a good lawyer that's able to perhaps do a plea. the government is interested often in two things. and that is first. what is the extent of the damage here? they still have a damage assessment to be done. and so we've seen in past espionage cases, where in exchange change for laying everything out telling us everything. where is all the information? how did this happen? walk us through exactly what happened that can lead to. you know, i won't say light sentences, but that's a consideration the justice department could make if he cooperates, but the second thing is, you know, you have to understand you have a suspect now who will go through the judicial system and be prosecuted if he doesn't plea, the government, especially in classified document cases, is always concerned about the fact that at trial classified information could be revealed in the very act of trying to prosecute this person. now there is something called sepe. the collapses fide information procedures act, which is i used it in my past cases where it's the ability of the justice department to basically negotiate with a judge to

news. the fbi has just arrested the suspect accused of leaking a trove of highly secret us government intelligence. the suspect jack to share a 21 year old member of the massachusetts air national guard. so in this video here, you're seeing to share a walking backwards. their hands on his head, is being taken into custody outside his home in massachusetts. the new york times and washington post report that the suspect was a leader of an online gaming group whose members called him o. g. cnn's oren liebermann is at the pentagon. but we're going to go first to cnn's evan perez, who covers the justice department. even the attorney general just spoke about this arrest phyllis in on what he said. evan. can you hear him? yes yes. i'm sorry . i thought we were about to throw through the sound. yes so the attorney general announced the arrest of jack teixeira, who he identified as a member of the massachusetts air national guard

. now the arrest was something that the fbi was working on the new there that identified him. i think you mentioned a little bit about his membership in that online group on discord. gaming group. that was that was that was, you know, apparently formed over the course of the pandemic , and in the last couple of days the fbi had narrowed down to identify teixeira. and this just a few. just in the last hour. you saw the pictures there of the share of being taken into custody by the fbi. the attorney general talked a little bit about the arrest here he is now. fbi agents took to share into custody earlier this afternoon without incident. he will have an initial appearance at the u. s district court for the district of massachusetts. i want to thank the fbi, justice department, prosecutors and our colleagues at the department of defense for their diligent work on this case. and this was the work of the fbi agents down in

the washington field office counterintelligence intelligence agents who do this kind of work. this is a specialist in hunting for leaks, and they were working with people from the pentagon, the army criminal investigative division as well as obviously people from the pentagon who are trying to do a damage assessment, which is like a work that's going to take a long lot more time. for them to do. you saw there alongside the attorney general, you saw lisa monaco, the deputy attorney general, paul abate, the deputy fbi director. that gives you a sense guys of how important the fbi, certainly the attorney general viewed this case because of the seriousness of the information that was being exposed. we're talking about documents that showed re very recent. you know, intelligence products from throughout the intelligence community, and that showed really is some intrusive, intrusive the intrusion of the of the u. s intelligence

community on russia as well as some of our allies again, something that is extremely serious and extremely ah, viewed very extremely seriously by the by the fbi and by the federal government here, so that's the reason why we expect now once he gets presented to a judge in massachusetts, he'll be brought to the washington, dc, area where he will face those charges at the eastern district of virginia. lieberman also with us , so, orrin, we just heard you there in the briefing at the pentagon. there are so many questions about how this could have happened, what safeguards were or were not in place. a lot of those questions. obviously we're sort of deflected, saying, look, this is an ongoing investigation. but there was some talk about changes that are being made in the wake of these leagues. what do we know about those initial changes or in this is the point that a number of the correspondents there in the pentagon briefing, including myself, kept hammering in on. what is the pentagon doing to look at the distribution of this

level of documents across as we've learned thousands of people distribution list that some officials have said are simply too wide and too far out there. another pentagon wouldn't go into specific steps that it was taken. but eventually, the pentagon acknowledged spokesperson acknowledged that they have pared down those distribution lists, as cnn has reported, so that not nearly as many people or i should say, not as many people have access to this because they won't give us a sense of how much that has been paired down. one of the other key questions, of course, was, how did an airman first class and e three a low ranking member of the enlisted community in the massachusetts air national guard have access to top secret documents that would eventually find their way up to, for example, the top u. s. general, the chairman of the joint chiefs of staff. to that the pentagon said that they are there are background checks and there are positions for background checks that require access to this level of classification. and those are intended to find people who perhaps don't deserve or shouldn't have this kind of access, obviously, in this case , and they wouldn't talk about this specific example, in this

