any moment now, former president trump will be wheels up from miami where he is set to face a federal judge on dozens of charges. law enforcement outside of that miami courthouse they are ratcheting up security ahead of donald trump's arrest. and now, other people

traveling with the president at this very moment, and why donald trump has kept this one aide so close to his side for the last few days. this is cnn "news central." any moment now, we are expected to see president trump for the first time today as he is leaving his golf club in new bedford, new jersey, and tomorrow, a remarkable moment in u.s. history is going to unfold. the first ever arraignment of a former president in federal court. we are learning that he is set to fly alongside a man that he is charged with, his aide, and who is also seen hitting the campaign trail with him this weekend and now they are heading to federal court together. right now, we will go to kristen ho holmes who is in new bedford,

new jersey. any signs of movement? >> rahel, no movement yet, and we are keeping a close eye, and yes, we expect him to leave now, but as we know the former president runs late, and what we have learned about walt nauta, and we have seen him all weekend, and walt was by his side and has been for months and if not years, and what is important to note about this, there are questions as to whether or not nauta would continue to stay by trump after they were both indicted. and would he cooperate in some ways with the department of justice, but it appears he is staying by the former president, and traveling with him as he said, and what we do know is when he lands in florida, he is going to doral resort, and the political team will be there to meet with him, and suzy wile his campaign manager, and others, his lawyers, who are trying to beef up the florida-based team. two of the lawyers resigned, and

he is looking for lawyers who are barred there who can help with the case. again, the big thing here is that trump is still a 2024 presidential candidate. what is clear to me when i am talking to the advisers and talking to republicans is that the legal issues are looming large over the republican party and the former president himself, and he said over the weekend that he didn't want to be indicted. we have reported that from advisers and allies who have heard him say that, but he has never said it that in a interview, but that is how much the top of mind it is in this third presidential bid. >> thank you, kristen holmes as we will go to you for any reported sightings. and this is from donald trump's bedminster estate, and you are seeing the people milling about and shortly, we do expect to see donald trump getting into the suv. we also expect to see his aide

walt nauta also listed in the indictment who is going to be traveling with donald trump today, and again, this is new jersey. they are headed to florida where tomorrow donald trump will surrender at a federal courthouse where we have seen security getting tighter over the last several minutes. and katelyn polantz is standing by at that courthouse in miami, and why don't you tell us what you are seeing. >> john, right now, we are seeing some more law enforcement patrolling around the outside of the courthouse, and there is a lot of people here. we are in downtown miami, and so that is to be expected. there is traffic around here. we have a federal complex around this courthouse, a detention center, and other court-related buildings, so there is a lot of questions of exactly how far the caution tape is going to spread, if you can see that behind me. what we are going to be turning to is a relatively short and procedural thing for donald trump in court. it is a significant moment,

because it does mark the start of this case, the arrest under federal charges of the former president of the united states for willfully retaining classified records trying to obstruct that justice department investigation, but in court, it could be a short proceeding, and not a lot of pictures and actually, no still photography or still recordings in court there. he is going to be before the magistrate judge, and answering the 37 charges, and also charged with co-defendant walt nauta and they will enter the initial plea of not guilty, and the magistrate judge goes on his way, and then aileen canon then ta takes over, the trump-appointed

judge. >> and we won't see any of this in realtime, is that true? >> we are still working on the details of exactly how much communication we will have from inside of the building in real time, but you won't see much in federal court. that is just how it goes. there were some restrictions loosened in covid, but no audio or video or broadcasting or recording or photography inside of a federal courthouse. it is really a place to observe the solemnity of the justice system, and it is a place where you observe it. the defendant is talked through exactly what is going on, and his lawyers will be telling him what to say. it is a very controlled environment. there is going to be a court sketch artist there though, so we will be able to see donald trump illustrated, john. >> of course, we will have the best reporting in the world including from you to find out as many of the details as we can about what takes place, and the key decisions of what will be

made. again, watching bedminster, new jersey. thank you, katelyn. and donald trump is about to get into one of the suvs and take a 30-minute drive to liberty airport where he is going to take off for miami shortly. >> and trump's opponents for the republican nomination are weighing in on the indictment and others are weighing in like asa hutchinson who says we don't need a commander in chief who disregards the nation's secrets and governor christy christie w will appear on a town hall tonight said this. >> is this the type of country who wants the conduct of a president of the united states. the facts laid out here are damning in terms of donald trump's conduct. that's what i think that we as a party should be looking at.

