3:02 am
including some breaking news, cnn this morning starts right down. and we're just hearing this morning from the wall street journal, actually putting out a statement, but it's just i was looking at the just looking at the wall street journal. obviously studying that the paper was printed before this happened, but yeah street journal, saying that that the wall street journal is deeply concerned for the safety of mr gersh covic, it said, so we're going to continue on and talk about all of that. questions of the details of this. we are going to start with this breaking news that it's coming out of russia just moments ago. now that the russians have arrested an american wall street journal reporter accusing him of espionage. russia's federal security service, which is formerly the kgb is now claiming that evan gersh garbage was quote spying in the interest of the american government and trying to obtain secret information. cnn's matthew chance is live in moscow,
3:03 am
matthew what? this is just breaking a few moments ago. what are we hearing about the details ? of course, according to russia about what happened here? yeah it's just breaking now because it's only in the last hour or so that the russian authorities, the fsb, the former kgb have made an official announcement that this arrest has taken place. although we've been we've been tracking it sort of through our sources, you know, for some time throughout the night. look i mean, there's not much detail about this. i can tell you what the fsb say, which is that they've terminated the illegal activities of an american journalist. they've named him as evan covic, the wall street journal reporter. here's what they say he was on. mission from the american side and had been accumulated, accumulating classified evidence relating to one of the enterprises of the russian military industrial complex. he was in yekaterinburg , which is a city about 1100 miles to the east of moscow. northeast in the euro region.
3:04 am
there is a lot of factors around there a lot of military factories and so it's very possible, although we don't know for sure that you know that he could have come into contact with with some of these highly secretive military facilities. the fsb goes on to say that while he attempted to receive them secret evidence he was apprehended in you, katerina berg, that city they have launched a criminal proceeding against him under protection to 76 of the criminal code, which is espionage in russia. and of course, those are immensely serious charges carrying up to 20 years in a russian jail if conviction is found. you mentioned the wall street journal that the reaction from them they're saying they're deeply concerned. about the safety of their reporter, not any heard any more from them. yet the state department has not issued an official statement yet either, because obviously mr covic is an american citizen, but we're expecting that very
3:05 am
soon, katelyn polantz says. i mean, if you look at what his bylines have been, he covers russia. he covers ukraine. he's talked about shizhen president xi jinping of china is well in the statement, i noticed the episode be noted that he was a credit to work accredited to work as a journalists in russia by their foreign ministry. obviously, russia has pretty strict laws for journalists who are operating in the country right now. yeah and evan obviously came under the same rules that that that i come under that that all of us working in russia come over, you get accredited by the russian foreign ministry. and with that sort of accreditation card, you can go around the country and you can talk to people about what they say whatever you like, but obviously we're in deeply sensitive times. they criminalized critical reporting here in russia of the russian state. it's against the law. for instance, the criticized that the russian military but to be clear these are much more serious charges than that. i mean espionage is obviously one
3:06 am
of the most serious things you can be accused of as a journalist in this in this country. we don't know the exact details of that. but getting information secret information about the military industrial complex. i mean, it may be about military facilities, but it can also cover a whole range of other issues as well. i mean, look, i'm sure having goes, covic was doing all the things that that we're all trying to do meeting people who have got family members in the russian military taking place. taking part in the ukrainian conflict, but russia calls it special military operation. there's all sorts of concerns about arms manufacturing, and whether russia's got enough supplies and so hopefully we'll get more details in the hours ahead. and i just want to know the new statement that we got from the wall street journal where they say, quote the wall street journal vehemently denies the allegations from the fsb and seeks the immediate release of our trusted and dedicated reporter of edgar's coverage. we stand in solidarity with evan. in his family, matthew, as we learn more this morning, we'll continue to check back in with you. thank you. all right. we'll continue on. let's bring in now.
3:07 am
political and national security analyst david singer at white house and national security correspondent for the new york times. david thank you so much. this arrest obviously comes at a very tense time for the u. s and russia. the diplomatic channels in place right now, what are they to deal with this? but then there are diplomatic channels in place. but you know, as we've often said on this show that while we're in something with the russians right now and with the chinese that is very different from the cold war. there are moments when there are cold, warlike behaviors underway and this is one of those moments. sadly um, during the cold war, it was not uncommon for western reporters. american reporters to be arrested and charged with being instruments of the state. was usually made up. there was a very famous case in 1986 of nick dal off and then for the u. s. news and world report who was arrested when he was doing ordinary reporting and
3:08 am
i think during a farewell tanya's to leave moscow, he. included some secret papers or so the russians so that soviets of content so therefore long history here, things like this being set up. let me ask you about the reporting because matthew chance talked about said, you know, it's illegal in russia to criticized the military. the last thing that he worked on was russia's economy is starting to come undone before that. ukraine says frontlines around in battle city of mahmoud of stabilizing but also he talked about russia's makes habit of harassing us planes in the pentagon. artillery shortage hampers russia's offensive in east ukraine, western officials say so some of his reporting has been very critical. not only are the russian government the economy issued, say, and which would include the government and also the military. this puts reporters western reporters in unique and dangerous positions in russia. that's absolutely
3:09 am
right, don. and you know, there was a national security law that was passed. oh just about a year ago, right around the time of the invasion, and many news organizations picked up their reporters and left moscow the new york times among them and the concern was that the way the law was written anything critical of the war. the war effort, uh, anything that didn't call it a special military operation, but rather a war or an invasion could result in arrest. but that's not what he has been arrested for. if you believe the fsb look, he's a very skilled economics reporter , among other things he used to work at the new york times in his career. and the, um, undoubtedly in in reporting on the russian economy is going to end up touching on issues that are sensitive to them at a time that the economy in russia clearly is in tough shape.
3:10 am
thanks to sanctions, of course, remember, we're only a few months out from when brittney griner got got released, also on some trumped up charge. of course, you take everything that's first be says at face value. david singer. thank you for joining us on this breaking news. we'll continue to follow. thank you very much for that new overnight. the u. s army is now confirming several casualties after two blackhawk helicopters crashed during a training exercise in kentucky. there are photos of the crash site from local radio station w. k. d z. you can see a plume of smoke and what looks like a piece of wreckage. witness who lives nearby told the radio station that what he heard right before the choppers went down. two helicopters came over pretty low and all of a sudden, soon as i got older house, something loud banging everything shut down just all of a sudden, so we dumped the truck came over here . that's what we've found two helicopters, so the national