case that was problematic. it didn't flag something here. perhaps that should have led to dod knowing. hey there may be an issue here so that part of the process and reviewing how do people get access to this level of documents and how are these distribution distributed? to make sure that they should only go to those people who truly need them in terms of who else and how these spread on discord , chat and messaging platform. the washington post spoke with somebody who said he was a friend of here on the server, and that revealed something that could be just as damaging to u. s national security and that's the leaks didn't start over the course of the past few weeks. but months ago take a listen to this. i was first made aware of these documents. i want to say about 6 to 8. months ago, i was in a discord server by the name of doug sticker central, and in this channel, there was classified documents being posted by a user who i refer to as yogi. from this point. the documents were often listed as ukraine versus russia. first

however, it's slowly spiraled into just intelligence about everything. the pentagon wouldn't say if other members of the massachusetts air national guard 102nd intelligence wing had access to classified documents and top secret information restricted in light of the investigation, but they did repeatedly say this was a deliberate criminal act. or leave marin. evan perez appreciate it. thank you both for joining us now. cnn political and national security analyst david sanger he's a white house and national security correspondent at the new york times and cnn military analyst colonel cedric leighton back with us as well, gentlemen, as we look at what's happening if we pick up colonel leighton if we could, where or in left off in terms of these questions about measures that are in place. to flag any potential issues for people who would have access to highly classified sensitive material. does this raise concerns for you? and is there anything that you have seen in your time? that would cause you to say those measures

may need to be looked at again? eric, i definitely think these measures need to be looked at again because what you're dealing with here is, you know people's lives, and you know it's things change in a person's situation. let's say their financial situation or their exposure to different people. i foreign people and on this just scored platform. we know that he was kind of a the suspect was contacted by nationals on that platform, so there are certain things there that become critical. the important and it didn't you know, leads you to believe these kinds of background checks need to be done in a much more thorough manner. that's one of the key things and they also need to be updated on a morgue. people basis than is currently the case. so, yes, they definitely need to be re examined and that there needs to be a full court press on that particular aspect of the clearance issue. david

what we believe to know is that the intel in these leaks is based on electronic intercepts collected by american intelligence agencies and not by human sources with that is a good thing that humans have not been compromised here, which would just be spies and various countries that having been said we know the consequences of this are significant, but given that this is through electronic monitoring, would our efforts at continuing this process would they be compromised at all? despite right, all of this information being out there. it's a good question, bianna and we don't really know the answer . is that right now, when you go through these documents, and i've been through a good number of them, but but not all of them. it's pretty evident that the intercepts that they've got , uh, have been summarized. so there's nothing in the documents, at least that i have seen. that would tell you how the nsa or u. s. cyber command

or others got access to this? that said, of course, it does alert our adversaries and in some cases, our allies the south koreans, the israelis, even the ukrainians that the united states is listening in to at least some of those those conversations. there is nothing on human intelligence. i've seen with it to this point that you were just making with cedric about limiting the where the intelligence flows. certainly it's very reasonable question to ask why a 21 year old guardsmen in massachusetts needs to see this material that is intended for the joint chiefs. but remember that the reason that we are spreading this intelligence or intelligence in general more broadly, is because, after 9 11 we came to the conclusion that we had kept everything to siloed and that you needed to spread information out. there was a reason that the fbi and others didn't know that there were the

saudi hijackers were in the united states. so there's a risk here of, you know, constricting too much, and then having some incident happened that leads you to suddenly try to open up again and we've got to break out of this cycle. well and perhaps breaking out of that cycle. you could almost equate it in some ways as to what we've seen david when it comes to airport security, one of the things that has been criticized certainly in the years right after 9 11 is that much of those measures were reactive reaction as opposed to proactive and so i wonder david based on your experience, if you see evidence that there may be a push towards more proactive moves here, where the u. s is in the intel community is constantly looking at how and where information is shared. what may have gotten out there who may have tapped in to the us who may be monitoring the u. s are those changes can they happen more in a real time fashion as opposed to when there is an emergency? that's right.

