arraignment expected to be met with crowds outside of the courthouse. law enforcement declaring they're ready if protests take a turn for the worse. inside trump's legal strategy. the possible defense plans his team could use. could this all end up at the supreme court? all coming in to cnn news central. >> that is the miami federal court, where in just a few hours, former president donald trump will surrender himself to the custody of federal marshals. we just learned intriguing, new information to the extent that trump seems to be keeping the other individual indicted, walt nauta, as close as he possibly can. he flew with him to florida and ate dinner with him last night. at this moment, trump is at his resort in doral, a few miles from the court. cnn has exclusive video of the

president last night greeting supporters there. later, the former president will be taken by car to the court. it is expected he will drive under the building. his appearance is scheduled for 3:00 p.m. this afternoon. once inside, trump will officially be under arrest. it is expected he will be fingerprinted but not have a mug shot taken. trump is expected to plead not guilty to all 37 counts. once this is finished, trump heads back to the airport and will speak at a fund-raiser at his bedminster golf club. paula reid is outside the court. it will be an inventful day to say the least. >> good morning, john. it's a solemn day. this is the first time a former president of the united states will be arraigned on criminal charges. this case doing with national security.

and as special counsel jack smith put it, this is an issue of life or death, dealing with the mishandling of classified information that could put lives at risk. the arraignment is hours away. the president seems to not have his full legal team in place after the departures of almost all attorneys that have been representing him so far in this investigation. we know today, he will be represented by one of his attorneys in another case. along with the former florida solicitor general. he is not expected to be too involved in this case. he knows the state of florida. they can usher lu the proceeding before they settle on a legal team. the president has been talking to local attorneys down here in florida. historically, he's had difficulty recruiting new lawyers. there's concerns about him paying his bills. firms are told they worry about alienating clients and reputational damage.

this is the first step. today's hearing is before a magistrate judge. they have plenty of time to get this team assembled before it goes before the trial judge, aileen cannon, a trump-appointed federal judge. she has made one decision in a matter related to this case. it was criticized by legal scholars and eventually overturned. usually the judge is not a big storyline in a trial, she likely will be. and every decision she makes will be scrutinized. today, the first step in what is expected to be a very long and truly historic case. >> paula reid, for us at the courthouse. an eventful day, a solemn day. a historic day. keep us posted on anything you see. bus loads of supporters of former president trump are riled up and planning to rally outside of court this afternoon. supporters are ready. randi kaye is there. you were inside the resort.

we're looking at the pictures now. what are you seeing so far this morning? >> we were inside doral when the former president arrived yesterday. and we were there when he came down to have dinner in the main restaurant at the resort. we got video of him greeting supporters. he was taking pictures. he paudzed and did some of that. they were yelling, we support you. he went into the restaurant with dinner. his son, eric trump, was waiting for him. saw him earlier in the day. we understand from sources that he was joined at dinner by his co-defendant, walt nauta and some of the of thtop advisers. his mood seemed to be upbeat. he seemed to be cheery

considering what an important day and significant day this is for him today. we know he will leave here about 1:0 this amfternoon. it's a 20-minute drive to the courthouse. we heard from the doral police chief, keeping a close eye on things not only here at trump doral and at the miami federal courthouse. he doesn't have any major concerns about safety. listen to this. >> we've been on the scene here at the trump doral for quite some time. and we've been monitoring the situation. this point, the crowds have been calm. >> here at the doral resort, protesters are starting to gather. we have seen the sharpshooters around the resort this morning and last night. and secret service is on-hand to keep a close eye on the

president. they want to make sure there isn't another situation like they had on january 6th, at the u.s. capitol. no call to action. they've been monitoring all of that. no threat assessment as of now. >> randi kaye, thank you for that, live from doral, florida, where the president spent the night. >> with just hours before the arraignment, cnn has learned which attorneys are representing trump. what can you tell us about the legal team? what are you learning? >> you won't see new attorneys to go into the courthouse today, despite his efforts to add someone before the 3:00 arraignment. it will be todd blanche and chris kye. the two attorneys will join

behind me today. he is indicted in the 37-indictment last week. he added to his legal team in april. he was sidelined from a majority part of it. whether or not he remains there remains to be seen. we have confirmed that one of the attorneys trump is trying to add to his team, ben cooney, a miami-based attorney, was seen at doral yesterday. it's not clear if anything was finalized as of trump set to go into court today. he is looking to add another florida-based attorney to his team. he's not had success in doing so yet. that doesn't seem to be a big concern for trump's legal team as of today. but the bigger concern is that the top two attorneys who are

handling this case resigned abruptly last week when they learned that trump was trying to add another florida-based attorney to the team, given they were handling it since last august. big questions about what the team will look like going forward. we know what it will look like today. >> that's a good point. not what we know about him adding to the team and learning new details about how he wants his team to approach this case in terms of its stance with the d.o.j. what are you learning there? >> it's interesting. he was told by sources he was pushing for a more aggressive stance against the justice department. that's notable because it's been pretty aggressive. we've seen what the attorneys have been alleging. they claim there was prosecutorial misconduct. they went before the special counsel. jack smith himself, to voice their complaints how the investigation has gone on. but the former president doesn't think that's enough. he wants them to take a tougher

