related to business fraud. as we wait for that to be unsealed. trump is expected to arrive at the laguardia airport in about an hour from now. we saw him take off from mar-a-lago earlier . from there he is going to head here to trump tower behind me in manhattan. that is where he is going to spend monday night before tomorrow. already security is tight and anticipation of the former president arrival. there are many trucks new york police from the trucks around the city on these blocks. new york officials today did make assurances that right now there are no credible threats, though at this time on the security preparations. meanwhile trump's legal team is drawing up his defense, telling cnn they will challenge every potential issue related to the indictment. charges stem from an investigation into trump's alleged role in a hush money payments to adult film stars stormy daniels in the run up to the 2016 election. now let's go to the courthouse, cnn, senior crime and justice correspondent shimon poke pas and senior legal affairs correspondent paula reid

are both there. paula, i want to start with you because several media outlets including cnn petition the judge to unseal the department early and also allow cameras in the courtroom. what can you tell us about the status of that? supporters. marjorie okay, there's been this push for more transparency from media organizations. we wanted the indictment to be unsealed ahead of tomorrow's arraignment when it is historically usually revealed for the forced first time, and also there's been a push for cameras in the courtroom, arguing that yes, while they're not usually cameras in manhattan courtrooms that there is no greater public interest. then when you were talking about the arrangement of a former president of the united states now the judge gave both the prosecutor is and the defense until one pm today to weigh in. the prosecutors took no stance on this, but surprisingly, the president's legal team is opposing cameras in the courtroom. they are really leaning into the idea that this is a security risk. they're saying that this could potentially contribute to a

quote circus like atmosphere in the courtroom. and they're also saying that having cameras in the courtroom would go against the former president's right to a presumption of innocence. but this is somewhat surprising for someone who is, of course, a very successful reality star. but look, this judge historically has not been in favor of having cameras even in high profile cases. so now that the defense has come out against that it's looking less likely that we will get this this access. yeah i mean, in some ways, it's surprising another way since he is a candidate to be president again, not as surprising the images of the motorcade going to, uh to his plane and his plane taking off those are the images. i believe we're going to see in a trump ad. if there's going to be one, he doesn't necessarily want one in the courtroom. speaking of the courtroom. what can you tell us about the changes to trump's legal team? well now that indictment has been filed, even though it's under seal. the former president has added an attorney to his legal team. this is not unusual, particularly in

his ongoing investigations. we see people coming and going from the team. in this case, it's attorney todd blanche. he has been added to the defense team, but a lot of people speculating about what that means for joe tacopina, who has really been the most forward facing member of the defense team. i spoke to joe a short time ago, though he said he's still on the team, and he says he will be the lead counsel. during the hearing tomorrow. syria and she wouldn't want to turn to you. there's been a lot of concern a lot of speculation a lot of trepidation related to what could be coming from a security perspective. what's your sense of things right now, in terms of what the nypd is prepared to do both today, tomorrow, kind of the whole assessment of things going forward. well, certainly securing the former president, making sure he gets inside the building here behind us. that's going to be the number one priority getting him in there, making sure no one tries to interrupt the proceedings with the issue now is like if they're not going to have fill cameras in the courtroom, every image that we could possibly get of

the former president. is going to be important, and one of those images could come here on hogan place. this is where the district attorney's office is. this is where we expect the motorcade with the former president to drive down. we expect that he's going to come out of the car and then walked through the doors of one hogan place which is here to my right. and walk in and surrender to the district attorney's office and then essentially, he will be under arrest. at that point is when the arrest processing the fingerprinting. all the paperwork that comes along with that will take place. but he will walk into these doors. he will be met there by district attorney staff the investigators on the case. ah those are the people that will be making the arrest and then they will take him upstairs where they will do the processing. but right now, as they prepare for tomorrow, we're seeing a lot of barricades here today. certainly we're seeing several more officers.