they need to be reviewing this morning. think about just the example that you used erica, which was three airports, so we now have a trusted traveler program. right and we think hard about who's a group of people who you think you don't need to search as often and you could just do that more periodically, and you can go through a lighter search there. there needs to be sort of equivalence of that in the world of classified information, but there's also got to be a much broader scale declassification as you go through a lot of these documents, who discovered that much of the material they picked is from open source data. it's from things you've read in the new york times, the washington post, the wall street journal or seen on cnn, and so we have to think a lot harder about just protecting those secrets that really need to be protected. and restricting that, uh and opening up so much more because otherwise, if you are protecting everything, you really don't

know what it is that you want to protect the most. colonel as we heard from the pentagon briefing that not much was revealed, except for an investigation into how officials can tighten the access to who is privy to this type of classified information. i'm just curious. what would you look into when making that decision as to who and who isn't pretty to this type of information. yeah exactly beyond a kid has to be looked at in terms of the mission of the particular units. so in the case of the 102nd intelligence wing, they actually have global mission. they're part of what's known as the distributed common ground system and what that really means is the get data from overseas to analyze that data. they helped the rest of the military and the intelligence community, analyze things that are going on in either real time or in your real time in various theaters. around the world, and it could very

well be the case that that unit is working issues such as ukraine, for example, so we have to have access to some of that information, but they don't necessarily have to have access to things that are going on in other places, and it's a really tough call. because once your senior leadership in any unit, including a wing like the 102nd to be aware of things to be aware of what you know, some leaders, like the chairman of the joint chiefs are thinking about, but you also don't want to that information to be misused into the more you spread it out. the greater risk of misuse. uh, it certainly is. so that's that becomes the dilemma , but that's the kind of thing that i'd be looking at. it has to be mission focused, and it has to be designed to actually work in a system where those kinds of things that they need to do their job. those pieces of information that they need to do their be given them, but beyond that, it has to be really strictly controlled. all right. and as we wrap this segment up, a reminder to our viewers that

questions for about four hours now, when we look at what his his children, donald trump jr and ivanka trump came in for testimony, and they answered questions, they went into a little after five o'clock, even if even a bit later than that, so it's really unclear how long this is going to go today. the last time he was here in august, when he started the fifth amendments more than 400 questions and said he would not answer them because he didn't want to be one of the protections against self incrimination he left around. 3 30. so now he is answering questions. his lawyer says he's not only willing, but he is eager to testify. today we could see this continue for quite some time as this afternoon continues there as that lawsuit you mentioned is more than 200 pages. there's a lot of very specific allegations in their specific questions that they've had for him in the past about how he valued some of his assets and including how he came up with the size of his penthouse apartment on trump tower, so this could continue. if these questions are detailed as they were the last time in depending on how long his answers are now

in the making. there's a story in every piece of land. run with us and start telling yours. historic flooding in south florida has spread a declaration of an active emergency in just 24 hours, up to two ft of rain has fallen there. many drivers had to be rescued. look at that water after their cars were just swamped by these torrential downpours that hit yesterday during rush hour to less and overnight, others had to be pulled from their homes and then carried to safety through waist deep waters. the broward sheriff's office. fire rescue teams report running hundreds and hundreds of water rescues in just the past 36 hours. cnn's carlos suarez joins us from fort lauderdale, fort lauderdale and carlos talk about what you're seeing there and how surprising all this flooding was for officials. well erica and bianna , the national weather service here in miami, has been able to confirm that two very weak

tornadoes hit to the south of us. forecasters there say they were able to take a look at some of the damage just to the south of the airport. now we're about a few minutes just north of where these two tornadoes hit in a neighborhood where as you can see behind me, the flooding is very much still a concern. in fact, its in this part of broward county in fort lauderdale that we have seen a number of rescue operations take place through. about the day we're talking about. team members with the broward sheriff's office as well as the fort lauderdale fire rescue. as you mentioned coming out to me, they have performed what they're being put as dozens and dozens of these rescue operations. in fact, we were at a reunification site. not too far from where we are alive right now. earlier this afternoon, it's where we saw a number of folks being brought back after being rescued from their homes. they were taken off these boats that have been put onto these trailers. we caught up with one man who described just how his home was covered in about three ft of water and everything that he had to do just to get his family

out. today. here's what he told us. we put towels and stuff in front of the doors because we didn't have time for sandbags. we didn't know it was gonna rain. this batch. we did the towels and then we just got overwhelmed. it just kept coming in and coming. anyone over the thresholds. next thing you know, we're in 23 ft of water. i had to run over and shut off all the power. so that way we didn't get electrocuted all sorts of things going through my mind. i tried calling really nobody could come out and help us because it just kept raining and raining in the water just kept coming up and up and up. alright and over at fort lauderdale hollywood international airport officials there tell us that airport is not going to reopen today. there had been some hope that they were going to be able to get flights up and running at some point today, however, because of all of the flooding that has covered the runways and the taxiways there were being told that the airport will not reopen until at least tomorrow. coming back out here in this one neighborhood. as you can see,

