on with campaigning, hugging supporters and trashing the legal jeopardy he is under. cnn's katelyn polantz was inside the courtroom in miami. what do we know and what's next here? >> well, what is next is there will be another moment where donald trump's co-defendant walt nauta is going to have to enter a plea of not guilty. he didn't do that yesterday though the former president did himself, and then the next thing that happens after that is the justice department is going to provide a list to donald trump and his attorneys as well as t so right now trump cannot speak about this case with walt nauta even thougn are traveling together. because walt nauta works with him ople, witnesses, and potential victims in this case that will be added to that list. they will be getting but with this case as it goes on, one of the things that's so

interesting about it is that in anre told when they're put under arrest that what they say publicly could be used against them in the court of law and donald trump has seemed to not had any hint of inhibition so far about talking about this case publicly. here's one of the things he said last night. >> as president, the law that applies to this case is not the espionage act, but very simply the presidential records act which is not even mentioned in this ridiculous 44-page indictment. under the presidential records act which is civil, not criminal, i had every right to have these documents. >> so what donald trump is repeating there is a legal argument that's something that is very clear that his legal team will make, but it will be up to the judge and the way the justice department has brought

this case is that they have focused that this is not about him being president. this is about the documents themselves being kept somewhere outside of the protection of the federal government. national security records and whether he was authorized to possess them or not, that just isn't part of what the law is here, the criminal law that trump is charged with. so there are going to be statements like that that could be part of this case moving forward especially if trump continued to acknowledge that he knew he had these documents and he kept them. >> katelyn polantz, great to have you. john, so many questions. you have to wonder if he's consulting with his legal team if he's making the comments publicly. he cannot speak to walt nauta privately or publicly about this case. >> he isn't talking to walt nauta and political arguments

are not always legal ones so we'll have to see how they lynn up. this morning republicans on capitol hill are vowing to retaliate against the justice department for the indictment against donald trump. republican senator j.d. vance from ohio says he plans to hold up president biden's judicial nominations indefinitely. he wants attorney general perec gar merrick garland in what a vance calls a politically motivated law. chief congressional correspondent manu raju is up on capitol hill. what are you hearing this morning? >> yeah. some of donald trump's staunchest supporters coming to his defense trying to use the levers of power to retaliate against the justice department. you're seeing it both in the house side and they're trying to restrict funding and that's the discussion going on about whether they can do that through the appropriations process to go after the justice department and on the senate side, senator j.d. vance announcing that he would

place a hold and something that any senator can do, and planning to do that on all justice department nominees other than ones who are nominated to the u.s. marshals services and in talking to vance and durbin yesterday who is the senate committee chairman and it is clear that the stand-up may persist at some time as democrats say they're ready to battle. >> i think i want some policy, some commitment from the attorney general that he will do prosecutions and politically motivated law in a much different way. we don't know exactly what that is. i'm sure eventually we'll talk to folks in the department of justice about what they'd be willing to do, but right now i don't expect merrick garland to change and i expect this to be in indefinitely. >> if you're in favor of the justice department, it is transparent that this is a political reaction to the arraignment of a former

president. >> now at the moment, j.d. vance's hold only applies to two pending nominees and one who is a u.s. attorney proposed to serve in mississippi and another one to lead the department of justice's office against violence against women prevention. that domestic office, nominated to lead that office, so it depends on how long it persists and if he continues to hold on to the nominations and more nominations come down, it can slow down the process in the senate and it could take some time to do this. >> tommy tuberville has been at a certain version of this for some time with the defense department nominees. what's the latest from there? >> yeah. that's right. more than a couple hundred at the moment and growing. 250 or so nominations. so more significant what tommy tuberville is doing, the senator from alabama, saying he would not relent on military

proportions, people proposed by the president to move up within the ranks of the military services and often people nominated to be generals and he wants to change the pentagon's policy over abortions saying the pentagon's policy needs to be changed, those who leave the state to get abortion services and that is something that the pentagon is not willing to do at the moment. at the moment that is causing a real concern, not just among depp democrats, but republicans, too, about the national security preparedness and the key nominations can't get filled. >> manu raju, thank you very much for the update. we will talk to you soon. >> cnn anchor and chief political correspondent, dana bash. you have a brand-new show, i am so, so proud of you. i love it, but i want to ask you some really fun questions here and ones that i know you know the answers to. so trump seems to be going back to the same old playbook where he is rallying his supporters by

attack, attack, attack and deny, deny, deny. can you tell me what your takeaway was when he said after this historic arrest and indictment on federal charges? >> it is kind of amazing how at odds his political playbook seems to be with his legal defense, sara. listening to him talk very openly about the fact that he, of course, did have those documents. he's not denying that and trying to explain why he had those documents. this seems to me to be a dream for jack smith and his team who are trying to prosecute this case. another thing, going back to manu's excellent reporting, it's kind of remarkable to hear jd vance say out loud that he knows that this tactic that he's trying to use to hold up judicial nominees is not going to change merrick garland's mind. so he's admitting publicly that