court officers, nypd personnel and tomorrow what we expect is that this entire street is going to be closed off as they bring the motorcade through here, but then also the streets surrounding the courthouse because there is some concern for protesters. there's a lot of choreography going around going on right now. certainly a lot to watch tomorrow as well. and shimon is going to be there for all of its own protest. paula reed. thanks so much. i want to get back out to caitlin tower, and i'd like her opinion on whether it's a regular thing for the president to be against creating a circus like atmosphere from a media perspective, katelyn polantz thoughts on that. yeah there will be some questions about that. of course that is going from the drop legal team. we should know we are here outside of trump tower just few blocks away from where she ammonia as we have seen its chief national affairs correspondent jeff zeleny and cnn senior legal analyst, both with us. the idea that they don't want cameras to

be in the courtroom. you know this office this courthouse very well. are you surprised that? no, i'm not. i think that's what i expected. so ordinarily in new york state courts and that's where we are. we're not in federal court, where in state court rule is no cameras in the courtroom, however, the judge does have discretion. judge can say i'm going to allow them and what the judge has to balance is on the one hand. the need for transparency in the public interest, which is not just high here, but i would say unprecedented in terms of how high it is. on the other hand, the need to protect the presumption of innocence of the defendant and the thinking there as well. the image of somebody standing at the defendant's table, even if not in handcuffs , even if not in prison garb still could be influential on our jury board. let's remember our whole jury pool is watching, so i think it's not at all surprising that the defense does not want cameras in there. i mean, an image of a person standing at the defense table could be even more prejudicial than a mug shot. if you think about it, so we will see what the judge decides on. this is important to keep in mind. tomorrow's arraignment is going

to last no more than 10 minutes. maybe it's as short as five minutes, so the judge will make his decision on tomorrow. ultimately it's going to be a much bigger question about does the judge allow cameras in for the trial? if there is a trial, right? and what is this judge have a history of doing when it comes to cameras, so this judge historically has not been open to the idea of cameras. he denied a request to have cameras in the trump organization trial, which happened last year. he did allow still photography in the room when alan weisberg was sentenced. but that's just a still photo. that's not a live feed trump's chief financial officer who is serving the final days of his present term, jeff, we just heard from jason miller, who is a campaign adviser to trump. he is on the plane with him right now, on the way here to new york. he is now saying, and, of course, we should know this is what he is saying. it's not filing that they've raised $7 million since the award of the indictment came down. on thursday. initially we were told $4 million in about 24 hours, and so we do know that right now they're saying trump's not going to speak while he's here in new york. we don't actually know if that's what's going to happen. what we do know he is planning

to speak tomorrow night back at mar-a-lago going to be delivering an address in prime time for mar-a-lago. once he returns there and really to do it on his own terms, so it's seen in a way of doing his rebuttal of this and his speech will surely go longer than 10 minutes. that is going to be arraigned tomorrow. so this is he wants something more dignified. we're told something that's not standing outside of the courthouse, so yes, he wants to gain politically from this in the short term, raising money, getting his rivals to circle behind him, but he also wants to sort of frame this in a way that that he can do it as a former president, and he's inviting friends and allies to mar-a-lago. he wants to be surrounded by them. so that is how he hopes to put a an exclamation point on this first quarter appearance, i guess so again, a short term political benefit the $7 million. we should point out if that's true , that's from small dollar donations, like selling all kinds of variety of things like indictment, merchandise and just people sending support because they think he's wrong. but again the long term benefit of this, we will just have to take our

collective breast. this will be with this presidential campaign likely throughout the republican primary, if not beyond its reshaped the state of the field right now, elliot tomorrow trump will be before this judge that we should not have been trashing, claiming that he hates him. he's also obviously gone after the district attorney here. we've seen that. there's a chance the judge could dismiss this potential. we don't actually know what the judge is going to do is never a good idea to talk negatively about the judge or the prosecutor. although you're entitled to do that. you do have a first amendment right? but there's two lines that we have to watch here. number one. at a certain point, the judge can issue a gag order, meaning i officially order you to stop speaking publicly about this case, and if that happens and trump violates it. then you can get into serious trouble. the other thing that we have to watch for is if it crosses a line. where it gets into the realm of threats. then there could be a charge here. potentially i don't think we'll see one. but it's possible at a certain point threats to a prosecutor threats to a judge become illegal. now that's a matter of judgment for the prosecutor, but if it if it gets

to a point where it appears that trump is calling for physical violence or making a physical threat, and that's a possibility. yeah of course. he backpedaled on some of the criticism after he was criticized for his clothes next alvin bragg with the picture of the baseball bat as well. and jeff, stay with us. we'll check back in with you, dan and phil. obviously we're waiting to see how this plays out, dana, you know as well as anyone because you spoke with trump attorney yesterday that they're still waiting to see what the details of this indictment look like. they don't even fully know the details of this. no not at all. which is why joe tacopina yesterday on state of the union was reluctant to say anything about and emotions that they would put out tomorrow at the indictment, even a motion to dismiss even though he said eventually they will do that the trump team they've been talking about sort of what's going to happen in the courtroom. you caitlin york and her panel up there. i want to switch for a moment to the raw politics of this because audie like we were talking about earlier when it comes to donald trump anytime, but particularly now because

