are standing by for possible deployment as officers across new york city are prepared as that possible rallying cry from former president trump made as a grand jury in new york city could be handing down a criminal indictment against the former president. we will talk about that and the implications. and also, a summit under way at the kremlin with russian president vladimir putin and xi jinping, and we are keeping up with their conversations. and also, the dow is up about 1%, as the fed chair jerome powell is looking at whether or not to raise the interest rates, and how are markets responding? we will keep an eye on that. and we are keeping an eye on the possible indictment, and it is possible that he could keep

an eye on that possible indictment in new york city as the grand jury could send down that indictment. what do we know? >> michael cohen was on standby and called as a rebuttal witness and he was not at least as of yesterday. one thing to play off here is that the grand jury could ask for additional witnesses, and they are a working body and they can request for additional information and their work is continuing, and we are waiting for the d.a.'s office if they are going to move forward with a indictment or not. if they choose the go forward they will ask the grand jury to vote on it, a then there is some decision, and the indictment is made public and trump's team is

going to be notified. but as of now, we are waiting to see how is it going to play out, and if the grand jury is waiting for any other witnesses or testimony, or if the prosecutors want to add another witness or two into the mix, but it seems that at most of the point most of the people who have touched the hush money, the people from the campaign, and the trump campaign, and michael cohen, and all of the people who have met with the prosecutors or the grand jury, so there is not a lot of others out there that you can think of who they would need to think of, and so, a decision is imminent, and a historic decision so that it is not made lightly. >> thank you, ckara scannell. and with us is the managing editor of "guideposts solutions." i am not asking you the weigh in on a charge or anything like

that, but from what kara just reported and the science of what we know about in terms of the activity of the grand jury, does this point to a pending indictment of some sort? >> it certainly does. i don't know how many witnesses they still plan to bring, but it is coming to the close here, and they only need a majority to vote on the bill to vote on an indictment in which they will notify the former president's consult and that is all they need to hand down the indictment. >> what do you think is happening behind the scenes? >> well, it is hard to tell. these prosecutors are very seasoned, and certainly taking their time with this indictment, and if they choose to do that and there is a lot of coordination with the president's consult, and he is knowledgeable and dogged attorneys trying to stave this off, and should they bring an indictment, there is some negotiation to happen to

determine when the president is brought down to lower manhattan for processing which as you have covered over the last couple of days is a complicated process to orchestrate. >> although, one would imagine this is not -- this is new york city, and this is lower manhattan, and they have dealt with the high profile individuals and certainly not a former president, but certainly a history to call on in terms of what they need for security, how they want to process this, how much or how little they want to put out there, and if there are concerns about public safety. >> absolutely. but nothing of the president and his detail brings a challenge for the law enforcement and the call to protest complicates law enforcement, but it can be done peacefully and the law enforcement is apt to deal with issues, but the details are the clunky state processing of someone of this magnitude through a building which has

hundreds of thousands of cases on a daily basis and shutting it down to make this movement happen is complicated and something that is clearly, they will be up for and ready for. >> how much detail, and we have learned that if there is an indictment that is going to be under seal until the initial court appearance, and how much detail are you expecting to see in the indictment? >> well, the indictment won't be unsealed, and it will be vague. the charges, and the most detail will be given at arraignment, and the indictment is issued and the d.a. has an option to contact the defendant, and in this case, the former president, and have him present himself or issue a warrant for his arrest. they will obviously choose the former in the hopes that he surrenders himself, and that is not going to trigger any other action by law enforcement, and at time of the arraignment, he

will go through fingerprinting, and he will see an emt, and then go through the process that any other defendant goes through, and at the processing similar to mr. weisselberg's processing, you will hear the d.a. lay out the parts of the case and get to the judge what they are trying to prove here. >> as you know, quite well, this is certainly dominating the headlines over the last few day, and we have house republicans saying that they want to speak to d.a. and they want access to the materials of the investigation, and as a former deputy chief investigator here, and is that raising a red flag for you that they want to get into the investigation here? >> i don't know the politics of it, but if the grand jury votes on a true bill, they only have to vote on the true evidence or reasonable cause that a crime occurred and if the politicians in washington want to take a

look at it, that is their prerogative, and every branch has their right to vet at the processes, and it is unusual obviously, but all of this is unusual, and that is why we are discussing this, and nothing like this in u.s. history, and interesting to see how this plays out in washington and new york, but obviously, it is leaning towards some sort of indictment on behalf of the d.a's office which is bringing legal issues for the president and the office, and maybe some other attempts to circumvent this by other legal means. >> sandy batista, great to have you on this morning, thank you. >> thank you for having me. and now, gathering for annual retreat as three key members are jumping to the president's defense before he is indicted, if he is, and jim jordan and two other committee heads called for testimony from the former manhattan d.a.

