guilty to the 37 felony counts that he faces. federal prosecutors say he illegally kept documents containing some of the nation's most sensitive secrets including america's nuclear program, and they allege that trump kept them in places like a bathroom, a shower, and his bedroom. >> the former president has called on his supporters to come out and protest peacefully, security, though, has been ramped up, and miami's police chief says the city is ready for this unprecedented moment in american history. we are too. we have team coverage with the expert analysis and correspondents on the ground in south florida, randi kaye is outside doral, sara murray, josh campbell, laura coates, john miller all with us here in studio, and carlos suarez and katelyn polantz are live outside the courthouse. we want to start with randi kaye in doral where trump is getting ready for that arraignment. the former president seemed at least in the exclusive video cnn got, a little bit upbeat yesterday. what's your sense of things right now? >> reporter: yeah, absolutely, phil, he was -- he arrived at

the doral resort here behind us at about 3:30 in the afternoon. he seemed a little bit somber earlier in the day, just quickly waved to supporters before disappearing with his son eric and some of his legal team. then later at about 7:00 p.m. we have video of him when he came down to the lobby last night to go to dinner at the main restaurant, he seemed much more upbeat, cheery, people were yelling to him. some of his supporters were in the lobby yelling we support you. you're going to win. we're behind you. he gave a thumbs up and then went inside and stopped to take some pictures with people who had requested that in the restaurant where he later kind with his son eric and some of his legal team for a couple hours. he had some supporters inside. the mood seemed to be pretty upbeat considering what an important day it is for him today. there were also many supporters outside. they were clashing with some of the protesters, police had to separate them at times. there was even one man dressed in a prison jumpsuit carrying a ball and chain. but here is what some of his supporters had to say out here.

>> i think it's absolute tyranny. that's what it is out here is tyranny. that's what we're seeing from the biden system and from the doj, just keeps getting worse. >> we don't even care if he's going to be in jail, and we have to write him in. you know to, to a lot of us, it like trump or nothing. we're not even looking at desantis as a second option. we're not looking at anybody else as a second option. >> reporter: so the former president is waking up here at his doral resort. there is plenty of security, sharp shooters, you name it, lots of security at the premise and outside the gates. he's expected to leave about 1:30 this afternoon. it's about a 20 minute drive to the federal courthouse. of course there will be plenty of security there, one major concern is any type of call to action. they certainly don't want another january 6th on their hands so they're taking all precautions not only here at doral, phil, but also at that miami federal courthouse.

>> carlos suarez is outside that federal courthouse in miami. what can you tell us about how prepared they are? we don't see crowds behind you, i know we're eight hours away, but so far. >> reporter: yeah, that's exactly right, poppy. we're about seven or eight hours away from the former president showing up to the federal courthouse here in downtown miami, and it is safe to say that at this hour there are more members of the media out here than there are members of law enforcement. it is our understanding that the security posture out here really has not changed much in about 24 hours since these plastic barricades and some of this yellow tape went up. there were some thinking perhaps overnight, we might have seen some metal barriers as well as additional law enforcement coming out to patrol the perimeter of this courthouse. instead, really the only thing that we have seen are a few of these federal protective service police members. now these folks, they're the ones that are really in charge

of the security inside of the federal courthouse. the chief of police yesterday for the miami police department said, look, we have enough resources for crowds of up to 50,000 people. we have enough officers that we believe we're going to be able to keep everyone safe. there is some concern going into today that law enforcement at least on the perimeter of this courthouse may not be ready for just the number of folks that may show up out here. yesterday the chief along with the mayor of miami, they had a news conference where they detailed some of their security plans. they kept them pretty vague. they didn't want to get into specifics. here now is an exchange that the chief of police had with my colleague shimon prokupecz. >> we've been hearing from people in the building around that area that they're concerned that there's no hardening around the area, the perimeter, and that people can just freely come and go. there's yellow tape right now that's been placed. will that change? because there is a lot of concern that people may try to

