>> any moment now the air national guardsman accused of leaking highly classified documents, is due in federal court. prosecutors are set to argue that 21-year-old jax teixeira still poses a great threat to national security and he should be kept in custody. in a late-night filing, prosecutors alleged he may have still have access to hundreds and made searches online in what appears to be a deliberate effort to disseminate this country's secrets. they also say he's a flight risk and attractive to foreign governments. jason, what more are prosecutors saying? >> reporter: a couple things. first of all, as you pointed out there, they are very concerned about this recent development that was late out in these court documents that he had viewed

hundreds -- not dozens, but hundreds of classified documents. the real concern, brianna is that if he gex out on bail, the thought is he'll be able to in some way access some of those documents. that's why prosecutors say it's one of many reasons he need to stay behind bars. he knows where the information is, how to access it, and based on his specialized i.t. skills, he presumably knows how to disseminate the information without being noticed. also the defense weighing in, saying, look, this was a young man taken into custody at his home without incident. they say he is not a serious risk of flight or obstruction, and that if the judge were to allow bail, perhaps he can set certain conditions, such as released to his father, confined to his residence, undergo location monitoring, no contact with witnesses, and no access to

the internet. again, 9 prosecution laying out a number of situation that they say should have been a red flag to not only the air national guard, but others, that they say that this young man was indeed troubled. going back to high school, brianna, they point to one incident, where they say he was denied a gun i.d. car by police after police found out he was suspended from his high school after he made comments about guns and racial threats. so, then, this is why i think there's so many questions to not only why was he a candidate for the air national guard, why did he have access to these types of classified documents? these are some of the things being argued outside the court. the judge has much to consider inside the courtroom. brianna? >> all right, jason. we'll be catching. this is really interesting, i think something that may work against him today, prosecutors

detailed the things he did to try to destroy evidence, they say, before he was arrested, right? >> reporter: right, right. he tried to destroy some of the things in his home, such as a laptop, a gaming console they found in a dumpster. he also at one point, when he found out the authorities were on to someone leaking this information, he decided to get -- to change his phone, get a new e-mail. in addition to that, investigators were very alarmed by some of the searches that they found. they say that teixeira's search for things like ruby ridge, the mandalay bay shooting, buffalo top shooting anduvalde, and they say these are red flags and why he's a risk. >> jason, thank you so much for that. jim?

a lot to break down as to how this happened. with me former director of national intelligence, james clapper. thanks for taking the time. >> good to be with you, jim. >> i know you've been watching this with great interest. a couple specific questions here. we learned that teixeira, had some issues that might have drawn the attention of investigators. the defendant was suspended in high school based on concerns comments he made about molotov cocktails, weapons, raciist comments in school. would those amount to red flags that could stand in the way potentially of getting a security clearance? should they stand in the way? >> well, yes, they will certainly red flags for at a minimum a duper investigation, perhaps more interview with his

teachers, school administrators, friends and acquaintances, neighbors, et cetera. yes, that would and i think that's really the key things to do here, how was this missed in the course of his initial background investigation and the granting of his clearance. >> so whose fault is that? who should have identified that red flag and investigated further? >> well, the system for running background investigations and adjudicating them, particularly -- the adjudication is a key thing. those are two separate steps. background investigation, which as the names implies, tries to gather up as much information about the person's background, and secondly adjudicators make a judgment about whether this

person is of sufficient integrity and character to be granted a clearance. somewhere in that will chain, in that process, something fell through the crac k in other words, how many is still out there. i wonder, after years of leaks, breaches that we know about, some we don't know about, why there isn't better tracking of what exactly he accessed, what he may have printed out, what he searched. why don't we know already?

>> well any many cases we do. the major intelligence agencies do have pretty good systems for tracking the electronic behavior of employees. again, a subject for examination here is, to what extent does this national guard unit have mechanisms in place to monitor his electronic behavior? and it is admittedly a mixed bag across the entirety of the intelligence community. i said that, what is at issue here, in my view, a fail dwrur of personal trust. we've had unfortunately a history of them in the past, edward snowden being a prime example ten years ago. we have this current case, and will probably have them in the future as long as we have to make subjective judgments about

people's character. >> yeah. sometimes personal trust doesn't work, the case of chelsea manning's well with the military. director james clapper, thanks for helping us break it down. goodness knows there's more questions to answer, boris. the u.s. economy grew at a slower rate than expected. 1.1 po respect, while economists were expecting nearly double that. depends on who you ask, that might actually be good news for the economy. ra hell solomon is here to explain. what does this mean for americans? >> well, for americans it means they're still spending, the report bears that out, but this is clearly a slowing economy. to your point, some would like to see that the federal reserve welcome some signs of cooling. 1.1 at the annualized rate, boris, that compares to what economists were expecting.

they were expecting 2 pick and roll 2%. it's the consumer, the u.s. consumer is really powering through, spending on things like goods, service, durable goods, restaurants, bars. net export was a positive contributor. on the flip side we saw a drawdown on inventories. also, businesses pulled back their spending. when i talk to mark zandy, how do you explain this? he told me, he said usually it's the consumer that pulls back, the businesses respond. this go-around, the thing that feels a little uncomfortable, if we go into a recession it probably broadband businesses pulling back and forces consumers to follow. at this point, that's not what we see.

