the cnn newsroom i'm erica hill. and i'm bianna golodryga. he was scared of getting caught transcribing classified documents at work. so what did he do? well, he took them home. that is just one of the stunning new details. we're learning about the suspect arrested in the flagrant pentagon leak investigation 21 year old jack to share a was charged with two federal crimes. today he did not enter a plea, but he will remain in custody until his detention hearing next week. to share a who was arrested yesterday at his parents' home was an it specialist for a military intelligence unit on cape cod, massachusetts. today's affidavit providing somewhere insight into why this effectively low level air national guardsman had such high level access to the sensitive information is beyond a mentioned he worked in. i t actually held top secret clearance since 2021 starting in december, according to the affidavit, he was posting hundreds of highly classified

intel documents to a chat group frequented by gamers. those documents later spread on social media. cnn's chief law enforcement intelligence analyst john miller, is with us as well as cnn national security correspondent natasha bertrand, who is joining us live from the pentagon. so john, let's talk a little bit more about these charges so to federal charges at this point, and what do they point to so these are your basic holding charges. this is unauthorized use of a government computer, you know, improper handling of classified documents , but as the investigation, which is literally today, only six days old, which is lightning speed in a in a classified leak investigation has to go further . which is okay. this is what we know. and we think that he was he had his friends. they were gamers. they shared this these documents in there. private discord space it was cool to have access to real secrets. what we don't have is an espionage charge. what we don't have is that he was working for a foreign government. what would don't have was, you know he was

leaking it to russia or china. um but they're not finished yet. so what we're going to see is he's arrested on probable cause . it's a complaint by an fbi agent. we're going to see an indictment and then you could see a superseding indictment, depending on where the investigation goes at minimum, at minimum for every one of the hundreds of documents that he may have posted each one of those could be a criminal count that would be added to those charges. yes so there could be more charges to come and be more charges could be facing serious time. right now. the ball is in his court, which is the key is whether or not and how much he's going to cooperate in the investigation, or just you know , uh, if his lawyers tell him we're not saying anything, and you know we're going to fight this. these are the choices that are in their court. now, more potentially, investigators could find as they're doing their searches. natasha can you tell us more about how this suspect was able to have such a hub, tie top level security clearance and

when he had access to that. yeah, be honest. so what we're learning is that he apparently was given this top secret clearance in 2021 a couple of years after he joined the air national guard and he was given this clearance because of his role as a let me just read it here. cyber transport systems journeymen, and that is a very long title for someone who was essentially an it person. he was 90% for the intelligence wing of the air national guard. he essentially made sure that all of these communications systems and the networks were up and running properly, so that, for example, intelligence analysts could properly access the intelligence that they needed to do in order to do their day to day job. but what we're told is that he was given this clearance just in case he was actually exposed to any of the content of these documents because again he was not necessarily engaging with the content on a day to day basis as part of his regular job, he was more responsible for the actual operation of those systems. so now the question is, of course, why did he access

those? very specific documents. and how did he manage to get them out of the facility? without anyone noticing? it does appear, according to the leaked documents that we have seen online over the last several weeks that he took photographs of these documents, and he took them home and he took photographs of them in his residence before posting them online. and so the question now becomes, what are what protocols were in place at this facility to kind of track this kind of thing. why did no one notice that he was doing this? because, remember, he was also transcribing them by hand at one point before he ultimately switched over to actually taking the physical documents out of the facility. so a lot of questions going to be raised here about why he was able to have access to this intelligence as such a low rank, of course as part of his day to day job, but also how he managed to get this stuff out of the facility itself. vienna yeah. really important questions to tasha. bertrand john miller. thank you both. also with us cnn national security analyst juliette kayyem . she's a former homeland

security official, julia good to see you, so we should also point out that in your time and homeland security in the state of massachusetts oversaw the air national guard there as we look at all of this, and everybody's trying to trying to put all the pieces of the puzzle together. i think the part natasha, but a really interesting point about about oversight. so we know that he had access because he had this job where he worked in i t he was responsible for basically keeping those systems running. the fact that there didn't seem to be any sort of checks and balances in place. no oversight based on what we know now, in terms of who may have been looking at those documents, what they could do with him that he could print them out and bring them home. you know, when you were there, was there any sort of oversight here? would someone in this position have a manager who is checking to see when they're accessing certain things? right and the and the yes and there are systems in place to determine how long someone's in a skiff. how did he get a phone in a skiff? i mean, in other words, if i'm assuming

