just moments from now, police in alabama will give an update on a mass shooting at a sweet 16 birthday party that killed four people and left more than 30. people injured. we're live in day ville with the very latest air national guardsman accused of leaking classified documents will appear before a federal judge in boston. this as his detention hearing has been delayed. we have new details coming in another honest mistake leading to more young people being shot to texas cheerleaders opened the door to the wrong car, and now one is in critical condition and a 25 year old man is in custody. we're following these major stories and more coming in right here to cnn news, central. all right. we have a press conference happening right now. let's

personal courage. it's gonna take personal courage of the individuals so that they were there that night. to come forward. come talk to law enforcement. tell the truth. we need that information, okay? i'm now going to turn it over to the fifth circuit district attorney mike sagers for his comments. thank you. we will send out an official press release with all the names immediately following this, please hold all questions to the end of the press conference. thank you. good morning, everyone. my name is mike siegrist on the district attorney for the fifth judicial circuit, which includes not only here in tallapoosa county, but also making chambers and randolph counties. i know that there has been some frustration among our community and among media about a lack of information that has been provided up to this point, and i want to explain part of the reason for that. as a prosecutor

. i cannot discuss this specific facts of the case is highly inappropriate for me to come out and publicly talk about that. and tell that information and the region is being defendants have constitutional rights. they've got to be tried by a jury of their peers inside this building, they have a right to be represented by counsel and for me to come out here and give information about what's going on in the investigation. i can't discuss the details of that with y'all. and i apologize, but i hope you'll understand that. north and law enforcement. so we won't be discussing all of the details. i can tell you a few things about the process of what will happen next with these individuals. first they will be entitled to immunize law hearing , which is a bond hearing that will have to occur within 72 hours, the state of alabama, where we requesting the no bond that's up to a judge to decide,

but that will be the state of alabama position. after that, there'll be an initial quarter appearance. then there'll be a preliminary hearing and then this information, depending on the outcome of that will go to a grand jury. the grand jury system in alabama, and each circuit operates differently here in tallapoosa county grand jury convenes twice a year once in march and then once again in september. once the grand jury's impaneled in march. they are still the grand jury for that six month period. we can recall the grand jury to present an indictment under special situations. that's unprecedented and hasn't been done that i'm aware of any time recently here . this is an unprecedented situation if we can establish the facts and are ready to present that we will be asking our grand jury to come back in to present that so we can move forward, um, efficiently and effectively. this is a very

complex case. we mentioned four counts of reckless murder. obviously that just includes the four deceased that have been reported. okay we've got a lot more victims in this. we've still got four that are in hospital. for that are in critical condition. they will be pending charges coming regarding all those. so when i tell you that this is just the tip of the iceberg. and forthcoming charges . literally, you know we're going to make sure every one of those victims has justice and not just the deceased. i'd be remiss if i didn't. um just like thank you to all the agencies and are gonna try to name a model because there's been so many literally every agency from federal, state and local that has been involved in this without the resources that they have brought to our community. we would not be where we are and have already made these first arrest. um, here today. i will

tell you that even though these are 16 and 17 year olds, we will be charging them as adults in this, um when i spoke to the press on sunday, i started off by talking about the victims and the victims services and i want to go back over that. we have information on our website, www dot fifth circuit d a dot org that has information to provide to victims and victims, families and, um, we've got victim services from the fbi victim services from the attorney general's office victim service from the opposite of prosecutorial services as well as our office. they're all working, too. provide the needs to the victims. when we talk about the victims. it's not just the 28 injured and 32 dead. there were so many kids in this

venue. and what they saw. it's their victims in this, their their families are victims of this, and you know the ripple effect of this, you know, it's kind of like a wave rolling across lake martin. but that ripple didn't stop when it when it hit the banks. there are other communities involved their kids from real town here, um one of the ones in critical condition had gone to the prom that night. in real town. there's kids from talis e kids from booker t. w kids from alexander city. um, we haven't even identified possibly. you know where all some of these kids came from, and it's a traumatic thing. for them and if they need help, you know our services are available for them as well. uh, and talking about the victims. i'll share something with you. i'm gonna try not to get emotional and i'm

not going to be taking any questions because i probably would but one of the victims that wasn't injured. lexi, lexi dowdell. is lexi 16th birthday party. sweet 16. there's an uncut cake and unburned 16 candles. that never got lit. lexie's brother was one of the victims. on her 16th birthday party. she's been out by her brother. he took his last breath. that's what we're dealing with here. those are what these victims went through. the message that i want to send is i know some of these victims personally. some of these kids are kids of friends of mine people that i went to school with people that i play ball with and against in the community back in high school and these are my kids. these are our kids. don't mess with our kids. do not mess with our kids.