>> and manu raja is joining us from manhattan and kevin mccarthy is concluding remarks and you spoke with him, and what did he tell you? >> well, he is defending the investigation into the prosecutor looking into the alleged hush money payments to silence stormy daniel and this alleged extramarital affair that donald trump had with her, and he is also defending the investigation and downplaying those payments. i asked him directly about whether or not he has any concerns s about these charges that come up against the former president, and he doesn't. he called it personal money that the president gave to stormy daniels. listen. >> this is personal money, and not trying to hide, and seven years ago and statue of limitation, and i know that you know in the heart of hearts that it is political, but i am concerned when i look out there and i see justice not equal to others and with a local d.a.

playing in president politic, and that starts right there, and if you think that it starts right there, don't you think it is going to happen across the country. >> he called it the statue of limitation, and saying it is not going to apply in this case, and extends to people living outside of the state, and the pandemic extended the statue of limitation, and we will see what the prosecutor comes up with if donald trump is indeed charged and also said that the house republicans are within their rights to ask questions about this, and even as they are taking this rather extraordinary step of intervening in this middle of this ongoing criminal investigation without knowing the full scope and charges against them and that what some of the top republicans told me, and jim jordan is one of them, and still moving ahead and he does not believe what donald trump did wrong, and what if any charges can come down the pike other than what he has read in

the reports. but democrats are calling it an effort to mettle in the investigation. mccarthy said he has not spoken to trump in three weeks about this investigation, but one of the colleagues, elise stepanek did speak to him and talk about the steps being taken to defend him in this case. >> manu raja, thank you. and now, joining us is cnn strategist paul begala, and now, democrats are in the wait and see mode. we are not hearing a lot at this moment. what are the conversations though that are happening behind the scenes. do you anticipate some sort of coordinated response or message among democrats? >> well, if there was, it would be a first, erica. my party is not exactly good at get dg organized. look, a lot of the democrats say

that compared to all of trump's legal woes, this the least of them, and they are right. he is looking at potential, potential investigations into the conduct of potentially inciting the january 6th riot, and allegedly looking into nuclear secrets and allegedly trying to overturn the election in georgia and those seem to me and most democrats much more serious, and yet, mccarthy really gave away the game when he said we want equal justice under law. and how do you square the fact that on the same operative set of facts the trump justice department prosecuted michael cohen for the same scheme, and they sent him to prison for the same scheme, and the charging document is the trump-appointed prosecutor said this, that cohen acted in coordination with and the direction of mr. trump. so how do you, these two were involved in the same act, and

one goes to prison and one can't be indicted, and it seems to me f there is equal justice, there should be equal justice. >> these are state crimes and not federal crime, and it is also worth noting that the justice department for whatever reason decided not the prosecute those crimes once donald trump left office as well. paul, you have done some presidential campaigns in your day, and as a purely political matter, political candidate ron desantis had a interesting comment. and yes, he criticized the d.a. for prosecutorial overreach, and then he pointed to hush money to porn stars and pointed out that such a thing happened there, and how do you assess desantis' response? was it effective? >> anybody who voted for trump does not deny it happened.

i tend to believe her, and i suspect that governor desantis believes her, but it is baked in with trump, and the bigger problem is this allegation of a criminal payoff, and it was weeks, days before the election that this payoff occurred, and again, michael cohen went to prison for it with the same act, and to me, the point that desantis, and everybody ought to make, treat people equally, and michael cohen is a felon and he went to prison for the same conduct that donald trump is going to be potentially indicted for and to me, that is equal justice and if you are a guy like michael cohen in new york city or the former president. >> and also, bringing in political commentator and former congresswoman, and when we look at how this is playing out, we had a forceful immediate r

reaction from kevin mccarthy, and then he went on to cite the need for trust that voters need to trust the party. how important is trust these da days? >> i have always said that absolute certainty, and when somebody gets ahead of anything before the information is the enemy of truth. you have to let things ride out. this, you know, i look, i believe that nobody is above the law, and i understand the desire to, and the principle here, but to a lot of the republicans, and to a lot of people who are not supporters of donald trump, it does seem as if this was an aggressive pursuit of the former president. it was thrown out by the fetc