>> and a little bit less critical former governor of south carolina nikki haley called it prosecutorial overreach, but it is time to move beyond the distractions. and governor of north dakota bergum called it a distraction. actually, i wanted to go to the pictures where he is going to be making flight from new jersey to miami where he is going to be answering the charges and traveling with his former aide and now co-defendant walt nauta, but if you are watching the screen, you are watching former president trump in that suv at the bedminster golf estate headed to the airport as john berman just said about 30

minutes away from where we are looking at traveling to the airport in newark, and he is with the former aide walt nauta who is now a co-defendant to go to miami to face the formal charges. sara, a lot to watch here, but as you are watching president trump on the move. >> it is a historic move and sort of everything from the indictment is historic, because it has never happened before when it is coming to federal charges and an indictment against a former president. that is why we are watching this so closely as he makes his way to the airport and then from there he will fly into miami. i want to bring in jen rogers who is a former prosecutor who can give you some idea that he is driving right now to airport which will eventually land him in miami. he is facing 37 federal charges, along with the person that we

think is with him, walt nauta, who is also charged in the case, and facing far fewer charges, but still very, very important and strong charges. you have said about the indictment that every american should read it. why? >> well, it is extremely well done. it is very clearly and concisely written, and so you read it, and sometimes the indictments are full of legalese, but it is setting out and sets out what sets out here, and he takes the documents and then asked for them, and then he refuses and then he hides them, and it goes back and forth and anyone who ed -- who reads them will understand what happens here. >> and so a conspiracy is two people involved, and so did he have to have him to put forth the conspiracy charges? >> no, it has to be two, but the

second person does not have to be charged. >> i wanted to talk about what is in the indictment, and donald trump in the sort of the motorcade leaving bedminster, new jersey, heading to the airport where he is going to be in a plane and eventually landing in miami, florida, where he is going to be arraigned tomorrow morning and going to meet with his attorneys in miami and i wanted to talk about one of the details, because one of the details in this has to do with his attorneys and former attorneys, and he is throughout this indictment, and how unusual to see an attorney talking about their client to clearly the justice department, and sort of issue of the attorney/client issue. >> that is why it is unusual, because usually the attorneys cannot speak about the conversations that are confidential, and in this case, the attorneys went to the court, and said, it is part of the crime, and these communications were used as part of the crime

as criminal activity and therefore they were able to pierce the privilege and force evan corcoran to turn over the notes and it was a treasure trove to the prosecution, and we don't know what he said to the grand jury, but what he turned over in voice memos and notes after meeting with the president lays it out there this scheme to obstruct justice that donald trump was doing with walt nauta trying to pull one over on evan corcoran and the fbi. >> and in there he is talking about the fact that he signed something or indicates in the indictment that he signed something that ended up being false, and it was not true, and so i am sure there was a moment of, he could also be liable, correct, if he was doing this at the behest of donald trump, he could be charged in the case, too, unless he comes forward -- >> well, if corcoran entered conspiracy, and knew what he was

doing, and that the object was to do something illegal, and i think that maybe that is why he was making careful notes and memos to protect himself in the event that what happened did actually happen. >> he is a lawyer after all. and talk about walt nauta, a u.s. navy veteran from guam, and he is on the indictment with trump, and not two separate indictments, and what are the prosecutors doing with him? you are watching donald trump's motorcade going to the airport there, and he is heading towards newark and leaving new bed bedminster, and going to miami where he will answer to count, and i wanted to talk about walt nauta and if the prosecution will continue to come after him to see if he will flip. >> i think they will, because they wanted to make him into a witness in the first instance,

