a neighborhood asked him to stop firing his game so he could sleep. moments later, he, his wife and three others were shot dead. ed lavendera is with us now. what you are hearing tonight? >> reporter: tonight, friends and neighbors are gathered outside of the crime scene where five people were shot and killed friday night, and family members, the people who survived the bloodily rampage have described in the last day the frantic 911 calls they were making, pleading for help. but this area of cleveland, texas, is in a remote area of the county. they got her as fast as they could, but it wasn't enough. 11:30 friday night, 911 received calls about gunshots, someone shooting in a nearby yard. the suspect had been drinking on

friday before the violence began, and the neighbored asked him to stop shooting. >> the victims came over to the fence and said, do you mind not shooting? we have a young baby who is trying to go to sleep. >> reporter: wilson garcia, whose wife and 9-year-old son were shot and kid, said they called 911 five times that night. they asked the gunman to shoot away from the property. he said, instead, the gunman came to the home 10 to 20 minutes late interstarted shooting inside the house, where 15 people, at least four children were present. only ten survived. those killed were marie daniel. jose. >> everybody who was shot was shot from the neck up, almost execution style. >> multiple people died.

two people died shielding children. there is a reward for theself who the fbi calls armed and dangerous, and the officers search door to door north of houston. >> what we need from the public is any type of information. right now, we are just running in dead ends. >> a fbi agent was seen entering the suspect's home monday afternoon and also searched various vehicles on the property. the fbi vehicles said the agents are following all investigative leads. gregg abbott unleashed a firestorm of criticism when he announced, i have announced a $50,000 award for the criminal who killed five illegal immigrants on friday. in a statement, the spokesman said one of the victims may have been in the united states illegally. we regret if the information

him in a rage. he pulled out a 9 millimeter handgun and emptied the cartridge, shooting into the ground startling everyone in the celebration. after that, the woman said they kept their distance from him. >> the kind of history revealed there. keep us posted. even though there is no way to make sense tofr any of this, we are joined by john miller and cnn analyst and former fbi director andrew mccabe. john, let me start with you. three days, more than 200 members of various agencies looking for the suspect. what is going on behind the scenes as they try to chase the leads? >> they are trying to put together what was the path of flight? you look at the rural area. if you zoom out on the map, you say if you go four blocks north of that house, you are in a vast wooded area. they found clothing and a cell phone in that direction that could have been his plan, which

was to go hide in the woods. this is a spontaneous escape. it's not something he charted out for a long time. so he's at a disadvantage. the other hand, there is a possibility of returning to mexico. he's been deported four times which means he knows that border crossing, how to get in, how to get out. mostly when he's been gotten out, it's not been voluntary. but it shows a familiarity with the process with the cartels, and the people who control those crossings. so, you know, what you're looking for is, is he hiding in the woods right now? did he come out the other side? did he make a six-hour drive to the border? if so, what car, and did he have help? who are his friends and acquaintances? you surround that and make contact saying if they help them, they are on the x. what are his needs? is he addicted to drugs? does he have a habit?

does he have something predictable to apply pressure there. and you look at habits, friends, needs, and you close the circle arnold him. the fbi will help with as much technical assistance. logistical assistance. witness victim assistance. but at the end of the day, greg caper is the sheriff. this is his shooting. these are his murderers and he's got the lead. >> andrew mccabe, authorities have been tracking the suspect's cell phone but found it abandoned saturday along with clothes. how complicated does it become when that aspect of the trail goes away? >> it's not helpful. you are limited by technologies to how well or how consistently the user retains it. it looks like he got rid of it quickly. you go back to the low tech investigative techniques that john just walked through.

i'm sure they are looking closely at anyone he knows. any relationships he can establish with family, friends, co-workers, neighbors. i'm sure they have been contacted by now and many of them are probably under tight surveillance to see if those are the folks he reaches out to for help and support. it's very, very hard to go on the run without a support network and a lot of money. and it's unlikely he had any of that in place before it happened. john mentioned, a crime of passion. it's unlikely he planned for any of this. he is probably very capable of getting himself across the board. he has done it a few times in the past. but he has to get there. he needs transportation. he needs cash to keep himself afloat and communication with a network to keep the going, and that is where the weaknesses come in. >> yeah, is there any commonalty with how people being chased like this end up being caught? >> there are many commonalties.

you know, it's very frequent that people will go back to places that in retrospect seem like the most of course places to look for them. girlfriends houses, family houses, residences, things like that. but it's understandable as well. you go to the places where you sought shelter before, you rely on the people to try to hide you. i expect all of those locations that the bureau and the local authorities are aware of are under tight surveillance for that reason. >> john, how challenging does it become for investigators if some of the undocumented immigrants in that area don't want to come forward with tips or lead because they are worried about their own status and maybe being deported. >> you know, you look at the two law men in charge there. you have greg capers, the sheriff. he has 40 years in law enforcement. most with the harris county sheriff. but he's be the sheriff of the county for a while. note the communications though.