he's not just a former president. he's a candidate to be president again. the, um combination of politics and this legal jeopardy that he's in our everything is opposite world when it comes to him or upside down world or whatever you would call it, but it is very much proven in cnn's new poll today, right, gloria it. what's fascinating about cnn's nepal is that it's just common sense, a majority of people say that they approve of this indictment. but a majority also think its political and people are not sure, like most like everyone, whether it's what he did allegedly is ethical on ethical or is it just or is it illegal? so uh, people are confused. they we don't know what's in the indictment. they think it's fishy. trump did something wrong . 10% only 10% of the people in this country think he's totally

blameless on this. so what does that tell you? but to be clear? i mean, when you course get down into the partisan numbers completely different. it's absolutely have many republicans feeling as though he is being unfairly targeted that this is a political prosecution. but of course, the reason why we're bringing it up is because those numbers of independence right exactly are the ones that are right now saying looks bad. we should look into it that that's sort of the tone but not sure, sure whether it's illegal. but you say it's common sense. um what we're seeing in this poll, but i, but i also just wonder about the idea of yes, it's definitely there's a partisan split, but this is beyond the partisan split when you see that 60% of americans approve of the indictment and three quarters say it's politics. they are the democrats approving of it because it helps they believe it helps them politically. or it's bad for donald trump political they don't like donald trump. you know, it's about it. i mean, you can't separated from how

people feel about donald trump himself and his. you know his approval in this is you know, it's unfavorable in this poll is 58. that's pretty high. i just want to correct myself. i said bad for donald trump. politically that is absolutely not the case in the short term. i was talking about the long time. go ahead. ask you actually send this both of you. you are the actual lawyer and you know all the lawyers and that that's what your job we're talking about some outbreak and i hope i'm not blowing you up by talking about what we were talking about during break. that we always think through the lens of the former president controls everything right, and that is always worked to his political benefit. he is now the first time moving into a venue where he controls nothing. maybe you can control the speech she gives afterwards. but on the day to day of what happens inside the courtroom, he does not get to control the pace or the timing or what comes out of it. is that a fair assessment really fair assessment and not only that, trying to take back that narrative in the courtroom will work against you. you can be silenced by a judge. you can be

fined by a judge. you could be thrown in jail by a judge. if you speak out of turn around of line, and also there's any number of steps along the very long and very slow and not like it is on tv process of a criminal trial where you're just not in control where you're waiting. you're sitting around and actually kind of being embarrassed by the judge. it it probably was a very good decision on the part of donald trump's team to not want cameras in the courtroom because he just simply as a political candidate or public figure is a minor figure in the courtroom. and really, the judge is the only person in the inspectors opinion matters. evidence on that. look, you've covered every investigation that has involved the former president since he took office. um there's about seven billion of them. yeah and you have all the documents and stories, but i think the interesting element here is we always try and figure out. okay. well is this gonna help him politically? everything helps him politically having covered all of these. what makes this different than perhaps some of the other ones that you have covered? especially since we don't actually know what's in

the indictment yet? we don't know yet what these charges are entail. i think it's a completely different game. he's playing now his legal team. is well practiced everybody around him as well practiced in trying to play delay game. you know, there's a reason why donald trump announced when he did right. he thought that this would help him if the with all the investigations going on and would help emphasize his victimhood, right, um it ended up getting him a special counsel, right? which is something he did not want. so everything that he thinks all the strategies that have worked for him so well when he was president, which was delayed delay delay, make sure your find a way to obstruct in public and in like completely with within plain sight. um and in that way , almost, you know, prevent the justice department from doing anything now. none of that works because he's no longer president. he doesn't have any of those powers anymore. and judges. you were seeing judges right now move. with speed to try to tackle some of the big

natasha bertrand is at the pentagon. so, natasha, what are you hearing from your sources? dana. so we're told that this chinese by balloon that transited the us back in february, it was actually able to capture some images and some signals intelligence from some of these military installations across the united states. now the u. s is saying at this point that they do not believe that the chinese by balloon was able to collect anything more sensitive than, say, a chinese satellite would that is constantly kind of orbiting above these sites. but they're important caveats to that, namely that the us government still doesn't know how much. it doesn't know, and that is because the chinese by balloon back in beijing, the people controlling it, they were actually able to wipe a lot of the information on that spy balloon kind of remotely erase it before the u. s government was able to examine it, of course, after shooting it down, and so that raises a lot of questions, of course, if the chinese government was able to remotely erase the content on that balloon, then what kind of