and he lied to them, but he would still be a valuable witness, because donald trump does not famously text or email, but he has one-on-one conversations in person, and walt nauta is the person with whom he was conspiring to moving the boxes back and forth and trying to keep them away from evan corcoran and the authorities, and those conversations would be valuable to v anhave, and they will have with the chance to come on board with the chance of leniency. we will see if he does or doesn't. >> and now we have read the 49-page indictment, and very detailed and a very strong time line, and it is an easy read actually. the judge is canon who was appointed by trump in 2022, and in the initial raid, if you will or the going into mar-a-lago, and he called it a raid, and it was not, because they told him that they were coming, but as

they went to search mar-a-lago, there was a legal battle, and she sided with trump's team with that battle, and what impact might she make in this case, because that was overturned by an appellant court? >> yeah, my concerns about aileen cannon is that she exercised jurisdiction over something that ultimately the appellant court said she shouldn't have taken in the first place, and she appointed a special master unnecessarily, and she then ruled against the special master, and she was slapped down hard by the appellant court, and the problem is bias here, and the problem is that it is very hard to remove her. so the prosecutors are thinking of doing is to wait for some sort of ruling that is going against them, and they can appeal to the 11th circuit, and say that she has bias and ought to be removed and the other concern is that she may slow walk it. instead of waiting for the

ruling, and push it out, and saying that the trial schedule won't accommodate it, and if it is beyond the election, then trump may dismiss it if he wins. >> and there is a tight, tight time line to put the case forward. >> you are looking at the live pictures of donald trump and the motorcade heading from the golf estate in bedminster, new jersey, and that is me and the picture right there of donald trump's motorcade heading through newark, and summit and melbourne, and lovely there, i might add, but i doubt that donald trump is getting a good look at the scenery right there, because he is planning and involved now in planning his defense. that is why i wanted to bring in katelyn polantz who is in florida for us right now. katelyn, give us a sense of today, because donald trump heading to florida right now, and it is important because he

is going to meet with his lawyers and some of them new lawyers in florida to get ducks in the row for what is an important defense effort. katelyn polantz, are you there? we do not have katelyn polantz. jennifer rogerogers, why don't tell me about the meetings that need to take place between donald trump and his attorneys to get straight between now and tomorrow morning? >> well, it is not much, because it is a formal proceeding to have the arraignments and the enter of the guilty or not guilty, and set a time line, and not a lot to discuss, but it is a complicated case, and we have classified protection act is involved and motion schedule coming up, and starting right now, and not necessarily the afternoon tomorrow, but soon, they will have to dig into what their defenses might be, and what motions they need to make,

and when classified information is involved, it is a little bit more complicated. >> and he has new attorneys, and jim trusty cycled out last week, and he has new lawyer, and do we know who they are, and how long does it take to get ramped up for a case like this? >> well, you have to remember that most people don't know that they are indicted until they are actually arrested. so it is common for most lawyers to know until they are indicted. one of the lawyers has been on the case todd blanch, a former colleague of mine from the southern district, and he will want some on the case who know the lawyers and the judge, and he will want experts in classifying the case, and todd didn't do that type of case in the southern district. >> that is a big thing to not have done work in before if this whole thing is about that? >> well, todd was a gangs

prosecutor, and he is very experienced in trial work, and it is pretty much the same thing, and he is still going to want to have people on the case who have done national defense work, and classified documents, and so he is going to be expanding the team, i am sure. >> and now i want to bring in kristen holmes who we have been speaking with throughout the morning. what you seeing? >> yes, we saw him leave and he went right by us, the entire motorcade and all of the security with him. as we have been reporting, he is expected to travel with the aide that he is indicted alongside, walt nauta, and the political team will be meeting him in miami, and all at the doral resort as they talk through the legal strategy, and what this looks like. again, it is a historic moment, and we said it when we were standing there, and i was standing there in west palm beach when he left the