he goes -- this is an elected sheriff who goes against the governor in a public statement that says i don't care if they are illegal or legal, what their status is here. this is my county. these were my people to protect. this is my case. he's sending a direct message to that community. aside from the 80$80,000 reward. any issues of immigration, that is our shared problem. this is our community. i'm your sheriff, i'm with you, please come forward. >> ed lavendera mentioned, he had a history of erratic behavior with fire arms. shooting in the ground at a celebration there. how is he able to obtain the guns? >> obviously, it's unlawful forren in who is here illegally to possess a firearm. so they cannot just walk in a gun shop and purchase one going

of questioning, why e. jean carroll didn't behave a certain way after she was raped. what do you make of the questions? >> i wasn't in the courtroom. a lot is on the details how he asked the questions, and it appears what he is trying to put front and center, is this the conduct of a person who has just been sexually assaulted, who has been raped and pointed to that she didn't go to the police right away, and she pointed out, she never sought counselling, and she had good responses, and we now know that people don't react in that way, and there is a societal assumption is that is how rape victims will attack. >> that is how people understand -- >> she identified being from a

friend that it happened as she testified on the stand that is really important corroboration to her credibility, and she just made it up. for fame and fortune, and that is what is alleged. usually her prior statement, her friend would be treated as hearsay, but because shihab charged with recently fabricated that account, the prior consistent statement that is made close in time that can come in to rebut that charge. >> you talk about political motivation. there was a line of questioning about a conversation with george conway, who suggested she might have a case against donald trump. >> one of the lines of attack is that e. jean carroll made the

allies of governor ron desantis escalated a fight against disney a thorn in his side. the hand picked side that was supposed to oversee disney has filed a count suit days of disney sued the board. they sayed they weaponized them for exercising their free speech rights. the appears disney tried to outmaneuver the control over the special taxing district. desantis says he thinks the counter suit. randi kaye from florida with the latest. what can you tell us about the lawsuit? >> reporter: ron desantis' hand

picked board filed the suit against disney parks. and the new board, the central florida tourism oversight district. it was filed in state court. disney's lawsuit was filed in central court. the new lawsuit aims to invalidate the deal with the outgoing board, which was overseeing the tax district for diz nir. lawsuit claims in an effort to stymie the representatives, disney had a series of 11th hour deals with soon to be released puppet government. disney did everything right to maintain control. it published two meeting notices, letting people know what it was planning to do and they can come and weigh in at the public meetings, disney says the whole thing is just an effort to punish the company, john, for speaking its mind. >> and remind people about that, which is sort of the crux of the

argument of disney's lawsuit. >> absolutely. disney filed the lawsuit minutes after the new board appointed by the governor, the special board to oversee the taxing district, made a move to take back control over the taxing district, to take back control and power from disney really, and the move was voting to invalidate the last minute agreement that disney made at the 11th hour with the outgoing board. disney's lawsuit nullifies the agreement as a latest strike in a targeted campaign orchestrated at every step by governor desantis as punishment for diz never's protected speech. disney's -- says it jeopardizes the economic future and violates its constitutional rights. >> okay, constitutional rights that is where it all started, right? >> absolutely.

more now from assistant u.s. attorney eli honing. i want to start with one major part of the disney lawsuit, the free speech lawsuit. the constitutional rights part. disney says that desantis is doing a reptribution. how important are desantis' words? >> it's the crux of the whole thing. they are saying we are picked out and punished by official state action because of our pole speech, and ordinarily, if you are the plaintiff, in disney's shows, you have to connect the dots and make an organizement, read between the lines. here, forget about it. desantis has come out and called them woke disney, and said i'm doing it to punish them for spoking out against the law. >> when they have a woke agenda, they become politically and not economic actors.

and big leaders make mistakes like disney to advance a political agenda. >> there it is. the plaintiffs, disney couldn't have made a stronger case themselves and desantis' rheto rhetoric has been evolving a little bit, he is a little more of them they shn't get special treatment. you can't unsay what you already say. >> yeah, he already said it. another aspect of it. people may not find contract law as sexy. explain what is going on. >> the old board, the disney board, on its way out of door, they knew they were going to be deplaced by the new board. in the last act of office, the old board signed a bunch of contracts with disney that keeps the status quo in place for the next 30 or so years and the new board board said no, we are going to cancel all the

contracts, and disney's argument, they were agreements and they were made when they had power and we relied on it. we are going to invest $17 billion based on that. the new board is saying this is a dirty trick late at night, and we get to throw the contracts out, and that's the crux here. >> there are two lawsuits now. the disney suit what was filed in federal court that contains the free speech act, and the desantis lawsuit in state court. what's going to happen with the two lawsuits? >> this is a quagmire. disney will say take a state lawsuit, move it to federal court. it makes no sense. you could have two irreconcilable results. disney will argue, move the state lawsuit in federal court, and that is another motivation here. i think desantis wants to avoid

does president biden view this? >> i think from the president's family's perspective, there are two themes at work. hunter biden's public and well known case with addiction. the child support case grows out of a relationship she had in 2016, a dark time in his life. he said he had no recollection of the encounter and he is now paying child support. the other thing here is the connection between efforts to try to under mine his father's election and potential re-election. it's worth reminding people here, the lawyers in the case were members of trump's legal team who did try to overturn the -- president trump's loss in wisconsin. they also consulted on the effort to slates of alternative electors, so it's impossible to disentangle this from the political context. >> and how president bind views

this? >> they are used to it as now. they see it as an outgrowth of a long running effort, and president trump, as you recall, pressured the president of ukraine to withhold military assistance to dig up dirlt on hundredor biden and his father. at this point, you see the president is not distancing himself from his son. recently on the trip to ireland, you saw them close together. they were off traveling together. one point, joe biden turned to his family and he said, i'm proud of you and he asked them to stand up in there. is an effort to say, we support you in what we know is a difficult path. >> harry, you have been looking at the polling here. what do americans think of hunter biden's behavior? >> i think we have to separate a few things here. number one, whether he did anything illegal, and did he do anything wrong that wasn't
