and welcome the viewers in the united states and around the world. this is the special coverage of the historic federal indictment of donald trump. we will watch with you and soon to see the unprecedented moment, the former president trump appearing in the federal courthouse in miami. you are looking at it right there, and he is going to appear there and surrender to the marshalls and expected to be arrest and taken into the courtroom to plead not guilty to mishandling of the documents. cnn has video of him at doral where he greeted supporters. and privately, he is pushing for the legal team to take a more aggressive stance against the justice department, wolf. >> we are getting new details there how he is keeping an alleged co-conspirator walt nauta in close reach. he flew to south florida with

trump, and flew ahead of them ahead of the court appearances, and right now, he is on high alert of potential threats, and they are saying that they are ready to handle the concerns, but there are no barriers to separate the trump supporters outside of the courthouse in miamik and that is where we begin with cnn reporter shimon prokupiez and also our court correspondent paula reid. shimon, what are you seeing on the ground with the security? >> at the moment, wolf, you can see the officers from the miami police pushing us off, because they are investigating something on the other side of this yellow tape. we were all gathered over there for a little while, and then all of the sudden, the police came in and said everyone had to clear the area, and there was media gathered over there as

well. and so, what they are doing, we are told is that they are doing a sweep, and something caught the eye of law enforcement, and something suspicious, and now they are doing this sweep. as you can imagine, wolf, everyone here is on high alert, and generally in this area, they have been allowing the trump supporters and protesters and the media all to gather here, and they have not separated any of the crowds, and we have not seen any barricades, and we have seen the officers out here, but this is the first time that we are seeing any kind of pushback from them, and their concern over something that they have discovered there. that they are investigating. this is the area where the media has been gathering, wolf, but also, many of the trump supporters, and i will show you some of them who are gathered out here on the street now, because the police have closed the street as they investigate what is going on here, and some

of them are now gathered here, and then on the other side, wolf, there is, that is where the media is gathered. this is generally the scene out here right now. i think that also, wolf, we have a drone shot over the courthouse where you can see some of the security. police, instead of placing the metal barriers that we are talking about, they have decided to use the vehicles, and the cars as a way to harden the perimeter of the courthouse. it is probably not the most ideal situation, and certainly something that we have not seen law enforcement do in other situations like when the former president appeared in manhattan, but i wanted to try to see if i can show you how much more of the area the police have closed off as they are investigating this suspicious package or something they found suspicious. this is what they have done here, wolf. using the federal protective

services, police suvs as a way to harden this, and keep the yellow tape around, and keep it down as far, and that is the entrance to the courthouse where they are also using vehicles to basically harden the area. for now, wolf, they are investigating this package, and peaceful out here, and no problems, and this is the first time that we are seeing the law enforcement activity to try and push people back because of this suspicious activity and people out here are sort of milling about and trying to figure out what is going on. once they clear that item, wolf, that they will allow the people back into the area, but certainly, what we are seeing since i got here this morning, wolf, number of people coming here is growing, a trump supporters and the vehicles coming through here with the

flags, and we will see what the police discover here, wolf. >> shimon, once you see what is in the suspicious package, or what is being looked for, we will get back to you. and paula, the truly historic moment, the first time a president has been arraigned for criminal activity. >> and it is interest, wolf, because as shimon laid out, there are dozens of supporters here, and system of them celebrating the indictment, and you have world media and lot of wildlife here at the court, and roosters walking among the protesters, and it is a circus-like atmosphere, and we are here for a serious and solemn occasion when it is the first president to be arrested and indicted on criminal

charges. and the president is to make the drive from his doral golf club to downtown miami to surrender. when he arrives he will be in a car and expected to surrender after he arrived underneath the building. we won't see him. but once he arrives inside of the buildbuilding, he will be u arrest. we are not expecting to see any of this process, but he will be arrested and fingerprinted and not likely to have a mug shot, and then he will appear before the judge, and he is saying that he will enter a plea of not guilty. that is the first step in a long and historic case. at the defense table is two attorneys todd blanche and chris kise, the former solicitor general of florida. this is not to be the final

team, but it is going to take some time to get those attorneys, but today, all of the proceedings are before the trial judge aileen cannon. she has made one decision in a matter in this case roundly criticized by scholars and overturned. usually the judge is not a storyline, but everything that she does in this case is likely to be scrutinized. >> of course, we will get back to you very soon. erin, your turn right now. >> thank you so much, wolf. let's bring in the panel here with our legal analyst, and of course, the political experts. karen, as paula is going through some of the people that we expect to be present on team trump and of course for doj and obviously the ringleader of the doj prosecutors is jack smith himself, and you know him. >> yes. >> and tell me about today, and what role he is going to play as the person, the ringleader here?