security reporter natasha bertrand is tracking this story for us at the pentagon. good morning to you, natasha. the army is set to hold a news conference this morning. that's right, don, and hopefully we'll get a little bit more information. but what we know now is that a pair of black hawk helicopters did crash on wednesday night near southwestern kentucky. they were with 101st airborne division, and it resulted in several casualties. now we do not know whether there were any fatalities at this point, but we are told that the helicopters were flying a routine training mission. that's according to a statement on the four campbell facebook page, and actually, the governor of kentucky has weighed in on this. and he said, quote. we've got some tough news out of fort campbell with early reports of a helicopter crash and fatalities are expected again. we do not know how many people were injured or killed. all we know at this point is that there were several casualties in. he of course, said that we will share more information as available. please pray for all those affected now.
3:12 am
unfortunately, these training incidents are pretty common. a congressional report published in 2019 found that between 22,006 and 2018 2018 nearly 32% of active duty military deaths were the result of these kinds of accidents. and actually, just last month, a blackhawk helicopter with the tennessee national guard crashed in alabama and killed everyone on board. so unfortunately, these training accidents are all too common. done alright natasha bertrand will be following this and news out of kentucky. this one thank you. also just moments ago. we have new information on pope francis's condition as he is fighting a respiratory infection. he's been hospitalized in the cnn's vatican. cnn's vatican sources say that he did sleep well on his first night there were told the 86 year old pontiff does not have covid 19, but he has been having difficulty breathing. he's going to need to stay in the hospital for a few days to receive treatment. of course, that was shortly before he was

hospitalized. you see the pope their blessing a crown in st peter's square. in recent months, he has been using a wheelchair. he's been dealing with some different health issues. obviously he is older, our cnn vatican vatican course on a daily gallagher's live outside the hospital in rome. delia we're hearing that he did sleep well on his first night, obviously welcome news. but when are we expecting a more formal update? from the vatican. well actually katelyn polantz that within the hour already something to know that the pope slept well, just to give you an idea where he is behind me. there's five windows there with their shutters pulled down. those are the pope's rooms. what we know, of course, for the moment is that the diagnosis is a respiratory infection. they said yesterday that the pope had been complaining for several days about respiratory difficulties. and so he came here yesterday afternoon and will need to stay for a few days, according to the vatican in order to receive medical treatment. now hope as you
3:14 am