>> and, rahel, the job continues to be strong. >> this is a real indicator of what's happening in the market, jabless claims falling to 230,000, that's lower than economists were expecting, also lower than the prior week, but really in this range we've been in of 220 to 250,000 over the last few weeks. boris, this would be the first report, the first sign of trouble in the labor market, the first flashing signs of trouble, perhaps. we're not seeing it yet. perhaps that's the reason why consumers continue to spend. now we'll have to wait and see how the federal reserve responds at its next meeting. rahel, thank you. the woman accusing donald trump of rape is back on the witness stands, what she's telling jurors, next. and bring any greiner spent

the woman accusing donald trump of rape is back on the stand today in a new york court. writer e. jean carroll crocksed by donald trump's legal team in the trial against the former president. she is alleged that trump assaulted her in a dressing room at a department store back in the 1990s. he denies the allegation, calling it a hoax and con job.

kara, can you tell us how the crocks has gone so far? >> reporter: e. jean carroll has been on the stand for about an hour today. they're at a lunch break right now. the former president trump's lawyers are laying out their plan of attack. they're looking to suggest she's politically motivated and doing this to boost sales of her book. they have taken some of her own words and said to her, dust didn't you tell people and say you even thought your own story, your own allegations of this alleged rape was odd? and carroll acknowledged certain parts of the story are difficult to conaccept. they also pointed to an e-mail exchange to her and one of her closest friends, one of the women we expect to hear testify to back up her allegations,

because carroll said she told her about this at the time. they pointed to an e-mail in which they talk about a potentially scheme where we must do our patriotic duty. carroll testified she had no idea what that was about. they also pointed to her financial motivation, in her draft of her book, she focused on the highlight of the proposal. they also had her great on the stand that the first time she told the story was when she was trying to sell this book. her crocks will continuross examination will continue. another bruising loss in court for donald trump. this could lead to a rare event, a former vice president testifying against a former

president under which he served. it involves the federal criminal probe of the former president and his actions tied to the january 6th attack on the capitol. a d.c. court ruled against trump's appeal, aiming to stop pence from testifying before a grand jury. kai kaitlan, could trump appeal again? i suppose he could do that -- >> jim, he could try, but this appears to be the end of the road, at least on the pence testimony. it's been the end of the road every time dump has gone to court in this january 6th investigation, trying to claim executive privilege, trying to block some witnesses from testifying or giving answers. in this case, mike pen, he is not like other witnesses. he's the vice president being called in to testify against the former president he was serving beside. he has said he is willing to testify under this subpoena,

because this has gone through the courts. we did get a court order that seemed to put a button on this. this is the end. there will be no emergency help to block donald trump to block the testimony at this point they want to hearing about the conversations they had. that includes a conversation that for jaret has heard before between donald trump and pence himself where pence wrote in his book about this conversation. it happened the morning of january 6th. trump said, you'll go down as a wimp if you do that. i made a big mistakes five years ago, whenever he picked pence as his running mate. that's what trump said. pence said he was unmoved by all

houston, this image captured on sunday. you can see in the image he is wearing a dark shirt and jeans and a baseball cap. now, authorities believe that raines stole a public works truck from an area in mississippi after his escape from the detention center. he drove that truck about 400 miles west to texas. that truck was later found abandoned in spring valley. you mentioned there are two other escapees being search forred, focused in central mississippi. casey gray zone, and corey harrison. police believe these two men may have stolen a red chevy silverado after their escape. that truck was last seen on monday morning, heading into neighboring rankin county. the fourth escapee you

pounds. now another drug company says they are going to ask the fda to approve one of their blood sugar regulators purely for weight loss. eli lilly says their injectable drug monojaro delivered weight loss of up to 45 pounds in obese adults with diabetes. elizabeth cohen is following this and joins us now. what does the data that eli lilly is putting out there say? >> so this data is really interesting, boris. i want to preface this by saying this is straight from a press release from eli lilly, not published in a medical journal, no one's reviewed it, so take it for what it is. in this study, over 900 people who have type ii diabetes and were either overweight or obese, average weight they started at 222 pounds. these were people that were quite heavy. and over the course of the 22-month study, they lost 34 pounds. that is a big weight loss.

you don't usually see that level of weight loss with a weight loss drug. but it may come at a certain price. what they found is that one in five people suffered from nausea or diarrhea. that's a lot, one in five, nausea or diarrhea. and also, a fair number of people had vomiting and constipation. i don't mean to get so graphic, but it certainly raises the question of whether people will be willing to take this drug if they're going to feel that way. and it actually gets even more severe. more unusual. they did warn, the company says that there may be side effects of kidney issues, pan kcreatiti or thyroid issues. if you're morbidly obese and on the verge of having horrible complications like heart disease or high blood pressure, maybe it's worth it. to lose a few pounds, definitely doesn't sound like it will be worth it and won't be approved for that anyhow.
