8:01 am
the breaking news this morning. the lawyers for former president donald trump are meeting with the justice department right now and what that could mean for the
8:02 am
former president. fragments and debris and a huge crash in va irginia and wh fighter jets were scrambling to shoot it down. and why drones are armed for ukraine against russia. and widespread layoffs and allegation, and what former senators are scrutinizing. this is cnn "news central." so, the breaking news that lawyers for former president donald trump have been seen going into the department of justice, and you might remember that trump's attorneys have been seen going in to talk to
8:03 am
attorney general merrick garland's office to discuss documents found at mar-a-lago. evan, is this meeting still taking place? >> it is still taking place as far as we can tell, john. we have not seen the trump attorneys leave the building. there is only one way in and out of visitors, and we are sitting there waiting for what you might say when they exit. this is a meeting that the trump lawyers requested for him. and with the attorney general merrick garland and no sign that merrick garland is actually meeting with him at this moment, and any sign that we are meeting at the general deputy lisa monaco, and literally for the justice department and this investigation in the hands of jack smith, the special counsel, and that they might have to
8:04 am
accommodate a career official at the justice department who can at least hear this letter they wrote, and that there is prosecutorial misconduct, and they did not specify what that prosecutorial misconduct is, and that president has been treated like anyone in the history of the presidency, and that is partly what the beef is and what they want to try to bring across in this meeting today. now, again, we don't know the specifics of that alleged misconduct that they are making or claiming, but we do know that one of the things that they are very unhappy with is that jack smith and the prosecutors have obtained a trove of information of attorney/client information, and information that is normally shielded from investigators, and they got that because the judge determined that this there was an exception under fraud that
8:05 am
obtained that evidence of exactly what this meeting is going to go, and who exactly they are meeting with, and what they want is to lay some claims about the way this investigation is ongoing. john? >> and question on the timing here, because you and others reporting that the grand jury that is hearing testimony about this is going to be back meeting again now for the first time in some time. what does that tell you? >> right, exactly. the context and the crucial timing is very important here. all signs indicate in the closing stages that it could mean a number of things that the grand jury which has not been seen at the courthouse in early may is going to have the grand jury that has not met in weeks
8:06 am
to bring an indictment, and there is a number of possibilities that this grand jury could be come back for and obviously we know that jack smith is holding the cards close to the vest, and that is why this meeting is so important from the trump perspective, because if they want to try to get to somebody inside of this building to try to say that there should be a pause, something should be done, then we will be need to find out. >> and when we are looking to find a meeting to find out if anybody is trying to find out what is the nature of the meeting behind closed doors? >> first of all, the dynamic that you have to keep in mind
8:07 am
here is the prosecutor behind closed doors and the gaps of any evidentiary gaps and what witnesses there have been and who is cooperating and who is not, and largely if they can outline what are the potential statutes that are implicated by the conduct they are investigating and so when they are holding the bulk of the cards, it is not just a meeting of magnanimous gesture, and i don't want to make that claim, but it is somebody who has the intention as a prosecutor to be closed mouthed, and not to be as forth coming in the courtroom or the trial because the other side has the outcome to go out to spend, and this is the track record here, and the idea of the misconduct is a huge allegation, and huge claim to level against any prosecutor and particularly the department of justice to go
8:08 am
to great lengths to jack smith to have the inproprietary between trump and his team and the attorney general merrick garland. what to keep in mind is the power dynamic, and what evan pointed out, a little kudos to be given to the process here, because grand juries are supposed to be secret and a little bit supposed to be in the dark here, and we are to be wondering, john, because it is more fairness for the defendant or the potential target. if we know everything, and the court of public opinion can undermine the ability to get a fair trial and fair jury impanels, and if that were to ever get there. >> base on everything that we do know, and what you are correctly pointing out, that is limited what we know, where do you see things right now? >> well, this is first of all, this is talking about the attorneys wanting to come in, and we have the reporting from coming in, and the excellent reporting from our own colleagues about the nature of
8:09 am
the documents viewed or disclosed or wanting to be disclosed, and the statements before our own town hall with our own kaitlan collins that he had documents and had every right to do so, and that he did not believe that he had the ability to show them whenever he wanted to, and the culmination of the long time, and the prosecution is what he is looking at, we are nearing towards the end of the investigation cycle. keep in mind though as well as this, we are, you know, over 500 days away from the presidential election, and internally, the department of justice has the eyes on the novelty of this entire investigation against a former president, and one who wants to have the rnc nomination again, and reported front-runner that very race, and so they know there are time constraints of when they can launch
8:10 am
investigations, and launch prose prosecutions, because they do not want to be seen as interfering with an election, and so the time line is shrunk for that reason, and given the fact that they have all of this information and if intent is all they were waiting for, the reporting has come in and seems to draw a clear line that they know what it is. >> laura coates, such important context, and thank you for laying that all out for us clearly. thank you. thank you, john. kristen holmes is going to be joining us now in washington, d.c., and she has been following this case, and obviously, talking with those surrounding donald trump, and have you heard anything from them since we have found out that they are, their lawyers are meeting with the doj? >> well, sara, we haven't had an official comment from the trump campaign, however, i did speak with two advisers on the background information on what exactly they are asking for, and you have heard evan asking for