>> he may or may not be present in court. he is directing what happens today, and he hand picked the prosecutors himself. it is a carefully choreographed, and they are not going leave anything to chance arraignment that jack smith has done, and he may or may not appear adds you saw at the last arraignment, alvin bragg did come to watch the arraignment, but i don't know if jack smith will or will not be there. >> and laura, whether he is there or not, but obviously, he is still in charge of it, but we will get a better sense of it of who is in the weeds here, right? >> of course, we saw him present, but he did not speak much when he was in a meeting with trump's attorneys prior to the indictment coming down, and part of the gravitas here, but this is how routine and mundane this part of the case can be is the reading of the charges. it is going to be very anti-climatic to know what the charges are, but it does not take away from the fact that it is monumental occasion of a

former president walking into a federal courthouse with federal indictment, and multiple and dozens of charges at this point in time, and things related to things that he did following presidency. and so some humility in terms of the courtroom experience, but very, very quick it is expected to happen. >> and so maybe we will see some humility, and perhaps we should see some humility, and it should be a humbling experience. >> correct. >> and i wanted to talk about the experience, and something that happened this morning, byron donald came on to defend trump, and he said, hey, there's 33 bathrooms in mar-a-lago, and so it is not like this one matters, and i have to say when those are the responses that you are getting, and people are putting them out there as if they are serious, how do you even respond to that? >> well, they are -- they don't have much to work with here.

if you are working with the indictment and looking at the pictures and soy get that i will cut byron some slack, because when you are seeing the pictures of documents in a bathroom, it was also on a stage and other places, but what they are trying to do is a political exoneration and put enough mud in the water to have republicans to hang their hat on as they argue in the public domain, and none of this is going to hang your hat on, and that he is not going to go with the espionage act on, and there is a so much going on, and i was there when byron gave the interview this morning and he gave an authentic review of what the republicans are saying, but at the core is that basically, the republicans want hillary clinton and joe biden and others prosecuted, and they

are not. >> and last night on cnn with anderson cooper, chris christie was very clear. it does not mean that it is not a conversation but this is not to be prosecuted, and it is not a hard thing to say, but as byron donalds is showing, it is not what you are getting from the lion share of the gop. >> no, it is not. and we have seen this trajectory since donald trump was first elected in 2016. byron is going to be in a safely red seat, and proversely coming to the defense of donald trump, and rendering these illogical and incoherent defenses help him in a primary and maybe even in other contests, but there are implications for other

republicans in the house of representatives in much more competitive seats. some of them -- >> if that is the norm and the dialogue, it is not good for others. >> this case is not going to be resolved today, and he is likely to be indicted in other jurisdictions and what is that meaning for someone who is serially indicted and running at the top of the ticket. and don baker in a biden district has probably done the right thing with respect to this in terms of helping his own re-election, but many have not made that. >> and what is interesting is serially indicted, and a couple of fradphrases come out, becaus that is powerfully said. and chris christie says this is going to go fast, and he says that even understanding that there is going to be arguments and fights and whatever, but the rocket docket that he cited in florida, and he said, you can get through it in a few months,

and complex siity of the situat, but a few months. >> well, it depends upon the judge, and aileen cannon who has demonstrated a biased toward donald trump, and as you can recall, when they executed the search warrant at mar-a-lago, she asserted herself in the case with a special master, and in the special master, two of the three were trump appointees and said she was biased and lawless, and didn't know what she was doing, and if that is the case, and she stays, and may be recused, but if she stays on the case, she could delay it, and help him to delay it. he does not want a trial, because there is nothing legal to hold up in court, and he doesn't want to mount a defense, because it is a strong case.