stance against the justice department. one interesting thing i learned as i was reporting on trump's legal team. when they got the target letter from the justice department saying he was a target in this investigation, notification from prosecutors allows the person who receives that letter to either present evidence to the grand jury or even go and testify themselves. i am told that trump expressed some interest in doing that. it's not clear how serious he was about it. but it is something that he talked about when they got that letter. he did not do so. we will see him today. we may not see him go in. but we know what he is expected to say in court today. that's not guilty. >> all eyes on miami for the rest of the day. >> no question about that. one thing that all the eyes will be watching is the security situation on the ground. you can see why it would be cause for concern. we know that miami police are going all-in for the day.

cnn chief law enforcement analyst john miller is here. you have sources everywhere. how do they feel right now? at 9:00, 10:00, this morning. where do things stand? >> miami d.p. is very confident they have what they need in terms of personnel and the help from other agencies. there's been a little tension in the background between the secret service and the local authorities. the secret service knows there's demonstrators and a cloud there. they like to have that locked down with barriers. but the miami p.d. says we have adequate personnel. there doesn't appear to be a giant threat to the former president from trump supporters who are coming to support him. they're confident of the perimeter. they're going to shut down two blocks around the courthouse. the former president's motorcade is going to go under the building and into a garage. he will be brought up a freight

elevator, the elevator that you can get from the garage. and that has enough room for the entire crew of people that will be moving with him in terms of secret service, fbi and so on. the fbi will arrest him. then, at the u.s. marshal's office, a united states marshal, apointed by president trump, who is still in office there, they will go through a booking process that will require fingerprints if they follow procedure for federal arrestees. a dna swab. the mug shot has been the dicey item here. if you take a mug shot front and side of the president of the united states, the collateral value of that, the risk of it leaking out, that would be against d.o.j. guidelines, they have struggled with. they will upload a picture to have a photograph, to check that box.

there's a lot of supporters that are taking to online forums frequented by extremist groups. a lot of them look to waco. what is interesting in talking to law enforcement sources. it's not just what's in the public domdomain. they are concerned object what is private. the extremist groups adapt to law enforcement action. that has law enforcement concerned. they are working with the fbi to scan for threats. to look online and see what's there. they're trying to use informant networks. many of the groups have been infiltrated by the fbi. they're trying to tap into the sources to figure out if threats are planned. >> when you look at the threats, when it comes to this particular case, there were threats before january 6th, that a lot of the groups that look at extremism, say they were ignored.

has that all changed? >> it has. the post-january 6th environment, it's not just about identifying the information but sharing it. one fbi report made its way to the system where it needed to go. but no one flagged it. there are processes that have been corrected. the great unknown is what are they not seeing? that has them concerned. we don't know -- you covered so many of the protests and counterprotests, there might be a co-mingling of the various groups. and it takes one rabble-rouser to set things off. that's something that us and the law enforcement will be looking at. >> the courthouse itself, that's not the only threat. >> the courthouse is not the threat because you do an ordinary threat assessment.

key quote in the case against donald trump. here it is. wouldn't it be better if we told them we don't have anything here? that's what donald trump allegedly suggested to someone who could become a key witness in this case. a person described in the indictment as trump attorney 1. who is trump attorney 1? federal prosecutors say this is the person that trump suggested to hide or destroy documents after a grand jury subpoena on may 11th, 2022.

their actions directly mirror those of evan corcoran. his own notes show trump asked corcoran on may 11th, if there was any way to fight the subpoena. corcoran told him he had to comply with it. trump invites officials to mar-a-lago to receive 38 classified documents corcoran found in a storage room. what he didn't know, was trump had directed walt nauta to move boxes before he searched a storage room. trump asked him, did you find anything? is it bad? good? then, they discussed the folder of the classified documents. notes taken by attorney 1 says, when trump made a plucking motion, suggesting the attorney remove anything that was, quote, really bad from the folder. fast forward to this, corcoran

before a grand jury, after a federal judge ordered him ruling that attorney/client privilege didn't shield his discussions with donald trump because the ex-president may have been trying to commit a crime, by using his attorneys. corcoran's notes are what "the new york times" has described as some of the most damning evidence in this case. >> thanks, sara. what will the trump legal strategy be? laura coates and defense attorney shan wu. "the new york times" did a nice time laying out four possible avenues of defense for trump. it's a good template for us. number one is, the trump team could say he had every right as president to take these documents when he left. what are the strengths and weaknesses of said argument? >> the biggest weakness is, he's no longer the president. the idea of this case hinging on

the unlawful retention, the removal but the retention of documents and obstruction following that, as well. the records, as we said, you're not able to keep the documents. these belong to the american people. >> i'm now told your microphone is not working. we're going to get that. we'll get that fixed right now. >> you want to hear me talk? >> yes. >> now that i'm audible, which is a weakness not to be heard. the biggest issue here, is you cannot retain documents. that's the crux of the argument. if you once had the document, if you no longer have that authority, as in the clock strikes midnight or 12:00 p.m., you no longer have that power. that's the crux of this case.

