the breaking news this morning, stunning evidence in the hands of prosecutors obtained by cnn exclusively, an audio recording of former president trump saying that he did not classify secret information in his possession, and a special investigation leading up to the former president leading up to an indictment of a former president for the first time in history. >> and seeing where this transcript fits into the indictment of former president trump, and a seven-count indictment, and we think, and we are saying we think, because we have not seen it yet. we are watching this federal courthouse in miami to see if it is unveiled when it is released.

>> and he says that he is an innocent man, and lashing out against the charges coming, and that was last night. this morning he told fox news that of course he would be pleading not guilty. we have the historic moment covered from many angles and the exclusive angle from paula reid, and donald trump on tape with a secret document in hand, and the doj does what with that in their hands now? >> well, we know that it is a piece of evidence that the prosecutors are particularly interested in, and in fact, trump's lawyers only learned about it after they asked and the prosecutors asked the witnesses about it before the grand jury. now, before i reveal some of the details of what we exactly learned in this transcript, i want to remind people that in this meeting of the summer of 2021 at the bedminster golf club, the former president knew that he was being recorded. at the time he was in the habit of having aides record conversations with the journalists or writers working on the book, and we know that

it is highly confident, and secret, this is secret information, and look, look at this, and note that secret and coy confi fidential are two differe thing, and look, look, and he is showing something to people in the room and none of whom have security clearances and the real quote is that he asked someone, and can we declassify and he says to himself, and as president, i could have declassified, and now i can't, and incredibly important evidence for prosecutors and the most significant thing out of this information that he shsaying to this group that i have secret and highly confidential information and he knows and knowingly and willingly retained what he knows is highly confident or secret information and acknowledging the limits of his classification powers, and so he knows that it is in the hands of the prosecutors, and they have asked the witnesses about it, and at

that the law enforcement took part in and we understand that there is a threat assessment done of this federal courthouse building, and there is no credible threat of this time, and there are additional resources sent here at this time, and secret service has to be making preparations to protect the former president donald trump who they are going to protect and continue to protect because he served as president of the united states, and again, obviously running for off office. >> but even with that, it is kick off a long process to kick off the trial when something is charged with the indictment charged yesterday, and we are waiting to see what the indictment is, and what it says and when the paperwork is going to be unsealed, and then the arraignment to where donald trump is expected to come into court and plead not guilty, and he is going to discuss the terms of the release, and likely not to be held in any custody pending trial, and he would very

likely be able to move freely because of the type of case it is. then, there is a long time, there is a period of time where everyone prepares for trial and where the justice department turns over all of the evidence they have collected to the defense team called discovery, and there is also all kinds of legal arguments that set the parameters for the trial, and what evidence can come in, and what sort of law needs to be applied there, and that is going to take place, and the trial itself is going to happen, and when the trial happens is going to be a huge question coming up here, because donald trump is running for president. a lot of times, it takes a full year or more to go from charging a case to a trial. so, there is always the possibility that this trial could come after or in the heat of the election next year. so that is a really, really significant thing, and timing is everything in a lot of these cases, and then of course, once there is a trial, he may either be acquitted, and there could be

a mistrial, and if he were to be convicted, that is when appeals typically would take place, but everything is now that motion and that movement towards this hearing next tuesday where donald trump is going to be appearing in person, and then the motion and movement towards the trial itself. >> and we know this morning that donald trump has told fox news that he in his words is going to plead not guilty, and so all of those things will start to take place and take shape. the enormity and the gravity of the case, and you all are giving us all of the best case, and thank you, katelyn polantz. >> and so much to go before we get there, and including what is inside of that indictment, and the transcript of where he is showing people secret documents and saying it is unclassified. and also, the possible charges

there, and sarah murray is showing us what is possibly seven counts here? >> yes, there is some that we know and a lot that we don't. jim trusty, donald trump's former attorney, shared with cnn what is a summary of what the trumm team got, and violation of the espionage act, and falsification of records, and conspiracy as well as false statements, but again, they are getting it from a summary, thane don't have the full indictment, and the public has not seen the full indictment, and it is not unsealed. remark b remarkably, it is donald trump who shared the news of the indictment on his own social page, and we have not heard from the justice department, and we have a broad brush view but no details. we heard from donald trump's attorney last night, and this is

infor information? >> it is a remarkable report, sara. i have not heard direct reaction, but after cnn has been covering the audio transcript for some time, it is something that the team is very concerned about, and really, because it is undercutting the former president's entire argument that he can just declassify documents when he chose and if the intent is there potentially, and that he knew that he was taking classified documents, and that he still had classified documents in his possession after leaving white house, and now i have spoken to many trump aides huddling nearby behind me in bedminster at his golf club in new jersey, and they say they are formulating response, and what they are trying to portray is that they are feeling emboldened by this, and that it could give him a short term political boost, and this is what they are saying and the message they want to put out

there, but we know from other people that i have spoken to, that they have serious reservations about this, and the indictment and what it could mean for his campaign, and they pointed to the manhattan district attorney indictment where they saw a political boost, and they are hoping to have that here, and in the last 48 hours, donald trump and the team have been reaching out the the allies on capitol hill and other conservatives who support him, and defend him, and push back on this indictment, and before it came, they were circulating the talking points to use and span the airwaves defending donald trump. that is the mood right now, and also, i will add that when the first indictment came earlier this year, and now this federal indictment, and even with all of the bravado that donald trump put out, he does not want to be indicted and have this a stain