happened. and what happens now? that's correct, john the detention hearing or what was supposed to be. the detention hearing has now been delayed. as you say the hearing that just took place lasted all just for about just a few minutes. the judge overseeing the hearing, david hennessy, basically just wanted to make sure that he heard verbally from teixeira 21 years old that he understood what was happening and that he was okay with this detention hearing being postponed and during once again, this very short hearing. we heard the judge say had he, in fact signed the waiver to postpone the detention hearing to share a simply said yes. and with that it was done. as you know, both sides had asked that this detention hearing be postponed to share his attorney, saying they needed more time to prepare their arguments for the detention hearing. so what happened here is the judge had suggested a date of may 3rd.

cheerleaders were told by the cheerleading coach that these four girls would travel from the austin area to the houston area where their team practice. it's a 300 mile round trip. they would do this three times a week they would go together. and that's why they were coming back so late at night there, arriving at this parking lot of a grocery store in the town of elgin, texas, just outside of austin, when one of the girls got out of the car to get in their own car, but by mistake, she says, she got into the wrong car. when she noticed that there was someone else in it. she got out and got back in her car. but that man got out of the car came around to where the four girls were. the young woman said she started trying to apologize for making that mistake. and then the man opened fire on them. one of the girls was not very severely wounded. she was treated and released. however the young woman by the name of peyton washington, who was a senior in high school is in critical condition and her coach shared some stunning details about what

an impressive young woman that says peyton washington was born with only one lung. and despite that obstacle, she says, her coach says she has rised to risen to the top of her sport here. in fact, she had committed to perform with the baylor acrobatics and tumbling team next year in college coach says she's an inspiration. she is the really huge face in the all star cheerleading world. she's a mentor, mentor and role model to so many kids in this industry. she's an amazing athlete. amazing kid. belgian police say they have arrested 25 year old pedro rodriguez jr they have charged him with deadly conduct , which is a third degree felony . police there in elgin sarah say that they can enhance or add additional criminal charges. and we're expecting an update on this case from elgin police in just a few hours, sarah let us hope and pray that peyton watches and makes it out. of the

life. but i understand it's part of this system that we have, which needs real tweaks. and i think that this has everything to do with race. the defendant's fear of black people, black men , black boys, and i think that's why we are all discussing this now for some reason. right because it it is something that is tragic. and i think that if the young man wasn't black, we wouldn't be here today. have some folks in kansas city. they're now calling on federal officials to conduct hate crimes investigation into the shooting, and we will stand by to see if that happens. john it is great to see him amazing. it's amazing. is nice to see. attorneys are expected to announce a civil lawsuit today against the city of memphis for the death of tyree nichols. the suit will also include the memphis police department and the individual officers involved with nickels. death the 29 year old black man was brutally beaten by officers during a traffic stop earlier this year. police body camera footage revealed the violent encounter while nichols was already

restrained. cnn's nick valencia is covering this, nick, what do we expect to happen today? good morning, john. this is being called a landmark lawsuit by civil rights attorney ben crump and is expected to happen in just under two hours from now. at one p.m. eastern civil rights attorney, crump will be joined by his co counsel, antonio revenue chee, as well as a retired magistrate judge from the city of memphis and all three attorneys site intentional infliction of emotional distress for lying to tyree nichols's mother. if you remember it was shortly after nichols was taken into custody that officers showed up at nicole's mother's home to say that he was a suspect in a dy arrest, despite there being no evidence to back up that claim, if you remember, in fact, the police report was riddled with inconsistencies and misleading information. those five officers involved in nickels deadly arrest have been charged with second degree murder. all of them have pleaded not guilty. there's been so much fallout from nichols arrest, including the disbanding of the so called scorpion unit, that specialized crime unit there. also been multiple police

women? and why well, sarah, this study suggests it's just a study not a formal recommendation. but it raises the question of whether black women should start mammogram screenings at age 42 rather than age 50 the reason why we already know that black women are less likely than white women to have breast cancer. the incidence rate is 4% lower, but when we do have the disease, the death rate among black women is about 40% higher compared with white women. so when we do have it were more like klay to die from the disease and the researchers behind this new study. it's an international group of researchers they analyzed more than 400,000 breast cancer deaths in data here in the u. s. and they came to this determination that screening earlier can enhance survival. among black women. now with that being, said sarah, the american cancer society already recommends that women all women should start considering mammogram start talking to their