storm the building or try to enter some of that area. are you going to harden that area? >> what i can tell you is tell them there's no reason to fear. >> reporter: and at least one other concern at this hour is that the miami police department has not decided whether the trump supporters as well as folks that are going to come out here to protest the former president, whether they are going to be kept in separate places outside of this courthouse, guys. >> all right, keep checking in with carlos. i want to bring back in our experts, cnn chief legal analyst laura coates along with cnn intelligence analysis, john miller, sara murray, josh campbell are back with us. john, what's going on behind the scenes that we're not seeing? i assume there's more happening. >> what they're scanning for is threats. the crowd outside the courthouse, these rallies have been called for 10:00 a.m. and noon, on the idea that you've got a 3:00 hearing. they're going to want those

crowds to build from there, and you know, they're coming from different places. but in the background infusion centers and the miami p.d. intelligence division in the 34 towns there and the fbi writ wider for the nation, they're all scanning in social media, in human sources, confidential informants to say is there someone planning something? because we've been down this road before just after the search warrant in mar-a-lago, a man with a semiautomatic rifle opened fire on an fbi office. so you're looking for those tells. and all those wheels are turning. >> i think, josh, something we need to pay attention to and you focus on this a lot is sort of what this means for national security, even though these documents eventually got back to the government, although we don't know about the iran document from the bedminster audio recording. no one seems to be able to locate that. there's still a lot of potential national harm here. >> it does, it reverberates.

obviously the fbi worked to get those documents back. there's still a question whether all of the documents are back within the custody of the united states government, but this reverberation that i continue to hear from folks that work national security, it's not just what the former president is alleged to have done with those documents, but the message that it sends to our allies overseas. you know, when john and i worked in the fbi, some of our closest partners were the brits, the aussies, the new zealanders. and that relationship is built on that trust that you share information. in fact, in the last decade, the fbi has basically leaned towards sharing -- unless you have a reason not to with those nations, and so there's question, if they were to be sloppily handled here in the united states even by a president or a frm ormer presid, that's a question. what concerns me is when it comes down to potential informants around the world that are watching this. john and i worked a lot of these intelligence issues. when you're sitting down trying to recruit an informant, that relationship is based on trust. these people are giving up

potentially their livelihood, sometimes their lives. if they believe for a moment that sharing information with the government, working with the u.s. intelligence community could lead to them being exposed, they may be more hes hesitant. some of this is unknowable. i think these consequents reverberate far beyond these documents. >> i think you have to get beyond the theory into the reality of it. you have two chinese nationals, two who were arrested and charged for trespassing at mar-a-lago who came in and were taking -- >> during this time frame. >> yes. who were arrested for trespassing, but they came in, they were wandering around. they were taking pictures. they had cover stories about why they were really there that unra unraveled. so when you look at the idea that, you know, to penetrate the world where you can obtain highly classified information requires an awful lot of work, unless you figure out that, you know, secrets are lying around a private club and all you need to do is either get a job there among the 150 employees, you know, in different low level

jobs, or wander around until you find the boxes in the ballroom. it's just -- for people who have lived in the classified world and you have to jump through the hoops to meet those requirements, it's bizarre. >> and notwithstanding the speaker's comments that bathrooms have locks on them, those who work in national security know there are these sensitive compartmented facilities that are lead lined. >> scifs. >> you have to swipe your way in to prevent what john is saying, that information getting into the wrong hands. >> yeah, and our team has reported that. you know, once you're in mar-a-lago, there's nothing to stop you from wandering around. >> you have the run of the place. >> you can go into the ballroom. if you're a person who happened to stumble into the ballroom when those boxes were in there, there's nothing to stop you going wild. >> i mean people look in medicine cabinets why not the boxes as well. >> that's a whole thing, it might be a thing that's happening, next to the shower. >> yeah, these photos -- >> the layout, it shows you, there are nosey people all over the place. >> i like the knocked over box

