former president donald trump to be arrest and arraigned. >> and they are preparing the defense and why the strategy might be delay, delay, delay. >> and right now, busloads of trump supporters are preparing to leave for miami and rally outside of the court, and the security is ramping up as the officials are tracking new threats. this historic day is coming to you now on cnn "news central." >> right now, all eyes are on former president trump's resort at doral as well as this courtroom in miami. donald trump is going to be under arrest and the first and only president to face federal charges. we are learning new details of the legal team. todd blanch and chris keys are expected to represent the former president today.

we also learned last night that trump ended up having dinner with his co-defendant walt nauta along with the attorneys. a number of senior attorneys were at the table at his doral resort. this is how we expect the events to play out. the former president is going to arrive at the car and it is 12 miles where they will be taken under the building and arrive there to enter without cameras or a press event. once he inside of that building, trump is going to be officially under arrest, and it is expected he will be fingerprinted and he will not have a mug shot taken and no cameras will be allowed in federal court, because that is the rule. and we expect him to plead not guilty to all 37 counts brought against himment we will go right to cnn legal correspondent paula

reid who is outside of the court there in miami. it does not appear a lot of things have changed, and what are you seeing there? >> well, right now, a lot of media, and there are a few people milling about, and we even have some roosters wandering about, but that is the most excitement we have seen so far, but it could change in a few hours when former president trump is to travel from his golf club to the federal court in downtown miami to surrender. as you noted, he going to travel to here by car to the garage underground here in miami, and sara, once he is inside of the building, he is under arrest, and he is going to be processed is more or less like any other defendant. he is going to be fingerprinted, but he will not get a mug shot. part of the reason is because mug shots are used to identify people if they go on the lam, and president trump is arguably one of the most famous men in

the world, so they don't need it here. and the then he goes before the magistrate judge, and jack smith and other prosecutors' charges will be read, and he has an opportunity to enter the plea, and he is going to preview what he said on to radio show. let's take a listen. >> the judge is going to ask you tomorrow how do you plead, and are you going to say anything beyond not guilty or make a statement in court tomorrow? >> no, i doubt it. i will say not guilty. i didn't do anything wrong. >> well, today, the hearing, he is going to be represented by todd blanche, and chris kise, and we know they are trying to bring on additional attorneys, and the departures of virtually every attorney that has represented trump in this investigation thus far, and it may take a while to get the team together, because the president has had difficulty to retaining

lawyers, but of course, this the case of a lifetime. >> paula reid, thank you for the updates where at 3:00 p.m. the former president will be arraigned. rahel? >> we know that after the court, the president is headed straight back to new jersey and campaigning and he is the gop frontrunner, and kristen holmes is in bedminster, new jersey, where a major fund-raising event is in the work, and you have more reporting of the president and his aid walt nauta, and what can you tell us? >> yes, rahel, we have learned that trump ate dinner with his co-defendant walt nauta and their attorneys and the political advisers, and this is interesting again, because as we have noted, there were a lot of questions as to what the relationship would look like after walt was named as a co-defendant, and clearly, they are in lock step as of now.

as they appeared at the courthouse, we know that in new york, walt was there in a body man capacity for trump, and behind him at all times, and we saw it on camera. but he is not going to be there and there is no one playing that role today, and so this is an interesting dynamic, and the other thing to watch for is the interaction between walt nauta and trump tonight at bedminster, and he is going to talk about nauta at all, and is nauta going to make any remarks or seen at the club? right now, that is unknown, rahel. >> a lot of questions for sure, and a lot to watch tonight. kristen holmes live in bridgewater. john. >> and now here to talk about the defense team strategy is laura coates, and also prosecutor nick ackerman, walt nauta flew to florida with donald trump, and ate with donald trump, and he seems to be wrapping him in a bear hug, and physical and metaphorical bear