intelligence wasn't able able to gather the u. s does not yet know about now, the pentagon has faced a lot of questions about this, too. they and depending on press secretary or deputy press secretary, i should say, just took some questions on this, and she suggested. that the balloon's path was, in fact deliberate. here's what you said. we do know that the balloon was able to be maneuvered and purposely driven along its track, but not going to get into specific sites. it was able to hover over but what we did do is take precautionary steps to limit the intelligence value that it would be able to collect. um and you know again, we took steps to protect our own military installations, um, from foreign intelligence collection. so this is key, the us, arguing that they were able to mitigate some of the intelligence value that beijing would have been able to collect from that spy balloon. but again, a lot is still unknown. here is the fbi continues to investigate the balloon and importantly, try to

figure out of course, what it was ultimately able to gather build. gonna definitely a lot of unanswered questions. still, natasha bertrand, thanks so much. now oil prices are surging today after opec plus announced an unexpected cut in oil output. this move could threaten amongst many other things, the federal reserve's ongoing efforts to curb inflation. cnn's anna stewart is in london. so anna what drove this decision? well that depends who you speak to if you go to saudi arabia, the defacto leader of opec. they say this was a precautionary measure , and it's to stabilize the oil market. the suggestion being that perhaps would be some sort of decline in global oil demand . now speaking to some analysts today, there's also the more skeptical view that this is a way to shore up oil prices and increased revenue for those big oil producing nations. and you saw that today, oil prices at one stage were up 8% on this news because you're taking supply off the market pushing up those price. aces, and some analysts actually think. you could see all prices returning to $100 a barrel by the end of

see what's happening. it looks like it's verging on circus already. i don't know that that's ever a big motivation for judges to make a decision to keep cameras out of the courtroom on that grounds. i think they have a decent argument in the in the, um to say that photographs of the former president standing behind the defense table could potentially prejudice a jury. uh there is some precedent for that. prejudicing the jury before one gets seated as far away in the future is that might be something the judge might be concerned about. however i think the transparency and public interest arguments are compelling, and particularly in a time when we have such a large segment of the country that really embraces conspiracy theories and things that are not factually accurate. have photographs of exactly what happened, i think would be important to down down play some of that potential effect. second so if there aren't cameras in the courtroom, can you just give us an idea of what exactly those routine steps of an arrest

processing would look like what would the camera's not see if they're not there in the courtroom tomorrow? sure so the arrest processing, which will take place in the manhattan district attorney's office, typically would not be photographed. they would they would bring him into usually a conference room or an interview room. they'll ask him some biographical questions about his name is the date of birth is his height, weight, those sorts of things that have to be input into the system, they would fingerprint him. with an electronic fingerprint, uh, fights and then, of course, we're taking st paul right now would not be released to the moment for cameras, typically walking to the courtroom or actually in the courtroom for the arraignment and inside that courtroom that former president will be standing behind the defense table. he will be asked to enter a plea and he'll we've been told he's going to plead not guilty, which is standard. he can either say that himself or he can have his attorneys under that for him. i suspect

with a legal criminal process. yes you may fall into the same patterns thinking that will be helpful to you, but also this dovetails nicely with some culture war issues that people like fighting. you have republicans who are upset about what they call liberal prosecutors, so it's great to be able to go after a prosecutor that you can kind of tar with that brush will probably have to do a lot of fact, checking over the next couple of days over whether or not um the alvin bragg is somehow connected to george soros. rose he is not. but you're going to hear these same kind of key words over and over again. and dog whistles. yeah in fact to try and undermine the process in general , and i bring that up because we have been focused all day on what trump does and what trump is saying where there is a huge circle the wagons effect that is happening right now, and they are going to be able to say whatever they want, right? they're not in this process in the court. well and you know, i think we need to kind of look at the evidence that is presented in this indictment. whoa don't