with the documents supplayed across the floor. >> you know who didn't like it, jack smith, we didn't hear a lot from him, the indictment speaks volumes, the report that will come to the attorney general about the prosecution and the declination of decisions will be in there. he focused on the idea of it wasn't just the dissemination, it need not be dissemination. compare that to of course the massachusetts air national guardsman where the discord disclosure for bragging rights, so to speak was everything. this didn't have that same implications. why? because we don't know to what extent it's been viewed already. we don't know who's seen it. we don't know the diplomatic relations that have been targeted and we also don't know what they were being used for or why they were there, a very benign explanation could be i wanted to have my bragging rights. a very nefarious one could be i wanted to shape a political narrative or i wanted to sell the information in some way. i don't know what the reason is. but the elements of the crime need not have anyone even prove

florida attorneys? >> reporter: well, poppy, everybody is getting ready for this case to be here, to stay here in the southern district of florida whether it's at the miami courthouse or it's at a different courthouse in this district, maybe west palm beach or force pierce where judge cannon sits. and what is happening is that donald trump needs some lawyers who know this court really well. he has a couple of people on his team who are able to practice law in florida, but he has been marred by departures of lawyers on his team pretty regularly over the course of the many investigations he's been under over the past five or so years, and then even recently some of the lawyers that shepherded this through, the investigation that we're around him and knowing every step of what was happening, they've all departed the legal team or have to be such as his defense attorney evan corcoran who still is representing him but has become an actual witness in this case. he has somebody coming that is managing his legal team right

now, but our understanding is they're completely trying to find others. and it is a question for us as well as these roosters crowing behind me of who exactly will show up in court today with donald trump. >> we did not miss the roosters. >> this is a real thing. there's like a rooster that's just like hanging out around the courthouse, is that correct? >> reporter: oh, we've got a flock. >> that's great. so if you hear -- i'm just telling, people who are watching if you wonder why it sounds like there's constantly a rooster behind katelyn, that is not a sound effect. katelyn's reporting is wonderful. special counsel jack smith has vowed to seek a speedy trial. the ultimate decision about that timing, evidence, and jury lies with the presiding judge, aileen cannon. laura coates is taking a closer look at the judge's power in this case. there's a lot of discussion

about the judge. how much can her decisions make or break what's happening in the months ahead? >> you might remember this judge because this is somebody who assigned that special master to look at the documents initially, got smacked down by the 11th circuit as well. so a little bit of information about it. she has a very big influence. one of the biggest ways she will is in terms of scheduling. a trial date will need to be set, of course, in this case you also have a motion scheduled. which means the things that you write to the court to decide what evidence is going to come in, what kind of arguments you want to have before the jury gets in and also consideration of timing of other trump cases. we already know that he is now a twice indicted former president, including one of a state trial proce proceeding as well. also, she'll have a very big role in the jury selection. we're talking about the court of public opinion so far, but remember, you have to actually impanel a jury through what they call voir dire, actual notions of it. how many strikes do you get to

figure out who gets out and who gets on that jury. also, the questioning, they're going to have to figure out what questions to ask. remember cases like the derek chauvin trial to name one example, this is a very, very well-known case right now, so impartiality will be the goal, and how you establish that will be very key. also, what if there's a hung jury or a declaration of a mistrial, that comes if a judge decides that, look, i'm going to be pretty trigger friendly in terms of the idea of not enough time to debate or deliberate, i'm going to go with the mistrial or not, that's very, very telling. also, a huge role in terms of the evidence. remember that? it's about whether you qualify or disqualify a witness or an expert. also about what's going to come in in your evidence. this person right here, of course, evan corcoran, this is the former attorney who had the attorney/client privilege pierce which allowed him to testify in front of the grand jury about his contemporaneously written notes or recorded notes. will that actually come in and

have the jury, a trial jury hear it, very, very different. also, you know the whole sustain, overruled, objections are not just tv courtroom drama. they have a very, very big role in what she might do with those for a mer tore yus objection or otherwise is key. you could have a directed verdict, which makes the jury superfluous, look, you got it wrong, here's my directed verdict instead. look at the timing of it, we're talking about in august the first republican debates. this date right here, the 22nd, is the date of that speedy trial where you say within 70 days of indictment. remember jack smith said we're going to have a speedy trial. that's your right as a defendant to actually have that. will they actually be ready by this point in time? that's a very, very quick turn around, even for a misdemeanor case let alone this one, everyone. look ahead, january got the iowa