he's taking pictures off of his phone questions about brought them home the documents home to take the pictures of them at home, but also in the picture is okay. right. so he so he does that, but i think the big question right now is who owned him. and this is where my brain is right now. and what i mean by that is he is he enters the state national guard massachusetts national guard and is in a in a state status. that means he's essentially owned by the governor, who i reported to at the time, so he is doing what we call state functions. there is a capacity in particular intel in particular at this wing in which the person is what we call federalize or title 10 status that i don't mean to get technical here. it just means he's owned now by the pentagon. and his reporting bypasses the governor and he goes up the pentagon chain. it was interesting to me to say the least, that at least what's been disclosed by the court yet now it does not at all make clear what status he was in when he had access to that information.

it says he has top secret security clearance. that tells me nothing. he could be either state national guard or federal national guard. i believe this is the next shoe to drop. i mean, i believe as we learn more, we will either determine you know, for reasons that are inexplicable to me that he was a state national guard member. having access to information as almost no relevance to a state national guard or possibly that he had been federalized under title 10 status, in which case the pentagon has a big problem right because he is reporting up the pentagon chain of command, and they should have had better oversight over him. and either case, let's just say it's not good. can you explain how the process works when somebody has top secret national security clearance because it seemed yesterday from the pentagon briefing that they were really focusing on the fact that he signed an n d, a and, and that in and of itself is sort of like the ball's in his court. he broke that agreement, and he gave the analogy that brigadier general that it was as if

somebody's home had been locked and somebody who had a copy of the key then decided to break back into that home. i mean, is it as simple as that? is this sort of like an honor system when it comes to national security issues. i mean, it is in some ways because you would hope, but that honor system is based on verify verify entrust right and the verification is not just the clearance itself. it's continuing reviews throughout the process. it is it is, too. they travel abroad. are they all of a sudden driving a fancy cars and then questions of espionage or they're getting paid by a foreign entity? um, are they going through something traumatic in their own life in which then the supervisor might actually limit their access? because people you know go through traumas and you don't want the necessarily to be to be to have access to this information. so the idea that it's like one and done right you get you get top secret clearance and then you know, please, please behave. that's not actually how it works. there's continuing processes of review of access to information. this

was a lot of paperwork that's leaving. this takes a lot of time. how much time did he have in those areas? how much time was he online? and i do think you know for us the particular uh, issue is going to be who owned him. state status or federal status, because that will then go to different problems. one is, of course, why does the state national guard member have this information? the other is the pentagon is it did not catch this and i think you know, as i said, in both instances, it's his fault. no question about it. but we as the government, i mean, we had the united states has to has to has to learn lessons from this. and these. these incidents are happening a lot, not a lot like this, but the pentagon is going to have to think about access. uh more carefully than i then obviously, this situation

could act fast here. you know, because really guys if they don't the entire way this abortion pill is administered would change virtually overnight . it would still definitely be available. but there would be these drastic changes that the fda has laid out. you know, they're saying that they're unsure how exactly they would handle it. if the fifth circuit ruling goes into effect, and they're saying that this is really a process that demands just a lot more than just a flip of a switch. so the doj has asked the supreme court to step in there laying out all of these logistical hurdles. but here is what would happen if the supreme court does not step in at about one a.m. saturday morning, so just mere hours from now, 1/5 circuit ruling it would take effect, and that ruling says that women beyond seven weeks pregnant cannot take mifepristone went up until now they've been able to get it up to 10 weeks pregnant. and also telehealth and prescription by mail options would just be eliminated so women for the past few years they've been able to get this prescribed online by their doctor and then get it in

the mail. that however, would end overnight tonight if the supreme court does not step in here now, doj has laid this all out in their filing to the supreme court, and they're arguing right off the bat. several things they're saying, look, this drug has been approved for more than 20 years since the year 2000. it's survived five presidential administrations because of this scientific backing for this and the world health organization has this drug listed on its list of essential medicines. so the deal j is doing all they can to put all of their arguments before the supreme court. it is now in the hands of the supreme court. american bianna, you know, we're expecting that potentially the supreme court might rule by the end of the business day, but really a. they don't have to act here. although it's likely they will and they could act all the way up until that one am east coast deadlines, so we'll see. the clock is really ticking here and a lot is at stake. guys it's going to be a busy next few hours for you, jessica schneider, thank you so much. keep us posted. we're keeping a close watch on what will happen