hug and why? >> because jack smith wrapped them both into one indictment. they are now considered co-defendants, and i would expect them to commntinue to communicate and why should they distance themselves. as co-defendants they will have counsel who will work together and decide what defenses should be, and how to present at trial, and he is going to have a separate attorney, but under a similar defense team, and the reason it is significant is because people talk about the expectation to flip this particular person. i hear about this notion of flipping someone as if you try to get the biggest fish in the pond, but it is essential to think about this indictment, and it says trump employee two, and employee walt nauta and the fact that they are conspirators and having them allegedly on the same indictment does not preclude them from having correspondence from here on out,

and the judge will not preclude them from being separate. >> and if you are walt nauta, and are you wanting to be tied like this, because there is a disparity? >> walt nauta ought to be cooperating and take a guilty plea and testify against trump, but the way trump has the arms around him, and he does not want to let him go, because the last thing that he wants is to have walt nauta to have a guilty plea and testify against him. >> how much of the handicap for the prosecutors not to grab this guy, because if he does not testify against him, what could happen? >> well, it is key, because they want him to be a guilty plea or to be a defendant in this case. that is why the case is in florida. they didn't have venue over walt nauta. he wasn't aware of the grand jury subpoena. he wasn't aware of what the archives was doing. donald trump was.

so under a supreme court ruling, they could not have brought walt nauta in district of columbia, and so it is very important that walt nauta be there, because he is the albatross around trump's neck. >> and remember that a conspiracy requires the meting of the minds and agreement and furtherance of that discussion and leaving one party out of the conspiracy is feeling like the job undone. also, the reason that you want to have joint trials if you are the court, it is a matter of efficiency of the process. i'm not going to use the court's resources and impanel new jurors and can you imagine the voir dire already to get a group of impartial jurors in this instance and have the same witnesses and the same presentation of the evidence, because there has to be a reason to separate the two for the courts, and the actual defense can move for it, but they might not ever want to. >> and if donald trump is elected president, nick, one

might rightly presume that he would pardon himself whether or not this case has gone to trial. isn't it in the trump's team interests to just delay it as long as possible? >> it is in their interests, but if i were jack smith, i would be appearing before judge cannon the first day and say that we turned over all of the documents and discovery and we want to have a motion schedule set so that in 45 days the defendants have to file their motions. we'll respond in 15 days, and we are ready to go to trial in four months. and ask the judge to set down a trial date. that is what ought to happen here, and there a good chance that it will. it is a simple case. there is not a lot to it. no reason for any kind of delay. >> laura? >> and even in a rocket docket jurisdiction, that is ambitious, and that means that you are

before the alvin bragg manhattan d.a. in march, and they have a sense of control thinking that they are persuasive, but you have issues including the attorney/client issue litigate and other issues, and so it is not slam dunk and with the eye to stretch it out, and we'd like to have more information and we have to figure out if they are alleging misconduct by the prosecutorsed and they do not have winning arguments as to what we know right now, but they want delays and trump has said that they want to raise money on this, and it might be advantageous, and we are talking about the court of law, but he is talking about the court of public opinion. >> and who decides that? >> judge cannon. there is no reason that she won't move it on expeditiously. and there is a lot of criticism because she screwed up on the rulings with respect to the special master, but she is

respect and has the bipartisan support of the senate, and she worked for a reputable law firm, and served in the attorney general's office, and there is no reason to believe that after she was reversed by the 11th circuit and instructed that donald trump is not to be treated any differently than any other defendant who is a criminal defendant in the united states, i think that she has learned the lesson, and the odds are that with everybody's eyes on her, she is going to be doing a good job, and at the end of the day, the best person to try donald trump if he is convicted is a trump-appointee, because that is going to tamp down all of the concern of politicization of the ju ddiciary and the doj.