imminent. meantime back in washington, trump is fighting several large investigations. several defeats in the special counsel's investigation that comes to january 6th right now he is trying to block some of his former aides from testifying , including probably most notably his white house chief of staff, mark meadows. let's bring in students senior legal affairs correspondent paula reid paula, we want to break down both of these. so let's start with what is happening here in new york. you were just here. this is this grand jury that we've been talking about. it did seem for a period of time that that this was imminent. but now the jury is this. a previously scheduled break. what is this? exactly? going to look like? so let's start with what do we expect to happen today? next week, and then the break? it's not unusual for grand juries to hear evidence on several different cases. that's what we expect will happen today. when the grand jury meets. they're going to hear evidence on cases but not the trump hush money probe next week. we also expect that the grand jury will meet on monday and wednesday, but we don't expect they will hear evidence on the trump probe, but
3:32 am
i want to be cautious here. katelyn polantz are conducted in secret things can change. so we're being a little more cautious than some other outlets. in terms of what will happen next week. it is not expected that they will hear anything on the hush money case or move to vote on an indictment. but again, i caution that can change. but we do know that after next wednesday they do have a previously scheduled break for several weeks. this happens across several religious holidays and school breaks. so it was scheduled previously, but that's not going to attempt down speculation about whether this break for nearly a month is the result of them wavering on their case, i mean, there was a lot of expectation that they were nearing the end of their investigation. of course, the former president, as you just noted, he said, a false expectation that he would be arrested last tuesday, even though the team said there was no basis for that. so at this point, we will continue to watch the grand jury. but based on our reporting, there's no suggestion there wavering on their case, so we'll see what we don't know
3:33 am
what they actually decide to do. you know, on the other investigation, this is the one that's into january 6th. it's happening out of washington. we saw the judge ruled that former trump aides would have to testify without being able to cite executive privilege. but now trump is pushing back on that. what do we what are we expecting in that front? okay this is an important reminder that the true legal threats to the former president, the bigger legal threats right now reside outside the empire state special counsel jack smith. he has scored several major victories against the former president and his attorneys, especially when it comes to trump's attempts to use executive privilege to block people from having to go before the grand jury, and we've learned that they're going to appeal, one of these rulings that would have forced several of his aides, including mark meadows, who is basically the great white whale for january six. investigators to testify now all of this is happening under seal, but we will continue to report it out because this has enormous consequences. not just for mark meadows. but for other top white house officials in the former president's administration. polaroid all

3:40 am
in a new episode of the cnn podcast the assignment cornish takes a look at the u. s. and this age of school shootings, speaking with cash at the catherine sh white, who is the creator of the fbi's active shooter program. about how the role that parents play has changed when it comes to mass shootings in schools. all you're teaching a child at that age is to listen. to follow directions and to be quiet. when they need to be. that's it. the other thing about training kids is you gotta lead by what they know. i think i hear parents all the time. say i don't want to talk to my kids about that. it's too scary where kids are talking about it. they're talking about it amongst themselves. talk to a group of fourth graders and ask what if they know anything about what? what school shootings and active shooters are, they don't so i think it's naive of parents right now to say i can't talk to my kids about that. it scares me. joining us now is audie cornish was the host of the cnn podcast. the assignment. this podcast is fascinating, because essentially what it does is
3:41 am
something i didn't even learn until like later in like high school, but a whole generation of kids who now are being trained what to do if there is an active shooter at their school, catherine was tapped to start this active shooter program under the obama administration after the sandy hook massacre. and at the time there was no kind of one point person in the government for families for anyone for is really kind of coalescing the whole thing, one point of contact and very quickly. they settled on the idea that there should be some kind of training , and she even advocates for active shooter drills, maybe a couple of times a year. in schools, which not everyone is doing at this point, and she likens it to fire drills, she says. we haven't lost a kid to a fire and decades, but we still do them. this is i mean, it's clearly an emergency, considering obviously what happened in nashville. what happens all too often in schools , and you saw the passion playing out in the halls of congress. right there. you had jamal bowman, who is from new york, thomas massey of kentucky.
3:42 am
going at each other. i'm sure the american people probably appeal. appreciate the passion. many in america. the passion from massey. i just want to put up this card just as should this, um full screen. this is thomas macias christmas card. this is from 2021 with guns there in the card asking santa for to bring more ammo. but this is sort of the sort of crazy thing that's happening in this country. when you have the you know, juxtaposed this the passion to that photograph. that's what the kids and the parents are up against. and i mean, i think this is why i wanted to tell this story. i grew up in the nineties. so columbine is my initial experience with mass shootings, especially on school grounds, and fundamentally, we can get really mired, especially as journalists in political paralysis in the debate about guns, but in the meantime, there's a cottage industry that is growing up to fortify school buildings right to have ballistic last architects who
3:43 am
are focused on better ways to design schools. you also have a bunch of people doing these run . hide fight style trainings kind of based on the fbi. theory about what to do to survive a mass shooting. and then lastly, you have teachers now embracing the idea of having to explain this to kids. so while politicians are doing in a way, nothing you have the rest of us now learning how to live with it, and simply finding ways to mitigate the casualties, which is obviously not ideal. and one of the fascinating things talking to catherine schweid is she was saying, you know, i tried to retire. i'd like to do not do this work anymore. and the phone calls keep coming, and so essentially, it's created this space where this is something that teachers have to know how to do. this is something they have to be prepared for how to teach their students how to do this. my mom is 1/4 grade teacher and we talked about how they do this regularly. they bring the kids
3:44 am
in. they line them up. they show them what to do, because there's a lack of action and this is kind of what they're forced to do. and, sadly, one of the highlights coming out of nashville has been seeing how well the school administrators responded. they were outside ready to tell the cops where to go inside. one of them handed the officers a key so they could get inside the door. so glad that you're outlining all of this because this really does show kind of the evolution, right? it's not the same kind of panic because we know more about what happens in these active shooting situations in their tough because sometimes in the past there former students, right and so you can do all kinds of things to the building. but a kid who's been to the training with you and been in the environment kind of knows what's going on. you know, it's a little bit tilting at windmills, but until there is some kind of broader action, what we're all doing now is learning how to live with it and building up systems to try and kind of, like, diminish the pain and i just don't know really, if
3:45 am
you can do that, right, especially when you're talking about schools. cornish thank you . thanks for having me really good podcast. everyone should listen to the whole thing and make sure you listen to it. there it is. the podcast the assignment tune in wherever you get your podcast. also this morning, the battle between florida governor ron desantis and disney is still very much in play. why his handpicked board actually says that disney stripped it. of its powers will tell you next. sorry we didn't get to the movie. so cozy. how many rooms arere in there? shoud we go check it out to stay here all weekend, verbal, the door code doesn't stay with you. it looks exactly like the picture because without privacy in your vacation home, full lug cabin guys, it isn't really a vacation fire. is it? what would the