and the feds would not touch it, so it seems is odd that a manhattan d.a. would be the one to continue to pursue this. so, i understand, and i really would appreciate it if my colleagues would take a step back and wait and let this breathe a little bit, and maybe they would have a better understanding what new evidence was found. >> congresswoman, is there anything in the indictment, if everyone waits, and is there anything to sway these congresspeople that could sway them before anyone reads what is in there? >> i mean, perhaps, but it would have to be pretty egregious, and they would have had to find something pretty egregious that makes people understand that they had to bring this up, and they had to indict a former

ukrainians and the united states have said is a nonstarter. we have will ripley in taiwan, and, so, xi has invited putin to china, and how things should go in ukraine, but it is not getting a lot of traction, and how is this going to work? >> well, i mean, first of all, he is keeping putin's russia from collapsing, and heavily sanctioned from the west, but you would not know it based on what xi jinping is proposing, and more cooperation in economy and trade and facilitating new trade in each other's countries and energy cooperation, and it is the kind of talk that you would have with a country that you were trying to grow your relationship with and that is exactly what china is trying to do with russia, because they have the same system, and the

same ideology and the same goal to try to destabilize the western world order that has been in place since the end of world war ii, and the peace plan that the chinese president is going to talk about, and the ukrainian plan has 12 points to end the sanctions is on rush sharks and shows ukraine to give up the territory that russia stole, and the pullback of nato from the eastern borders and conditions that would have chinese contractors in ukraine for the reconstruction, and that going to be an interesting conversation, because it is not taking into account any of the demands of ukraine to take back the land. and they are having a meeting in the large, posh, socialist hall that you will see in beijing and north korea and the kremlin, and in ukraine, the president and his people are facing daily bombardment of the civilian

infrastructure and a lot of them struggling in the dark right now. >> so, nick, you spent a lot of time in moscow, and part of what vladimir putin wants is definitely already getting which is this picture with xi jinping, and how much more does he realistically want from these meetings, and are you seeing the signs that he is getting it? >> he would like to get the weapons from china, and he needs ammunition, and shells from the artillery on the front lines and a noticeable dropoff from the front line, and he would like to have missiles to target the ukraine infrastructure, and a long list on the military terms that he want, and it is interesting that publicly, xi jinping has brought with him the two top foreign policy with people him, wang le and the defense official, although putin has brought some of his into the

meetings with him, his minister and business minister. and putin would desperately like weapons, but xi has been put on notice not to provide any sophisticated weapons, and not any weapons at all. it is not clear what computer chips he may be offering to have russia to build their own missiles, but what xi is giving putin, and remember that putin is the more smaller succulent partner, and when xi is under economic stress, gets good business deals for putin, but what it will do for putin is to help him to fund the war, and allow him to keep it going, and he wants a long drawn-out war. it is in his best interests, and so xi by putting more money into the chinese economy to make up for the deficit for what putin is losing from the international sanction, and this is going to

>> and now, our analyst is joining us now. and now, jerome powell has a number of decisions to make especially with raising interest rate. it seems there is no right answer? >> it seems only meh! answers here. gosh, we have had a mini banking crisis and pull back on the rates, then they are seen as not tough on inflation, and not in touch with the real economy, and kowtowing to wall street, and that is the last thing that the biden administration wants to be seen as doing. but on the other hand, if they do a hike, and a strong hike, then we may start to see more dominos fall, and that is where we are. we are at a pendulum shift. i have been doing this for 30 years, and this is the biggest pendulum shift that i have seen with the higher rate hikes since i have been reporting honestly. >> and how much of that needs to

happen at this point? >> well, all of us. i feel like i have been banging the drum for ten years, and it is finally my time. and we have had a period of low rates that has been lasting too long, and we like it to buy things when the rates are too low, and it makes us feel rich, but it is too much risk, and risk is like water, because it finds way out, and rates have to go up, and it can do it slowly, and the fed has done a good job in that, but they are out, and slow and steady, and the thing that i am worried about with the silicon valley bank story, is that we have been going up on the rates for some time, and why didn't they get the message, and who else is playing this game of

indigenous tribes because it is a sacred land, and do you think that should be something that is brought to congress? >> look, this president has made a point to recognize the indigenous people in our lands, and we have made a point to do that. i believe we will continue to do that work here in congress. and not the mention the economic value of this designation, and everyone is thinking of las vegas as gaming and tourism which is certainly the lifeblood of the economy, but the outdoor recreareation is just as import. when you look at the outdoor recreation supporting over 50,000 jobs, it is not only for the economy of southern battle