. >> this morning the security has been ramped up before the arraignment of president trump in a few hours. looking outside, you can see what appears to be press, but there are major concerns about the lack of barriers around the courthouse as large numbers of trump supporters are expected but the miami law enforcement says they are ready. shimon? >> yes, you would expect some fencing or barriers as we have seen in other situations, but rahel, what we have seen from the federal protective services have done, and instead of putting the barriers or the fencing that we have come to see at many of these things, we are seeing the police using vehicles

as barriers around the entrance of the courthouse. that is the entrance into the federal courthouse. it'll be up on the 13th floor where the former president will make his appearance once he gets inside. he is expected to go to a different floor first where he is going to be processed, and then he goes up to the 13th floor. this is the security situation here, and how the miami police and the federal law enforcement has decided to protect this area. i want to show you the other side from the drone. we have a drone up in the area from the other side of the courthouse, and this is the street that leads into the garage, the underground garage where it is possible that the former president will enter, and you can see from the other side as well, that there is not a lot of the police presence or the barriers or the police vehicles that are being used for security

purposes. or acting as the barriers. and then i want to take you back out to this side on north miami avenue, and here you can see it is getting crowded and hours away, and there are a lot of trump supporters, and some people who are protesting against the former president out here, and you can see this confrontation here. and so that is what we are seeing out here, and it is becoming like this, you know, the media-like, this circus-like atmosphere, and then out here on this street, and this is the other side of north miami after knew where we have seen many of the former president's supporters driving up and down with the trump flags and american flags driving up and down, and this is the atmosphere out here just hours away from the former president here appearing for his arraignment and arrest, and that is essentially it. we have seen the police officers

on the bikes riding through, but the thing that is a little concerning for law enforcement officials that i have talked to is that there is no separation between the groups. the supporters of the former president and those protesting him and sort of like none of those metal barriers that we have seen in other situations. >> well, shimon, you say that some of the law enforcement sources say it is concerning, because we are not seeing the barriers put up just yet. >> yeah, i mean, i am surprised, because i was in manhattan when he appeared there, where donald trump appeared when he was arrested a couple of months ago, and completely different situation. you had met al barriers placed all around the courthouse, and the street that the former president was driving into, and walked completely blocked off, and we are not seeing any of that in this situation. it is very open, and people are

just allowed to go as if nothing is going on here, and it is a little shocking to me. >> shimon, we still have five hours and there are busloads of supporters expected from orlando, and any sense from the people you are talking to how large the crowds may get out there? >> they don't have a sense on exactly what the crowd size is going to be, and there are a lot of people on social media, and other chatter urging supporters to come out here, and so that is what is concerning them, and they are anticipating a lot of people, but they don't know if it is actually going to happen, and the miami chief police said that there is nothing to fear, and they are ready and prepared to handle up to 50,000 people he said yesterday. so we will see how this goes. >> shimon, it is great to have you there on the scene and providing that show and tell and the perspective that you pr pro provided. initially, it looked like a lot of press. but from what you can see, is

there more press than trump supporters or critics, and walk me through what you are seeing? >> yeah, so, let me show you overhead here. this is where the majority of the trump supporters have gathered. there are a couple of people who are protesters, and you can see that there are some confrontations. i mean, just people kind of voicing their opinion. it is peaceful, but they are going back and forth, and you can see the media, and i want to just quickly show you, rahel, this is where the media has camped out, and certainly more media out here at this point than anything else. >> well, certainly a few more hours before that scheduled appearance at 3:00 p.m., and great to have you, and stay in close contact and keep us posted if anything happens. and more on the security preparations is a person who knows all about it, former fbi director mccabe and is a cnn

analyst, and we have heard from shimon prokupiez, that there is no separation of those who are there to support donald trump and those who are standing there against him and believe he should be jailed, and there is no separation of the fences to the courthouse, and there are police cars and a couple of them that we are seeing now, and what does that tell you about security? >> so, a couple of things, sara, that are concerning to me. the first one is just the ability to prohibit the crowd from getting too close to the federal courthouse. typically, that is done with the larger interlocking barriers and either the bicycle racks that we saw at the capitol on january 6th or larger fencing, and thing about using those is because they are connected together and make one long chain, the crowd has to slow down to try to disassemble that if it is possible to get past it. what you are seeing there with