caucuses. likely to have the first republican primaries, very important to somebody who is now the front runner in that particular thing. march 5th, super tuesday, the 25th of march, the manhattan d.a.'s indictment trial. a defendant has every right to prepare for trial, so a judge is not going to want him to say have a trial that ends on friday in this case and then go to new york on the 25th. that wouldn't be fair or reasonable. finally, look at this date, november 5th, remember this date? that's the presidential election date, other elections as well. the doj does not want to be viewed as trying to interfere with elections. they want to be able to stop their investigations or trials if they're able to not start in a time it might interfere. that's going to be very difficult to do so. and finally, should she stay or should she go. there's a song in that somewhere, i won't sing it this morning to you all, but judge cannon, she gets to decide if she wants to recuse or not. a reassignment could come from

charges with very sensitive material that he was hiding in his spare bathroom and in a ballroom. these are not just frivolous charges, and it bothers me that some of our republican leaders are willing to, you know, not even willing to take a look at the evidence. obviously everybody's innocent until proven guilty, but no man is above the law, not even the president of the united states or the former president of the united states. and we've got to get to the fact. just being dismissive, i understand republicans being concerned that we're not, you know, that we're not being balanced in our prosecutions and, you know, they can argue about the weaponization of the justice department, but we've got to at least take a look at these facts because it's very, very serious and concerning and it deals with national security. >> a point of fact there is that another special counsel still probing the biden documents, so that is still ongoing.

you just said everyone in america is innocent until proven guilty. do you then disagree with republican presidential candidate asa hutchinson who says even this probe at this point is disqualifying for president trump, that he should get out of the race? >> well, you know, i do think he's innocent until proven guilty. i've been the leading proponent, i don't think he should be the nominee. i don't think he should be running for re-election, and i'm happy to see asa hutchinson and chris christie starting to say the things i've been saying for years, even before this investigation. we've got to get to the facts. obviously it's very difficult for somebody to be a candidate for president and deal with, you know, 37 counts, multiple indictments in multiple places, and potentially others while trying to campaign. i mean, it's just not what we want to see. it's not how we get back to winning again. >> one thing i've been really struck by is the response in the past few days of republican voters. i mean, you look at the abc poll, the cbs poll, they say the

same thing, that many republican voters just simply don't care. this doesn't change their opinion. in fact, in one of those polls, 14% of republican primary voters said it may improve their opinion, the indictment. may improve their opinion and their view of donald trump. you're about to exhale a big sigh i can see, and i'm wondering what that tells you about the state of your party? >> well, i'm very concerned about it, and, look, i think that's why it's so important -- i thought it was important that the -- this indictment was really detailed and provided a lot of information because i think they were concerned about looking as if it was political going after a -- the leading republican presidential candidate in the middle of an election. people -- the messaging about the weaponization of the justice department, it's unfair, it's people just coming off donald trump. it's been effective messaging. and while i don't understand why so many people continue to ignore the facts and it does concern me, look, there's no

question, donald trump could go up in the polls as a result of this just like he did in the -- after the last indictments in new york, and it's very troubling. >> we've seen you tweet out support of a number of republicans who have announced that they're running for president. you obviously took yourself out of this, you know, weeks ago. many people expected you to run as well. but then you also wrote in your march "new york times" op-ed warning of a, quote, multicar pileup that could potentially help mr. trump recapture the nomination. is that what we're looking at here as more and more jump in, a multicar pileup and trump gets propelled to the nomination no matter where this case goes? >> it doesn't sound like too many people followed my advice. i did not want to be a part of that. there were a bunch of us that were sort of all within the margin of error, tied in single-digited, ans and trump a. i thought it was much better to coalesce around a couple of strong candidates and figure out who's best one to challenge him, but having 12 candidates, it