get crazy here. i know. i know. i'm being sarcastic. that's actually huge. it is it is because and again i'm not the lawyer here, but it seems to me like they're not if they go to a felony charge, which everyone seems to presume they're going to do because they wouldn't do this over a misdemeanor. they can't depend on michael cohen alone. i don't think prosecutors would do that. so what evidence do they have from mr pecker, the national enquirer owner, for example. what corroborating evidence. do they have that we don't know about because we haven't seen the documents that perhaps they have seen and then as for these republicans who are defending him, no doubt audience right. they will continue to defend him because it's in there. political interests. at this point. it's also when donald trump's short term political interest, but in the long term, they all know that what's good for donald trump is not good for the republican party, necessarily as you head into a presidential year. so

what do they do? if jack smith, the special counsel comes down with some more charges against donald trump? then what's their song doing a lot of investigating right? and this is where it goes from nuisance to something that has long term damage. to a specific branch of government, which is to say we're going to haul these prosecutors in front of us for whatever reason, or at least just make their life a little difficult by constantly requesting information, and it's interesting in this moment when they're talking about weaponization of the government to be going this route against prosecutors. you mean that the chairman in the house republican chairman of the house, i hear what you're saying about the republicans sort of running to donald trump's defense, and there is definitely a big difference between what's good for the republican party. and what's good for donald trump. but my sense in talking to republicans is that they definitely feel squeezed. they don't feel i mean, this has been the story of trump and trumpism. when it comes to most

republicans, they don't feel like they have a choice with this particular case, but to defend donald trump, even those who are um not the most. staunch trump supporters are reluctant to say anything negative because they are. they don't see this as the case for them to hang their hat on when it comes to trump. bingo this is the easy one right? it fits all of the very lazy kind of front running attack lines in terms of who the prosecutor is and where he was on criminal justice issues and new york city and where progressives are um, the case itself, i think has been perplexing to some degree because we haven't seen the indictment. and so you talk to republicans who probably want to go anywhere near anything related to jack smith or anywhere near anything related to what happened in the lead up to january, 6th or january 6th. and this is the way to say, all right, i'm gonna i'm not gonna get on his bad side on this one, but i am at least i can get a check the box here and then move on. i think one of my questions are related to that. is if

you're alvin bragg and alvin brags team you can't front run any of this information you've had to stay completely silent. what is their plan to try and counter that if they have any at all to counter it in court, and that's the problem. you you know you're sort of neutered as frankly anyone in government but particularly a prosecutor because trying to litigate the case in public actually, number one is bad for the jury pool because potential jurors are going to start hearing it. the folks in new york city who will have to serve in judgment of this, they'll start coming to conclusions about the evidence long before they should the public of the media. everybody will and it does not serve a prosecutor well. to be out there in front of a case. this is the challenge with news of an indictment. a dropping and then five or six days passing and giving when the defendant now has an opportunity to shift the public narrative, and like we said a little earlier in the show, it's a defendant who is quite skilled at manipulating sort of the public narrative around him. there's just really no way for prosecutor to win,

and you just hope that the judge can instruct the jurors. put aside everything. you've heard judge this on the basis of the evidence of the evidence and look. misdemeanors are serious, too. i think a lot of people are getting in the their heads this notion that the mere fact that something is a misdemeanor doesn't mean that it shouldn't be prosecuted anyone who has been the victim of a misdemeanor assault would tell you that misdemeanors can be serious crimes to that. i mean, if you think about the gerald ford basically partner nixon, it was like, look, never ending investigations and prosecutions into form. presidents presidents they cause a kind of stress and distress on the country. so that's where this reluctance comes from, i think and to your point about whether the prosecutor has to speak out. i think of it this way. everything about our media environment of the last 25 years. the imagery that is connected to criminality . we are seeing it right that that sort of helicopter or drone footage of someone's vehicle kind of moving in any direction

that's like from crime reporting our crime reporting in general, about courts and being in courts. all of this, it does have enough. fact right on people's minds about what's going on, and it's very different than an impeachment with you, audie. real quick. where i do agree with you is that the public does not draw a distinction between jack smith and special investigation and new york city d a federal versus state. all they see is that one individual donald trump is at the center of an of a whole bunch of investigations together. take a quick break, but i just want to say that i completely agree that that imagery that sort of o j motorcade imagery is definitely speaks to crime. but donald trump is in a category of his own up until this point, when it comes to being able to flip that on its head for his own political advantage, never mind his legal jeopardy his own political advantage and the question is going to be whether or not he can keep that streak going. trump needs enemies. and so now he has an enemy. alvin bragg. he's running against alvin bragg is not running against desantis. right now.