the use of the vehicles, it is a show of forts, but a large determined crowd can easily and quickly walk right past those vehicles, and it is unlikely that they would ever use the vehicles or move them around to confront the protestors physically, because that would be a very dangerous thing to do. so prohibiting the crowd to get to the courthouse is one thing, but the idea that the crowd is intermingled, and we saw that there is numerous examples that you can point to and the most visceral is the protest in charlottesville in the unite the right rally, and when you have two sides of the crowds emotionally charged and extremely polarize and prone to get with starting shouting matches and personal altercations, and that can go anywhere from there, it is essential to keep those sides separate as much as you can, and

you do it by designating areas for different groups to express their first amendment rights, and the fact that we have not done that is concerning to me, but if the crowd is small, it never turns into a problem, but as the numbers are growing and the reports of chartered buses coming in from orlando, i would be concerned if i were running this security operation. >> i wanted to mention that we are looking at live pictures and you are seeing some of the crowd which is at this point small, and certainly some arguingb but verbal arguing between a couple of people on their thoughts, but i wanted to ask you, because you mentioned january 6th, and mentioned some things then, and a lot of the things were missed, but have we learned a lesson, and no separation of those for/against him and there is little separation of those folks in the courthouse, and have

lessons before learned since january 6th? >> well, unfortunately, we have a real spotty record on that count. here in d.c. particularly on the capitol grounds, they have learned some lessons, and we saw that when the security measures were enacted after january 6th for large events and they brought in the large fencing that cannot be penetrated by a crowd, and additional national guard troops as needed and other la lessons learned, but across the country at sensitive sites is concerning, because the threat posed by protests that turn violent particularly those that are set off by the presence of domestic violent extremists, and that can happen anywhere. the nation's capitol is not the only site, the only kind of the sensitive site for that type of

activity, and we have seen armed protests take place in different statehouses across the country. we have seen acts of domestic terrorism take place all over the country, and this is a litmus test of how well something like a southern city, large major metropolitan area like miami and how well have they been watching way that law enforcement has changed the perspective. >> i can tell you that being at dozens of protests, and especially black lives protests, there is a very different scene outside of this courthouse where others have been protesting, and we will have to wait and see, because there are other things that we can't see as well. john? >> we are obviously watching that closely. and in the meantime, donald trump is pushing the legal team to be more aggressive against prosecutors. what does that mean. we will look at that when right after this.

no one knows more than kaitlan collins at the courthouse in miami. kaitlan, give us a sense of what you are learning this morning and what is the latest from inside trump world. >> well, john, those two attorneys that you showed todd blanche and chris kise have entered the formal notices that they are going to be the two attorneys to represent the president in court when he comes for the arraignment in hours from now, and that is not the plan from last week. yes, todd blanche was expected to take the helm of the case, and that is notable given that he has been on trump's legal team since early april, but chris kise is the former solicitor general just to handle the documents case last fall, but he was quickly sideline and he has not played a major role since, but he is going to be in the courtroom today after the president failed to add another attorney to the team, and he has

failed to do so, and he has been on the phone today, and there is a gathering of the protesters today, and even counter protesters who came by, and we will see how that changes before 3:00 p.m., but as we are seeing the scene, we may not see trump himself walk inside with the two attorneys that i was mentioning. and a real question is what that legal team is going to be looking like going forward, because it is not clear to me that chris kise is going to be staying on the case and continues to be one of the attorneys who is going to be going to trial, but he is filling a place going into court to nail down another florida attorney, and of course, john, that is coming after the two people who came litigating the case resigned abruptly after they learned that he was trying to learn another attorney. ben cooney was seen at doral and

whether he is getting that job is still in flux, john, but it is speaking to what the former president is facing as he comes here today to utter two words not guilty. he is going to have of course a long stretch ahead of him as that team is working on the legal strategy, and the republican allies are working on the political strategy of what all of this is looking like, john. >> we have camera looking at the ground shots around the courthouse from where you are, and there are three distinct groups. people protesting in support of trump the, and a few counter protesting against trump the, and then the media. to be honest, three to four cameras for every protester there, but things can change. what's the vibe where you are? >> things can change, and that is really important, and what you have heard from our colleague shimon, is that he has said that based on what he has seen at any other event and something as highly charged as