it is just for politics. if he was doing this in a way that he really thought he would get a result that might be one thing, but he's saying he doesn't expect a result which is translated as this is a political move. >> well, it's revenge and retaliation if you look at it on its face, correct? >> i want to talk to you about some of the republican presidential candidates and what they have said after this indictment. one of them seems to have softened on her rhetoric at this time and of course, nikki haley. i want to let you listen to what she said she would do if, in fact, this went to trial and ultimately if trump was found guilty. >> when you look at a pardon the issue is less about guilt and more about what's good for the country, and i think it would be terrible for the country to have a former president in prison for years because of a documents case. that's something you see in a third-world country. i saw that in the united nations

so i would be inclined in favor of a pardon. >> do you think her reaction is simply a sign of she's afraid of the base and these were nuclear. they were about nuclear capabilities. they were really, really sensitive material that being hurt people in the field, as well. >> it's a sign of how incredibly tricky most of these candidates, not all, but most of these candidates running against donald trump believe this to be which on its face is kind of remarkable because chris christie made the case two nights ago to anderson cooper in cnn's town hall. if you are running against him and if you're his political competitor for the nomination, why would you make arguments against him? never mind the legal part of it, just on the politics of it and it is not the way it is in donald trump's republican party which is still is which is why

you hear nikki haley, maybe the prime example of someone who is trying to feel her way. you can almost sort of see her walking through the field looking at where the political land mines are with every one of these statements and knowing what we know about the republican electorate, it's maybe kind of understandable. not if you're somebody like chris christie or asa hutchinson who say, you know, this is done. we're done. we should not have a nominee, never mind a president who was accused of doing such things and admits that he took these documents and held on to them. >> i am curious when it comes to republican lawmakers and the leadership. if, once again, you're hearing something different privately than we have been seeing publicly which is a lot of people that are showing support, at least from house republicans. >> a lot showing support. if you listen very carefully,

trump's previous court appearance in new york. the sheriff making that move in preparation of a possible indictment there in georgia. cnn has reported that trump is likely to find out by the end of summer whether the d.a. in fulton county fannie willis will charge him over his alleged attempts to steal the 2020 election in georgia. cnn's sara murray is here. >> you can see the legal troubles that donald trump is facing and i think one of the most pressing is this criminal investigation that's been going on in fulton county and it's interesting that they did send law enforcement representatives to both new york and miami to essentially try to make their own security plan. they are bracing for a potential trump indictment to be announced maybe in august and maybe we'll see multiple defendants and look, they want to keep donald trump and any potential defendants that they may want to

keep charges safe. we saw a lot of security even when they were picking the special grand jury back in may of 2022 because they are just so concerned about the security posture surrounding this case, john. >> of course, georgia would be after a case brought in florida, the federal case and after the case brought here in new york and then, of course, there is this other federal investigation with jack smith still very much pressing on including some new witnesses that have been spotted at the courthouse in d.c. >> that's right. while donald trump was dealing with his whole arraignment in federal court there were witnesses showing up in washington d.c. to appear before the grand jury investigating january 6th. one of those is michael mcdonald, chairman of the republican party in nevada. he was called as a witness and he plead the fifth a number of times concerning trump advisers. >> sara murray, great to see

you. thank you very much. rahel? >> joining us now is former watergate prosecutor nick akreman. great to have you here. >> great to be here. >> we heard from trump last night, clearly defiant. does that give you a sense of what the possible strategy for his defense team might be because it doesn't sound like he's denying it. >> he can't deny it. it's impossible. he had the stuff. it was on his property in terms of his defense for his actual trial none of this makes sense and to get up and say hillary did it and selective enforcement. >> right. >> selective enforcement is such a hard, hard motion to make. i can't ever remember a situation. historic arraignment, historic indictment. what happens now? >> the government to produce discovery, documents. one item that the defense does

not have is the actual search warpt that was executed. the affidavit underlying that search warrant. so one of the things they will do is they'll take that search warrant and say there's not probable cause and try to make a motion based on that. my guess is that there's probable cause in that affidavit and that that's going to be a complete losing motion. do they, for the defense, do they re-visit the fact that attorney-client privilege was pierced here? do they circle back to that? >> i'm sure they will, but that is also a big loser. the purpose of the attorney-client privilege is if i'm your attorney and you're my client you want to be able to get all the facts from your client and have complete confidence that what you're talking about is in confidence. it doesn't apply when you're using your attorney to commit a crime like he did here and had his butler there take 30 boxes of documents and move them out of the storage area where the lawyer was reviewing documents so he couldn't produce those.

