city of mariupol, and they showed this video of him driving around in the middle of the night, and the plans to rebuild it, and a city that the russians destroyed in the first place. and with us is the retired brigadier general mark with us. and he wanted those out before the meeting with xi jinping, and what will he get out of that? >> well, what he gets in his own mind and affirmation that these are russian territory, and mariupol that he fought for weeks is a great victory for russia, and he is putting down the foot and saying that this is

russian territory, and mariupol is russian. >> so, as he puts foot down, and you have everything else swirling around and not only the meeting today, but the charges from the icc that also came ahead of the visit, and how much does any of that play into the cal calculus? >> well, the icc indictment doesn't mean anything. if they go after me, they will go after zelenskyy as well. but as russia does not acknowledge membership of the icc, he is not the slightest bit concerned about it. >> so, general, we are watching the meeting between the chinese leader, and vladimir putin, and what language are you are watching most closely to gauge the level of chinese support? >> well, if there is any kind of agreement or language from xi jinping that would suggest that we need to support russia with more than rhetoric, and actually give them supplies whether they

are lethal or nonlethal, that is a clear affirmation on the part of the chinese that they have picked sides. >> and we saw a little bit of this ahead of the visit and the very language that was chosen, and so it showed clearly what we may be ibl to expect. >> that is correct, but i don't believe that chinese would get large amounts of lethal equipment, and certainly not the equipment that the russians so desperately need. if he gives artillery ammunition, it is going to be small amounts, and at this point, we have seen 10,000 rifles coming across, and that is not going to tip the balance. the only thing that would help russia right now is 300,000 chinese troops doing the same thing they did in north korea in 1950, and we know that is not coming. >> we will watch the

u.s. stocks are opening up this morning following a coordinated effort from the central reserve to head off a banking crisis. the dow is up 1%, and this is a win. >> and that is big. and over the weekend, the switzerland government agreed to buy credit suisse. and so we are joined by matt egan, and so does that mean it is going to ease concerns, it is difficult to tell? >> well, the markets are responding, but this is after a series of losses in the last week or so. there is a confidence problem, because banking is a confidence deal. >> hubris. >> yes, but too much is a bad thing as well as what we have

right now which is shortage. so we have weakest link to weakest link. going to ubs coming to the rescue to the 2.5 billion deal to buy the ailing rival, and the swiss government is forced to sweeten the deal and putting up $9 billion to take on potential loss that ubs could take on, and the central bank is providing 2 billion in loan, and so this is the first of the systemic banks since the global crisis, and this is the forced marriage, because they have forced ubs to do it, and they did not want to buy credit suisse, because it has been a train wreck for years, but the regulators forced them to. it is like if john's new england patriots were told to buy the new york jet, because they keep losing, and it is bad for the league, and the patriots are

so dangerous, and so is this different, might this happen? >> well, it is pushed by flight attendance for 30 years, erica, but this came up with a safety summit here. and now, lap babies is the industry term for this, a child under 2 can be on the lap free of charge, and instead of being in a car seat which is what the safety regulators and the ntsb would like. this faa summit last week, which is focused on the run way win kurgss, and the notice of the turbulence issues on the rise, and jennifer homendi has said that the recommendations to make that the turbulence is not as bad, but there was a severe turbulence in december and of the 36 people on board injured, one of them was a 14-month-old baby. and the ntsb says that if this is attacked now and something

that the faa can do to require that the parents put their child in a seat and strapped in, that would make a difference. >> it is most common issue on airliners and it makes a difference if you are not belted in. you have to make sure that you are belted in the not just portions of the flight, but the entire flight. >> the issue here is that an accident or the incident, or turbulence issue, and the average baby who is weighing 10 pounds, and under 10gs, the force of gravity that you would go through in the crash, that would make the baby weigh 200 pounds, and so the big solution here is to put your child in a strapped in front-facing or rear facing child seat. and the faa has specific instructions on the website, and you should be able to make sure

new this morning, the only surviving son of alex murdaugh is speaking out about the death of 19-year-old steven smith. his body is scheduled to be exhumed for a private autopsy. >> and the son is slamming baseless rumors that he was involved in smith's death in 2015. we are joined by dianne gallagher in charlotte, and this is one of the unusual episodes that before this last trial began, and now we are getting a new chapter there, and what is buster's connection to this? there is no real connection to this, and though there are podcasts and social media rumors around this, and there is new representations to the mother of stephen smith who is the 19-year-old nursing student who was killed in 2015, and ruled initially as a result of the

hit-and-run, but the responding officers and others say it does not appear that he was hit by a car based on the evidence at the scene. in 2021, s.l.e.d. released a statement saying that they were reopening the investigation of smith's death based on the investigation of the double murder of paul and maggie murdaugh, and that is the only connection to the murdaugh family that has ever been officially made there, and s.l.e.d. has not commented on what they found that caused them to reopen it. sunday, they said they have made progress in the death of steven smith, but that the investigation is active and ongoing. so this morning, buster murdaugh made a statement ahead of sandy smith. he said, i have tried my best to ignore the vicious rumors of my