mar-a-lago club in manhattan for that indictment. and it is still historic to be the only president who has been indicted twice. talking to the aides and advisers he is defiant and ready to fight this. the big question is if people are ready to get on board and stand by him. in the past, the republican party and the allies have rallied around them, but there are starting to be breaks in the faction, and that is what i am hearing from multiple allies that are a little bit concerned that if the legal conticerns continue to mount, the legal battles, it is hard for trump to be electable in 2024, but as of now, they are ready to fight it. he is saying that he is not taking any sort of plea deal, and he is pleading not guilty when he gets into the courtroom, and they are focused on the politicsf this right now. >> kristen, you have reporting of the trump team reaching ut to attorneys, and they have not

decided correct on the attorneys in florida yet, have they? >> that's right. so they are looking for the florida-based attorney, and someone who is barred there, and as we know lindsay halogen is barred there, and she could do the front work, but it is still worked out right now. and now, chris kies who is part of the trump team, he is barred in florida, and he has been doing a lot of the reach out, and talking to the florida firms and gauging the interest in who would be willing to represent the former president, and who is out there. and we have reporting that some florida firms have been reaching out to trump. now, the big thing here is that this is obviously a huge federal case. so they are looking for a heavy hitter. they need somebody who has experience dealing with the department of justice, and it is just unclear who exactly they are talking to, and whether or not they have lined anybody up

who has that criteria. >> kristen, again, we are watching this motorcade as it is heading to the newark airport from donald trump's bedminster golf estate, and somewhere in there alongside him is walt nauta who is also listed in the indictment. i wanted to pick up on one thing that you said there, there are beginning to b as e, as you detd there, cracks in the trump world, and how are these cracks coming in the political world. are we talking about people tr tr tr tr tangentially and who are they? >> i want to say not to top advisers and they say that he

did nothing wrong and defiant, but this is larger picture that we are talking about, some of the allies and who they lean on to go out there on the airwaves and go out there to support the former president. it is not quite a divide in any way that i am seeing now, and it is not as though people have turned on him, but it is feeling more as though a wait and see kind of mentality. what is this going to look like. one of the things they, the republicans that i am talking to say who is actually electable in a general election, and obviously, concern for years if trump could win a general election, particularly since he lost the general election in 2020 is now amplified, because when you are looking at the legal problem after legal problem and indictment after indictment, and is this too much for the american people. that is what i am told by the republicans, and something that they are taking into consideration, and they are people who do support the president, and they are people

who like to see him be president again, and they are concerned about the legal cloud over him. >> and this is a really big case, and in this particular case, and this is involving quite a bit of potential jail time, and for that team to be thinking about as he is running for president. and i wanted to go to katelyn polantz outside of miami, the courthouse there, and eventually trump is going to land this afternoon, but the big deal happens the next day for the public. he is going in and he will be arraigned in court. can you give us some sense, caitlyn of what is going to happen, the timing of all of this? >> sure. so, these sorts of court appearances, the initial appearances, they are quite procedural and quite quick. there is not a lot of discussion or arguments or legal decisions that have to be made there. they are before a magistrate

judge, and so not even the judge that will shepperd the case to trial, and with this expectation with donald trump, there is quite a bit of security around the courthouse, and the plans for him to get into the courthouse securely with the co-defendant, that is in the works, and planning around that, but when he gets into the courtroom, it is he, him, the lawyers and the public, who is allowed watch, and the defenders, and go through what he is going to be charged with or go through in detail or just read, obstruction of justy, and willful detention of national information, and do you understand what you are charged with, so on, so forth, and then he is going to say that you can enter a plea. that is when donald trump and his co-defendant will enter the plea of not guilty, and then that is going to kick off the rest of the proceedings, and there is timing to talk about and when do they start to see

♪ welcome back to the breaking coverage. you are watching president trump's motorcade as he makes his way from the bedminster golf tournament to where he is going to go to miami to face charges and arraignment. i will bring in carlos suarez who is outside of the court in miami. carlos, as we know the security there is already taking precautions to try to take precautions to make sure it goes off safely and barricades have been put up. what else are you seeing?