see happening around the country right now is that the country has changed on the issue of abortion dramatically. and that the republican party is split on the issue. i mean, you do have as i was mentioning candidates like mike pence, for example, uh , tim scott, for example, uh, who are going to say? you know, we've gotta we've gotta be anti abortion, although skim tim scott is a little more moderate on the issue, then mike pence, but now you have this five week ban. in florida. as you pointed out earlier, most women don't know their pregnant five weeks and so you have a country that is overwhelmingly in supportive of women being allowed to make the decision. as i said seven in 10, americans support the use of an abortion pill. you could also describe republicans as having overplayed their hand in the tennessee legislative statehouse there, given what transpired

over the past week, we just saw these two state representatives reinstated all this issue of surrounding gun reform legislation. gloria we did see the governor earlier this week signed an executive order that would strengthen background checks. it's a step in the right direction. gun gun reform activists would say, do you think this is a sign of something that we could see potentially other? er. republican states do as well or do you think this is sort of an isolated issue? and perhaps sadly, because this governor had close family connections and friends who were victims to these, the mass shooting? well you know, after parkland if you'll recall in florida, ron desantis had a signed a red flag law. so perhaps, unfortunately, it's more likely when it hits home in your own state is that the governor is more likely to do something, although that hasn't happened in texas after you've all day, for example, i think that for some

reason, and i've been trying to figure it out. gun reform is not as motivating factor for voters. as other issues like abortion has proven itself to be, and i don't know that after all of these mass shootings, whether finally some kind of compromise on gun reform, whether it's an assault weapons ban or will finally get approved. it's hard to understand why this hasn't been more motivating. and maybe after what we've seen in the deaths of children, it will become that way. and maybe we saw that in tennessee a little bit, but it comes down to the state legislatures here. and if the state legislatures are as polarized as they are right now , i'm not quite sure what happens on a national level. no one. i know what it would say. oh, sure, we're going to get an assault weapons ban. that's not about to happen. gloria borger.

always good to talk to you. thank you. thanks, guys. i want to take you now to san francisco, where we're hearing from the sfpd, an update. there's been an arrest in the stabbing death of cash founder bob lee. let's listen in, and the investigators who worked tirelessly to ensure that this case was handled appropriately and, in fact to be clear that every single case involving any homicide or any violence is always brought the same attention is brought to ensure that justice is served and working hand in hand with our district attorney has been the incredible work that they've done together to ensure that this canada case was handled appropriately. and meanwhile, we know that this has been a high profile case, and there have been a lot of speculation and a lot of things said about our city and crime in the city. but

these two leaders have been extreme. only responsible in their handling of this case, and we appreciate their hard work. to ensure that bob lee's family receives justice and anything that happens to anyone in this city receives the same justice. so at this time, i would like to turn it over to bill scott to provide you all with an update. thank you, mayor. and good morning, everybody. first of all, i'd like to express my deepest condolences to the family and friends of mr robert lee, known as bobbly. i'm going to be brief on the details. but here's the summary in the update on april 4th 2023 at approximately 2:30 a.m. san francisco police officers from southern station responded to the 300 block of main street for report of a stabbing. officers arrived on scene and located.

and located the victim, later identified as 43 year old robert lee, suffering from an apparent stab wound. officers rendered eight and summon medics to the scene. mr lee was transported to zuckerberg san francisco general hospital with life threatening injuries despite efforts by first responders and medical personnel, mr lee died from his injuries. the san francisco police department homicide detail responded and took over the investigation. homicide investigators developed information that identified the suspect. as 38 year old neema momeni emeryville, california. we can confirm that mr lee and mr momeni knew each other. however we will not be able to provide further details at this time regarding the evidence that confirms that information. this morning members of the san francisco police department's investigations bureau and

tactical unit serves several search warrants and arrest and arrest warrant in san francisco and emeryville, california. mr momeni was taken into custody without incident and emeryville, california. he was transported to the san francisco county jail and booked on one charge of murder. california penal code section 1 87, a i'd like to remind everybody that this is still an open and ongoing investigation, and we will not be able to provide further details at this point. before i turn this over to our district attorney i want to assure everyone that our investigators have been working tirelessly. to make this arrest and bring this case to justice for the lee family and his loved ones. just as we would for every homicide that occurs in this city. i like to thank homicide investigators led by detective brett dettmer. and detective thomas make mcwilliams also lieutenant