. is there any circumstances under which you could see yourself dropping out of the 2024 presidential election? >> no, none whatsoever. >> not dropping out and the former president says that if he wins in 2024, he will appoint a special counsel to investigate president biden and his family. >> and now we can do it now, because now the box has been open. the pandora's box, it's been open and it's been wide open, so i'm allowed to do that. >> let's bring back in our panel and i think the framing of this is entirely political, there is no basis beyond the politics of a special counsel that was appointed by an attorney general to have separation from politics. i also think the way the document is framed and the charges within them get to the idea of trying o'separate any politics from this. the basis of the documents themselves both have a legal purpose but also i think get at some of the allegations that

have been made about the president. >> yeah, i think that that's right. when you look at the documents that they lay out in this indictment, they sort of list these 31 classified documents here, and i think what prosecutors want to do is they want to be able to demonstrate the severity of the information, the national defense information that donald trump took, to be able to at least show to the jury, look, when you look at these documents, you're going to see why they shouldn't have just been laying around in a bathroom at mar-a-lago. there are also a lot of different agencies who have interest in this. we saw this big list in the indictment of all of the different agencies who have some kind of interest in the intelligence that was collected. so they have to go through with these agencies and essentially whittle down what are the documents that we feel comfortable listing in these indictments. what documents will we feel comfortable sharing with the jury and that's a hard conclusion to reach. again, you don't want to do more than you have to do because these could still contain sensitive information that, you know, these agencies don't want to be made public even to the jury pool, but you want enough that a jury looks at it and

thinks, wow, this is bad. >> we've already seen attacks on the special counsel jack smith. i assume that they will continue and perhaps gain more momentum. jack smith has gone after -- prosecuted and led teams that have prosecuted democrats and republicans in office. john edwards, et cetera. >> bob menendez, senator bob menendez, the former governor of virginia as well. oh, international war criminals at the hague. this is somebody who is known to understand the optics of things. i don't think he's going to take the bait, though, because of course the very reason he's here is not just to avoid a hint of impropriety but because general merrick garland, before this even indictment came down, it was thought that, hey, listen, this is going to be the attorney general going after the main competitor of president biden. now, trump can pretend to have had an epiphany that this might

be the circumstances now, but that was the whole contemplated reason to have jack smith there. i think staying out of the limelight, having the indictment speak for itself, having the eventual report come out as well is going to be very key. also, not just for reputation wise but because you've got a jury pool to consider here. everyone in florida right now likely is going to know about this case. it's not going to be a situation where you say i've never heard of it. has the former president been charged, it will be can i believe that i can be impartial here. and i want to just say while we're talking about a presumption of innocence, that's so important, but a presumption of innocence does not mean a presumption of corruption at the department of justice. they've got to prove their case. there's a burden of proof, but we cannot assume by virtue of the fact this is a political figure being charged that it means that politics was at play. >> for both of you guys, given what we've seen in terms of the public rhetoric behind the scenes, there's local, there's state, there's federal, kind of all involved in this, how does that play out on a day like

today? >> well, what you're seeing at the courthouse, and you know, we've heard shimon prokupecz reporting on this, you know, yesterday and overnight, is some tensions developing over whether the courthouse should be locked down and surrounded by metal barriers because they expect crowds and demonstrators. and the secret service always likes that model because they don't like crowds that aren't contained when they have a protectee. and then, you know, you have the miami police saying this is our city. these are our people. we do major events all the time. we have a feel for this, and you know, we're doing it the way that we think is the right way to do it. so it's interesting seeing those tensions in the background. now, there is nothing in this universe that isn't touched by politics, so we have to take a step back and say, you know, you've got florida, which is, you know, has a lot of trump support there, which is why they're going to get the crowd

that, you know, they didn't get in new york theoretically. you've got a republican mayor of the city of miami who's very active in politics. you've got a republican governor of the state, so there may be an idea that, a, in the judgment of miami p.d. trump supporters are not a threat to donald trump. there also may be an idea that we don't want to over police this event because it will look political. >> and then even beyond what's happening there on the ground, we know across the country, the fbi they're working their informant networks for domestic terrorism threats. as closed off and as insulated as these groups think they are, many of them are infiltrated by the fbi. it's led to infighting, pa paranoia, consternation among these groups. the fbi doesn't mind that one bit, the infighting with these groups. they're looking for these threats. what concerns me today, first the unknown, right? anytime you have a situation that can be volatile, what could happen, right? but secondly, we still don't know if there's going to be this
