at donald trump's mar-a-lago residence drained a swimming pool that flooded a room where surveillance was finding a room where there were hundreds of classified documents. now, the u.s. attorney for the southern district of u.s., and i wanted to talk about the draining of the pool, and the timing notable, right? two months after all of the documents were handed over. for it to be more than notable, and for it to carry criminal liability, what would the prosecutors have to prove? >> they would have to prove intentionality that either the pool boy or maybe his superior told him or were aware that surveillance video was being requested by investigators and

prosecutors and that they knowingly drained the pool to essentially destroy the equipment. that is what they would have to prove that it was not coincidence or accident and willingful. >> someone meant to damage that room by draining pool. >> exactly. >> so the prosecutors have taken the cell phone from this maintenance person, and explain the significance there. >> look, there is no doubt that the prosecutors are zeroing in on not just on trump himself, but on some of the workers and some of the aides, and some of the equipment managers at mar-a-lago, and clearly, they are looking for anything they can find, any paper trail, and any text messages or any direction to this maintenance worker to, hey, let's drain the pool today and see where it goes. they are looking back in time, and was this drained before or

ever problems before? and all angles, but usually there is a paper trail with this. >> that type of person or level of employee, and why is somebody like a maintenance worker, sometimes an attractive witness in an investigation? >> yeah, that is like the pick of the litter, and that is what the prosecutors like to pick the lowest level people within a conspiracy and cooperate them up. they never really cooperate down, so they are looking for the pool guy to say, who told you do this if anyone, and maybe he is going to implicate someone, and then that person implicates someone, and up the chain that way. >> and the investigation that appears to be drawing to a close, and why is that said with a certain level of confidence and what are the signs out there? >> a couple of bread crumbs that we are picking nup news reports including that yesterday we also learned that trump lawyers came in for what is a pitch meeting essentially with the department

of justice, and the special counsel's office to essentially plead their case for why trump should not be indicted. i am curious the hear, because we have hear scatter shot defenses and some of which are internally inconsistent, but they have put their best foot forward in the two-hour meeting yesterday, and that is usually coming to the very end when they believe with near certainty or certainty that charges are going to be brought. >> i was going to ask two things, that generally those meetings come at the end, and question two, does that meeting ever work, and pitch meeting ever work and do you talk a prosecutor out of a meeting if they are convinced? >> i sat on the southern meeting in district of new york who listened to the pitch, and it did happen, and absolutely, but at this level with this case, i doubt it is going to happen. because the prosecutors have

out of this, james comer who is part tof the oversight committe said that he might have been involved in this scheme, and jamie raskin said that they looked into this, and there were no facts to corroborate this, and they have basically moved on, and so it is interesting how the two sides are kind of having different narratives of what this document entails, and i will add that the fbi is saying that it is uncorroborated document, and the allegations are unverified and it contains raw intelligence, and really something they don't want to put out there, and not in the nature to publicize these document, and they don't want to give it to the committee to have it potentially copies sent around congress. >> and considering how leaky congress is, so it is as you have covered it for so long.

and what would a contempt vote mean for the fbi director? >> well, it is interesting, because if the committee moves forward on contempt, and they are planning to do this on thursday against the fbi director christopher wray, and if it passes through the committee which they plan to do, kevin mccarthy said he will bring it for a full vote which happens next week, and if they succeed this, it is first time that a fbi director is held in contempt. the top democrat jamie raskin has said that he wants to convince as many republicans as he can to vote against this. he called it a war on law enforcement that the republicans are engaging in, and we will listen to what he had to say. >> any republican who describes himself or herself as pro law enforcement will be in a very strange position to be holding fbi director in contempt for doing his job. it is a part of a war on law

from illegitimate numbers, and we know how well that is working for us. brian chung is joining us with more. what are you learning? >> yes, kate, the message is that scam messages are on the rise, and the trade commission shows that the complaints about the text message scams are outpacing those of email, and phone scams. this is how big of a deal it is. what do they look like? often they are posing as delivery people or banks or even government agencies, and that can be problematic, because the links in the texts are easy to click on if you are duped to thinking that it is the irs coming after you for some payment or whatnot. and the scale is massive. we are talking about 225 billion

because they went and criticized him, he is going to be spending the taxpayer dollar on this, and it is like all of the vendetta stuff that we have seen before, and it is a light touch against donald trump that he has vendetta stuff against anybody who crosses him, and what this going to tell you? >> well, first of all, she is portraying desantis as a mini-me of donald trump, and she knows if she going to be winning this primary, the first person she has to take on is desantis before she even gets to donald trump. so what she is doing is showing her differences with desantis. whether it is on ukraine for example, and remember, desantis called it a territorial dispute, and she said it is an existential threat to the country, and that we need to support ukraine, and so she is taking him on directly, because she knows that he is standing in