kelvin sanders and our entire homicide team who have worked not only in this case, but all of our open cases. i said from the start. that i have every confidence. and the men and women and the members that we're homicide. they have an 85% clearance rate year today and that is expected to go to 92% because we just saw the 1994 case. yesterday as well. we never give up finding justice is justice for the victims in this city, and i want to make sure that everybody knows how hard the men and women and members of this department work. to keep this city safe. with that said just a reminder. we won't be able to provide any details in this case today. but this is an ongoing investigation. we still have work to do and our job is to provide the best evidence possible to this district attorney and her team. so we can bring this case in any other homicide, a crime in the city to justice. so with that i'd like

has been identified, arrested and now will be brought to justice. as a former prosecutor in our homicide unit. i have personally worked on cases. with the detectives that solved this case. they are dedicated to justice and have further demonstrated their commitment to ensuring that san franciscans do get justice when something like this happens. i am here today to formally announced the charges against mr neema momeni for the murder of bobbly. the specific charges that we are filing today include murder in violation of penal code section 1 87, as well as a special allegations, also known as an enhancement, alleging that this murder was committed with a knife. ask for next steps as i know you all are eager to follow this case. mr momeni is expected to be arraigned in department 10 of the hall of justice tomorrow afternoon at 1:30 p.m. my office

the sfpd chief that that suspect was taken into custody is 38 year old name among many that the chief said that the two know each other but said they would not be giving any details of the evidence in terms of how they they know that but again name among many taken into custody in the death of bobbly charged with one count of murder will continue to follow those updates. alright well, lawsuit has just been filed by the estate of a man who died after spending 20 days in solitary confinement. this was at the jackson county jail and indiana 29 year old joshua mckellen. moore was arrested for pulling a nurse's hair while being treated at a nearby medical facility. cnn obtained edited video clips from the jail cells ceiling, mounting surveillance camera from the family's lawyers, and we must warn you, they are disturbing. according to the lawsuit, mclemore had a history of schizophrenia and substance abuse and experiencing a mental health crisis. at the time of

his arrest. he was placed then it alleges in a windowless isolation cell where he remained naked and confined for the next 20 days. attorneys say he lost him £45 in less than three weeks, and an autopsy revealed his immediate cause of death. with multiple organ failure due to refusal to eat or drink with altered mental status due to untreated schizophrenia in a cnn has reached out to the jackson county sheriff's office for comment, along with advanced correctional healthcare, incorporated, uh, cnn political commentator van jones is joining us now he is also as many of you likely know an advocate for criminal justice reform. the details here really surprised. so many of us these details that are alleged in this lawsuit fan . what more what do you know about this? and we're were you surprised when you when you heard about this? well um, i was heartbroken, but unfortunately not surprised. unfortunately um , in our country, the abuse of

solitary confinement has reached really epidemic proportions in the united nations defined solitary confinement for more than 14 days as torture. um and yet there are people in the united states who are in solitary confinement for literally years on end. um having a schizophrenic episode should not be a death sentence in this country, having mental health issues should not be a death sentence in this country. there's a particularly appalling given the fact that there was like literally no medical attention given to him, even though he wasn't eating wasn't drinking particularly appalling , but i think people would be shocked to know how many people find themselves in situations like this and worse for even longer. um this this particular family is just in a better position to bring forward the case. yeah he ultimately lost £45 during his stay there, but as you noted van, he never saw a doctor or mental health professionals while he was being kept there. the lawsuit has been filed by his family. what legal recourse do they have? well

obviously, a civil suit here for wrongful death is going to go forward. i think if there's ever been a case of wrongful death when somebody you know, pull somebody's hair and winds up 20 days with no medical attention, losing weight, not eating and dies. i don't know a more open and shut case for wrongful death , but i hope they asked for more than just monetary damages. at some point, we've got to go for a systemic change. uh this is brute, brutal, brutal torture that the mandela rules. the united nations has says the psychological impact of the compounding psychological impact of prolonged indefinite solitary confinement is the equivalent of torture. that's not new. n says. torture the world should listen . we are torturing people right now in the united states by keeping people in these conditions and it's not just people have mental health issues. uh the routine use of