it just doesn't apply when you're using someone like an attorney to commit a crime. let's talk about the butler, the valet, walt nauta, who we have seen over the last 24 hours still very close to the president and walt nauta and the former president not speak directly about the case. how is something like that enforced when we can all see they're still very close. >> yeah. it's not. even in the real world and practically speaking, each of these people will have an attorney. there's going to be what's known as a joint defense agreement which means that the attorneys can properly speak to each other about strategy, about the case and consult with their lawyers and their clients at the same time. so it's -- it's a standard warning that's putting all of these post-indictment warnings, bii really don't think it's that meaningful here. >> how challenging does it become when the president,

former president continues to speak as he does and how challenging is it for his team when anything you say can be used against you. in terms of the actual defense it has to be making it more challenging and even finding a jury that's not impartial. >> everything he says can be use as evidence in the case. he continues to do that. he did it at the cnn town hall. he did it last night. they'll take the statements because he's made so many contradictory statements about what he did and they'll take the snippets and they're all admissible admissions by donald trump. >> with respect to the jury pool. i think what people realize is they'll be able to find a jury that's fair and impartial. you'd be shocked at how many people are out there that really don't know a lot about this case. we saw it in spades with the forelady of the grand jury in georgia who said she knew nothing about what was going on

investigators investigating the movie "rust." the show's armorer hannah gutierrez was likely hungover when she inserted a live round in the gun. witnesses will testify gutierrez was drinking heavily and smoking marijuana in the evening during the shooting of "rust." gutierrez-reid has been charged with two counts of involuntary manslaughter. the new port news, virginia, who was shot in january will not be teaching in the fall. abby zwerner told the new port public schools that she was resigning from her position on march 13th. according to her district, the last day of her contract was june 12th. zwerner's attorney says that she

modelo especial overthrowing bud light and there are flat-out changing tastes and also the backlash from the social media post by transgender influencer dylan mulvaney. cnn chief business correspondent christine romans is here with the details. romans? >> hi there, john. yeah, modelo prevails, pardon the pun over the king of beers dethroned here. bud light in the most recent month, bud light's share of the market was less than modelo so it lost its top standing there. 8.4% of beer sales in may belonged to modelo. only 7.3%, bud light. that is a big shift and there are changing tastes happening and this is the month of may. there's cinco de mayo and a clear advertising campaign from modelo and changing tastes. analysts tell us there's been a growing affinity for mexican beer and spirits for some time

now. so that's a tipping point that you're seeing here. when you look at overall sales, sales for bud light down more than 24% in the month. that is kind of a staggering number here and for modelo, sales up 12.2% and these numbers are telling a story. you mentioned the transgender influencer who had one can, one customized can of bud light and did an instagram post and conservative media and conservative social media went on a very full, full, forceful boycott of the beer and so that is one other kind of factor here at play. so you have two things happening. you have changing tastes and years of declining tastes for light beer in particular and then you have this social media fail, quite frankly from bud light. a lot of corporate directors are watching what bud light did in this whole situation and finding a lot of fault with how it

managed and behaved the situation from a corporate and pr standpoint. christine romans, thank you very much for that. rahel? >> john, thank you. a cool spring and wet winter that brought flooded roads, swollen rivers and a sky-high snow pack in the california mountains are being credited for suppressing wildfire activity across much of the west coast. in fact, a new national wildfire outlook shows this summer's hot spots are not in the west, but in some unusual spots. take a look at this map. the red that you see here, this is all areas that experts say there will be an uptick in the danger. climate correspondent bill weir joins us now. as we show the map, highlighting areas like the great lakes and new england. what's behind the change? >> well, it's just not enough water in those places. we're used to saying that about california. look at that map. it's rare to see california green and vermont and maine as red. the upper midwest you've got

there. almost all of michigan now is in wildfire threat there, the pacific northwest, as well. this is the result of drought, and we saw what the droughts in canada are doing up to their forests now, five times the normal amount of wildfires burned up there and so we have seen in strange places like rhode island and there were two back-to-back fires, the biggest since 1942 and this never happens. in massachusetts, over 800 fires there and that seems small in comparison to the big, mega fires we see out west, but in tight, you know, residential areas, there's a lot more population density in the northeast. so you have to worry about these in places where people just aren't used to dealing with smoke and fires and another thing, rahel is summer after summer is dryer than usual and that brings a lot of stress on the trees and both with pests and the kind of insects that can make these trees vulnerable

chance to speak a bit more freely and she expressed some shock over the fact that many republicans are continuing to support the former president despite his indictment. that's the lone comment we've heard from this administration so far relating to the president's legal issues, but the first lady also went on to criticize the former president and framing this election as a choice between the stability -- she believes is offered by her husband and what she described as corruption and chaos from the trump administration. the first lady said in those fund-raisers out in the bay area last night, quote, we cannot go back to those dark days. you know what's in store if these maga republicans win. we know it because we lived it. remember how hard it was last time. this time it's going to be even harder. now the first lady has never really shied away from taking on republicans, but you are seeing her do this in the early stages of the campaign. these fund raises that she's participating in are really her first solo appearances that