for french president emmanuel macron, but it is sparking yet more protests across the country, cnn's replied. guin joins us now from paris. so what kind of reaction have you seen? in response to this ruling? earlier today, fred? well, there's been a lot of anger, especially here on the streets of paris, guys. we had a demonstration that took place just as the verdict from the constitutional council was announced, and the situation now in the evening is one where there is still a lot of display of anger, but crowds have dispersed a little bit of a cat and mouse game between the cops and the protesters were still out here. you can see right here. the police still out in full force. we have the police fans. they're behind us. we did see the police. charge a couple of protesters. so it has been. you know, some of the difficult night here in paris so far, and in general, we do have to say there are a lot of people here in france were very angry at the fact that the retirement age is going to be lifted, but they're also angry at the way that emmanuel macron has pushed all of this through. they feel that

he sort of bypassed large parts of the legislative process. and one of the things that we sort of taken note of, as we've been reporting on this on the ground is that there are also a lot of young people who are joining those protests, and a lot of those young people are telling us that they want to continue to fight this bill with the kind of protest that we've been seeing here over the past couple of months, and especially over the past couple of days. of course, several 100,000 people went on the street. yesterday throughout france. there were a lot of people at protests in france today again as well. and even here all through the night, you can still hear the sirens as the police are out in full force, and people are coming up and challenging those police officers because they are so angry with what they feel is just the way that emmanuel macron, they believe has essentially done damage to democracy here in this country, guys. macron's argument is that this is what was necessary in terms of where the economy was headed. but there are many people there on the streets that are just not accepting it. a huge development there in that country. frederik pleitgen. thank you. newly unsealed

documents reveal the texas man who killed a protester at a black lives matter rally in 2020 spread racist messages online for years now, the texas government promised to pardon daniel perry shortly after he was convicted before he was sentenced. abbot claimed perry was protected under the stand your ground law in texas. new evidence, though, may complicate abbott's efforts. jake tapper to have more on this story at the top of the hour on the lead, so, jake, i know you've been following this very closely tell us more about these about these new posts and really the impact that that could have on this pardon request from the governor. well, mr perry's defense attorneys are lashing out at the court for releasing the these messages, almost all of which were not allowed to be shown to the jury. but perhaps perhaps it will complicate efforts to pardon him or give him a new trial. among the posts that he wrote. ah on june 1st 2020 on on facebook, he wrote. it is official. i am a racist

within the state and nationally as well. this is something that we are watching nationwide. jake thank you so much. and be sure to join jake at the top of the hour for the lead with jake tapper. and we want to bring you this breaking news just into cnn. justice samuel alito has extended a hold on a lower court ruling that would have imposed restrictions on access to abortion drugs. so this is what we were waiting to hear on jessica schneider joining us now we've been waiting to hear from the supreme court. what does this mean now? jessica? this basically means that we're on hold with all of this will no more next week. i mean, this is the very short order from justice samuel alito here and what are you saying is he's granting what the justice department wanted. the justice department asked for a number of things, one of them being a short administrative stay. so all of these changes to the abortion pill would not go into effect overnight tonight. so the supreme court is saying yes, we will give you that brief pause, and that pause will last until

just before midnight wednesday. and justice. alito is also asking the parties to file additional briefs is if necessary. so what this does is this doesn't settle any questions. this doesn't settle the underlying merits of this case. this basically just puts on pause what might have gone into effect overnight tonight, so really, this whole thing is going to play out again in just a few days when we're once again in that waiting mode to see what the supreme court again decides to do, because this is an administrative stay a very short stay. where the small the supreme court gets more briefing from the parties and further decides how to act here, but the takeaway from all of this is that mifepristone is still available in the same form. it was just a week ago. before that texas judge made all those changes to it. it is status quo for how it's been for the past several years, women can get this pill. they can get it up to 10 weeks of pregnancy. they can also get it via telehealth medicine and via mail. that will

be the case until at least late wednesday night when the supreme court will again weigh in on this, so essentially, guys, the supreme court just really kicking the can down the road on this, too. vision, saying will revisit this next week. but for now, things are status quo. there's been a lot of back and forth a lot of confusion, the justice department pointed to all of this confusion and they're they're filing to the supreme court this morning, but it does sort of. just keep things on hold while this continues to get sorted out, guys so you could interpret this as a short term of five day victory for the doj to keep things at status quo. what do we expect to hear? come wednesday. is there anything left for either side to file or to petition before we hear from the supreme court once again? there might be bianna justice. alito is telling the parties that they can make additional filings by tuesday. so presumably the parties here doj the drug manufacturer as well. and maybe