8:11 am
this being prosecutorial misconduct, and so, when i asked what this overreach was, they believe they have some evidence here, and the other thing that i am told by another adviser they are planning to argue is the best thing is to close this case before the election, and essentially alleging that this is going to lead to election interference, and this is what we have heard from former president trump, and a preview of what he could say if he loses the primary as i have heard from the advisers and they believe that the republican primary field is going to be completely set by the end of the week and almost set, and that the election has begun, and something they argue, and it will interfere into the election, and where their brains are right now. >> as this is going closer and closer for the primaries, they are going to give you that
8:12 am
argument, but any indication of exactly what they are talking to the doj about, and you said prosecutorial misconduct, and overreach, and any specifics? not even one? >> not even one specific, and i have asked routinely what they believe is prosecutorial misconduct as well as details into what they are saying is overreach, and what kind of examples they have, and again, i have not heard back on anything specific as to what they believe this overreach was. >> i am sure we will be hearing from somebody in this case after the meeting and we appreciate your time, kristen holmes, for your reporting. and now, we are hearing that ukraine has a network of secret agents working inside of russia, and helping to sabotage the russian forces, and ukraine is saying that they are arming agents with drones, and the u.s. officials belief that the pro ukrainian agents inside of russia may have been behind the drone attack in moscow earlier
8:13 am
last month. joining ging us for more on thd with more on this is senator chris van hollen is the ukrainian forces arming agents inside of russia with drones and could that be a good strategy? >> i will have to get more details on this, and president biden is clear that as we get more information on ukraine fighting the aggression of russia, and more specifically training pilots on the f-16s our rules of the road is that they
8:14 am
cannot use that u.s. military equipment on offensive operations inside of russia. but of course, that is not going to constrain ukraine to do what is best with their own resources. so, in terms of the u.s. participation though, we have made it very clear that those weapons cannot be used, again, inside of russia. >> the idea more broadly of ukraine kind of taking fight to russian territory, it has been a source of concern all along from the biden administration, as you have noted to be it from u.s. weapons or others, it is going to lead to the war escalating, and to the war drawing united states potentially into it further, and do you see it happening here? i mean, we are seeing a definite uptick in attacks on russian soil. >> well, a couple of things. first of all, as you know, president zelenskyy and the ukrainians are going to soon
8:15 am
mount their spring offensive. president zelenskyy announced it the other day, and that is of course to reclaim the territory that russia has taken within ukraine. look, the ukrainian people are taking direct hits on the soil everyday including bombing on kyiv and other civilian targets, and war crimes being committed against them. so i think that it is a lot to ask them not to use, to be able to use their own resources to take some of the actions in russia, if in fact, that is what is happening here as the reporting you cited suggests. but again, i do support the president's clear distinction here between what ukraine does with its own resources and what they do with the u.s.-supplied weapons. >> absolutely. let me ask you with this new video that the pentagon has released, and the pentagon is speaking out in releasing the new video and slamming china
8:16 am
right now, and the chinese military ship is being seen cutting off a u.s. navy destroyer in the taiwan strait coming within the reports are within 150 yards of the u.s. ship and forcing navy destroyer to abruptly slow down to avoid a collision. it is no secret that u.s./china relations are at a historic low, and how do you see this given this kind of contextt? >> well, kate, it is another provocative action taken by china, and a series of provocative actions, and here we are conducting joint exercises with our canadian partners and the united states has been very clear that we do not seek conflict with china, and we are equally clear that we will defend our rights, and the rights of our partner in the region when it is coming to a free and open pacific. meaning freedom of navigation,
8:17 am
making sure that our ships can continue to conduct themselves in accordance with the international rules. so, it is china that has been provoking in this case, and the united states has tried to reach out to have talks at the secretary of defense level with china and so at least we have a hotline to reduce the chances of accidental conflict. so far, china has rebuffed those efforts. >> along that vein, i wanted to ask you, jake sullivan said that biden is going to meet with xi jinping at some point, and would you advice the president to have that meeting sooner than later or do you think that the meeting should be held off? >> no, i think that it is important that we engage in the dialogue with china, and that the president should meet with
8:18 am
president xi at the time that they can arrange, but we should also be trying to have this dialogue at lower levels, and still high levels when you are dealing with the secretary of defense. we want to make it clear to our friends and allies, we are not seeking conflict here, and we are trying to de-escalate, and we are trying to make sure that there are hotlines in the event of accidental engagements that they don't escalate into full blown conflict. and the fact that china has rejected those efforts, obviously, it is a concerning sign. i think that we should meet jake sullivan and he has met with the counterparts, and secretary yellen has been engaged with economic conversations, and we have been very clear in the united states that we are not trying to decouple our economy from china, and we want to