>> and meantime as we are ready for the miami police who didn't put up barriers and they could have from 5,000 to 50,000, and so far, not many people, and so far peaceful, and there is something that i have to say in the moment, because who know where is this goes, but something calming about that as a citizen. >> so, there's a thing going on here which is, you can see the secret service is leaning into the federal government to say, we don't have the barriers that we want, so we are going to ring the building with vehicles to create the hard perimeter. they want more security, because they have standards and procedures and the ideas of crowds and protectee, and there should be barriers and the miami police is saying that we have a group of trump supporters here,

and we don't consider them to a threat to donald trump, and we have adequate resources in terms of the personnel, and so there is a clash of styles there. and the wild card is of course when your trump supporter start to fight with the counter demonstrators and do you lose control of the situation there, and they are confident that no, we are not. so it is interesting to see this type of the tension in the background of the agencies that usually work very well together. >> so stay with us, and the indictment is going to shine a big light on the split of the house and the senate. we have been talking about the house, but the senate is different. the one side slamming the doj and why it is okay to have documents in bathrooms, but the other is not saying much at all. we will have live reports from capitol hill, and the arraignment afterparty, and the big money fund-raiser that trump

the reaction? >> it is mixed. you have heard some rushing to donald trump's defense and others not so much in this case, but others like lindsey graham saying that donald trump brought on this just because of his own actions. >> reporter: shouldn't he have given back the documents to have avoided all of this? >> yes, most get into trouble by their own actions. but he should have. >> i am not supporting or condemning it, and i'm not the spokesperson, and that is my stance as a member of congress. if he becomes president one day, then i have to comment on it. >> reporter: as a military guy, he allegedly had national security documents -- >> that is problematic. >> and the record is a cause of concern that he has to overcome

the presumption arising from the past rulings that she somehow favors the president who she favors, former president donald trump. in the total scheme of things, i would advise her to recuse. >> reporter: that last comment is coming from richard blumenthal from the judge who is expected to take the case, judge aileen cannon, and blumenthal calling for the recusal, and dick durbin said that he does have concerns with her potentially overseeing the case, but he would not go as far as blumenthal to call for her to recuse as they graple with the indictment and the case that could play out over the next year, and shake up the map heading into the 2024. erin? >> absolutely, manu, from capitol hill. wolf. >> erin, thank you. we will discuss further what is

going on on this truly historic day. and our analysts here in washington, and gloria, let me start with you, and what we are seeing a historic divide emerge among the republicans themselves with the indictment against trump. >> it is not just a division, but it is a chasm between the weaponization of justice, and then we hear that justice is not carried out equally, but what we are not hearing about from the republicans is details of what actually happened here in this case, and the questions of obstruction which is sort of key to this indictment. now, what is interesting to me is that manu was pointing out that lindsey graham who vociferously defended president came out to say, that most politicians commit self-inflicted wounds is a way of saying that none of this had to occur as we all know if donald trump hadn't insisted on

hanging on to these documents. which he did for more than a year. i mean, you know, the archives went to him, and they bargained with him, and they tried to find out where the documents were, and they tried to get a hold of them, until they had to execute a search which the republicans also criticize as unwarranted, but i do think that what we are going to see a little bit of softening on some of the republicans' part, and the senate is different from the house, but you saw congressman crenshaw walking away from manu, because he did not want to talk to him, but he said, i'm not defending it. that is as far as he went, and there is silence for example from mitch mcconnell, the senate republican leader. >> silence. and julia, the very explosive national security secrets contained in the documents make it harder for veterans who put

the physical wellbeing on the front line are not going to defend this. what is interesting is that the indictment is a story, and i thought that it was interesting is that the story as it was released started with not law or politics, but national security. the first paragraph mentions two key factors at play here. one is the military and intelligence agents, and a nod to them, and in order, the obligation to them, and not to trump is that we protect the work that they are doing, and the second is that there sis a o exist on a globe by itself, and it exists for those who need access to the highest clearance are protecting them or at least not putting them in bathrooms, right? there may be a gap of always