this, there is usually a lot more security when it comes to barricades and what not, but we are not seeing it yet, and there are people arriving, but it is 10:30 a.m. here, and what does it look like at 3:00 when trump is expected to show up. so it has been calm so far, and we will see if that changes or whatnot. of course, it is a lot of the former president's supporters who are criticizing the indictment. the one holding the poster the trump indictment celebration tour walked by us, and so that is a question of what it looks like when it changes, but right now, more members of the media as we are keeping an eye on the security and the secret service as he makes his appearance this afternoon. >> our kaitlan collins, keep us posted. thank you. sara. as president trump turns himself in miami today, he is

also facing several other legal battles. and sara murray is with us, and can you lay out how many battles he is facing and could be facing? >> yeah, donald trump says that he is indicted every two months, and he is not necessarily wrong, because he has a lot of legal scrutiny hanging over his head. there are a couple of things decided, when you are thinking of the e. jean carroll case, and in the hush money case, he has been charged with 34 felony counts and he has pleaded not guilty there, and there are the two criminal investigation cases, and one is sprawling investigation in georgia in the efforts to overturn the 2020 election case with the allies and we expect the d.a. to make announcements if anyone is going to be facing charges in august, and another one is the jack smith investigation into january 6th investigation, and we don't know the timing there, but there

is an active grand jury meeting today and last week and hearing from witnesses, and we are waiting to hear what that case brings. >> and those two cases are the ones that people feel are the most impactful, the georgia case, and the january 6th case. >> i wanted to ask you if you are hearing anything about donald trump maybe using this in front of the judge to say, i look, i have all of the thing, and i cannot juggle all of this at once, and then the political opponents and his own team saying, hey, look, we have a campaign going, and this, and there is a distraction there, and trying to use that as well? >> you will be seeing the timing arguments for donald trump, because the reality is that his campaign calendar is colliding with the court calendar, and in all of the cases, you have a right to prepare for trial, and you do need time to prepare for trial and it is true in new york, and the classified documents case, and if he is

charged in georgia or january 6th case. and the question is when you go before the judge, how amendable are they to take into account the campaign schedule. >> that is what we have seen someone writing a book before, and that did not fly, and the campaign may not, but the other cases may, and so that is something to take into account. rahel. >> and the latest on the philadelphia bridge collapse. transportation secretary pete buttigieg is expected to go to the site today. that is next.

on the side and ignited and caused this fire and then caused this northbound portion of i-95 to collapse. we are learning that the southbound lanes are not structurally safe, and they have to be demolished as well. these heavy machineries are puncturing holes in them to demolish them. the sad news that we received is that initially, no reported injuries at this incident, but then we learned from the pennsylvania state police is that one person was recovered from the wreckage at this point, and we are not reporting the name, because we are waiting for the pennsylvania medical examiner to confirm the name. and we are hoping to hear from the secretary of transportation pete buttigieg to give us more on the time line, but the governor josh shapiro said it could take months. >> thank you, danny freeman. and if the criminal trial of

professor at the university of miami, and it is great to is you here, and to be clear, we are not at the jury selection phase of any potential trial, and putting that out there, but that said, there is attention on what a potential jury would look like. what questions would a lawyer ask a potential juror? >> well, from the attorney's perspective, they would want to know the juror's world view, and what we have studied is that how we view the world is how we derive the facts, and so they will be trying to get ensights as to how potential jurors are going to be viewing is the government involved in the weapon that ex-39 trump can do

juror who they voted for, because that might not be relevant, but what might be relevant is where they get the views, and what blogs they read, what podcasts they listen to. you might remember in the trial with jean carroll which was a civil trial, it came out that one of the jurors actually listened to what we might call a right wing blog, and big tussle if he should have been disqualified. that is often done through the questionnaires, but a lot of the judges don't like the questionnaires, but this is striking me as a questionnaire of getting a lot of information up front on those types of activities by the potential jurors makes sense. >> scott, we don't have a lot of time, but talk to me about the need and the challenge of both sides to find the potential jurors who can be fair with so much attention on this case and