even the doctors who brought this case they might file additional, um, additional filings with the supreme court and the supreme court at that point will decide a number of things whether to institute a more lengthy stay while these appeals play out in the fifth circuit, what's interesting is the fifth circuit has already set a briefing. scheduled for this, and they have scheduled oral arguments pretty quickly to happen on may 17th so presumably potentially the supreme court on wednesday could say okay, we are going to grant a stay until the fifth circuit. he hears this appeal, and then it would really put everything on pause for likely weeks, if not months. so yeah, there could be more legal filings in the next five days, but everything is on hold until late wednesday night when the supreme court should yet again decide whether to continue this pause, or maybe do something different, like let these changes go into effect. okay jessica stay with us. also joining us cnn legal analyst joan biskupic. john there's so much focus on this because of the drug write it because of the

access that it's had, but also because of the fact that this ruling just a week ago by this judge in texas, called into question the fda approval process. this drug was approved in the year 2000, and there has been a fair amount of data since then, in terms of feedback about the impact on women and how safe it is. so this is also a major focus because it's going to involved potentially the fda approval process. absolutely this is, you know it was as far reaching beyond abortion access to the fda approval for any new and existing drugs. so what's going to happen here is, jessica said. we have breathing room for five days. by tuesday noon, the original, um challengers, the antiabortion physicians and medical groups and anyone supporting them needs to get their filings into the supreme court by noon and tuesday. right now, we already have heard from the department. of justice. and the drug manufacturer, danko,

plus, also today, more than 20 states, who wanted a pause in this litigation had already filed at the supreme court to so i imagine we'll get a russia filings by tuesday. and this this temporary pauses just until wednesday. so that gives you know the justices a chance to actually read up on this to consider what their next step will be. this is a set of justices that just 10 months ago had overturned constitutional abortion rights nationwide and sent it back to the states. but as you said, erica, this is a whole different kind of battle over the authority of the food and drug administration to review and approve drugs. in this case, obviously the first pill of a two drug abortion medication protocol. and what's an issue right now? is the access not just not the core approval of that drug that looks like you know, at least the lower court said that that was

done properly in the challenger's couldn't go after that at this point, but what's at issue is more the availability. may women get this through the mail, or must they go in person? what's the window of availability? seven weeks versus 10 weeks, but all of that uncertainty that we had up until you know, just like five minutes ago. now. ah dissolved for at least five more days, everything would have gone into effect from those lower court decisions against the fda approval. uh at midnight texas time. one a.m. saturday our time in the east coast, but now everything will play out in legal filings. the main thing we're all going to see is exactly how the original challengers, as i say the anti abortion physicians and medical groups how they tell the supreme court do not interfere. now let let these um this fda approval be rolled back enough to put

more restrictions on the restrictions on the drugs, erica joan, if i could just ask you given the legal president in the standing that congress had given the fda the authority at years ago that in addition to this drug, having been approved now for over 20 years, are you and the question the legal question we keep hearing is that the plaintiffs, there's a question about whether what legal standing they had to even file this lawsuit given all of that. are you surprised by this ruling from the supreme court, for now, at least, just kicking the can down the road. no i'm not. and you're exactly right, bianna. first of all, it's just an order. it's just them. it's just samuel alito. he obviously he didn't quite refer. he didn't refer to the court. but i'm sure he was getting signals from his colleagues that this is what they needed to do. at this point. the reason it went to justice alito just so we make clear is that he is in charge of emergency petitions for the fifth circuit. it's the regional circuit that actually handled the lower court case, so it's

this was frankly, this was the prudent thing to do. given how fast moving this was since last friday, when you know everything was upended with the district court's decision that suddenly as i said, you know, went against the fda validation, but you're exactly right that this is a whole different kind of case. that is, you know, is unprecedented in terms of the attack on the fda and a single judge. essentially putting himself in the shoes of the regulators to say. that he can he looking at studies and medical findings and scientific determinations that he can assess on his own the safety and effectiveness of myth of kristen and what the department of justice has said and the drug manufacturer who has intervened is you know he should not be able to do that. and just because this is longstanding, uh