being in the skiff, but people certainly know that those pictures looked wrong. so our present capabilities are impacted by what our allies are likely to believe in terms of the evidence, and they are seeing the polling that trump is the frontrunner, and this is where want to seeing where the challengers are. >> and i wanted you to hear one of trump's challengers tim scott. >> what we are seeing under the joe biden leadership is that double standard. that double standard is unacceptable and you cannot protect the democrats while targeting and hunting republicans. this case is a serious case with serious allegations, but in america, you are still innocent

until proven guilty. >> you a former prosecutor, and what do you say to the arguments like tim scott is saying about the double standard going on? >> he is right that double standards have no place in the american criminal justice system. but where he is leaving out information though is to go to trial in the first place, often the prosecutors would have gotten the charges or the claims they were making past the federal judge in the first place ark and to get convicted at a trial, you have to get past the taint of politics in the case. so it is a little bit of misleading to suggest that merely because you have a democratic president that nothing could be fair. the question is what would the solution be, wolf?

if the justice department investigated and prosecuted hunter biden tomorrow, would everybody fall in line, and say, it is okay to prosecute trump too because they prosecuted a democrat. it is just -- there is no words for it. >> and the other side saying that they are just prosecuting hunter biden, because of donald trump. i think they are walking a fine line if you are running for president, because you don't want to condone reckless behave, and so he tweaked it at the end, but he comes out in the beginning to talk about the double standard, and that is what we are going to hear, and we heard frit nikki haley as well, and we will be hearing from the presidential candidates to navigate the line. >> one congressman who endorsed trump said that indictment is one-sided account from the special counsel jack smith. and i don't know if the defenses from trump hold up from your

legal perspective? >> the and they are going to be looking for those things, and looking for anything that is wrong, and looking for prosecutorial misconduct or anything that is wrong, and this is under review in the district of columbia, and also, the search, and if there is misconduct, and also, evan

corcoran, the attorney of trump, and the dictated notes and in the indictment, and can that be excluded by judge cannon who is going to have this case, and so now the question is going to be tested, and this is the way it should be tested in the rule of law. >> quickly, there is no stronger day for the prosecution than the day the indictment comes out, because you have not seen any legal challenges that comes out. and what norm is saying, all of this is subject the being attacked, and this is not to say that the whole case falls apart, but he is kind of right in that it is a one-sided argument, because that is what an indictment is. >> you are saying that the legal battle is just beginning. and so we are hours away from a truly historic moment of an indictment of the former president of the united states, donald trump, and yet, he is still struggling to finalize his own legal team. and so we will have new

live coverage of when we expect former president trump to walk into that courthouse to enter a plea to the 37 charges in that indictment brought from that search of his mar-a-lago resort. one of those conspiracy charges carries a 20-year prison sentence, and it is the first time in american history that a former president faces criminal charges. and we got more details of the booking process, and kaitlan collins is joining us from miami. kaitlan? >> yes, wolf. it is going to be looking similar to what an average person would be showing up to the courthouse like this one behind me in miami. this is where former president trump is going to be in a matter of hours. he is going if be coming in, and the booking process is looking like what you would expect.

former president donald trump is spending this morning at his resort in doral, florida. he arrived there just ahead of the arrest on 37 charges for the handling of highly classified documents. cnn's randi kaye is also in doral ahead of the arraignment. randi, what has the former president been up to since he arrived? >> wolf, he got to the resort yesterday afternoon at 3:30, and his son eric trump was waiting

in the lobby for him, and his lawyers and they went upstairs to hold some strategy meeting. we didn't know if we would see him again, but we got exclusive video of him when he came down at 7:00 p.m. when he came downstairs to dine with his son eric, and some of his lawyer and we have learned that his co-defendant walt nauta was with him, and some top advisers and few supporters were yelling him, that we support you, you got this, you will have a great day, and we love you, and a thumbs up, and once he got into the restaurant, some people asked if he would take pictures with him, and he did that before disappearing in the back room to have another strategy session with his lawyers and his son eric. we know that he is to depart here, and it is a 20 minute drive or so to doral to the