white house attorney jim schultz. sorry you can't be here in the studio, jim, and great to have you, nick. and this is coming from paula reid and the team, and what donald trump said to a group of people who had no classification in a 2021 meeting. i could have classified and now i can't, and going further with the paper, and this is secret information and look, look at this, says donald trump, and what is your reaction? >> my reaction is that the star witness in this case is donald trump. they have actually got him talking aboutt this on tape, and it is totally eviscerates any defenses that he has been putting forward. this is actually the third case that they have tapes. they have a tape in the new york district attorney's office that corroborates michael cohen. they have got a couple of tapes in the georgia case that are going to make him the star witness in that case, and so

what we are going to see is that donald trump is the star witness in three prosecutions. >> jim, what are you seeing in this new reporting coming out of what the prosecutors have in their hand. >> what do you see, jim? >> they have more or they would not have brought the case. he says they are succinctly bringing the case. and again, quoting bill barr, they offered to, and they asked for the documents back, and they asked for the documents and according to bill barr, all they did was to jerk around the justice department, and when that happens, that is when you open the door to all of the other problems that are really just former president's feet. >> nick, looking at the transcript, and look at it from the counter perspective and the defense team's strategy, if you

will. what defense do you put up if you have the president's own words presented to the jury. >> zero. you not cross-examine the tape, and the best you can do with the tape is to try and pick out ambiguities, but this is totally unambiguous, and he is making statements that cannot be explained away. what this also does is one key piece of this prosecution is going to be proving donald trump's motive as to why he kept the documents, and why he stole the documents and why he obstructed the department of justice from getting them. this is one motive proven right now that he was using them for political purposes to go after people that were attacking him. here he is going after general milley who basically said that towards the end of the term he was concerned that donald trump might be invading iran, and he was keeping his eyes on him very

closely. now what does donald trump do? he uses a classified document that was basically something that defense department does on probably any country that we have concerns about, particularly iran, where they have a plan in place in case they have to invade. so now, donald trump is trying to use that to say, well, it is not me who wanted to invade iran, it was general milley, and so using national security information for that purpose is absolutely foreboden, and the real question is if there is more to the motive. is motive spelled out in the indictment that we see in the couple of days. the information that was subpoenaed from the trump organization on seven different countries including saudi arabia is going to be interesting to see if they can show a financial motive as to why he did this. >> look, there is a lot that is not known, and there is a lot of detail from great reporting from

our colleagues is that coming out, jim, but everyone is going to wait to see what is in the indictment, and how much is in the indictment, and the process continues, but you have worked with donald trump, and you worked for donald trump for a period of time, and he did say today, that of course, he is going to plead not guilty in court. could you see him reaching any sort of plea deal, jim? >> absolutely not. i don't think that it is in his dna to reach a plea deal here, and they are not posturing themselves to reach a plea deal here, and they are reaching out to allies in congress here to build their army if you will to fight this in the public view, so there is not a plea deal in near sight if ever, and he is not posturing for that in any shape or form, and he is willing to fight on and go to the nomination for president and seek the presidency. >> so we will wait for that

you are looking at live pictures of air force one at joint base andrews and president biden has departed the white house and he is on his way to joint base andrews where he going the leave for north carolina, and the reason that we are watching this very closely is that it is going to be the first chance to see if president biden is going to comment on the indictment against former president trump. this is the first public appearance since word of that indictment became public. president biden has assiduously avoided commenting on the investigation into president trump, and so it would be unusual, but rest assured the reporters there, and rest assured they are there, will try to get comment from president biden. we will go back there in a moment. earlier, cnn broke news of a

tweeted in his defense including speaker of the house kevin mccarthy showing divide of the upper ranks of the republican w to deal with donald trump. mccarthy rushing toiz h defense last night indicating that they plan to use the power of the house the go after the justice department saying in a tweet that it is unconscionable to indict a opposing candidate. and he said that i, and every american who believes in the rule of law stand with president trump against this grave injustice, and the house of representatives will hold the department of justice accountable. and it was actually the trump's own attorneys that it is broader than that, because it is involving obstruction of justice, and other charges aside

from the handling of documents, and we have not seen the charges at all, and even as the republicans are vowing to go after the justice department, it is unclear exactly what they mean by that, and if they are going to be using subpoena power to go after the special counsel, but there are some republicans who are speaking out against donald trump, and namely the critics like senator mitt romney who issued a statement saying that by all appearances he says that the justice department has exercised due care. he said that it afforded donald trump the time and opportunity to avoid the charges that would generally have been not afforded to others. he adds that the allegations are serious, and if proven, they would be consistent with the other action offensive to the national interests. and so it is going to show you the divide that continues within the republican party. we will see how the members speak when they return to congress next week, and we will be asking questions of what they plan to do next and respond.

candidate asa hutchinson from arkansas who said that he believed that the president should step aside, and this reaffirms donald trump to respect the office and end his campaign. and that is the most explicit, and the only call for him to end the campaign that we have heard. we heard from former new jersey governor chris christie say that no one is above the law, and that is how we are seeing this indictment play out in this field. >> we are also joined by republican strategist doug heye, and thank you for joining us on this eventful day, and what does this do to the 2022 presidential race, and we are in the middle of the campaign for the primary? >> i don't think that we know yet, but this weekend is going to be interesting as we see donald trump, mike pence and ron desantis all in greensboro, north carolina, addressing the republican convention there