this is not a matter of personal documents. we're talking about defense-related information. information that would be harmful or helpful for a foreign adversary. a post-it, a note that says good job, donald. some of the headlines we're talking about here, that's a different scenario. >> the second area, this is distd distinct from the first, that they have not made in court, that trump declassified the documents as president. the strengths and weaknesses here? >> the biggest weakness there is the audio on trump himself. recognizing he cannot declass if i the documents when he leaves. the order to declassify has been debunked by people that work with him. that's a weakness.

they're between a rock and a hard place on this. he's been so all over the board as to where they declassified. can he do it at will? and the biggest problem with that a argument, is that the baltimore charge, espionage act, does not depend on whether they're classified or not. it's documents relating to national defendants. that's a big achilles heel. >> they have said it in public but have yet to say it in a legal document. selective prosecution. that's another avenue. that has to do with what we've heard publicly, hillary clinton. what about hillary's e-mails? >> what aboutism is not going to be a successful legal argument. you have prosecutorial discretion. discretion to figure out when you want to pursue charges and do not. it's based on the evidence.

drawing analogies between the conduct of hillary clinton and donald trump, or even former vice president mike pence or current president joe biden, as then vice president, has to do with the conduct at issue. not just the information at issue. the e-mail server had classified information. not the actual tags in physical, tangible documents. according to allegations in this complaint, donald trump did -- never tried to return them. doubled down. tripled down. quadrupled down that he had every right to access them and retain them, as well. and the core of this investigation and indictment is also obstruction. what did you do to avoid the federal grand jury reviewing this case? what are you doing to avoid any sort of prosecution? why not return them, and have that drawn out or considered later on? that's the big question here.

that's the crux and conspiracy. >> the last area, i'm going to add to this. the last area is prosecutorial misconduct, a phrase that's been tossed around by people close to trump. i want to add to this, this idea they're going to fight. and sara laid out evan corcoran's testimony and the evidence he provided. they will fight the ruling that was issued in d.c. that allowed attorney/client privilege to be pierced there. what's the strength and weakness to that? >> i think we have to pars those two out. partal misconduct is not the same of them fighting the ruling that chief judge howell made about corcoran's work being part of the crime/fraud exception. that's a legal argument. there will be delay litigating that case. the prosecutorial misconduct, and the what aboutism review, is

they did things wrong and they are targeting the president, that's a weak way to go in terms of attacking the case ahead of time. there may be jury nullification effects on that. as a legal basis, that's more atmospheric. i don't know if that's a strong defense for them. >> how about fighting the attorney/client privilege issue there? do they have luck challenging that? >> to do this in the first instance was a huge decision to pierce the attorney/client privilege. in d.c., there was a case made for the crime/fraud exception was appropriate here. we do not use that privilege as a way to shield crimes. let's plan a crime. i told my attorney about it. we're good to go here. they have to reconcile that. the fact it's down in florida, very different. could be. we have no idea standing here right now, what was the deciding

factor for the grand jury? was it corcoran's testimony? was there other factors? even if that privileged discussion does not come in, there's other things the indictment alleges. >> our thanks to both of you. you would expect maybe for them to try all of this, if anything else, to delay this the as long as possible, which may be the best avenue here. >> a lot to watch, john. ahead for us, chris christie goes on the attack against trump. in a cnn town hall, calling him a three-time loser and a child. in congress, trump loyalists lashing out at the justice department for the former president's current legal problems. details on their effort.

inflation, finally cooling. brand-new data released, showing the consumer price index, ticking up 0.1%. economists were expecting prices to increase 0.2% from april to may. it's the 11th-consecutive month where inflation has slowed. some welcome news. former new jersey governor and 2024 presidential hopeful, chris christie, not backing down on attacking donald trump. he called trump angry and vengeful and slammed the former president for his documents probe. christie making it clear that he's the only presidential candidate willing to harshly criticize the current front-runner. omar, look, i don't think it's a surprise that christie came out

swinging here. but what were your takeaways? >> he did talk about policy issues, mass shootings, and the future of this country and more. but a big part of the christie campaign is taking on donald trump correctly. he leaned heavily into that. for example, he didn't just talk about, for example, i should say, when he talked about the house, white house and senate being last from republicans, he could have just said that. instead, he said this. >> he hasn't won a damn thing since 2016. three-time loser. 2018, we lost the house. 2020, we lost the white house. we lost the united states senate a couple weeks later in 2021. and in 2022, we lost two more governorships, another senate seat and barely took the house of representatives, when joe biden had the first two incompetent years i've seen in

we're hearing, lauren. >> there is a shark divide. and some is between the house and the senate. some is happening between republicans who feel it's their job to defend the former president and those who are holding back any comment. for now, one of the members is dan crenshaw. that these are problems. there's a reason he's not commenting. you heard from john thune saying these are serious allegations, as well as john cornyn, another member of republican leadership saying, this is not good. you have some republicans who want to take action. including taking steps, like defending the special counsel's office. that's an idea that marjorie taylor greene talked about this.