>> yeah, that is exactly right, rahel. we are on the west side of the federal courthouse where it is quite clear in the last couple of hours that law enforcement is starting to make the necessary preparations ahead of the president's appearance in federal court here on tuesday. the federal protective service here is among the group here that is in channel of making sure that the courthouse is remaining safe. earlier today, we saw them put out yellow tape and trying to close off a part of the courthouse, and they have put up the barricades around the perimeter of the building and now the city of miami, and the miami police department is expected to detail the safety and security plan at a news conference here in downtown miami at 2:00 this afternoon. we are told that the chief of police for the city of miami is going to give us a better sense of how many officers they plan on having out here. the mayor of miami is going to be talking about the preparations they are going to have for any of the supporters

of the president, the former president who might show up to this location. it is still unclear at this hour exactly where all of these people might be put ahead of the president's arrival here later today. we have seen some of the trump supporters walking around the property, holding up signs, and they have the make america great again hats on, and the rain has pushed folks out, and not a whole lot of coverings out here, and this part of miami, i will say it is quite known for the security, because there are a number of federal buildings here. you have the brand-new federal courthouse building and across the street is the old courthouse, and the federal attorney's office is there, and the detention center, and a lot of the security that we saw going into today is something that you would expect considering going into the building is quite clear from what we are seeing right here on the ground is that a lot of law

enforcement personnel are moving into place, and they are starting to get a lot of more folks in anticipation of the crowds that we may see tomorrow. guys? >> all right. carlos suarez live in miami. thank you. joining us now is the cnn chief law enforcement intelligence officer jen rodgers and you have reporting on the expectations in miami. >> sorry, i was talking to manny morales, the chief of police for miami p.d., and i have known him for a long time, and he is the chief of police, and he says all hands on deck, and they have 1,400 cops and everybody who working today and tomorrow will have a role in this, and whether it is answering the calls for the rest of the city and the large group for this. and he says that they are ready to surge. they have the help from miami-dade county, and they also have 34 towns in that area where

they have mous with that, and they can get them to contribute. what he is talking about is that they are prepared for the crowd, and he said that they are going to be using up to 5,000, and he said -- >> is that big? it feels big. >> and that is the high end of the number, and that is what they are building towards, and i don't see it going past that, and he has not seen any considerable threats, and he said, we have had this before and dealt with it, and they are a city used to major events, and so they are confident about, you know, getting him motorcaded from one end to another, and into and out of the building, and when he leaves, they expect him to go back to the airport and get on the plane for bedminster, and so they have been preparing for this obviously since late last week. >> all right. i have a question for you jennifer rodgers. in order for donald trump to appear in court for the

arraignment, he has to have local counsel, and somebody on the bar or can add one of his attorneys. if he is unable, and so far we know that he has not made that decision, and the decision has not been made, and if he is unable to get that attorney in florida, does the arraignment still happen, because the arrest could? >> yes, of course, it will happen, and they could waive the requirement for the day for todd blanch to appear and do the paperwork later and i would not worry about that from stopping the arraignment. >> so for all intents and purposes he has attorneys to go forward and whether or not they have the florida attorney that they are struggling to get. >> yes. that is right. >> and jennifer, it might be helpful to understand that one of the things that we have heard from one of the former president's supporters is what about this person, pence or biden, and does this theory that if in fact he did do this, it was not just me, is that is going to hold up in court or admissible?

>> no, it is not that defense, and like in traffic court, i was speeding, but i was going with the flow of traffic, and so you cannot point the other people that it was okay that i broke the law because other people were, too. >> and now, back to security, you mentioned that they don't have any specific threats in miami at least according to the chief that you spoke to, and what about overall chatter and the comments made to republicans in congress who have said things like this is war. >> they are aware of that, and aware of the online comments more vitriolic like "time to load the magazines" and "this is civil war" and things like that, but it is not a specific credible threat of the specific event, but on the other hand, the intel teams are tracking the people like proud boys and other groups to figure out if people who have been part of the disorder before, are they going