cnn's leyla santiago live for us in miami. good morning, leila. is this new board considering legal action? yeah they are, don. and you know the timing of this is interesting because this agreement by the old the outgoing board members was reached just in the days before the state's takeover of this improvement district. so that means that the feud between governor ron desantis and the state's largest private employer not over yet. thank you. in a story with more twists and turns than any disney movie, the former disney controlled really creek improvement district board pulled a fast one just before governor ron desantis and his hand picked board took over this development agreement essentially strips the government of the government powers and give those powers to disney. the board quietly approved the agreement on february 8th as florida lawmakers met in a special session to give dissenters control of the district. i cannot imagine orange county

hundreds of people in kentucky protesting outside the state capitol yesterday gathered as lawmakers they're enacted with democrats are calling the most extreme anti lgbtq bill in america, er, human rights you gotta and the republican led legislature overwhelmingly voted to override the democratic governors veto of the bill law creates new restrictions for young trans people in the state. including banning gender affirming care and talking about sexual orientation or gender identity in schools. united states supreme court is familiar with hearing cases related to lgbtq rights, and cnn has brand new reporting this morning on that front sentence, joan biskupic has a rare look at secret negotiations. chief justice john roberts led on several 2017 cases involving gay rights. and here's what she writes here. i quote the negotiations in those cases not previously reported offering glimpse into trade offs among justices demonstrate the chief soft power of persuasion and
3:58 am
show that the courts sentiment on gay rights issues can be both brought and evolving. so joining us now is cnn's senior supreme court analyst joan biskupic. she is the author of nine black robes out recently, beautiful book, very informative. um so we're so happy to have you on thank you very much for joining us on this issue. it's fascinating because when the supreme court declared a constitutional right to same sex marriages in 2015 justice roberts was so opposed that he dissented from the bench, but you have new reporting about some later actions that he took on gay rights. how these backroom dealings played a role here. that's right. morning dan and katelyn polantz. from the bench in his 18 years for that case, but then, just two years later, he worked privately with justice anthony kennedy, who wrote that landmark obergefell ruling declaring same sex marriage, constitutional. and he

worked with him behind the scenes and two cases, one involving two lesbians who wanted both names and birth certificate of their baby and arkansas was preventing that and another case involving a colorado baker, who had been sanctioned for refusing to serve to bake a cake for two gay men who wanted to celebrate their wedding and he works with justice kennedy button hold him to rule for the women in arkansas so that both names could be on the birth certificate. but then eventually to favor the baker over the two gay men who felt like he said, should be sanctioned under colorado anti discrimination law. but it just showed down and katelyn polantz. weighed in to try to make sure that the court isn't going to go too far, too fascinating direction. and he's more of an institutionalist even though he felt so strongly about that obergefell ruling. it's a

fascinating look behind the scenes, which is always what i'm i'm interested in. and so i mean, what else does it say to you in a bigger picture about how he worked behind the scenes, how he negotiated with the other justices? you know, katelyn polantz till late 2020. he was always trying to pick off individual justices to try to send the signal that there is. i say the court wasn't going to move too far too fast in either direction. but as you know, he doesn't have that same court. justice kennedy has since left the bench, replaced by brett kavanaugh partner that he had in many of his negotiations with stephen breyer, and he left last year. so we're not going to see as many bridge building cases down the road as we saw prior, caitlin wow. it's like an end of an era. essentially so it shows you how much the court changing has had an impact on. that's right. thank you, joan. always a pleasure. thank you. we're following a lot of breaking