to play such a role in the events tomorrow, and, you know, they are confident that they have a handle on it. >> handle on it in terms of what kind of chatter is happening within the groups, and what are they detecting in terms of an effort maybe? >> i think that what they are seeing is what we are seeing in the online forums, and that is vitriol, and that is history, because we are seeing the same chatter on the day of the new york indictment, and all kinds of threats and so on, but nothing occurred. there is two kinds of things to factor in, what is going to happen with the crowd, and that is where they have invested a lot of effort, but then the wild card which is of course that lone wolf who is taking the chatter differently as more than chatter, and they may act on it. that is something that you face in anything like this, in the threat world. >> all right. john miller, jennifer rodgers, thank you both for being with us. stick with us, because it is still happening, and still the

and sources in miami, but they have concerns about system of the security outside, and some of the crowds that we may see outside of the courthouse. through all of the experience, and walk me through what law enforcement is keeping track of and watching and what to do once they start to have these concerns, what they they do? >> the miami pd and the intelligence people are talking to the miami-dade intelligence people talking to the fbi intelligence people, and passing the information back and forth and who is hearing what, and they are obviously looking online to social media, but also pinging out to human sources people that they have had in other cases, and people that they have relationships with as confidential informants saying keep your ear to the ground, and what are you hearing. what their concern is that they will have a large number of people, and the other concern is we missing something. >> hang on. you are looking at live pictures of newark liberty airport, and

welcome back to cnn. this is special live coverage of the former president of the united states now on board his plane where shortly he will take off and head to florida. tomorrow he will surrender to federal authorities. he will be under federal arrest, donald trump, charged with the willful retention of national security documents, obstruction of justice, directing false statements to be made, a whole range, dozens of charges there. with us now, cnn legal analyst jennifer rogers and chief intelligence and security analyst john miller. i want to bring our audience up to speed with what we've been doing here which is you've been going through the federal processing documents that in theory donald trump, who will be in custody tomorrow, will have to help fill out. just read some of the questions that will have to be answered. >> well, it's, you know, very

extensive. but it goes through basic things, any injuries, medical ailments post-op recovery, psychiatric/emotionally disturbed, a checklist. but you get down to security cautions, current or former military, current or former law enforcement person, current or former intelligence officer, meaning do we have to be careful of this prisoner because, you know, they might have access to secrets. of course this is for people, you know, this part of the form is for people who are going to be remanded which we don't expect with president trump. but it's interesting that they're going to have to check all of these boxes, kind of going down to complete the form. >> you talked about one of the things that's been asked which is have you been arrested, that would have to be checked yes. what about some of the other things that you were mentioning that potentially he'd have to answer like have you threatened -- >> made threats to witnesses or prosecutors. >> or prosecutors. >> there's a section here, are you a gang member?

have there been threats made to witnesses, prosecutors, so on and so forth. are you the leader of any organization? you know, there have been a lot of statements made that the question is does that constitute a threat. but they'll get through the form. >> right. >> and i don't want to make more or less of it. it's just -- it's interesting reading it because to a normal federal defendant, this is all routine. when you're talking to a former president of the united states, having to check all these boxes you might have to pause on a couple of them. it's at best awkward. and -- >> so much has been so historic about all of this, as you point out. we don't have a lot of time left. but one thing we've been watching closely is was walt nauta, is walt nauta with the president. jennifer, if i could quickly have you say the reason why there's so much attention on walt nauta is the question of could prosecutors get him to flip on trump, which at this point it doesn't appear that they have. but certainly something that they may try to revisit.

>> they're trying to make him into witness number one. conversation, we know they occurred because of phone conversations between trump and nauta around the conspiracy of hiding evidence, moving boxes of documents, having the former president review them and approximately out what he wants and put them in the storage room before the lawyer's going to see what's there, pursuant to the subpoena. they want that testimony. and not only that, we have to remember walt nauta is the body man. he's around the president for the past however many years. so if you get him on board, he's not just going to be witness number one in this documents case, he can tell you all about what happened after the election leading up to january 6th and a whole lot more. so he is someone they really, really want. they took a shot at him before, and i think they'll take another shot for sure. >> until the trial comes, they'll be going for him. thank you so much, jennifer rogers, thank you so much, john miller, for being here with us. again, remember, trump is on his way -- on the plane and going to be on his way to miami. stick around for the premiere of "inside politics" now with dana bash. that's next.
